Was macht eine Demokratie resilient? Welche Schutzfaktoren gibt es und wo ist sie verwundbar? Wann wird aus Schutz eine Gefahr? Als Teil der Forschungsgruppe 'Resiliente Demokratie' soll in der Arbeit dargelegt werden, inwiefern das Vereinswesen ein schützender Faktor für die Demokratie in Österreich ist und einen wesentlichen Beitrag zum Parteienwesen leistet. Vereinigungs- und Versammlungsfreiheit sind Grundrechte, die in Österreich seit dem Beschluss des Staatsgrundgesetzes 1867 gewährleistet werden. Sie finden auch in der allgemeinen Erklärung der Menschenrechte der Vereinten Nationen von 1948 Erwähnung. Unterbrochen werden diese Grundrechte durch totalitäre Systeme. Anhand eines Vergleiches der Vereine und Organisationen der Deutschen Demokratischen Republik (DDR) möchte ich aufzeigen, inwieweit die Möglichkeit, jederzeit einen Verein mit einem Zweck gründen zu dürfen, zu den Schutzfaktoren der Demokratie zählt. MandatarInnen in Österreich, egal ob Nationalrat, Landtag oder Gemeinderat, sind nicht nur KandidatInnen ihrer Partei, sondern zumeist auch in Vorfeldorganisationen dieser aktiv. Dort haben sie zumeist das Rüstzeug für die politische Auseinandersetzung erhalten. Wie diese Strukturen aussehen, ist von Partei zu Partei verschieden. Dies wird in der vorliegenden Arbeit beleuchtet. Aber auch Zusammenschlüsse, die nicht direkt mit Parteien oder dem Staat zu tun haben, haben einen zunehmenden Einfluss auf die Politik. Dazu zählen zum Beispiel BürgerInneninitiativen, Nichtregierungsorganisationen (NGOs), zivilgesellschaftliche Zusammenschlüsse und so weiter. Welche Erfahrungen spielen dabei für das Parteiwesen eine Rolle? Wie organisieren sich diese Zusammenschlüsse? Welche rechtlichen Grundlagen gibt es dafür? Die Arbeit ist qualitativ gestaltet. Dazu wurden Interviews mit ExpertInnen geführt, die anhand ihrer Erfahrungen ihren Weg in die Politik zeigen sollen. Sie wurden dazu befragt, was sie von der Vereinigungsfreiheit halten und wie sie zu den Anträgen auf Auflösung von Vereinen stehen, die im Parlament diskutiert und abgestimmt wurden. Dabei kommt die qualitative Inhaltsanalyse nach Mayring zur Anwendung. In der Ausarbeitung zeigte sich, dass für PolitikerInnen das Vereinswesen eine zentrale Rolle in der Vorbereitung für ihre Arbeit als FunktionärIn bzw. MandatarIn einnimmt. Eine Funktion im Verein ist mit Verantwortung verbunden. Entscheidungen werden getroffen, die den Mitgliedern gegenüber gerechtfertigt werden müssen. So ist es auch in der Politik. PolitikerInnen müssen ihren WählerInnen bzw. den BürgerInnen erklären können, warum sie bei einer Abstimmung so entschieden haben. Auch formale Tätigkeiten, die man später im politischen Amt benötigt, werden im Verein erlernt. Als besonders wertvoll ist der Kontakt zu BürgerInnen hervorzuheben. PolitikerInnen bekommen Zugang zu zahlreichen Informationen und Ideen. Das gebildete Netzwerk unterstützt die politische Arbeit. Das Vereinswesen, so wie es in Österreich existiert, ist ein Resilienzfaktor der Demokratie, weil jederzeit die Möglichkeit besteht, Personen mit gleichen Interessen und Zielen zusammenzuführen. Die InterviewpartnerInnen waren sich darin einig, dass eine Veränderung des Grundrechts der Vereinigungsfreiheit nicht notwendig ist. Im österreichischen Vereinsgesetz gibt es Möglichkeiten der Optimierung zum Schutz der im Verein tätigen FunktionärInnen. ; What makes a democracy resilient? What safeguards does it have and where is it vulnerable? When does a safeguard become a danger? As part of the "Resilient Democracy" research group, I would like to demonstrate that civic associations and societies are a safeguard for democracy in Austria and make a significant contribution to the political party system. Freedom of association and assembly are fundamental rights that have been guaranteed in Austria since the Basic Law was passed in 1867. They are also identified in the United Nations Universal Declaration of Human Rights of 1948. These fundamental rights are suspended by totalitarian systems. By drawing a comparison with the associations and organisations of the German Democratic Republic (GDR), I would like to show why