Policies that were formerly regulated within the domestic context have been subjected to international law (IL). This has resulted in a growing number of international agreements and bodies. Some of these institutions gained new legal quality in terms of their legal obligations, procedural rules, and dispute settlement. With this trend of growing international legalization, also the normative expectations of IL have increased. In particular the key standard of democratic participation has to be met by international institutions to be considered legitimate in the long run. This crucial relationship between international legalization and democratic participation has been neither systematically theorized nor empirically researched so far. The project forms part of a larger research strand on the interplay between law, politics, and democracy. By introducing a model of legalization's structure-inherent and actor-dependent effects, I demonstrate that legalization's costs cause powerful actors to restrict democratic participation in highly legalized international institutions. Der Band widmet sich den rechtlichen und institutionellen Rahmenbedingungen athletischer und künstlerischer Wettkämpfe vom archaischen Griechenland bis in das spätantike Rom. Das Regelwerk der agone, die Finanzierung durch öffentliche Förderungen und reiche Privatsponsoren wurden ebenso angesprochen wie das Training der Athleten und Siegespreise und Privilegien, die den sozialen Status der Athleten, im Besonderen der Sieger, determinierten. Darüber hinaus wurde die Aufmerksamkeit auf das Ende der klassischen griechischen agone aus römischer Perspektive gelenkt. ; The volume deals with the juridical and institutional framework of athletic and artistic games from archaic Greece to late antique Rome. Moreover attention was drawn onto the end of the classical Greek agones from a Roman perspective. ; Der vorliegende Band des zweiten Wiener Kolloquium zur Antiken Rechtsgeschichte widmet sich den rechtlichen und institutionellen Rahmenbedingungen der sportlichen und musischen Wettkämpfe des klassischen Altertums. Der zeitliche Rahmen erstreckt sich von der Archaik bis in die Spätantike (8. Jh. v.Chr. – 6. Jh. n.Chr.). Das Regelwerk der Agone, ihre Finanzierung sowohl aus öffentlichen Mitteln wie auch aus privaten Zuwendungen vermögender Sponsoren und die Ausbildung der Sportler bilden den ersten Schwerpunkt. Siegespreise und Privilegien, die den sozialen Status von Sportlern und insbesondere Wettkampfsiegern bestimmten und für die Attraktivität der Agone ausschlaggebend waren, stehen im Mittelpunkt weiterer Beiträge. Derartige Fragen waren stets Gegenstand einer "Sportpolitik", die unter den kleinräumigen Gegebenheiten der klassischen griechischen Stadtstaaten anderen Spielregeln folgte als etwa im Imperium Romanum, wo der Kaiser versuchte uniforme, reichsweite Bestimmungen durchzusetzen. Unterschiede im Konzept von Sport und Wettkampf bei Griechen und Römern werden aufgespürt und unter anderem anhand der Gladiatorenspiele als einem spezifisch römischem Sonderfall illustriert. Ein weiterer Aspekt ist der Blick auf das Ende der klassischen griechischen Agonistik aus der römischen Perspektive: Das christlich gewordene Kaisertum duldete die heidnischen Agone nicht mehr, entwickelte aber gleichzeitig mit den spätantiken Zirkusspielen und ihren Wagenrennen und Tierhatzen neue Formen des Wettkampfs und der Volksbelustigung. ; The Second Vienna Colloquium on Ancient Legal History addressed the juridical and institutional framework of athletic and artistic games in classical antiquity. The chronological frame ranged from Archaic times to Late Antiquity (8th cent. BCE – 6th cent. CE). The symposium covered three main areas of interest. Firstly, the agones' rules and regulations, the funding by public contributions and wealthy private sponsors as well as the athletes' training were approached. Prizes and privileges, which determined the athletes'—and especially the winner's— social status and were thus crucial to the agones' appeal, were then attended to by several papers. In contrast to the conditions under the Imperium Romanum, where the emperor enforced nation-wide regulations, the "politics of sports" followed different rules in the small-scaled world of the classical Greek poleis. Thus, differences in the conception of sports between Greeks and Romans were traced and exemplarily demonstrated on the basis of the gladiatorial games. Lastly, attention was drawn onto the end of the classical Greek agones from a Roman perspective. The now Christian empire couldn't tolerate the pagan agones anymore and instead developed new forms of athletic competitions and public entertainment: late antique circus games and chariot races.

