La huida de sus países está causada por terribles conflictos como guerras, violaciones de derechos humanos, terrorismo, persecuciones… Este trabajo de investigación tiene como objetivo analizar las causas de estos movimientos, las rutas que toman para llegar a Europa y examinar las diferentes respuestas de los gobiernos de la UE y en concreto la política de asilo y acogida del Gobierno de España. ; In recent times Europe has experienced a large increase in the arrival of refugees, from very different parts of the world (Syria, Eritrea, Somalia, Afghanistan, Iraq.) for help and international protection. The reason they flee their countries is because of terrible conflicts and wars, human rights violations, terrorism, persecution . This research aims to analyze the causes of these movements, the routes they take to reach Europe and to examine the different responses of EU governments and particularly the policy on refugees by the Spanish Government.

La gente se ve obligada a dejar sus países por motivos políticos, guerras, persecución, pobreza, desastres ambientales y violencia. El número de personas desplazadas a causas económicas está creciendo. Los dos instrumentos internacionales sobre el estatuto jurídico delos refugiados (Convención de Ginebra y el Protocolo de Nueva York) no se aplican a los casos relacionados con la pobreza y crisis ecológicas o medioambientales. A pesar de los retos en cuestión, la Iglesia está cada vez más preocupada, por eso pide a los Estados encontrar alternativas para aquellas personas que no cumplen los requisitos para obtener el estatuto de refugiado. Ellos buscan una mejor vida y modos de satisfacer sus necesidades. ; This article discusses contemporary refugees crisis and explains the reasons that are causing forced displacement flows. It also looks at the international refugees norms which were put into place to address such crisis. People are being forced to leave their countries because of political struggle, wars, persecution, ethnic cleansing, poverty, ecological disasters and violence. The number of persons displaced for economic and environmental reasons is also on the rise. Nevertheless, the two international instruments relating to the status of refugees (1951 Geneva Convention and 1967 New York Protocol) do not apply to those cases related to poverty and natural disasters. Despite undergoing serious challenges, most of them are being expelled from countries in which they seek asylum. Through the Twenty Action Points designed for the 2018 Global Compact on refugees, the Church is pushing the Nation States to find alternative solutions for those who do not fulfil the requirements to obtain refugee status or enter a country without authorization. La Consejera Jurídica Regional del Alto Comisionado de las Naciones unidas para los Refugiados brindó un concreto panorama acerca de la Problemática del Refugiado. Explicó la determinación de la condición de Refugiado, los Procedimientos para dicha determinación y los Criterios utilizados en ella, criterios que por otra parte están contenidos en la definición de Refugiado. La cuestión de Refugiados y la violación de los Derechos Humanos ocupa un aspecto central de su disertación, como así también el "Derecho Internacional de los Refugiados", (particularmente la evolución operada desde la perspectiva del individuo refugiado y de los Estados receptores); Normas y Mecanismos de Protección. Un lugar destacado ocupó la explicación de las funciones de Protección del ACNUR delineándose claramente que el mismo no es un órgano de denuncia y carece de carácter político. ; In her lecture, the Regional Judicial Advisor of the High Commissioner for Refugees of the United Nations, presented a thorough overview of the Refugee Question. She explained how to determine the status of the refugee, the proceedings and the criteria adopted to make this determination, this criteria are contained in the Refugee Definition. The question of refugees and human rights occupied a central place in the discussion as well as the International Law for refugees (in particular its evolution in the legislation and polices of the United Nations). Para Zygmunt Bauman el fenómeno de las "vidas desperdiciadas" es sólo un producto del proyecto de la modernidad, del cual este autor fue uno de los mayores críticos. Si bien el discurso de la modernidad ha variado, a su juicio, el fragmentado y, por tanto, precario concepto de "modernidad" debe entonces ser reconstruido. La agudización de las contradicciones del discurso de la modernidad se asienta en fenómenos dramáticos, como el de los desplazados, el de los refugiados, el de los miserables, etcétera; es decir, de lo que Bauman denominó "desechos humanos".
The aim of this paper is to highlight some of the difficulties that mental health providers face when trying to provide the best standard of mental healthcare to refugees, especially in countries where the political environment is skeptic of, or even hostile to, creating programs specifically designed to improve the standard of living of this population. We also focus briefly on the dichotomy between the need to do research in this population in order to obtain data that will help us offer the best care possible to them, and the peril of undermining their autonomy by subjecting them to studies they might have otherwise refused to be part of, if they were in a less precarious position. Throughout the article, we offer practical advice that mental healthcare providers can follow to ensure that they are offering the best possible care to their patients while remaining respectful of their rights. In recent years, thousands of people have been displaced due to natural disasters and of climate change. However, the issue is not addressed by international law or policy. Natural disasters should be granted eligibility for the benefits set out legislation on status of refugees. Migration policies should clearly account for environmental factors triggering mobility, with the aim of protecting environmental migrants and responding to their needs. This paper offers a prospective basis for legal policy in this area and about the question of how regulate international migration in the context of natural disasters and of climate change. ; En los últimos años, miles de personas se han visto forzadas a desplazarse a consecuencia de los desastres naturales y del cambio climático. Sin embargo, esta causa de desplazamiento forzado no se contempla ni en la normativa, ni en las políticas internacionales. Los desastres naturales deben ser considerados como una causa de protección para disfrutar de los beneficios que concede el estatuto de refugiado. Las políticas migratorias deben contemplar los factores ambientales como causa de movilidad, con la finalidad de proteger a los migrantes y responder a sus necesidades. Este artículo ofrece una perspectiva de las políticas legislativas en esta área y sobre como regular la migración internacional en el contexto de los desastres naturales y el cambio climático.