the opportunity to found an association at any time and for any purpose is one of the safeguards of democracy. Political representatives in Austria, whether members of the National Council, a state parliament, or a municipal council, are not only candidates for their party, but are mostly also active in their organisations too. It is there that they mostly acquire the tools for political debate. The look of these structures varies from party to party. This should be apparent in the way they work. But alliances that are not directly related to political parties or to the state are having a growing influence on politics. These include, for example, citizens' initiatives, NGOs, civic associations, etc. Which experiences play a role in the party system? How are these associations organised? What is the legal basis for this? A qualitative approach has been used in this paper. For this purpose, expert interviews were carried out. These interviews should show their route into politics based on their experience. I would also like to know what they think of the freedom of association and, because it is currently being discussed of proposals for the dissolution of associations that were discussed and voted on in parliament. This work has used Mayring's approach to qualitative content analysis. The elaboration showed that for politicians, associations play a central role in the preparation for their work as functionaries or mandataries. A function in the association is linked with responsibility. Decisions that are made must be justified to the members. This is also the case in politics. Politicians should be able to explain to their constituents or citizens why they made this decision in a vote. Formal activities that are later required in political office are also learned in the association. Contact with citizens is extremely valuable. Politicians get access to a lot of information and ideas. The formed network supports the political work. The association system, as it exists in Austria, is a resilience factor of democracy because there is always the possibility to bring people with the same interests and goals together. The interviewees agreed that it is not necessary to change the fundamental right to freedom of association. The present article analyses the qualitative and quantitative parameters of the execution of foreign policy in the Constitution of the Republic of Lithuania. It should be noted that the matters of foreign policy were on the brink of constitutional regulation for a long time. The powers of institutions of the state in the field of foreign relations were established laconically by the Constitutions of first and second "waves" of establishment of constitutionalism. It was argued that the choices of decisions and the execution of foreign policy were determined by political reasons and the law could only fix the results of that policy. That is why these constitutions should be seen as establishing quantitative characteristics of action of the state institutions in the field of foreign policy. As a result of the changes in the concept of the Constitution and the general recognition of the relevance of constitutional regulation from the middle of the twentieth century the constitutional acts began to define not only the powers of certain state institutions in the field of the foreign policy but also the objectives and principles of this policy. These objectives and principles are qualitative parameters of the action of state institutions, which are mandatory constitutional requirements to all subjects engaged in foreign policy. From a qualitative standpoint, the powers of the state institutions can be exercised only by taking the constitutional objectives into account and by respecting the Constitution. The Constitution establishing both qualitative and quantitative characteristics of the execution of foreign policy becomes an actual basis of this policy. It is unlawful to execute foreign policy without complying with its objectives and constitutional principles. The institutions of constitutional review have the powers to determine the constitutionality of legal acts related to the