The 1962 law that established the single middle school is considered, almost unanimously, as one of the most important post-World War II school reforms, despite its legislative process has been uneven and tiring and its political-cultural compromises are not always a success. It has contributed, though with difficulties and contradictions, to changing the identity of the Italian school, trying to make the school more authentically democratic and fighting that class selection that affected the most socially and culturally deprived classes. This contribution aims at analyzying the pedagogical debate in those years on the subject of teacher training, an issue that was widely debated among the various pedagogical currents and, moreover, deemed decisive for the success of the reform. Indeed, the issue was the training a new figure of middle school teacher, endowed with a serious pedagogical and didactic preparation, as well as a democratic mentality and a disposition to community work. ; La legge del 1962 che istituì la scuola media unica è considerata, secondo opinione quasi unanime, come una delle più importanti riforme della scuola del secondo dopoguerra, nonostante il suo iter legislativo sia stato accidentato, faticoso e carico di compromessi politico-culturali non sempre felici. Essa ha contribuito, non senza difficoltà e contraddizioni, a mutare il volto della scuola italiana cercando di renderla più autenticamente democratica e combattendo quella selezione di classe che colpiva i ceti più deprivati sul piano socio-culturale. Il contributo proposto intende analizzare il dibattito pedagogico di quegli anni sul tema della formazione degli insegnanti, che fu ampiamente affrontato dalle diverse correnti pedagogiche e, inoltre, considerato decisivo per il successo della riforma. Si trattava, infatti, di formare una nuova figura di insegnante della scuola media, dotato di una seria preparazione pedagogica e didattica, oltre che di una mentalità democratica e di una disposizione al lavoro comunitario.
The article poses the problem of the possible identification in the Italian legal system of an organic collection of regulations that govern and control libraries, with special reference to those that carry out a public service. It is basically a question of establishing if in Italy there is a "library law", that in any case represents a more extensive and complex phenomenon than simple library legislation. Reference is in fact made to the concept of "juridical process", as outlined especially by Norberto Bobbio, regarding and strictly connected to the other fundamental concept of juridical system, within the realm of which juridical institutes are born, in a framework that must exclude the presence of "antinomies", that is to say of contradictions between regulations.It is well known that the Italian situation is characterized by the absence of an organic state law on libraries and by the presence, on the other hand, of a vast legislative corpus of a regional nature; this leads to the emergence in the library field not only of legislative sources that differ from those of the state, but even of a plurality of juridical systems, composed not only of formal laws, but of legislative situations of various nature. What has however been lacking up to now, both on the state side and on that of the region, is an activity of systematizing those regulations capable of outlining with precision and effectiveness some fundamental institutes, first and foremost that of public libraries. The most recent developments of basic local autonomy and the progressive establishment of the need for inter-institutional initiatives, based on the principle whereby in the case of two crimes, the punishment for the more serious crime takes precedence over the application of the punishment for the less serious crime, do perhaps make it possible to foresee a path to a better systemic arrangement, which however cannot disregard, obviously, the effective existence of sufficiently equipped library institutes. This can also form the confirmation of some principles established by the institutional school: that is to say the logical precedence of bodies that can be organized over the pure manifestation of legislative will. ; La questione posta nell'articolo riguarda la possibilità di individuare nell'ordinamento italiano un insieme organico di norme che disciplinano e regolano le biblioteche, con particolare riferimento a quelle che svolgono un servizio pubblico. Si tratta insomma di stabilire se esiste in Italia un "diritto delle biblioteche", che rappresenta comunque un fenomeno più ampio e complesso della semplice legislazione bibliotecaria.Viene fatto riferimento al concetto di "sistema giuridico", così come è stato delineato in particolare da Norberto Bobbio, in riferimento e in stretta connessione con l'altro concetto fondamentale di ordinamento giuridico, nell'ambito del quale si determina la nascita degli istituti giuridici, in un quadro che deve escludere la presenza di "antinomie", vale a dire di contraddizione tra le norme.La situazione italiana è caratterizzata, come è ben noto, dall'assenza di una legislazione statale organica sulle biblioteche e dalla presenza, invece, di un vasto corpusnormativo di carattere regionale; ciò porta a configurare l'esistenza in campo bibliotecario non solo di fonti legislative diverse da quelle statali, ma addirittura di una pluralità di ordinamenti giuridici, fatti non solo di leggi formali, ma di realtà normative di varia natura. E' mancata tuttavia, fino ad ora, sia sul versante statale che su quello regionale un'attività di sistematizzazione delle norme capace di delineare con precisione ed efficacia alcuni fondamentali istituti, primo tra tutti quello della biblioteca pubblica.I più recenti sviluppi dell'autonomia locale di base e la progressiva affermazione della necessità di iniziative inter-istituzionali basate sul principio di sussidiarietà permettono forse di intravedere una strada di migliore organizzazione sistemica, che non può tuttavia prescindere, come ovvio, dall'effettiva esistenza di istituti bibliotecari sufficientemente attrezzati. Ciò può anche costituire una conferma di alcuni principi posti dalla scuola istituzionale: vale a dire la precedenza logica di entità organizzabili rispetto alla pura manifestazione di volontà normativa.