In a general framework, the displaced and environmental refugees are in a process of continuous growth, the level of application and creation of laws must be accurate, being both internally and internationally referring to the individual part and rights of each human being. There are various factors that participate in this problem or that are affected by the same situation, issuesthat range from a cultural, social to economic perspective. The environmental impact on society has transgressed borders and territories in various nations, so this phenomenon and social fact should be considered a priority in a local, regional, state, national and international scenario, creating and legislating in this regard as well as contemplating it in the institutional development plans. ; En un marco general, el número de desplazados y refugiados ambientales va en un proceso de crecimiento continuo, debido a esto, el nivel de aplicación y creación de leyes deben ser certeras, siendo tanto de manera interna como internacional referente a la parte individual y de derechos de cada ser humano. Existen diversos factores que participan en esta problemática o que bien se ven afectados por la misma situación, cuestiones que van desde la perspectiva cultural, social hasta la económica. El impacto ambiental en la sociedad ha transgredido fronteras y territorios en diversas naciones, por lo que este fenómeno y hecho social debe considerarse de prioridad en un escenario local, regional, estatal, nacional e internacional, creando y legislando al respecto además de contemplarlo en los planes institucionales de desarrollo.
El artículo se interroga sobre el lugar ocupado por unas mujeres extranjeras consideradas como "étrangers réfugiés" por la administración francesa desde la Monarquía de Julio hasta el final del Segundo Imperio. Después de las Tres Gloriosas, una serie de emigraciones políticas europeas contribuyó a ampliar los rangos de los extranjeros tratados en Francia como unos "refugiados": liberales italianos, españoles y portugueses, polacos de la "Gran Emigración", pero también carlistas españoles que atravesaron la frontera durante la primera guerra carlista.Nuestro estudio analiza la manera con la que la administración francesa privilegió el reconocimiento del título de "refugiado" a los padres de familia, descartando a las mujeres que eran sin embargo numerosas, tanto extranjeras como francesas. Las mujeres aisladas, solteras o viudas en exilio representaban un grupo aparte que recibía peculiar atención. ¿Cómo, en ausencia de hombres adultos en su entorno, consiguieron ser designadas y reconocidas como unas refugiadas? ¿En qué medida la administración francesa desarrolló la idea de vulnerabilidad para ellas? Mostraremos el papel que aquellas mujeres pudieron desempeñar en las relaciones con la administración francesa y con la sociedad local. ; The article addresses the role played by foreign women considered as "étrangers réfugiés" by the French administration from the Monarchy of July until the end of the Second Empire. After the Three Glorious Days, a series of European political emigrations contributed to increase the number of foreigners that the French goverment treated as "refugees": Italian, Spanish and Portuguese liberals, Poles of the "Great Emigration", but also Spanish Carlists who crossed the border throughout the first Carlist war.Our study will try to analyse how the French administration privileged the recognition of the title of "refugee" to the only men, household heads, discarding their women who were nevertheless numerous. Isolated women, single women or widows in exile represented a separate group that received peculiar attention. How, in the absence of adult men in their environment, did they manage to be designated and recognised as refugees? To what extent did the French administration develop the idea of vulnerability for them? We will show the role that these women have been able to play in relations with the French administration and with local society.
El artículo propuesto busca examinar los acuerdos, medidas, programas y planes de acción especiales que la Comisión Europea ha puesto en marcha para abordar la situación migratoria que se vive en Europa, y cómo estos discriminan a las personas solicitantes de asilo en función de su nacionalidad. Grecia junto con Italia, son los primeros países de la Unión Europea a los que llegan las personas migrantes/refugiadas/solicitantes de asilo y donde estas experimentan por primera vez, dentro de las fronteras europeas, las consecuencias directas de las decisiones, acuerdos y medidas implementadas. El presente artículo se centrará en el caso griego. La mayoría de las investigaciones actuales sobre desplazamientos forzados se centran en el conflicto sirio, olvidándose del resto de conflictos y personas que buscan refugio en Europa provenientes de países como Afganistán, Irak, Irán, Pakistán y Palestina, entre otros. Multitud de personas solicitantes de asilo llegan a Grecia cada mes desde hace más de dos años. El acceso o restricción a servicios y programas dependiendo de la nacionalidad del o la solicitante de asilo supone una clara discriminación por origen nacional y la aparición de categorías como refugiados de primera o segunda clase. El programa de reubicación es un claro ejemplo, ya que únicamente siete nacionalidades, además de las personas apátridas, pueden acogerse a dicho programa ; The article seeks to analyze the special agreements, measures, programs and action plans the European Commission has implemented to address the current migratory situation in Europe and how these mechanisms discriminate against asylum seekers depending on their nationality. Together, Greece and Italy are the countries in the European Union where most migrants / refugees and asylum seekers first arrive and experience the direct consequences of these agreements, measures and decisions taken within European borders. With that in mind, this article will focus on the Greek case. The most recent research projects on forced migration focus on the Syrian conflict, paying little attention to other conflicts and nationalities such as the Afghan, Iraqi, Iranian, Pakistani and Palestinian nationals seeking refuge in Europe. Significant numbers of asylum seekers from the above mentioned countries have been arriving in Greece every month since 2015. Access or restriction to services and programs depending on the nationality of the asylum seeker implies a clear discrimination which is based on their national origin, as well as the emergence of categories like first or second class refugee. The relocation program clearly discriminates against asylum applicants depending on their country of origin since just 7 different nationalities, as well as those considered stateless persons, are eligible for such program