execution of foreign policy. Constitutional regulations previous to the Constitution of the Republic of Lithuania of 1992 only defined the powers of state institutions, i.e. the quantitative parameters of their action. The Lithuanian Constitution of 1992 also established the constitutional objectives and principles of foreign policy. This area of constitutional regulation has been enhanced by the participation of the Republic of Lithuania in the European Union. The author suggests analysing this matter as an autonomous constitutional principle and not only as a case of participation in international organisations or an integral element of the principle of geopolitical orientation. Constitutional objectives and principles of foreign policy, as well as the other provisions of the Constitution regarding the exercise of foreign policy, are interpreted in constitutional jurisprudence. In cases concerning the constitutionality of international treaties, laws and other legislative acts directly related to the exercise of foreign policy, the Constitutional Court reveals the content and meaning of the qualitative and quantitative constitutional parameters of foreign policy. Despite the fragmented nature of the case law one can see the precise contours of the foreign policy system. ; Straipsnyje analizuojami Lietuvos Respublikos Konstitucijoje įtvirtinti kokybiniai ir kiekybiniai užsienio politikos įgyvendinimo parametrai. Reikia pažymėti, kad ilgą laiką užsienio politikos formavimas ir įgyvendinimas buvo konstitucinio reguliavimo pakraštyje. Pirmosios ir antrosios konstitucionalizmo įtvirtinimo "bangų" konstitucijose buvo fiksuojami tik valstybės valdžios institucijų įgaliojimai užsienio santykių srityje, dažniausiai itin lakoniškai. Buvo teigiama, kad vienokių ar kitokių užsienio politikos tikslų ar sprendimų pasirinkimą lemia politiniai motyvai, kad teisei lieka tik tos politikos įforminimo vaidmuo. Todėl šiose konstitucijose regime vien kiekybines atitinkamų valstybės institucijų veikimo užsienio politikos srityje charakteristikas. Konstitucijos sampratos pokyčiai, konstitucinio reguliavimo visa apimančio pobūdžio pripažinimas lėmė, kad nuo XX a. vidurio konstituciniuose aktuose imta įtvirtinti ne tik tam tikrų valstybės institucijų įgaliojimus užsienio politikos klausimais, bet ir fiksuoti šalies užsienio politikos tikslus bei principus. Tai jau kokybinio pobūdžio valstybės veiklos parametrai, kurie tampa privalomais konstituciniais imperatyvais, saistančiais užsienio politiką įgyvendinančius subjektus. Kiekybiniu požiūriu nustatytų valstybės institucijų įgaliojimai gali būti įgyvendinami tik siekiant konstitucinių tikslų, tik paisant konstitucijos. Konstitucija tampa tikruoju šalies užsienio politikos pagrindu. Užsienio politika, pažeidžianti konstitucinius jos tikslus ir principus, negalima. Konstitucinės kontrolės institucijos įgyja įgaliojimus vertinti teisės aktų, susijusių su užsienio politika, įgyvendinimo konstitucingumą. Lietuvos Respublikos konstituciniame reguliavime iki 1992 m. Lietuvos Respublikos Konstitucijos buvo nustatomi tik veikimo kiekybę fiksuojantys valstybės institucijų įgaliojimai. 1992 m. Konstitucijoje fiksuojami ir užsienio politikos tikslai ir principai. Konstitucinis narystės Europos Sąjungoje fiksavimas sustiprino tokią konstitucinio reguliavimo kryptį. Autoriaus manymu, Lietuvos narystę Europos Sąjungoje reikia traktuoti kaip savarankišką konstitucinį principą, kurio turinys netelpa vien į narystės tarptautinėje organizacijoje atvejo ar geopolitinės orientacijos sudėtinio elemento rėmus. Konstituciniai užsienio politikos tikslai ir principai, kitos konstitucinės nuostatos, susijusios su užsienio politikos įgyvendinimu, yra oficialiai aiškinamos konstitucinėje jurisprudencijoje. Konstitucinis Teismas, nagrinėdamas bylas dėl tarptautinių sutarčių, įstatymų ir kitų teisės aktų, susijusių su užsienio politikos įgyvendinimu, konstitucingumo, atskleidžia tiek kokybinių, tiek kiekybinių užsienio politikos konstitucinių parametrų turinį ir reikšmę. Nepaisant jurisprudencijos fragmentiškumo, joje galima aiškiai matyti konstitucinių užsienio politikos pagrindų sistemos kontūrus.

