Abortion has become a common practice in modern China since the implementation of birth limitation policy in the 1950s. In recent decades, the growing prevalence of abortion among young unmarried migrant workers has aroused public concern. Socially, abortion among this group of young women is often seen as a reproductive health problem or anomalous phenomenon that needs to be managed and handled; at the individual level, abortion is singled out as a behavioural misconduct of young women, which signifies their moral failure. However, these indiscreet and injudicious perceptions fail to acknowledge the complexity and structural dynamics behind their choices.While past studies have examined abortion through perspectives including law, morality, policy and reproductive health, or analyzed its impact on macro politics and institutions at a societal level, few of them have looked into the authentic experiences of these women and examined the whole issue from the perspective of interpersonal and gender dynamics. To fill the gap of knowledge, the present study aims at comprehending this distinctive life event of women and reflecting women's agency. Through conducting intensive ethnographic observation and in-depth interviews with 20 unmarried female migrant workers aged from 17 to 28 years old with diverse background, the underlining forces behind the occurrence of abortion are revealed, such as the influence of state family planning policy, the complex changes of lifestyle under market reform,and the heavy influence of partners and families on the decisions concerning marriage and childbirth. This study also traces the process within which abortion decisions are made, from sexual contacts, contraceptive uses, abortion decision-making,to the negotiation between partners, depicting women's responses to structural constraints and how their choices are made under the influence of migration. ...

這項研究是以民族誌描述方法,以南中國傳統的原生牛奶和現代的進口牛奶之生產及消費切入點,探討現代性的問題。對近代中國奶品需求急增的研究,大多解釋為現代西方食習慣之影響。我透過在順德及香港牛奶生產者及消費者日常生活的描述,試圖說明這食習慣的改變並非單是「西化」;相反,這其實是中國傳統的一種延續,再由殖民主義、資本主義,全球化,及中國建構新型國家這四種動力驅使下形成。而這四種動力又有賴市場 (本地及跨國的乳品公司、財金投資者、食品包裝生產商等) 、醫科專業人士及政府對 「健康」、「飲食文化遺產」等概念賦予新的社會價值。本文嘗試透過傳統和現代的牛奶之生產及消費,審視現代中國人對「健康」和「飲食文化遺產」的觀念和價值,在近年食品安全問題的陰霾下如何改變,這又如何反映中國在現代化和新型國家建構過程中的社會變遷,並探究有關身份認同,家庭角色與現代性的意涵。 ; This thesis is an ethnographic study of the change in the production and consumption of indigenous and imported cow milk in South China, particularly Shunde and Hong Kong, during the post-Mao period. Contrary to the popular view that cow milk consumption in China is a result of Western influence, the milk production and consumption in South China is actually a continuation of the Chinese tradition. This thesis shows that the popularity of milk consumption in Shunde and Hong Kong is driven by the forces of colonialism, globalization, capitalism, and modern state-building. Milk consumption in these two places is mainly promoted through three kinds of agents - the market (global and local milk companies, financial investors, food-packaging companies), medical professionals and the State. I illustrate how these forces and agents affect the classification, meanings and values of health and culinary heritage, and how this results in a reinvention of tradition and a change in the concept of morality, amidst concerns over food safety. 學者研究中國上古時期政治思想,往往以漢武帝以後的儒家思想作為國家權力正當性的基礎,但是此理論的缺憾是,如果只以儒家思想作為國家意識形態的標誌,就難以解釋西漢武帝以前的國家權力正當性是如何運作的。其實早在作為中國最早期實行帝制的秦王朝,已憑著統一的法律標準與有利於專制王權實行管治的官僚機構,確立國家專制權力的基本模式。 ; 本文試圖從儒法之爭的框架跳出來,從法律思想的角度,考察先秦至秦代的法律觀念、法律與國家官僚機構的關係及法律原則與「國家意識形態」的關係等議題。