ÖZET Türkiye'nin güney doğu komşusu olan Kuzey Irak ya da Irak anayasasına göre resmi adıyla Irak Kürdistan Bölgesel Yönetimi (IKBY) son beş yılda Türkiye'nin Ortadoğu'ya açılan tek kara kapısı konumuna gelmiş bulunmaktadır. TUİK'in son beş yıllık ticari rakamlarına bakıldığında Irak, Türkiye'nin (ki burada civarındaki pay IKBY'e aittir), Almanya'dan sonra en büyük ikinci ticaret ortağıdır. Mal, hizmet, insan ve sermaye gibi her türlü ticaret hareketliliğinin olduğu Türkiye ile Kuzey Irak arasında legal ve illegal (kaçakçılık) olmak üzere iki tür yoğun ekonomik ilişki bulunmaktadır. Yaptığımız saha çalışmasında da görüleceği gibi illegal ticaret, legal ticaretten neredeyse daha fazladır. Bunun başlıca sebepleri ise, coğrafi nedenlerden dolayı sınır kontrolünün zorluğu, petrol, sigara ve çay gibi ticari ürünlerde iki taraf için ciddi karlı fiyat farklılığı, komşuluk, ortak dil, akrabalık ilişkileri, IKBY'de özellikle petrolün sudan ucuz olmasına karşın Türkiye'de aşırı pahalı olması…gibi nedenler Türkiye ile Kuzey Irak arasındaki ticaretin başlıca sebeplerini oluşturmaktadır. Bu sürecin hızla geliştiği son onüç yılda Türkiye ile IKBY arasındaki ekonomik ilişkileri güçlendiren iki önemli tarihi süreç yaşanmıştır. İlki 2003 yılı Nisan ayında Saddam Hüseyin'in devrilmesinden sonra Kuzey Irak'ın Irak anayasasına göre IKBY olarak resmi olarak varlığının kabulu, diğeri ise 21 Mart 2013 yılında Türkiye'de PKK ile kırk yıllık silahlı çatışmayı (Temmuz 2015'te fiilen bitmiştir) geçici olarak donduran çözüm süreci. Çalışmamız bu aşamaların ikinci maddesi kapsamında üç ana bölümden oluşmaktadır. Birinci Bölüm: Türkiye ile Irak arasındaki ekonomik, sosyal, tarihsel ve siyasal ilişkiler, İkinci Bölüm: 2002-2013 yılları arasında Türkiye ile IKBY arasındaki ekonomik ilişkiler, Üçüncü Bölüm: Çözüm süreci döneminde (Mart 2013 ve Temmuz 2015) tarihleri arasında Türkiye-IKBY arasındaki ekonomik ilişkiler. Bu çalışmada Türkiye-IKBY arasındaki ekonomik ilişkilerde çözüm sürecinin yeri ve 6 önemi üzerinde durulmuştur. Bu kapsamda hem sahada çalışılmış hem de teorik bilgilerden yararlanmıştır. Yapılan çalışmada çözüm süreci döneminde (Mart 2013-Temmuz 2015) legal ve illegal (kaçakçılık) yollarla Türkiye ile IKBY arasında ekonomik ilişkilerde ciddi artışlar görülürken, Temmuz 2015 yılından itibaren fiilen ve resmen biten çözüm süreci sonrasında, Güneydoğu'da başlayan silahlı çatışmalar ve Kerkük –Yumurtalık boru hattı, Türkiye-Irak arasındaki ana sınır kapısı konumunda olan Habur sınır kapısı yoluna yapılan saldırılar sonucu Türkiye ile IKBY arasında ekonomik ilişkilerin ciddi kırılmaya uğradığı görülmüştür. Anahtar Kelimeler: Türkiye, IKBY, Çözüm Süreci, Ticaret, Habur Sınır KapısıABSTRACT Iraq Kurdistan Regional Government (IKRG), with its official name according to the constitution of Northern Iraq or Iraq, which is the south eastern neighbor of Turkey, has become Turkey's only land border gateway to the Middle East in the last five years. Iraq is Turkey's second largest trade partner after Germany where about 90% of the shares belong to the IKRG looking at the last five years' trade figures of the Turkish Statistical Institute (TURKSTAT). There are two types of intensive economic relations between Turkey and Northern Iraq, where goods, services, people and capital have all kinds of trade activity, both legal and illegal (smuggling). Illegal trade is almost more than legal trade as we can see from field work that we did. The main reasons for this are the difficulty of border control due to geographical reasons, the serious profitable price difference for the two sides in commercial products such as petroleum, cigarettes and tea, neighboring, common language, kinship relations, although the oil is especially cheap in IKRG, extremely expensive in Turkey are the main causes of trade between Turkey and Northern Iraq. Two important historical processes have been experienced that strengthen the economic relations between Turkey and IKRG during which this process has developed rapidly in the last thirteen years. The first was the official acceptance of Northern Iraq (as an IKRG under the Iraqi Constitution) after the overthrow of Saddam Hussein in April 2003 and the other is a solution process that temporarily halts the forty-year armed conflict with the PKK in Turkey in March 21, 2013 (actually ended in July 2015). Our work consists of three main parts under the second item of these steps. Chapter One: The economic, social, historical and political relations between Turkey and Iraq, Chapter Two: Economic relations between Turkey and IKRG in 2002-2013, 8 Chapter Three: Economic relations between Turkey and IKRG between March 2013 and July 2015 during the solution process. This study focuses on the place and the importance of the solution process in the economic relations between Turkey and IKRG. In this