Die Energieträger wie Braunkohle und Steinkohle, Erdgas und Mineralöl sowie Kernenergie sind längst auf dem Markt etabliert und sind allgemein als wettbewerbsfähig anerkannt. Eine weitergehende Umgestaltung der bisherigen Erzeugerstruktur ist jedoch erforderlich, da diese konventionelle Stromerzeugung umweltbelastend ist. Die weitere Verbreitung und Förderung umweltfreundlicher Energieträger, wie beispielsweise Sonnen-, Wind- oder Wasserenergie ist deshalb erforderlich. Regenerative Energien können jedoch noch nicht auf einem wettbewerbsoffenen Markt aus eigener Kraft bestehen. Die Marktfähigkeit erneuerbarer Energieträger kann ausschließlich durch staatliche Förderungs- und Steuerungsmaßnahmen erreicht werden. Zu diesen Maßnahmen gehören die Preis- und Quotenmodelle mit den grünen Zertifikaten. Die Besonderheit der Fördermodelle liegt in ihren vielfältigen Gestaltungsmöglichkeiten. Die einzelnen Elemente eines Modells sollten jedoch an die festgelegten Ziele und spezifischen Bedingungen im jeweiligen Staat angepasst werden. Es gibt kein universelles Fördermodell, das immer und überall verwendet werden kann. Jeder inländische Gesetzgeber steht damit vor der Aufgabe, anhand der festgelegten Ziele und vorhandenen Möglichkeiten die beste Förderregelung auszuwählen, bzw. ein Mischmodell zu entwickeln, in dem die verschiedenen Elemente kombiniert werden. Ziel der Untersuchung ist daher die rechtsvergleichende Analyse der Regelungen über die Modelle zur Förderung erneuerbarer Energien auf der Grundlage des gemeinschaftsrechtlichen und völkerrechtlichen Rahmens. Ein weiterer Schwerpunkt der Arbeit liegt in der Analyse der Umsetzung der zwei unterschiedlichen Fördermodelle am Beispiel Polens und Deutschlands. Auf gemeinschaftsrechtlicher Ebene haben die Elektrizitätsrichtlinie aus dem Jahre 1996 und aus dem Jahre 2003, die Richtlinie zur Förderung der Stromerzeugung aus erneuerbaren Energiequellen aus dem Jahre 2003 und 2008 als auch die unverbindlichen Dokumente wie das "Grün- und Weißbuch" sowie das "ALTENER"-Programm, zur Etablierung der Problematik erneuerbarer Energien erfolg-reich beigetragen. Auf völkerrechtlicher Ebene ist dagegen vor allem das Kyoto-Protokoll als Grundlage zur Förderung erneuerbarer Energieträger zu erwähnen. In Polen wurde das Quotenmodell mit den grünen Zertifikaten als Fördermodells eingeführt. Die Teilung der Entgelte in Herkunftszertifikate und in die Vergütung für physische Energie gab den Anla-genbetreibern eine ausreichende Grundlage für Investitionen. Falls die festgesetzte Quote durch den Zertifikatserwerb nicht erfüllt werden kann, weil keine weiteren Zertifikate in der Berechnungsperiode angeboten werden, können die Verpflichteten die Quote durch die Bezahlung einer Ersatzgebühr erfüllen. In Deutschland wurde das Preismodell eingeführt. Die im deutschen Fördermodell vorgesehenen festen Vergütungssätze ermöglichen den Investoren die Errichtung von neuen Anlagen, die erneuerbare Energieträger einsetzen und effektiv zur Entwicklung dieser Quellen beitragen. Die gesetzlich eingeführten Modelle zur Förderung erneuerbarer Energien sollten finanzielle Anreize schaffen, um die Investoren zum Engagement bei der Errichtung von Anlagen zur Erzeugung erneuerbarer Energien zu bewegen. Das Ziel der Förderung – die Durchsetzung der derzeit überwiegend nicht wettbewerbsfähigen Anlagen zur Erzeugung erneuerbarer Energien auf dem Markt – wurde sowohl in der polnischen als auch in der deutschen Fördermaßnahme erreicht. Die Förderung sollte idealerweise zur zukünftigen Marktfähigkeit erneuerbarer Energien beitragen. Aus diesem Grund wäre es wünschenswert, die Fördermaßnahmen mit dynamisch eingebauten Mechanismen so zu gestalten, dass im Laufe der Zeit die Aufhebung von Unterstützungen möglich wird. In der polnischen Förderregelung wird dies – im Gegensatz zu den deutschen degressiv ausgestalteten Vergütungssätzen – nicht bezweckt. ; Energy sources such as coal, natural gas, petroleum, and nuclear fission have long been established on the marketplace and considered competitive. However, a comprehensive restructuring of energy generation is necessary, as conventional energy generation pollutes the environment. Therefore environmentally friendly energy sources, such as solar, wind or water power need to be promoted. However, regenerative energy sources are still not capable of competing with conventional energy. Marketability of renewable energy sources can only be achieved through government-sponsored promotion and regulation. Such measures include fixed price and fixed quantity models with