The purpose of this paper is to analyze administrative-territorial reforms in Estonia, the comparative analysis of the public administration reforms in the Baltic Sea region, to formulate principles and purposes of the administrative-territorial reform in Estonia. An administrative-territorial reform has been topical since in the Estonia regained its independence but there are virtually no results. In 1995, a law was passed granting the Government the right to take decisions on the country's administrative-territorial division. Both the local authorities and the central government can initiate changes in the administrative-territorial division. A public opinion poll must be conducted before any decision on changes can be taken, although the Government is not bound by the results of the opinion poll. By the spring of 2009, there were 227 local governments in Estonia, including 194 rural municipalities and 33 cities. The administrative-territorial organisation of Estonia needs changing. The average population of Estonian rural municipalities is less than 2,500 people and, in spite of mergers, there are still inexpedient units where the centrally located settlement is separated from its hinterland in administrative terms. However, one must be objective when preparing and carrying out the administrativeterritorial reform. The often expressed opinion that decreasing the number of rural municipalities would result in retrenchment of resources in terms of the number of local officials and administrative costs is misleading

y Legal issues relating to religion have been a matter of dispute in Japan from the nineteenth century up to the present day, and the Japanese experience in this regard continues to be relevant to international discussions in this area. The article provides a convenient introduction to the subject for readers who are not specialised in the study of Japanese religions. At the same time it contains new materials based on personal observation, particularly in connection with the imperial enthronement ceremonies (daijôsai) which took place in 1990 and which have previously been little documented. Also considered, against this political and legal background, is the underlying question as to how the plurality of religions is currently regarded in Japan. Attention is drawn to the markedly factional character of social institutions in this as in other fields. At the same time it is widely recognised in Japan today that the freedom of religions to exist in their plurality, and in some cases to cooperate with each other, can only be secured on the basis of equitable legal provisions which are respected by all concerned. The section headings may be translated as follows: developmental and secularisation processes in the history of Japanese religions, the plurality of religions as understood in East Asian thought patterns; Japan's current constitution - separation and freedom; borderline problems in the separation of religion and the state; the law on religious corporations; conclusions - tolerance, columnarization (verzuiling) and competition.

Die jährliche Veranstaltungsreihe des Hamburger Max-Planck-Instituts "Aktuelle Entwicklungen im japanischen Recht" wurde am 21. März 2016 mit einem halbtägigen Symposium mit Vorträgen zu den folgenden Themen fortgesetzt. Die Beiträge werden nachfolgend in überarbeiteter Fassung wiedergegeben.Das erste Referat war dem neuen japanischen Gesetzentwurf zur Regelung von Aktivitäten im Weltraum und den damit zusammenhängenden haftungsrechtlichen Fragen gewidmet, die mit dem Schadensersatzregime für Nuklearschäden verglichen werden. Der zweite Vortrag gab einen fundierten Überblick über die aktuellen Entwicklungen im internationalen Familienrecht Japans. Anschließend wurden zwei neue Entscheidungen des OGH zur Verfassungswidrigkeit des befristeten Wiederverheiratungsverbots für Frauen (sechs Monate ab Scheidung) und zur Verfassungsmäßigkeit des Verbotes der Führung getrennter Nachnamen für Ehepartner vorgestellt. ; On 21 March 2016 the Hamburg Max Planck Institute proudly hosted a further installment of its annual lecture programme "Current Developments in Japanese Law". The half-day symposium considered several topics of interest. The lectures are presented hereafter in a slightly revised version.The first speaker looked at recently proposed Japanese legislation regulating space activities as well as associated issues of liability, with comparative reference being made to the compensation regime for nuclear damage. The second talk presented a thorough overview of current developments in Japan's international family law. The symposium was rounded out by a discussion of two new Japanese Supreme Court rulings, the first on the constitutionality of the law prohibiting women from remarrying for at least six months from the time of divorce and the second on the constitutionality of Japan's prohibition against separate surnames for married couples.

Two Centuries of the Police Force and Changes in the LawThe Editorial Board has asked me 'to reflect upon the institutional history of the police with regard to the altered norms of justice'. I limited myself to the principles and rules of constitutional and criminal law. In my view, Fijnaut pays little attention in his book to the combined action of basic constitutional tenets, requirements and principles on the one hand, and the integration and functioning of the police within the Dutch state system on the other, although he does consider the police to be a government institution pur sang. The development of the principle of legality, in particular (which means that an action cannot be deemed punishable, nor be punished, without first going through the proper legal channels) is underexposed. Put more generally, many chapters only refer in passing to the interaction between developments within criminal law and the duties of the police, including how the police interpret and implement their duties. The latter are indeed an explicit part of the analytical framework of Fijnaut's book. This review is part of the discussion forum 'De geschiedenis van de Nederlandse politie' (Cyrille Fijnaut).