Dottorato di ricerca in Diritto dei contratti pubblici e privati ; In data 11 maggio 2005, il Parlamento europeo e la Commissione hanno adottato la direttiva 2005/29/CE relativa alle pratiche commerciali sleali poste in essere tra imprese e consumatori nel mercato interno. La presente direttiva intende contribuire al corretto funzionamento del mercato interno e al conseguimento di un livello elevato di tutela dei consumatori mediante l'armonizzazione delle disposizioni legislative, regolamentari e amministrative degli Stati membri in materia di pratiche commerciali sleali. Scopo del presente lavoro vuole essere quello di indagare la fattispecie in commento, avendo particolare riguardo alle disposizioni nazionali di recepimento della suddetta direttiva comunitaria (D.Lgs., n. 146 del 2 agosto 2007). Ove si volesse sinteticamente rievocare la recente evoluzione normativa che ha condotto all'affermazione di un diritto dei consumatori anche nel nostro Paese, sarebbe possibile configurarla come un tentativo di superamento dell'inadeguatezza della disciplina codicistica e delle tecniche di tutela dei diritti basate sull'azione in giudizio del singolo interessato. Il fine è quello di attribuire al consumatore e, oggi, anche alle microimprese, una posizione giuridicamente più forte per compensare la loro intrinseca debolezza sul piano sostanziale. La disciplina relativa alle pratiche commerciali scorrette estende la tutela del consumatore - oltre la soglia stessa del contratto - all'intero rapporto di consumo. Il complesso di questa normativa, elaborata proprio per superare la constatata inadeguatezza della tutela "formale" garantita dal codice civile, determina una necessaria esigenza di adeguamento del sistema e degli stessi abiti mentali degli operatori del diritto, aprendo una serie di questioni su cui è utile soffermarsi. Si tratta di individuare il nuovo punto di equilibrio nei rapporti tra autonomia dei privati e ordinamento. In tale contesto, occorre ricostituire un bilanciamento degli interessi e degli adeguati criteri di giudizio volti a chiarire se la normativa a tutela dei consumatori esprima un'istanza di tipo dirigista oppure si configuri come una nuova frontiera dell'affermazione della libertà dell'individuo. Si può proporre un primo tentativo di risposta che ruota intorno alla consapevolezza e all'autonomia della scelta di consumo. Queste devono essere garantite nella loro effettività in quanto divengono, nel quadro del mercato concorrenziale, un momento altrettanto essenziale come quello della competizione tra le imprese. Il consumatore, infatti, potendo scegliere tra le varie offerte induce una pressione nei confronti delle imprese che devono sforzarsi di offrire beni e servizi sempre migliori. La volontà e la capacità di giudizio del consumatore devono essere protette da abusive pressioni esterne, senza però essere annullate o sostituite integralmente da determinazioni eteronome di natura amministrativa o giudiziale. In questo contesto assume un ruolo rilevante l'Autorità Garante della Concorrenza e del Mercato la quale, chiamata a vigilare anche in materia di pratiche commerciali scorrette, ha il delicato compito di rendere operativo l'insieme delle tutele previste in astratto dalla legge senza pregiudicare la libera e consapevole scelta del consumatore nonché la libertà di impresa. Seguendo tali linee programmatiche sarà possibile individuare i punti di forza e nello stesso tempo di debolezza che potrebbero rilevare in sede di tutela civilistica delle ragioni del consumatore non trascurando il fatto che, da un lato, la disciplina delle pratiche commerciali scorrette non è stata disegnata dalla direttiva 2005/29/CE in funzione della produzione di effetti inerenti ai rapporti contrattuali tra il professionista e il consumatore, dall'altro, è la prassi che impone di approfondire tale interessante profilo di indagine. Tra gli obiettivi del presente lavoro si inseriscono, altresì, talune necessarie considerazioni in merito alla disciplina statunitense delle unfair commercial practices – frutto di un periodo di ricerca che, colui che scrive, ha avuto l'onore e il piacere di svolgere negli Stati Uniti d'America presso la Fordham University School of Law (New York City). ; The Directive on Unfair Commercial Practices was adopted on May 2005. Commercial practice refers to activities linked to the promotion, sale or supply of a product to consumers. It covers any act, omission, course of conduct, representation or commercial communication – including advertising and marketing – which is carried out by a trader. If it is unfair, this means it is deemed to be unacceptable with regards to the consumer, according to specified criteria. The Directive has been passed to strengthen the confidence of European consumers in cross-border transactions. Evidence showed that citizens were unsure if their rights would be adequately protected in international purchases and