green certificates. The support schemes for renewable energy sources are characterized by their wide-ranging adaptability. The various elements of a scheme must be adapted to a given country's set goals and specific circumstances. There is no universally applicable model. Based on given goals and opportunities, every domestic legislator faces the challenge of choosing the best scheme or developing a mixed model that combines various elements. The aim of this study is to provide a legal analysis of regulations concerning the support schemes for renewable energy sources within the framework of EU and international law. Furthermore, the study aimed at comparing support schemes implemented in Poland and Germany. In the EU, the electricity directive from 1996 and 2003, the directive on the promotion of electricity from renewable energy sources from 2003 and 2008, non-binding documents, such as the "green and white book", as well as the "ALTENER" program, successfully contributed to establishing the topic of renewable energies. Regarding international law, it is primarily the Kyoto protocol that has to be mentioned as a basis for the promotion of renewable energy sources. Poland introduced a fixed quantity model with green certificates. Separated reimbursements for certificates and for physical energy provide power generating companies with a sufficient basis for making investments. If a set quote cannot be met by purchasing certificates because no more certificates are available in a given fiscal period, companies can meet the quantity by paying a compensation. Germany introduced a fixed price model. The fixed reimbursements envisaged in the German model enable investors to build new facilities that use renewable energy sources and contribute effectively to the development of these sources. The legislative support schemes for renewable energies are intended to offer financial incentives to investors committing themselves to the construction of new facilities that provide renewable energy. The aim of the promotion – the establishment of currently non-competitive renewable energy facilities on the market – has been achieved as well by the Polish as the German measures. Ideally, the promotion should contribute to the future marketability of renewable energies. It would therefore be desirable to use dynamic mechanisms for designing incentives in such a way that support can be reduced over time. The Polish model does not intend this, unlike the German model under which reimbursements are degressive.

National audience The Convention on Biological Diversity endorsed the idea that the enhancement of biodiversity can be at the heart of a strategy combining nature protection and sustainable development. This article deals with the way in which a natural substance marketing sector is organised, as part of a project in Bolivia. The Biodesa-FFEF programme aims to conserve biodiversity through the promotion of aromatic and medicinal plants. Biodesa is an example of the implementation of CBD principles in a country with advanced legislation on access to gene resources. The pursuit of activities as diverse as exploration of new plant potential, legal access to resources, production of scientific knowledge and valorisation of ethnobotanical knowledge leads to the creation of new partnerships around a university centre in Cochabamba. We are studying the construction of such partnerships between public and private, between market and conservation, between supply and demand of plant resources, between scientists and local knowledge holders. The question is whether these partnerships are likely to lead to the emergence of a market for natural products. ; National audience La Convention sur la diversité biologique a entériné l'idée que la valorisation de la biodiversité peut être au cœur d'une stratégie alliant protection de la nature et développement durable. Cet article s'intéresse au mode d'organisation d'une filière de commercialisation de substances naturelles, dans le cadre d'un projet en Bolivie. Le programme Biodesa-FFEM a pour objectif la conservation de la biodiversité à travers la valorisation de plantes aromatiques et médicinales. Biodesa constitue un exemple de la mise en œuvre des principes de la CDB, dans un pays ayant une législation avancée quant à l'accès aux ressources génétiques.La réalisation d'activités aussi diversifiées que l'exploration de nouvelles potentialités végétales, l'accès légal aux ressources, la production de connaissances scientifiques et la valorisation de savoirs ethnobotaniques, ...