Tijdens een treinreis las ik een tijd geleden het volgende stukje in Metro (2 september 2008): Meisje geschept door politieauto in Haarlem [.]. Op het eerste gezicht zou men denken dat het meisje de politie-auto voor had moeten laten gaan als de politie-auto met zwaailicht en sirene reed. Echter, uit het Reglement Verkeersregels en Verkeersketens 1990 (RVV 1990) blijkt dat de politie-auto het meisje voorrang had moeten verlenen ongeacht of de politie-auto met zwaailicht en sirene reed. Laten we dit eens 'logisch' analyseren. Volgens artikel 50 RVV 1990 moeten verkeersdeelnemers voorrangsvoertuigen (motorvoertuigen die de optische en geluidssignalen voeren) voorrang verlenen.

This dissertation utilises methodologies found in the discipline of law and economics in analysing the emergence of international human rights law and the structuring of international human rights treaties.

Security law, or more comprehensively conflict and security law, on the international level represents the intersection of three distinct but interrelated fields: international humanitarian law (the law of armed conflict, jus in bello), the law of collective security (most identified with the United Nations (UN) system, jus ad bellum) and arms control law (including non-proliferation). Security in this sense is multifaceted - interest security, military security and, as is often referred to in the context of the EU, human security. As such, the law covers a wide range of specific topics with respect to conflict, encompassing the use of force, including choice of weapons and fighting techniques, extending to the rules applicable in peacekeeping and peace enforcement, and yet also dictating obligations outside the context of conflict, such as safeguarding and securing dual-use materials (those with both peaceful and military applications) to prevent malicious use.

Die Diplomarbeit untersucht ob in den Menschenrechten ein Recht auf humanitäre Hilfe während bewaffneten Konflikten existiert, ob der UN Sicherheitsrat dies anerkennt, und die Konsequenzen für den betroffenen Staat. Da internationales Recht sie nicht definiert, bezeichnet humanitäre Hilfe hier kurzfristige Hilfe für das Überleben der Bevölkerung während eines Konflikts. Die Kommentare von UN Menschenrechtsorganen zeigen, dass ein von Konflikt betroffener Staat nationale humanitäre Hilfe leisten muss, wenn das Überleben der Bevölkerung davon abhängt; ansonsten muss er internationale Hilfe akzeptieren. Humanitäre Hilfe wird dabei nie als Menschenrecht bezeichnet, aber als Teil überlebensnotwendiger Menschenrechte gesehen; Zugang zur Hilfe ist durch die Verpflichtungen des Staates aufgrund der Menschenrechte gesichert.Weiters wurde aufgrund von Sicherheitsratsresolutionen zu vier bewaffneten Konflikten zwischen 1990 und 2000 festgestellt, dass der Zugang zu internationaler humanitärer Hilfe wichtiger geworden und regelmäßig in rechtlich bindenden Kapitel VII-Resolutionen zu finden ist. Ein Recht auf humanitäre Hilfe wird nicht erwähnt, aber der Sicherheitsrat verpflichtet die Staaten dazu den Zugang sicherzustellen. Als Letztes wurde die Literatur zur staatlichen Souveränität untersucht und festgestellt, dass Menschenrechte, humanitäres Völkerrecht und Sicherheitsratsresolutionen die Souveränität einschränken, weil der Staat internationale Hilfe akzeptieren muss, wenn die Situation ernst genug für die Bevölkerung ist. Weiters hat der Sicherheitsrat seine Kompetenzen ausgeweitet und verabschiedet heute rechtlich bindende Resolutionen wegen Menschenrechtsverletzungen und fehlender humanitärer Hilfe.Ein Recht auf humanitäre Hilfe ist daher bis heute nicht explizit in internationalem Recht anerkannt, aber Menschenrechte und Sicherheitsratsresolutionen verpflichten die Staaten den Zugang zu humanitärer Hilfe während bewaffneter Konflikte zu garantieren. ; The diploma thesis questions if a right to humanitarian assistance exists today in human rights during armed conflicts, if such a right has been recognized by the Security Council, and consequences for an affected state. There is no definition in international law, so humanitarian assistance refers here to short-term aid intended to ensure the survival of the population during armed conflict.The commentary of the UN human rights treaty bodies shows that the state affected by armed conflict has to provide national humanitarian assistance, if the survival of the population depends on it; otherwise it has to accept international assistance. Humanitarian assistance has thereby never been called a right, but it is considered part of human rights essential for survival and access to it is guaranteed due to the human rights obligations the states are under.Furthermore, this thesis examined the Security Council resolutions adopted because of four armed conflicts between 1990 ? 2000, and has established that the access to international humanitarian assistance is very important and is included in legally binding resolutions adopted under Chapter VII. While a right to humanitarian assistance is not mentioned, the Security Council obliges the states to ensure the access to assistance. Finally, this thesis examined the literature on state sovereignty and established that human rights law, humanitarian law and Security Council resolutions restrict it by forcing the state to accept international assistance, if the situation is dire enough for the population. It is possible to observe that contractual agreements between the state and private persons in general and contractual agreements with civil servants in particular were accepted into neither of the self-differentiating realms of public and private law, as both categories of law, like the public and private spheres themselves, typically demonstrated a deep separation in continental Europe. This can be seen in Germany through the evolution of state and legal theories, particularly in the works of Justi, then Gönner, through to Hegel and numerous other legal theorists of the 19th century. Die deutsche rechtswissenschaftliche Literatur des 18. Jahrhunderts und des frühen 19. Jahrhunderts zur Kooperation zwischen Staat und Privaten befasst sich fast ausschliesslich mit der Rechtsform des Staatsdienstes. Dabei ist zu beobachten, wie der Vertrag zwischen Staat und Privaten im Allgemeinen und der Vertrag mit Staatsdienern im Speziellen mit der sich vertiefenden und für den kontinentalen Raum so typischen Trennung von öffentlich und privat respektive öffentlichem Recht und Privatrecht zwischen Stuhl und Bank geriet, d. h. weder im einen noch im anderen sich ausdifferenzierenden Rechtsbereich Aufnahme fand. Für Deutschland lässt sich dies anhand der Evolution der Staatsund Rechtstheorien nachvollziehen – insbesondere von Justi über Gönner zu Hegel und zahlreichen anderen Rechtswissenschaftlern des 19. Jahrhunderts.

