Fifty years after the creation of the European Common Market and fifteen years after the introduction of a chapter concerning public health in the CE Treaty, we can question about the consequences of the European law's influence on public health. To answer this question we must beforehand explain how public health was ruled by European law. In spite of uncertain legal basis, the European Community has become involved in public health questions and introduced material European law in a matter distant fiom the original concems of the European Community thus contributing to public health improvement, some States having yet no legislation regarding this matter. In spite of public health protection rema.ining, in principle, in the field of competence of the States members, the national objective of public health is at the same time infiuenced by communautarisation. The latter don't however conflict against the fact that members of an integrated system based on the fiee tratnc of goods pass public health constraints providing that these are justified, improve the health of citizens of States who wish develop the protection of their nationals ; Cinquante ans après la création du marché commun et quinze ans après l'introduction dans le Traité CE d'un titre consacré à la santé publique, on peut s'interroger sur les conséquences de l'intervention du droit communautaire en matière de protection de la santé publique. This work is about the reconstruction of the public law because of digital new uses, reviewing the transformation of the main public law concepts. This in order to identify which concepts can withstand, change or disappear because digital new uses. This will be the moment to mention the new digital items, to confront their compatibility by the public law. Moreover, we will consider how the public law is able to comprehend news uses and digital reticulated communication structures. Then, the purpose of this work is to reintegrate public law into the network paradigm in order to find out the ability for the public government to take part efficiently in most digital activities and digital business activities. In this way, we will be able to design how to guide the conceptual transformation of the public law in the digital transition of the government facing new digital challenges. ; Ces travaux portent sur la recomposition du droit public du fait du numérique. Il s'agit donc d'étudier la transformation des principaux concepts du droit public afin d'identifier ce qui résiste, ce qui se transforme et ce qui disparaît après que le numérique infléchisse les comportements et les activités. Ce sera l'occasion d'évoquer les objets nouveaux du numérique et voir leur compatibilité avec le droit public et le droit de manière globale. Également, l'opportunité sera donnée de réfléchir sur l'appropriation juridique des comportements et des formations réticulaires en vigueur dans les usages qui font appel aux technologiques numériques. Partant, il s'agira de réinsérer le droit public dans le paradigme du réseau numérique afin d'y dégager les moyens de repenser les moyens d'intervention de l'État sur les activités numériques et notamment les activités économiques numériques. By making a survey of the several rules of current public international law, this dissertation will try to make the reader undestand the importance of the protection of children's rights all over the world. Nowadays, children die every minute because of conflicts, diseases, malnutrition., a lot of them are exploited and have no possibilities of going to school, seeing their future escaping them every day a little more. It is against all these too recurring problems that States have to intervene by exercising their legislator's role, both on the international level and on the national level. But they also have to take their role of subject of law by respecting the international conventions which they made a commitment to respect of their own free will. This respect requires them to protect the children by offering them the possibility of enjoying humanitarian aid set up by many organizations loudly proclaiming that everybody has to act, in one way or another, to allow the development of many and various actions in spite of difficulties. ; En faisant un tour d'horizon des diverses règles de Droit International Public en vigueur, ce travail tentera de faire comprendre à son lecteur l'importance de la protection des droits de l'enfant dans le monde entier. Aujourd'hui encore trop d'enfants meurent chaque jour à cause de conflits, de maladies, de malnutrition…, beaucoup trop sont exploités et n'ont pas la possibilité de suivre des cours dans une école, voyant ainsi leur avenir leur échapper tous les jours un peu plus. C'est contre tous ces problèmes, trop récurrents, que les Etats se doivent d'intervenir en exerçant leur rôle de législateur, tant sur le plan international que sur le plan national. Mais ils doivent aussi assumer celui de sujet de droit en respectant les conventions internationales qu'ils se sont engagés à respecter de leur plein gré.