were therefore not taking advantage of the European Internal Market. The Directive aims to clarify consumers' rights and to simplify cross-border trade. Common rules and principles will give consumers the same protection against unfair practices and rogue traders whether they are buying from their corner shop or purchasing from a website based abroad. The Directive brings harmonization and mutual recognition between states, bringing down internal market barriers. On September 21, 2007, Legislative Decrees n. 145/2007 and 146/2007 entered into force, transposing Community Directive 2005/29/EC into the Italian law. These decrees modify the rules on misleading and unlawful comparative advertising (by modifying the Legislative Decree no. 206/2005 - Consumer Code) and introduce a new set of rules on improper or unfair commercial practices, entrusting its implementation to the Antitrust Authority. Commercial practices are considered unfair if they run "contrary to the requirements of professional diligence and materially distorts or is likely to materially distort the economic behaviour with regard to the product of the average consumer whom it reaches or to whom it is addressed, or of the average member of the group when a commercial practice is directed to a particular group of consumers. " (Section 20(2) of the Consumer Code). Two different types of unfair commercial practices have been distinguished. One concerns "misleading practices," which may involve " misleading actions" or " misleading omissions." Actions or omissions are considered misleading to the extent that they induce average consumers to make decisions they would not have made otherwise. Another type of unfair commercial practices concerns "Aggressive practices" wich are practices that employ harassment, coercion or other undue forms of influence to pressure the average consumer into making commercial decisions they would not have made otherwise. The new set of rules also identifies commercial practices which are in all circumstances considered misleading or aggressive and no additional burden of proof is necessary to demonstrate their capacity to misguide consumer choices. About unfair commercial practices, misleading and unlawful comparative advertising, the new rules empower the Antitrust Authority to launch proceedings also ex-officio (i.e. even when no complaints have been received from external sources). It is endowed with investigatory powers, including the ability to gain access to any pertinent document and to request pertinent documents or information from anyone, the capacity to sanction refusals to cooperate or the transmission of untruthful documentation or information, to conduct inspections, to receive assistance from the Italian Tax Police and to conduct surveys and economic analyses. From the studies relating to the Italian law discipline it has emerged that the discussion about unfair commercial practices finds a significant example in unfair practices regulated from Federal Trade Commission Act wich is even worth analyzing. The Phd thesis also investigates the likely impact of the consumer regulation on the private law of contract and the consumer's right of redress.
Law 92/2019 reintroduces civic education into the Italian curriculum as a cross-curricular and multidimensional subject covering three elements: the Italian constitution, sustainable development and digital citizenship. The aim is to encourage schools to update their curricula and teaching programmes to develop "knowledge and un-derstanding of the social, economic, legal, civic and environmental structures and profiles of society" (Art. 2, point 1). Starting with an overview of the meaning of citizenship and democracy, this contribution sets out an analysis of the most important European initiatives related to digital citizenship education by UNESCO, the European Union and the Council of Europe. The authors will highlight similarities and divergences in compar-ison to the context and priorities of the Italian school system. ; La legge 92/2019 reintroduce l'educazione civica all'interno dei curricoli scolastici in quanto insegnamento trasversale e multidimensionale fondato su tre assi: Costituzione Italiana, Sviluppo sostenibile, Cittadinanza digitale. L'obiettivo è stimolare le scuole all'aggiornamento dei curricoli e delle attività di programmazione didattica per sviluppare «la conoscenza e la comprensione delle strutture e dei profili sociali, economici, giuridici, civici e ambientali della società» (Art 2, comma 1). Partendo da una riflessione intorno al significato di cittadinanza e di democrazia, il contributo propone una lettura delle più importanti iniziative europee relative all'educazione alla cittadinanza digitale ad opera di UNESCO, Unione Europea e Consiglio d'Europa, mettendo in risalto analogie e punti di divergenza rispetto al contesto italiano, evidenziando le priorità verso cui la scuola dovrebbe tendere.