This doctoral dissertation in sociology aims to renew the analysis of contemporary migrations and of the international hierarchies that underlie them through the case of higher educated migrants. It studies specifically the case of people who migrated to France or Germany in adult life and who live in these countries by the late 2000s. This rapidly growing population is subject to mechanisms of legal and symbolic exclusion in the country of arrival that could offset the advantages due to a large amount of educational resources and international skills. This ambivalence is the starting point of this research, that is grounded on empirical data that combines statistical surveys (French and German Labor Force Survey, Trajectoires et Origines survey) and ethnographic interviews with immigrant doctors and engineers. In the first part puts the notion of "choice" in the migratory orientation under scrutiny. First, it analyses how expert and political discourses have contributed to spread the theoretical scheme of a global market for "talents" that would turn towards the most "attractive" countries. Then it highlights the existence of two main systems of circulation that are widely separated: Africa towards France on the one hand, Eastern Europe towards Germany on the other. The first system relies on the French linguistic and educative influence on formerly colonized countries while the second system is grounded on the old economic exchanges between Germany and Eastern Europe, recently facilitated by the European integration. The second part is focused on employment and occupations in the country of arrival. The struggle to access upper occupations explains why immigrants are often in a contradiction of status compared to the social stratification of the other higher educated people. Moreover, they experience frequently a downward occupational mobility after migration. The phenomenon of deskilling varies with nationality, country of education, language and "race". It is different in France and Germany and contributes to transform gender relations. Hence, the opposition between central and peripherical countries is objectified and specified through the analysis of two contrasted contemporary systems of migration. ; Cette thèse de sociologie vise à renouveler l'analyse des migrations contemporaines et des hiérarchies internationales qui les sous-tendent à travers le cas des migrant.es diplômé.es du supérieur. Elle s'arrête plus précisément sur les personnes ayant immigré en France ou en Allemagne à l'âge adulte et qui résident dans ces pays à la fin des années 2000. En expansion rapide, cette population est exposée à des mécanismes d'exclusion juridiques et symboliques qui peuvent contrebalancer les avantages liés aux ressources scolaires élevées et aux compétences internationales. Partant de cette ambivalence, la recherche s'appuie sur un dispositif empirique qui combine des enquêtes statistiques (Enquête Emploi, Trajectoires et Origines et Mikrozensus) et des entretiens ethnographiques auprès d'immigré.es médecins et ingénieur .es. Dans la première partie, la notion de « choix » dans l'orientation migratoire est déconstruite. Nous analysons d'abord comment les discours experts et politiques ont contribué à diffuser le schéma théorique d'un marché global de « talents » qui s'orienteraient en fonction de « l'attractivité » des pays. Nous dégageons ensuite deux espaces de circulation majeurs et largement cloisonnés : de l'Afrique vers la France d'une part, de l'Europe orientale vers l'Allemagne d'autre part. L'influence linguistique et éducative de la France sur des pays autrefois colonisés est à la base du premier système, tandis que les échanges économiques anciens entre l'Allemagne et les pays de l'Est, récemment facilités par l'Union européenne, servent de fondement au second. Dans la deuxième partie, on s'intéresse à l'emploi dans le pays d'arrivée. Du fait d'obstacles dans l'accès aux professions supérieures, la situation des immigré.es relève souvent d'une incohérence statutaire au regard de la stratification sociale des autres diplômé.es du supérieur. En outre, elles.ils font souvent l'expérience d'un déclassement professionnel consécutif à la migration. Le phénomène de déqualification varie selon la nationalité, le pays de formation, la langue et la « race ». Il se décline différemment en France et en Allemagne et contribue à recomposer les rapports de genre. Introduction: recently, general practitioners were allowed to deliver non contraindication certificates (NCIC) for level 2 and higher divers. However, the universitary course doesn't provide any specific learning. Primary objective tries to describe, according to the divers, the medical assessment of fitness to dive leading to a NCIC. Secondary objective describes the qualifying level of the physicians and their use of support documents during this consultation. Material and method: an anonymous paper survey was given to licensee divers on their leisure sites. Questions on socio-demographic data and on key-points of the consultation were asked. General and federal practitioner were surveyed on their qualifying level in the diving domain and their use of self-administrated survey or examination sheets. Results: 113 divers were included in the analysis. 