The Andean Court of Justice (ACJ) and the Permanent Tribunal of Review (PTR) of Mercosur have used the European Court of Justice (ECJ) case law to define the principle of free movement of goods enshrined in the Cartagena Agreement and the Treaty of Asuncion. This paper seeks to analyze the manner in which the ACJ and the PTR have applied the ECJ case law in order to determine the existence of trade restrictions. It is argued that there is a need to developed a contextual interpretation of the principle of free movement of goods in the Andean Community and Mercosur that clarifies and develop the concepts of the Cartagena Agreement and the Treaty of Asuncion in the light of their own integration processes, of which the ACJ and the PTR are part. ; El Tribunal de Justicia de la Comunidad Andina (TJCAN) y el Tribunal Permanente de Revisión (TPR) del Mercosur han utilizado la jurisprudencia del Tribunal de Justicia de la Unión Europea (TJUE) para definir el principio de libre circulación de mercancías consagrado en el Acuerdo de Cartagena y el Tratado de Asunción. Este artículo busca analizar de qué manera el TJCAN y el TPR han aplicado dicha jurisprudencia para determinar la existencia de restricciones al comercio. Se plantea que existe la necesidad de desarrollar una interpretación contextualizada del principio de libre circulación de mercancías en la Comunidad Andina y el Mercosur que aclare y desarrolle los conceptos incluidos en el Acuerdo de Cartagena y el Tratado de Asunción a la luz de los propios procesos de integración de los que el TJCAN y el TPR forman parte.

The principle of mutual recognition concerning the free movement of goods has played a key role for the development of doctrine in European Union Law. With the cases Dassonville, Keck and Cassis de Dijon the European Court of Justice has founded this principle of mutual recognition which has been more and more in competition with direct regulations of European bodies. The principle has often been questioned due to a large amount of problems resulting from this non-regulative principle whose legal bases are not even clearly defined and require a judicial interpretation. ; El principio del reconocimiento mutuo relativo a la libre circulación de mercancías ha tenido un rol clave en el desarrollo de la doctrina en el Derecho de la Unión Europea. Con los casos Dassonville, Keck y Cassis de Dijon, la Corte Europea de Justicia ha dado lugar a este principio, el cual ha entrado más y más en competencia con las regulaciones directas emitidas por los órganos europeos. Él ha sido a menudo cuestionado debido a la gran cantidad de problemas que surgen de tratarse de un principio no-regulatorio cuyas bases legales no están aun claramente definidas y requieren de interpretación judicial.

La Libre Circulación de Personas tras el Brexit

This paper will deal with the free movement of persons between the European Union (EU) and the United Kingdom after the United Kingdom leaves the EU. It is a major issue considering the vast number of European people living and working in the EU and, inversely, of Britons residing in EU countries. At this point, with negotiations taking place, we can only set out a number of the possible scenarios, in the wake of the final result. This project begins with a historical description of the EU and the entry of the United Kingdom. The free movement of persons and the scope of the rights of EU citizens will then be analysed. Possible causes that motivated the United Kingdom to request their exit from the EU are also assessed. Based on the possible outcomes resulting from the United KingdomEuropean Union negotiations, we will finally examine the repercussions on the Union as far as free movement of people is concerned in a post Brexit scenario. Finally, a series of conclusions drawn as a result of the work to be carried out will be provided, albeit the final terms of the agreement are still to be settled. ; El presente trabajo tiene como objeto el estudio de la libre circulación de personas en la Unión Europea (UE) tras la salida del Reino Unido de dicha Unión. Se trata de un problema que afecta a un apreciable número de personas que residen y trabajan en aquél país y de nacionales británicos que hacen lo propio en países de en la Unión. Comenzadas las negociaciones no cabe sino una exposición de los posibles escenarios que son en teoría posibles. Se analiza el alcance, no sólo de la libertad de circulación de trabajadores sino de los derechos de los ciudadanos de la UE. Asimismo, se estudian las posibles causas que motivaron al Reino Unido a solicitar su salida de la UE. Este estudio ofrece alguna propuesta de solución, con las limitaciones derivadas de la falta de existencia de un acuerdo en el momento de conclusión de este estudio.

Presentación de la ponencia impartida en las II Jornadas de la Comisión de Igualdad de la Asociación Española de Derecho del Trabajo y de la Seguridad Social (AEDTSS) dedicadas a «Migraciones e igualdad: dimensiones y desafíos en el ámbito laboral y protección social» que se organizó en formato virtual. En la ponencia se abordan cuestiones como la regulación de la búsqueda de empleo en la Unión Europea a través de Internet, el principio de libre circulación de trabajadores, las herramientas digitales discriminatorias que vulneran dicho principio, así como la configuración del derecho a no sufrir discriminación (directa, indirecta y múltiple) por razón de nacionalidad u origen geográfico.

La red EURES como instrumento para favorecer la libre circulación de trabajadores

En este trabajo, se realiza un recorrido por la normativa europea en materia de libre circulación de trabajadores y se recogen aquellos aspectos en líneas generales que afectan de forma directa a las personas que ejercen su derecho a la movilidad laboral en Europa. Para ello se ha realizado un análisis de la herramienta del Portal EURES de la movilidad profesional, determinando así, que conforma un puente de comunicación entre las personas y los servicios de empleo de los Estados miembros de la Unión Europea. En este portal se recogen materias relativas a las condiciones de vida y trabajo, oportunidades, vacantes, demandantes y empleadores, etc. La gran parte de información es proporcionada por la propia red o por los socios de la red EURES; los consejeros de cada provincia o región de cada Estado miembro. A su vez, surge el planteamiento relativo a la dificultad que supone el diseño y formulación de esta herramienta, teniendo en cuenta variables tan complejas como la clase social, la cultura, la igualdad de oportunidades, los sistemas de Seguridad Social, etc. ; In this document, I'll be doing a tour over the different regulations that we have in Europe on the free movement of workers in the European Union. What means for an European citizen the need to go to another country and make a way of living in a Member State of the EU. In order to that, I have done a review of how this matter affect directly to the people who exercise their right to move around Europe looking for a job. To do it, I did a review of a tool that we have the right to use, as European citizens, called EURES, the European Job Mobility Portal. I've determined that this portal acts like a bridge of communication between the people and the national employment services of the Member States of the EU. This portal collects and reunites matters related to the cost of living and work conditions, opportunities, rights and obligations, the different responsibilities for employers and employees, etc. Most of the information that somebody can need, is provided by the portal by his own, but, the EURES institution has EURES advisers who can provide a more personal service and give information adapted to each case. They are located all over Europe in different provinces of the Member States. Also, I've made an approach to the challenge of designing and formulation of this portal, having in consideration all the complex matters that merge in to this topic as, social class, culture, equal opportunities, Social Security Systems, etc.