Hrvatska Vlada nastavlja kontinuirani rad s ciljem kurikularne reforme na čelu s premijerom Plenkovićem koji je postavljen da bi se osigurao nastavak rada. Talijanska Vlada je usvojila Zakon o reformi nacionalnoga odgoja i obrazovanja, tzv. "Dobra škola". Jasno su bili definirani svrha i ciljevi, alati, načini realizacije i vrednovanja te dodaci za rad za nastavnike i školu te za sve one koji žele ulagati u školsku infrastrukturu. Postoje dvije vrlo slične realnosti u školama koje imaju potrebu za snažnom podrškom društva. ; The Croatian government has continued with its work aiming at curriculum reform with premier Plenković at its head: he has been given this task in order to ensure that this reform will continue. The Italian government has incorporated a law concerning the reform of national education tiltled as the "Good School". The aims and means have been clearly defined, the tools required, the means of realisation and evaluation, as well as additions for teachers, schools and all those who desire investing in school infrastructure. There are two very similar realities in schools that have the need for the strong support of the community. ; Il Governo croato sta continuando a lavorare alla Riforma curricolare e a capo della Commissione per l'attuazione della stessa è stato eletto il premier Plenković per garantire la continuità. Il Governo italiano ha approvato la Legge sulla Riforma del sistema nazionale di istruzione e formazione, la cosiddetta Buona Scuola. Sono stati chiaramente definiti gli scopi, gli obiettivi, gli strumenti, le modalità di attuazione e valutazione, i bonus per docenti e gli school bonus per coloro che vogliono investire nell'infrastruttura scolastica. Sono due mondi scolastici molto simili che abbisognano di un forte sostegno della società.
The introduction aims at underlining how the Resistance movement has been dealt throughout the political debate hold in republican Italy, summing up how scholastic law deals with the topic. Eventually, it sums up the following parts of the volume.
"Poetry and the law are born in the same cradle". Thus Jacob Grimm, the great Romantic philologist and founding father of German studies, wrote in 1816. This famous statement was inspired by the new juridical science fostered by his ma - ster, Friedrich Carl von Savigny. With the establishment of the Historical School of Law in 1814, and by assigning a fundamental role to the jurists'interpretation, Savigny had proposed to maintain the old Reich's heritage in Germany rather than introducing a civil code fashioned after the Napoleonic template, thus lay - ing the foundations of a bond between the study of the old German law, the Ro - mantic Lied and the aspirations of many writers and intellectuals who, like Jacob Grimm, believed in the rediscovery of the German people authentic traditions. In nineteenth-century Germany, nation building and state building were thus both conceived and supported by means of that bond between law and literature. In this case the law-literature paradigm guided the process which combined the cultural formation of German identity with the political project of national uni - fication. The essay outlines the development of this fascinating and ambiguous project and its ultimate failure in 1848.
The introduction of Law 92/2019 has renewed attention on the goals not only of Civic Education itself, but also of the whole school system, on its being truly democratic, equal and inclusive, issues that have become even more urgent with the emergence of the pandemic that has amplified inequalities. Already the 2016 Council of Europe document Competences for Democratic Culture had stressed the fundamental need to take «measures to tackle social inequalities and structural disadvantages». The paper presents a thematic analysis of the text of the law, the guidelines and the goals in order to identify, on the one hand, the fundamental conceptual cores that guided the legislator in the selection of the topics to be taught and its objectives and, on the other hand, whether and how the underlying concepts of citizenship and citizen are consistent with the urgent need to tackle growing social inequality. ; L'introduzione della legge 92/2019 ha riacceso l'attenzione sugli obiettivi non solo dell'Educazione civica, ma anche del sistema scolastico nel suo insieme, sul suo essere realmente democratico, equo e inclusivo, questioni diventate ancora più urgenti con l'insorgere della pandemia che ha amplificato le iniquità. Già il documento del Consiglio d'Europa del 2016 sulle Competenze per una cultura della democrazia aveva ribadito la necessità fondamentale di adottare "misure per risolvere i problemi delle disuguaglianze sociali e degli svantaggi strutturali". Nel contributo si restituisce un'analisi tematica del testo della legge, delle linee guida e dei traguardi al fine di identificare, da un lato, i nuclei concettuali fondanti che hanno guidato il legislatore nella selezione dei temi oggetto dell'insegnamento e dei suoi obiettivi e, dall'altro, se e come i concetti di cittadinanza e cittadino a essi sottesi siano coerenti con l'urgenza di contrastare la crescente iniquità sociale.