65,5% of the certificates were written by the family physician, 8,8% by a general practitioner and 15% by a federal doctor. In 74,3% of cases, neither the self-administrated survey or the examination sheet were used. 29,2% of the consultations lasted less than 15 minutes. 20 physicians were included in the second analysis. Only federal doctors kept forming in the diving domain. 9 physicians didn't use any support document. 3 Never refused writing a fitness to dive certificate. Discussion: most of the NCIC were written by general practitioners. However, continuing education offers in this domain is limited and doesn't fit to the needs. Using self-adminstrated survey and examination sheets could be more systematic. The federation and the clubs could play a role spreading these documents. They would serve both medical and legal parts. A medical booklet that the diver inevitably presents during a diving-related consultation could be created. Conclusion : diving accidents can be dramatic. The evolution of the legislation concerning diving NCIC enforces to rethink the general practionner studies to this specific consultation. ; Introduction : récemment, les médecins généralistes sont autorisés à délivrer les certificats pour les plongeurs de niveau 2 et plus alors que le cursus universitaire ne prévoit de formation spécifique. L'objectif principal tente de relater les pratiques médicales pour la délivrance du certificat de non contre-indication à la plongée (CNCI), sur la base déclarative des plongeurs licenciés. L'objectif secondaire décrit le niveau de formation des médecins et l'utilisation de documents supports lors de la consultation de non contre-indication à la plongée. Matériel et méthode : un questionnaire papier anonyme a été distribué à des plongeurs licenciés sur leur lieu de loisir. Des questions portaient sur les données socio-démographiques des plongeurs puis sur certains paramètres de la consultation en vue de recevoir le certificat médical. Des médecins généralistes et fédéraux ont été questionnés sur leur niveau de formation lié à la plongée et l'utilisation de documents supports. Résultats : 113 plongeurs ont été inclus dans l'analyse de la première étude. 65,5% des certificats ont été rédigé par leur médecin traitant, 8,8% par un médecin généraliste autre, 15% par un médecin fédéral. Dans 74,3% des cas, ni l'auto-questionnaire ni la fiche d'examen clinique n'ont été utilisées. 29,2 % des consultations ont durée moins de 15 minutes. 20 médecins ont été inclus dans l'analyse de la seconde étude. Seuls les médecins fédéraux réalisaient une formation continue en lien avec la plongée. 9 médecins n'utilisaient ni auto-questionnaire, ni fiche d'examen clinique. 3 médecins n'ont jamais refusé de délivrer un certificat de plongée. Discussion : une grande majorité des certificats ont été rédigés par des médecins généralistes. Cependant, l'offre concernant la formation continue dans le domaine est limitée et ne correspond pas aux besoins actuels. L'utilisation de l'auto-questionnaire et de la fiche d'examen pourrait devenir systématique. Les clubs et la fédération pourrait avoir un rôle à jouer en diffusant ces documents. Ils serviraient les deux parties autant sur le plan médical que juridique. La piste d'un livret médical que le plongeur présenterait à chaque consultation en lien avec la plongée mériterait d'être concrétisée. Conclusion : les accidents de plongée peuvent être dramatiques. L'évolution de la législation concernant les CNCI imposent de repenser la formation des médecins généralistes à cette consultation spécifique.

Le corps de la femme est un champ fertile, un champ où se jouent des batailles idéologiques, des querelles politiques et des luttes de pouvoir. Dès les premiers mois de la transition tunisienne, la question de la condition féminine s'est inscrite au cœur des débats publics sur la refonte de la nouvelle Tunisie, et ce souvent à travers la problématique du corps de la femme. Ce travail de recherche étudie l'impulsion de la mise à l'agenda de la question féminine à travers trois corps : le corps voilé des munaqabas de la Manouba qui revendiquent la liberté d'habillement ; le corps outragé de Meriem Ben Mohamed, violée par deux policiers puis traînée en justice pour atteinte aux mœurs ; et enfin le corps exhibé d'Amina – emprisonnée pour atteinte au sacré – qui arborait ses seins nus sur lesquels étaient écrites des revendications féministes. Á partir de ces trois cas d'étude, nous avons constaté que la corporalité féminine agit comme un catalyseur pour la construction des problèmes publics dans un contexte transitionnel et postcolonial, compris comme une forme précise de fenêtre d'opportunité politique au sens de Kingdon. Ce contexte est traversé par la bipolarisation politico-sociale du pays – entre islamistes et progressistes – et par l'influence du néocolonialisme, plus précisément à travers la colonialité du pouvoir, du genre et des médias. ; El cuerpo de la mujer es un campo fértil, un campo de batallas ideológicas, de