Sexuelle Gewalt im bewaffneten Konflikt wurde jahrhundertelang nicht beachtet, da Vergewaltigungen als vernachlässigbarer Nebeneffekt von Kriegshandlungen betrachtet wurden. Diese Wahrnehmung änderte sich erst in den 90er Jahren, als die Kriege im ehemaligen Jugoslawien und der Völkermord in Ruanda weltweit Aufmerksamkeit für das Phänomen der gezielt eingesetzten sexuellen Gewalt gegen Frauen auslösten. Seither hat das Völkerrecht in Bezug auf das Verbot sexueller Gewalt eine beachtliche Entwicklung erlebt.Diese Diplomarbeit untersucht einerseits das Verbot sexueller Gewalt im Humanitären Völkerrecht und im Internationalen Strafrecht; andererseits widmet sich diese Arbeit einem bestimmten Aspekt dieses Verbots, der nach wie vor strittig ist ? nämlich der Frage, wie Vergewaltigung als völkerrechtliches Verbrechen überhaupt definiert sein sollte.Bereits die Genfer Konventionen und ihre Zusatzprotokolle enthalten explizite Verbote sexueller Gewalt; die darin enthaltenen Normen wurden jedoch im Bereich des Internationalen Strafrechts neu interpretiert und weiter ausgebaut. Insbesondere die Rechtsprechung des ICTY und des ICTR hat hierzu einen wertvollen Beitrag geleistet: beide Tribunale haben sexuelle Verbrechen sowohl als Verbrechen gegen die Menschlichkeit, als auch als Kriegsverbrechen und als Völkermord verfolgt.In ihrer Rsp haben die Tribunale außerdem erstmals internationale Definitionen für das Verbrechen der Vergewaltigung entwickelt. Die Urteile Akayesu, Furundzija und Kunarac enthalten die bisher einflussreichsten Definitionen. Darüber hinaus enthalten nun die "Elements of Crimes" des Internationalen Strafgerichtshofes die erste schriftlich niedergelegte Definition. Diese Arbeit analysiert die bisher vorgeschlagenen Definitionen und diskutiert, welche von ihnen für das internationale Verbrechen der Vergewaltigung am besten geeignet erscheint. Basierend darauf wird außerdem in Kapitel V (Conclusion) eine neue, alternative Formulierung vorgeschlagen. ; The issue of conflict-related sexual violence against women has been marginalized for centuries, since rape was considered a negligible side-effect of war. This perception only changed in the 1990ies, when the Yugoslav Wars and the Rwandan genocide revealed massive sexual atrocities that were often consciously employed as part of a military tactic. Since then, a rapid development concerning the prohibition of sexual violence can be observed in international law. This thesis has a twofold research purpose: Firstly, the protection against sexual violence is examined in International Humanitarian Law and International Criminal Law. Secondly, a currently still contentious aspect of this prohibition is specifically addressed ? the lack of a settled definition of rape as an international crime.While an explicit prohibition of rape is already laid down in the Geneva Conventions and their Additional Protocols, the scope of protection against sexual violence has been significantly expanded by the jurisprudence of the international criminal tribunals. Both the ICTY and the ICTR have prosecuted sexual violence under every category of international crimes contained in their statutes, i.e. as crimes against humanity, war crimes and genocide.In addition, the tribunals can be credited with developing the first international definitions of rape, since there was no definition of the crime in international law at the time of their establishment. So far, three principal definitions have emerged from the