La ricerca indaga, nell'ambito dell'educational evaluation, sulla funzione dell'autovalutazione nel processo di valutazione dei docenti e sul suo ruolo nello sviluppo professionale degli insegnanti e nel miglioramento della scuola. All'interno degli approcci della program evaluation la valutazione dei docenti è connessa alla valutazione del curricolo; dall'analisi delle teorie e dei modelli di valutazione del programma si individua una linea di tendenza verso una progressiva partecipazione del docente e verso una specifica attenzione al suo portato nella valutazione, dinamismo che avvicina alla pratica auto valutativa. L'utilizzo di pratiche auto valutative emerge dalla comparazione delle prassi valutative dei paesi europei; la competenza auto valutativa e valutativa dell'insegnante diviene indispensabile, se ne verifica la presenza nei profili professionali dei docenti di Inghilterra, Francia, Finlandia e Portogallo, confrontati tramite un metaframework (Danielson, 2011). L'autovalutazione delle proprie competenze diviene esercizio della competenza del valutare, operazione mentale da apprendere al pari delle altre; si parla, date queste premesse, di apprendimento della valutazione (Guasti, 2013), nel quale il soggetto ha un ruolo attivo e consapevole. Nel percorso italiano di valutazione della scuola e dei docenti, dai progetti sperimentali di valutazione alla Legge 107/2015, si ricercano passaggi auto valutativi e si prendono in esame documenti e strumenti per analizzarne gli aspetti auto valutativi. Il profilo professionale del docente italiano è ricostruito a partire dalle leggi, dai contratti e dai progetti sperimentali. È la "scuola vissuta" ad essere interpellata con la survey approach rivolta ad alcuni dirigenti scolastici; l'indagine conferma il valore dell'ipotesi iniziale, evidenziando attenzione e ricettività verso le pratiche auto valutative della scuola e dei docenti. Un ruolo sempre più attivo del soggetto nella valutazione, sino al suo compimento nell'autovalutazione, insieme alla considerazione della parte processuale dell'insegnamento- apprendimento, possono rappresentare la chiave di volta per lo sviluppo professionale dei docenti e il miglioramento della scuola. ; The research, in the field of educational evaluation, the role of self-evaluation in teacher's evaluation and in professional development of teachers and the improvements of schools. Within the approaches of the program evaluation the evaluation of teachers is linked to the evaluation of the curriculum; from the analysis of the theories and the models of the evaluation of the program a tendency can be identified toward the participation of teachers and an attention toward what teachers can bring to the evaluation, dynamism that approaches to self-evaluation. The use of self-evaluation practices arises from the comparison of different evaluation techniques in european countries; and the competency in self-evaluation and of the teacher's evaluation becomes necessary, it's checked the presence in the professional profiles of teachers in England, France, Finland and Portugal, compared with a metaframework (Danielson, 2011). The self-evaluation of competencies becomes and exercise to evaluate, a mental operation that must be learnt like others; it's discussed the "learning to evaluate" (Guasti 2013), in which the subject has an active role. In the Italian path of evaluation of school and teachers, from the experimental project of evaluation to the law 107/2015 the self-evaluation step are searched and documents and tools to analyse the self-evaluation aspects. The professional profile of the Italian teacher is built from the laws, the contracts and the experimental projects. The "everyday school" is called upon with survey approach to a few head teachers; the enquiry confirms the value of the initial hypothesis, highlighting the attention towards auto-evaluation practices of the school and the teachers. An incresingly active role of the subject of the evaluation, until it's success in the self-evaluation, together with the consideration of the process part of teaching-learning, can represent the key for professional development of teachers and the improvement the schools.

The second paragraph of Article 3 of Law no. 92 of the 20th of August 2019 on the introduction of civic education into school teaching indicates active and responsible citizenship among its learning objectives, while article 8 suggests making the teaching of civic education cross-curricular and integrated with outside-school initiatives. FridaysForFuture (FFF) is a movement of great social relevance, being an informal and outside-school enactive network capable of influencing public debate and the political/economic agenda. Its main activity, in keeping with Law no. 92, concerns the encouragement of sustainable development through the promotion of collective awareness and identity and civic engagement. By adopting the enactive and systemic approach, this article analyzes the convergences and divergences between FFF and Law no. 92, the possible role FFF could play in teaching civic education in schools and the limits of Law no. 92 in detecting and including emerging and informal networks such as FFF. ; La legge n. 92 del 20 agosto 2019 sull'introduzione dell'insegnamento scolastico dell'educazione civica indica la cittadinanza attiva e responsabile tra gli obiettivi di apprendimento e invita a rendere l'insegnamento dell'educa-zione civica trasversale e a integrarlo con esperienze extra-scolastiche. FridaysForFuture (FFF), a sua volta è un movimento nato dal basso di grande rilievo sociale, una rete enattiva in-formale ed extra-scolastica votata a influenzare il dibattito pubblico e l'agenda politico/economica. La sua attività principale, in linea con la Legge n. 92, riguarda la promozione dello sviluppo sostenibile perseguita attraverso l'impegno civico e la formazione di una consapevolezza collettiva. Adottando l'approccio enattivo e sistemico, in questo articolo si analizzano le convergenze e divergenze tra la legge n. 92 e FFF, il possibile ruolo di FFF nell'insegnamento dell'educazione civica e i limiti della legge n. 92 nel rilevare ed includere le reti emergenti ed informali quali FFF.