discordias políticas y de luchas de poder. Los primeros momentos de la transición tunecina han estado marcados por la efusión del debate público entorno a las bases de la cimentación del nuevo estado, y la condición femenina ha ocupado un lugar central en este debate, a menudo concentrándose en torno a la problemática del cuerpo de la mujer. Esta investigación estudia en profundidad el establecimiento en la agenda política, social y mediática de la cuestión femenina partiendo de tres cuerpos de mujer: el cuerpo velado de las munaqabas de la facultad de la Manouba que revindican la libertad vestimentaria; el cuerpo ultrajado de Meriem Ben Mohamed, violada por dos policías y acusada de delito contra moral pública; y el cuerpo exhibido de Amina – encarcelada por delito contra la fe pública – en el que la joven exponía reivindicaciones feministas. A través de estos tres casos de estudio, esta investigación constata que la corporalidad femenina actúa como un catalizador de construcción de los problemas públicos en el contexto post-colonial y transicional, entendido, este último, como una ventana de oportunidad política según Kingdon. Este contexto está ampliamente marcado por la bipolarización política y social del país – dividido entre islamistas y progresistas – y por la influencia del neocolonialismo, implicando la colonialidad del poder, del género y de los medios de comunicación. ; The woman's body offers a breeding ground for ideological battles, political quarrel and power struggle. Since the early days of the transition in Tunisia, women condition was put at the heart of the public debate dealing with the remodelling of the country, often through women body issues. This research work analyses the process of social construction of problems and how women issues are put on the agenda, following three different bodies: the veiled body of munaqabas, from Manouba University, who vindicate the right to clothing; the outraged body of Meriem Ben Mohamed, raped by two policemen, who faces legal actions for outraging public decency; lastly the exhibited body of Amina – confined for abusing the sanctity of cemetery – who bared her breasts with feminists claims. On the basis of these three case studies, the research notes that feminine corporeality operates like a catalyst for the construction of public problems in postcolonial and transitional context, narrowly understood like a window political opportunity. This context goes through a political and social bipolarization – between islamists and progressives' policies – and under the influence of neocolonialism, more specifically the coloniality of power, gender and media.

Cyberangriffe sind zu zentralen Herausforderungen staatlicher Sicherheitspolitiken unserer Zeit geworden. Wie haben sich die Politiken in den Bereichen der Strafverfolgung, der nachrichtendienstlichen sowie militärischen Nutzung des Netzes entwickelt? Welche internationalen sowie domestischen Einflüsse haben die Entwicklungen geprägt? Der Autor geht diesen Fragen nach und analysiert die deutsche und britische Cybersicherheitspolitik seit den späten 1990er Jahren. Er zeigt, dass die Cybersicherheit sowohl die zwischenstaatlichen Beziehungen als auch die Relationen zwischen Regierungen und Bürger*innen beeinflusst.

"Empirische Befunde zur rücklaufsteigernden Wirkung von Remindern sind konsistent und zahlreich. Nur wenige Studien beschäftigen sich mit dem Einfluss von Nachfassaktionen auf das Antwortverhalten der Respondenten und die soziale Zusammensetzung der Befragtenstichprobe. Vorliegender Beitrag untersucht diese Aspekte anhand der Daten einer im Jahr 2009 im Raum Südbaden durchgeführten postalischen Befragung (N=3.555) unter 49- bis 81-Jährigen zum Thema 'Kriminalität im höheren Lebensalter'. Die Analysen ergeben, dass das Ausmaß fehlender Antworten (Item-Nonresponse) mit den Mahnaktionen zunimmt, wobei der Zusammenhang zwischen der Zahl der Nachfassaktionen und der Zahl fehlender Antworten kurvilinear ist. Mahnaktionen rekrutieren v.a. Gruppierungen in die Befragungsstichprobe, die nach einmaligem Anschreiben üblicherweise unterrepräsentiert sind - nämlich Personen, die jünger sind, im ländlichen Raum wohnen sowie einen schwächeren Sozialstatus und geringeres politisches Interesse aufweisen. Mahnaktionen tragen damit zu einer Verbesserung der sozialen Zusammensetzung der Stichprobe bei. Hinsichtlich sozio-demographischer Merkmale sowie psychosozialer Befindlichkeiten unterscheiden sich die Befragten des Erstversands allerdings nicht gravierend von denen der gesamten Befragungsstichprobe. Eine Ausnahme stellt das kriminelle Handeln der Befragten über die Lebensspanne dar: mit zunehmenden Kontaktierungen werden deutlich weniger delinquente Personen in die Befragung einbezogen. Die Antworten der Respondenten zum Befragungsthema stehen demnach in deutlichem Zusammenhang zum Erhebungszeitpunkt. Nachfassaktionen können somit auch hier zur Abschwächung anfänglicher Verzerrungen beitragen. Aus methodischer Sicht sollten Mahnaktionen deshalb prinzipiell in das Erhebungsdesign postalischer Befragungen eingeplant werden. Insgesamt drei Erhebungszeitpunkte erscheinen dabei optimal."