tribunals? case flow, which were contained in the Akayesu Judgment, the Furund?ija Judgment and the Kunarac et al. Judgment. Moreover, there is now a written definition of rape laid down in the Elements of Crimes of the International Criminal Court. This thesis analyzes each of these definitions in order to evaluate which of them is to be preferred. Das Rechtsregime des internationalen Investitionsrechts ist im Laufe der letzten Dekade mitunter heftig dafür kritisiert worden Belange des öffentlichen Interesses zu vernachlässigen und den Schutzmantel von Investoren über die Maßen zu dehnen. Aus der Lehre wurden insbesondere Bedenken geäußert, dass eine Fehlinterpretation und ?leitung des Regimes weitreichende Implikationen für den regulativen Handlungsspielraum von Gastgeberstaaten mit sich bringen würde und Staaten letztendlich davon abbringen könnte förderliche bzw. notwendige Maßnahmen zum Wohle der Allgemeinheit zu implementieren. Die Spannungen zwischen privaten und öffentlichen Interessen sind dem internationalen Investitionsrecht inhärent und Schiedsrichter stehen regelmäßig vor der delikaten Aufgabe Investoren ihren völkervertragsrechtlich zugesprochenen Schutz zukommen zu lassen, und dabei die ratio des gesamten Systems aufrecht zu erhalten, und Staaten genügend Spielraum zu lassen um ihre legitimen umwelt-, sozial- und wirtschaftspolitischen Interessen zu verwirklichen. Die gegenständliche Arbeit widmet sich diesem, im internationalen Investitionsrecht omnipräsenten Balanceakt, der letztendlich die Tragweite des gesamten Regimes definiert. Der Fokus liegt hierbei, anders als in einer Vielzahl verwandter Publikationen weniger auf politischen und ökonomischen Erwägungen als dem (völker-)rechtlichen Rahmen innerhalb dessen Schiedsrichter dieser prekären Aufgabe nachkommen dürfen. ; The international investment law regime has in recent years undergone some at times rather harsh criticism as to its reluctant stance towards issues of public interest, other sources of international law and its overly investor-friendly jurisprudence. Scholars have in particular voiced concern in regard of the regime?s potential to constrain states in their ability to regulate on behalf of the public good, chiefly premising arguments on the assertion that looming compensation claims may dissuade states from pursuing their policy objectives. The tensions between public and private interests are very much system-inherent and arbitrators most regularly have to walk a fine line between protecting investors and their commodities and thereby upholding the very purpose of the system, and giving states enough space for pursuing their legitimate policy objectives. In essence, it was a surrender of state sovereignty, which was deemed capable of attracting foreign financiers and continues to form the foundation of the regime, yet states somewhat underestimated the open-ended nature of the bargain they delivered and investors have shown little hesitance to probe the limits of their protective coating. It has ultimately been laid into the hands of arbitral tribunals to elucidate the ambits of international investment law and it is fair to say that the task has proven to be a matter of some delicacy. The thesis is dedicated to what many deem the most important challenge various investment treaty tribunals continue to face, to strike a balance between the economic rights and interests of investors and the states? right and duty to pursue their (other) public policy objectives.