La parte central de este trabajo es la integración escolar de las personas con discapacidad en Italia, en el marco legislativo de los modelos teóricos y conceptuales que históricamente la han explicado. El discurso sobre la integración se inscribe después de casi cincuenta años de la Ley nº. 118/1971, la cual estableció de manera innovadora un precedente en la tradición pedagógica de mi país para todos los estudiantes con discapacidad: la educación obligatoria debe tener lugar en las clases comunes de las escuelas públicas (art. 28). De este modo Italia comenzó a mostrar en la escena mundial su modelo de integración escolar, caracterizado por la plena participación de los alumnos con discapacidad en el sistema educativo de educación y formación, sin trayectorias separadas de las ordinarias. En vista de esta ley, el proceso evolutivo no se ha detenido, es más, ha progresado en gran medida. Así que después de la primera parte, donde se presenta el marco histórico-cultural internacional, y en la que se expone el concepto de discapacidad y de trastorno del espectro autista, sigue una visión general de la legislación en materia de integración escolar en Italia que ha intentado abrir las puertas a la comprensión del carácter específico italiano. Tras una primera etapa representada por la Ley 118/1971 que regula la inserción de las personas con discapacidad en el entorno educativo, un segundo paso decisivo ha sido la Ley nº. 517/1977, que ha especificado el principio de integración. Este modelo ha anticipado varios años lo que a nivel internacional se destacaría después en la Conferencia de Salamanca (7 - 10 de junio de 1995) y en la Convención de las Naciones Unidas sobre los Derechos de las Personas con Discapacidad, adoptada por la Asamblea General de la ONU el 13 de diciembre 2006, que compromete a todos los Estados firmantes a considerar formas de integración escolar en las clases comunes. Este paradigma es el punto de referencia de la Ley n° 104/1992, que ha dictado "los principios del ordenamiento en materia de derechos, integración social y asistencia de las personas con discapacidad" (art. 2), y que establece la cooperación necesaria entre la escuela y los servicios sociales y sanitarios del territorio, haciéndose sentir sus efectos hasta nosotros. Finalmente, se muestra la organización de la red regional de apoyo a la integración escolar con los mecanismos que se han sucedido a lo largo de la evolución legislativa. Por último, el resultado de una investigación cualitativa y cuantitativa llevada a cabo en la escuela primaria de la ciudad de Palermo, mediante la administración de cuestionarios de autorreporte (self-report), pero también haciendo uso de las cualificadas opiniones del Ministro de Educación y del Subsecretario de Estado para la salud y de otros representantes institucionales escuchados en calidad de observadores privilegiados, se ha expuesto el método de aplicación de la integración escolar de niños con trastorno del espectro autista en el contexto local de Palermo, bajo la mirada de los padres, de los profesores y de los directores de centros educativos. Siguiendo el ejemplo de la investigación llevada a cabo en las escuelas de la ciudad de Palermo, habida cuenta de los marcos teóricos previamente descritos, ha sido posible exponer y profundizar el marco existente, discutir los elementos críticos surgidos del sistema legislativo previsto para la integración y la inclusión escolar de las personas con discapacidad, especialmente de los alumnos con trastorno del espectro autista, y valorar los posibles remedios para un mejor enfoque de la esfera de la discapacidad grave. ; The heart of the present work is scholastic integration of disabled persons in Italy in the legislative framework of the theoretical-conceptual models that historically have dealt with it. The reflection on integration is taking place almost fifty years after the passing of Law 118/1971, which in an innovative way created a landmark in the pedagogic tradition of my country for all disabled students: compulsory education must take place in normal classes at state schools (art. 28). In this way Italy began to manifest on the world scene its model of scholastic integration, marked by full participation of disabled pupils in the education and training system, without education of disabled people being separate from ordinary education. In the light of this law the evolutionary process has not stopped, and indeed it has advanced considerably. Therefore after a first part, in which the international historical-cultural framework is introduced and in which the concept of disability and disorders of the autistic spectrum is illustrated, there follows an overview of the legislation on scholastic integration in Italy that tries to open the doors to an understanding of Italian specificities. After a first stage represented by Law 118/1971 aiming at insertion of disabled people in schools, a second decisive passage was Law 517/1977, which specified the principle of integration. This model came quite a few years ahead of what at the international level was then underlined with the Salamanca conference (7-10 June 1995) and with the UN