On the occasion of the recent legislative changes contained in the Ordered Text of law 27444, Law on General Administrative Procedure,the legal nature of the most recent exemptions of administrative liability isanalyzed. Likewise, a count is made of the exemptions that already existed inthe environmental legislation and how they had been operating; in order tosee the points of contact between a subjective liability regime, based on guilt,and a relative, risk-based objective liability system. ; Con ocasión de las modificaciones legislativas contenidas en el Texto Único Ordenado de la ley 27444, Ley del Procedimiento Administrativo General, se analiza la naturaleza jurídica de los novísimos eximentes de responsabilidadadministrativa. Asimismo, se hace un recuento de los eximentes que yaexistían en la legislación ambiental y cómo venían operando. Finalmente,se establece los puntos de contacto entre un régimen de responsabilidadsubjetiva, basado en la culpabilidad, y un sistema de responsabilidad objetivarelativa, basado en el riesgo.

El secuestro es un delito grave que va en aumento, que atenta contra la libertad, en concreto la libertad ambulatoria por cuanto el sujeto no puede trasladarse de un lugar a otro, y en segundo lugar el patrimonio económico del mismo ya que está siendo obligado a entregar algo a cambio de su libertad. Al igual que en los delitos de privación de libertad, se afecta la libertad, sin embargo, en el secuestro consiste en secuestrar a la persona para obtener de ello o de otra como precio de liberación, dinero, bienes, información u otros documentos con efecto jurídico.

This article develops the essential aspects that characterized the reflection on the general principles of Rights in the Cuban legal ideology between the years 1959-1992. In this sense, the impacts of the reception of the Soviet socialist theory of Law in the Cuban doctrine of the time are specified. The conceptions related to the theory of the sources of Law and the theory of the legal norm are characterized, this as a presupposition for the analysis of the politicized and ideologized vision that was defended on the principles in the selected period of time. ; En el presente artículo se desarrollan los aspectos esenciales que caracterizaron a la reflexión sobre los principios generales del Derechos en el ideario jurídico cubano entre los años 1959-1992. En este sentido, se puntualizan los impactos de la recepción de la teoría socialista soviética del Derecho en la doctrina cubana de la época. Se caracterizan las concepciones relativas a la teoría de las fuentes del Derecho y a la teoría de la norma jurídica, esto como presupuesto para el análisis de la visión politizada e ideologizada que sobre los principios se defendió en el periodo de tiempo seleccionado. ; Cet article développe les aspects essentiels qui ont caractérisé la réflexion sur les principes généraux du droit dans l'idéologie juridique Cubaine entre les années 1959-1992. En ce sens, les impacts de la réception de la théorie socialiste soviétique du droit dans la doctrine Cubaine de l'époque sont précisés. Les conceptions liées à la théorie des sources du droit et à la théorie de la norme juridique sont caractérisées, ceci comme un présupposé pour l'analyse de la vision politisée et idéologique qui a été défendue sur les principes dans la période de temps choisie.

The era of trade liberalisation for the ASEAN Economic Community (AEC) began in December 2015 and brought about economic liberalisation in the Southeast Asian region. This era is competitive and the ASEAN member states (AMSs) almost do not have full power of sovereignty to govern their own economic national matters. In this globalised dependence era, the majority of states in the world have to adjust and adopt as well as adapt their national laws to internationalised rules of law. This trade liberation era also has forced companies and other business entities, including Small and Medium Enterprises (SMEs) and Cooperatives in Indonesia to compete with each other in order to tap the benefits of international trade liberalisation. In this context, SMEs and Cooperatives in Indonesia need some kind of protection from the government that does not oppose international regulations on trade. While the number of SMEs and Cooperatives is 98 per cent, their contribution to Indonesian export is small, at only 19 per cent. They are weak in terms of capacity building and access to capital, information technology, global markets as well as integration with regional and global market chains. This research paper evaluates SMEs and Cooperatives in Indonesia in terms of facing AEC trade liberalisation, i.e., what has done and should be done by the authority is to give proper protection to the SMEs in Indonesia by focusing on the manufacturing SMEs as this sector has the best chance of boosting SMEs' export capacity and building the competitiveness of Indonesian SMEs in order to be equal with other SMEs in the ASEAN region.

since 2007 ASEAN has moved towards an ASEAN Economic community(AEC) as an economi integration of member states based on four economic pillars. One of AEC economic pillar the single market and Production base, means,the region as a whole must become a single market and production base to produce and commercialize good and services anywhere in ASEAN. The establishment of AEC is offering opprtunities in the from of a huge market of US$ 2.6 Trillion and over 622 million people. Of this number, around 40 per cent or 245 million people live in Indonesia. Numerous officials and othes have their doubts and worried that Indonesia will mainly be the market for the AEC and Indonesia's progress in developing its human capital will be negatively impected compettition from other ASEAN nations. The crucial futher step of the AEC is to implement the free movement of skilled labors as one of five core principles of single market and production base pillar, as it will boost economic integration in the region levels. In practice however, progress towords freer mobility has been slow and uneven. In practice however, progress towards freer mobility has been slow and uneven, due to rigid national immigration policies, inequalities in professional education and licensing regimes, public ambivalence toward the AEC, and the vast income gap that many countries fear will contribute to brain drain. This article examines impediment of free movement of skilled labors as a result of weak political and public support to drive the process forward as well as the myriad policy and procedural obstacles of free movement of skilled labor of selected categories of professions associated mainly with trade in service and invesment, this article also reviews the AMSs' policies in these areas