為了更貼近自秦至秦知識分子的「生活世界」,本文採用回到文本本身的研究方法,找出反映儒、道、法各家思想特徵的文本及其中的思想如何互相對話與融合,並從中探討戰國中後期至秦的知識分子與國家官僚對法律與政治觀念的表達,及其中的政治關懷。 ; 本文將從法律思想與國家意識形態的角度,更緊密地考察法律觀念背後反映的政治權力意識,從先秦至秦「刑」、「法」的觀念與實踐的起源、秦國家法律標準、秦法律原則與官僚政治道德的關係三方面探討秦代國家專制權力的正當性基礎。 ; Conventional studies on Ancient Chinese political thoughts consider Confusianism as the basis for legitimising the ruling of the state. However, this theory fails at explaining the period before Han Wudi(漢武帝) officially proclaimed the supreme status of Confusianism. As early as Qin Dynasty(秦朝), the state has established a centralised authoritarian government through its standardised legal practice and complex bureaucratic system. ; Therefore, this study avoids the orthodoxy in explaining political thoughts with the struggle between Confucianism and Legalism and investigates the relationship of laws and the bureaucratic system as well as that of legal principals and state ideology in pre-Qin and Qin period. By scrutinising the contemporary thoughts through careful textual analysis, this study expounds the encountering of Confusianism, Daoism, and Legalism and also their synthesis. Upon this, it moves on further to examine how the literati and the bureaucrats in later Warring-States period(戰國時代) to Qin Dynasty delineated laws, political beliefs, and the political concerns therein. ; From the perspective of state ideology, this study aims at analysing the conception of political power as reflected by the legal thoughts in three dimensions: 1) the origin and practice of "xing"(刑) and "fa"(法) in Pre-Qin and Qin period; 2) the historical image and the relationship between legal standard and state ideology as embodied in the reform of Shang Yang(商鞅變法) in the Qin state(秦國); and 3) the legal principles and the political morality of the state bureaucrats in the later ...

本項研究旨在探討近代中國男性知識分子性別與國族論述之間的互動關係,藉以突顯近年學者利用後殖民性別/國族理論模式解釋上述問題的盲點和不足之處。 ; 根據後殖民性別/國族理論的觀點,反殖民男性精英的性別與國族論述之間呈現出對立和矛盾,這成為了學者們以性別角度,批評近代中國國族主義的基調。然而,本研究要論證的正是這種後殖民性別/國族理論難以完全解釋近代中國歷史語境中的相關議題。 ; 本文第一章探討康有為的「男女平等」論述如何假借儒家傳統「聖人」的論述模式,開拓現代性別平等的論說空間;第二章分析金天翮在晚清國族主義脈絡下建構的「女權」論述,如何為當時女權主義者打開批判男權統治的論述場域;第三章闡述周作人五四時期的「女性」論述如何通過新性道德討論,以及批判父權意識型態,創建女性主體性的論述模式;第四章解析張競生的「女體」論述如何將女性情慾與國族論述連結起來,開創女性情慾自主論的空間。通過四位知識分子的思想分析,本文勾勒出晚清以迄五四這個歷史階段較突出的性別/國族論述模式,闡釋近代中國性別與國族論述之間的互動關係。 ; This research aims to explore the interactive relation between gender and nation in the discourse of the Modern Chinese intellectuals. Through details examination of the interactive discourse of gender and nation, this study seeks to demonstrate the inadequacy of the postcolonial critique of the nationalist bias on gender. ; According to the gender analyses of the post-colonialists, gender and nation appear to be placed in opposition and conflict with one another. It is from this perspective of gender that many Chinese study scholars advance their critique on Chinese nationalism. However what I want to argue in this thesis is that such application of the post-colonial critique on gender and nation is over-representation of the gender/nation discourse in the context of Modern China. ; In the first chapter of this thesis, I shall demonstrate how the discourse of Kang Youwei on "equality between men and women (「男女平等」)has revised the conception of the "Confucian sagefor the alignment with the modern discourse on equality of gender. In the second chapter, I shall how Chin Sung-ts'en's(「金天翮」) dissemination of the conception of" Women's Right(「女權」) has inspired the female elite to criticize the patriarchy in the context of the national discourse on Late Qing period.