convention on the rights of people with disabilities approved by the General Assembly of the United Nations on 13 December 2006, which committed all the signatory states to introducing forms of scholastic integration in ordinary classes. This paradigm is the reference point of Law 104/1992, which laid down "the principles of the framework on the subject of rights, social integration and assistance of the handicapped person" (art. 2) and specified the necessary collaborations between school and the social and health services of the territory, making its effects felt down to our day. The organization of the territorial assistance network was finally illustrated for scholastic integration with the orders that followed one another in legislative evolution. Lastly, the fruit of qualitative and quantitative research carried out in primary schools in the city of Palermo through the administration of self-report questionnaires, but also drawing on some qualified opinions of the Minister of Education and the Undersecretary of State for Health and other representatives of institutions consulted as privileged observatories, there was illustrated, with parents, teachers and scholastic executives looking on, the modality of realization of scholastic integration of children with disorders of the autistic spectrum in the territory of Palermo. Taking hints from the research conducted at schools in the city of Palermo in the light of the theoretical frameworks previously delineated, it was possible to illustrate and extend the current picture, to discuss the critical aspects of the planned legislative system for integration and scholastic inclusion of disabled persons and particularly of pupils with disorders of the autistic spectrum, and to appraise the possible remedies for a better perspective on the sphere of serious disabilities. The hope is that this work can contribute to driving away the risk, particularly for disabled people, of experiencing bitter "loneliness", even precisely because of those people who declare they are and want to be – at the level of daily proximity, in the professional or institutional context – true "friends." Considering that disability and the theme of personal diversity are more a question of civilization than a legal one, the hope is that we will never see, in any context and in any form, what Milan Kundera said: "A man is condemned to loneliness not by his enemies but by his friends ." La esperanza es que este trabajo pueda ayudar a evitar y a alejar el riesgo, especialmente para las personas con discapacidad, de vivir una "soledad" amarga, tal vez precisamente a causa de quienes se declaran y quieren ser - a nivel de proximidad cotidiana, en el contexto profesional o institucional, - "amigos" de verdad. Dado que la discapacidad y el tema de las diferencias personales son más una cuestión de civilización que de tipo jurídico, la esperanza es que nunca se haga realidad, en todos los contextos y en todas las formas, lo que decía Milan Kundera: "Para condenar a un hombre a la soledad no están sus enemigos, sino sus amigos".
Autorevole esponente della penalistica 'liberale', all'avvento del fascismo Luigi Lucchini si presentava quale anziano superstite d'una generazione che aveva visto nel diritto, e in particolare in quello penale, il perno d'un assetto costituzionale in grado di garantire al giovane Regno d'Italia l'equilibrio tra i poteri, il rispetto delle garanzie individuali, l'ordine pubblico. Proprio l'esigenza di sicurezza, al termine del biennio rosso, spinse Lucchini, che si era esposto sino a qualificare delitto il socialismo militante, a sostenere l'ascesa di Mussolini. La sintonia, però, fu breve: già all'inizio del 1924 il penalista si accorse che il governo brandiva con disinvoltura l'arma dei poteri straordinari ed esprimeva una «volontà più che dittatoriale». Il dissenso esplose con il delitto Matteotti e procurò a Lucchini, oltre all'isolamento scientifico, serie incomprensioni che ebbero anche spiacevoli risvolti giudiziari. Gli ultimi sforzi del giurista patavino furono tesi a rinverdire l'eredità della penalistica 'civile', in contrapposizione ai criteri che guidavano l'azione codificatrice del guardasigilli Alfredo Rocco.Luigi Lucchini, authoritative exponent of 'Classical School' in Italian criminal law, was elderly when Fascism came to power. He was a survivor within a generation that had considered Law, especially Criminal Law, a constitutional instrument to ensure the young Kingdom of Italy balance of powers, respect for individual rights, public order. After the 'red biennium', just the need for security convinced Lucchini, who had called 'crime' the militant socialism, to support rise of Mussolini. Agreement, however, did not last long time. At the beginning of 1924 he noted that government was using overly emergency powers and was showing «a more than dictatorial will». Dissent exploded at Matteotti's murder. Lucchini was culturally isolated and also suffered a judicial persecution. In recent years, Lucchini strove to defend legacy of 'civil' criminal law scholars, against principles to which the Minister of Justice Alfredo Rocco wanted to inspire his future code.