The failing firm defense is an Anglo-Saxon creation conceived almost a century ago. This conception has been conceived in order to support the fusionintegration of companies in financial crisis with others in solving situation, even if its operation from the competence defense right perspective, generates dominance situations, or is objected by the fair competence authorities.Not only the United States of America but the European Union elicited doctrines, jurisprudences, and statements that have embodied the figure of failing firm defense, but its treatment was not pacific or simple. The reach of these has generated significant controversies regarding concepts and "traditional" regulations such as monopolies, abuse of domain position, and limits between judicial liquidation, corporate reorganization and the principle of conservation of companies.Despite the importance of this figure as well as the scenario where it can be applied, there is no pronouncement in Colombia about the opportunity, the use and the boundaries of this figure. For this reason, the aim of this study is to present the current situation of the failing firm defense at the systems in which it is regulated, in order to review its effectiveness as well as provide tools of analysis that allow a potential study and development of this topic in our country. ; La excepción de empresa en crisis o "failing firm defense" es una creación anglosajona de hace poco menos de un siglo, que ha sido concebida como un mecanismo para auxiliar a empresas en situación de crisis financiera permitiendo su concentración-integración con otras en situación de solvencia, incluso si la operación, desde el punto de vista del Derecho de defensa de la competencia, puede generar situaciones de dominancia o ser objetada por parte de las autoridades de competencia.Tanto en los Estados Unidos de América como en la Unión Europea, han suscitado doctrinas, jurisprudencia y pronunciamientos que han dado cuerpo a la figura de excepción de empresa en crisis, sin que su tratamiento pueda definirse como pacífico o sencillo, toda vez que su alcance ha dado lugar a grandes controversias respecto a conceptos y regulaciones "tradicionales" como son los monopolios, el abuso de la posición de dominio y los límites entre la liquidación judicial, la reorganización empresarial y el principio de conservación de las empresas.No obstante la importancia de la figura y la problemática que plantea su aplicación, en el Derecho Comparado, en Colombia aún no existe pronunciamiento alguno respecto a la oportunidad, el uso y los límites de esta figura, por tal razón, a través de este trabajo se busca presentar la situación actual de la excepción de la empresa en crisis en los sistemas en que se encuentra regulada con el fin de examinar su efectividad y aportar herramientas de análisis para un potencial estudio y desarrollo del tema en nuestro país.

Por tanto, este artículo pretende hacer un recorrido por el antes y el después de la publicación en democracia de la primera norma general estatal audiovisual que, al menos en un primer momento, parecía establecer los inicios de un camino que desembocaría en la obtención de licencias y en la normalización del sector libre y comunitario. Este trabajo analizó la incidencia de la aplicación de la ley 1530 de 2012 (reforma al régimen de regalías) sobre la estructura organizacional y financiera del departamento del Meta, teniendo como horizonte de tiempo el periodo 2012-2015. Se inició revisando la estructura del modelo anterior de regalías frente al vigente, permitiendo identificar y describir los cambios generados. Asimismo, se determinaron las ventajas y desventajas del régimen de regalías actual en el modelo administrativo de los recursos, el ejercicio de inversión y la autonomía de gobierno en el manejo de los mismos. El análisis permitió evaluar el cumplimiento de los objetivos de ahorro, equidad, competitividad y buen gobierno sustento del cambio de sistema de regalías desde la teoría de la gestión de las organizaciones, destacándose la complejización del modelo en la toma de decisiones frente a las necesidades de inversión, la pérdida de autonomía del departamento y alto nivel de dependencia presupuestal de los recursos de regalías. It began reviewing the structure of the previous model Photo against the current in order to identify and describe the changes generated. El TJUE ha ido desarrollando una relevante jurisprudencia sobre el principio general de igualdad de trato, centrada principal, aunque no exclusivamente, en alguna de sus manifestaciones específicas, como la edad, y que se ha caracterizado por ofrecer una interpretación amplia y generosa de dicho principio, reforzando su alcance y contenido normativo. Esta doctrina jurisprudencial ha desempeñado un papel impulsor de la acción de la Unión en aquellos ámbitos competenciales donde habitualmente opera el principio de igualdad de trato, como la política social y la política de empleo. Ahora bien, esta tutela judicial de la igualdad de trato se funda en una jerarquía de motivos discriminatorios que tiene su origen en una opción del legislador de la Unión y que se proyecta tanto en el distinto alcance material de las discriminaciones prohibidas como en los diferentes niveles de justificación de las diferencias de trato admisibles. ; The ECJ has developed significant case-law on the general principle of equal treatment, this being chiefly focused, although not exclusively, on some of its particular aspects, such as age. The said case-law is characterized for its wide and generous interpretation of the aforementioned principle, having reinforced its regulatory scope and content. This case-law has given impetus to EU's action in those competence scopes where the principle of equal treatment applies, such as in social and employment policies.