The relationship between Lombard and Roman law has been the centre of important debates among Italian and German scholars during the 19th century. In particular, the attention drawn by the celebrated writer Alessandro Manzoni on the condition of the conquered people under Lombard rule gave rise to scholarly quarrels, which were sometimes biased by the national pride heightened by the contemporary political background. Other European legal historians, though, have all but rarely entered into such questions, whose nationalistic pattern was clearly perceived even at the time: few of the French followers of the German historical school of law treated the subject, albeit significantly, and only a shallow reflection of it touched the Angloamerican tradition of historical studies
Le prolusioni e i testi delle lezioni universitarie sono il punto di partenza della ricerca: tali scritti offrono una prospettiva privilegiata – all'interno del mondo giuridico subalpino prima e unitario poi – per valutare se e in che misura questi 'discorsi giuridici', per loro natura indirizzati a un pubblico di élite ma non limitato ai soli universitari, abbiano influito non solo sulla vita scientifica, accademica ma pure su quella culturale, politica ed istituzionale. La prima parte della tesi è dedicata ad un'analisi dettagliata del dibattito sull'istruzione legale a partire dalla 'Riforma Alfieri' del 1846: si è cercato di offrire un quadro della situazione didattica della Facoltà giuridica torinese nella seconda metà dell'Ottocento, attraverso le parole – ed in specie i testi di lezione – degli stessi protagonisti che si preoccuparono di migliorare la qualità e l'organizzazione dell'insegnamento. Tale cornice aiuta a comprendere meglio il clima e l'ambiente di convinta partecipazione al miglioramento della didattica giuridica in cui si inseriscono le prolusioni e i discorsi inaugurali, che a loro volta rispecchiano le problematiche e gli argomenti topici del periodo, e le lezioni dei docenti della Facoltà subalpina. In proposito emerge l'importante contributo di tre di essi, il Merlo, il Melegari e l'Albini: nella seconda parte della tesi è stato dedicato un capitolo a ciascuno di questi tre giuristi. La scelta è ricaduta su questi tre docenti perché, sebbene molto diversi per origine e percorso di formazione, hanno offerto un diretto contributo personale al miglioramento degli studi legali sia con la collaborazione fattiva ad un perfezionamento legislativo del cursus studiorum legale sia con i loro insegnamenti che erano significativi del nuovo percorso degli studi legali intrapreso dopo la riforma Alfieri del 1846. Il punto di incontro fra i tre studiosi si trova nel comune convinto e profondo interesse per il miglioramento degli studi legali. La lettura dei testi delle loro lezioni ha permesso di poter apprezzare tale sforzo, non solo dal punto di vista dell'impegno per il miglioramento della regolamentazione degli studi nella Facoltà legale, ma anche da quello del contenuto degli insegnamenti. ; The introducing lectures and the transcriptions of the University of Turin courses in law are the starting point of the research. These documents offer a privileged perspective on the law environment of the subalpine world, and subsequently of united Italy. They allow us to evaluate whether and how these discourses in law, addressed to a privileged public but not restricted to university circles, have had an influence not only on academia but also on the cultural, political and institutional life of the time. The first part of the thesis is dedicated to a detailed analysis of the debate on the structure of legal studies, starting from the 1846 "Alfieri reform". The goal is to delineate an outline of the situation of didactics of the Turin's Law School during the second half of the nineteenth century. This is accomplished through the words and the transcriptions of the courses of those same professors that were influential in improving the quality and organization of the teaching. Such analysis helps better understanding the environment of active participation to the amelioration of the didactics of law education in which the inaugural lectures are immersed, reflecting the problems and topics of the time. In the second part of the thesis, the contributions of Professors Merlo, Melegari and Albini are discussed, and a chapter is dedicated to each of them. The analysis of the work of these three scholars is particularly interesting as, even if very different for social origin and academic curriculum, they have offered an important personal input to the enrichment of the law education path, both with an effective collaboration in the legal definition of the cursus studiorum and with their teachings, providing significant examples of the new study path in law (post Alfieri reform). The meeting point between the three scholars is the common interest for the improvement of legal studies. The analysis of the texts of their lectures has allowed this effort to be appreciated, not only under the point of view of the legal definition of the cursus studiorum, but also under that of the contents of their teaching.