context, both field work and theoretical information are used. It has been seen that economic relations between Turkey and IKRG have been seriously broken the result of armed conflicts starting in the Southeast and the attack on Kerkuk-Yumurtalık pipeline, the Habur border gate road, which is the main border gate between Turkey and Iraq after the de facto and formally ending solution process since July 2015, while there has been a significant increase in economic relations between Turkey and IKRG through legal and illegal (smuggling) routes during the solution process (March 2013 - July 2015). Orta Doğu coğrafyasının önemli ve büyük devletlerinden olan Türkiye ve İran'ın binlerce yıllık geçmişe sahip siyasî ve kültürel ilişkileri vardır. Bu uzun ve zengin tarihi arka plan iki ülke arasında zaman zaman dostane zaman zaman gergin ilişkiler örüntüsünü oluştururken, kaçınılmaz olarak karşılıklı etkileşimi de beraberinde getirmiştir. Geçmişte siyasî/ideolojik çatışma, jeostratejik rekabet, ekonomik hâkimiyet ve dinî ihtilaflar nedeniyle karşı karşıya gelen iki ülke; Türkiye'de cumhuriyetin kurulması İran'da Kaçar Hanedanlığına son verilmesiyle birbirine yakınlaşmaya başlamışlardır. Bu yakınlaşmada her iki ülkede söz konusu değişimleri gerçekleştiren ve ülkelerinde batılılaşma politikaları uygulayan milliyetçi karizmatik liderlerin büyük etkisi olmuştur. Bu sayede iki ülke arasında süregelen ihtilafların halli ve ilişkilerin sağlam hukukî zemine oturtulması mümkün olabilmiş, iki ülkenin ilişkilerini gölgeleyen kuşku ve önyargı bulutları dağıtılmıştır. Ortak güvenlik kaygılarını taşımaları ekonomik ve toplumsal gelişmeyi arzulamaları ve milliyetçi, modernist yaklaşımları iki ülkeyi yekdiğeriyle işbirliğine daha çok itmiştir. Yine iki ülkeyi tehdit eden ayrılıkçı/Kürtçü akımlarla ortaklaşa mücadele zarureti de iki ülke ilişkilerini etkileyen bir diğer faktör olmuştur. Yabancı aktörlerin de müdahil olduğu bu süreçte iki devlet birbirleriyle rekabet ve çatışma yerine uzlaşma ve işbirliği siyasetini takip ettikleri sürece kârlı çıkacaklarının farkında olarak ilişkilerini bu doğrultuda sürdürmeye gayret etmişlerdir. Ancak içsel ve dışsal bir dizi faktörün izin verdiği ölçüde bu politika sürdürülebilmiş ve bölgesel işbirliği çabalarında da ortak hareket ederek birlikte yer almışlardır. ; The relations of Turkey and Iran, which are important and strong states in the Middle-East, date back to thousands years ago. The relations which characterised sometimes with tension sometimes with friendship have caused an inevitable interaction between the two countries throughout history. The two states, which confronted with each other due to the reasons such as political/ideological tension, geo-strategical rivalry, economic hegemony and religious contraversy in the past, have started to get closer to each other since the foundation of Turkish Republic in Turkey and since the owerthrown of the Kaçar dynasty in Iran. In improving the relations of the two states the nationalist charismatic leaders who have been the main actors in change and Westernisation policies, have played very important roles. Thus, the contraversies between the two countries have been solved and the relations have been placed a solid legal ground, ending the suspicion and prejudice characterised the relationships between the two states for a long time. The common security concerns, aspiration for economic and social development and nationalist modernist aprroaches have forced each country to cooperate with the other one. Moreover, the necessity for common combat against seperatist Kurdish movement which thretaens both states is another factor which affect the two countries' relations. In the process which foreign (outsider) actors have also involved, the two states recognised that if they develop peaceful agreement and cooperation instead of rivalry and conflict, it would be more in favour of them, and they shape their relations accordingly. They have sustained this policy as long as internal and external factors let to do so and they have taken place in regional cooperations, acting together.
Tatar, Volkan (Arel Author) ; 2010 yılında Tunus'ta bir gencin kendisini yakmasıyla başlayan Arap Baharı, toplumsal, politik ve ekonomik bir kriz haline gelerek birçok bölge devletini derinden etkilemiştir. Tunus'ta başlayan ve domino etkisiyle bölge devletlerine yayılan hareket, başlangıçta bölgedeki devletlerin uzun yıllar yönetiminde olan siyasi elitleri tedirgin etmiş, sürecin devamında ise iktidar değişiklikleri meydana getirmiştir. 2011 yılında Arap Baharının etkisine giren ve her geçen gün daha da çatışma bölgesi haline gelen Suriye'den, yaklaşık 4 milyon kişi başka bölgelere göç etmek zorunda kalmıştır. Göç eden kitlenin büyük çoğunluğunun hedefi, coğrafi yakınlığın da etkisiyle Türkiye'dir. Bu sebeple Türkiye, Arap Baharının olumsuzluğunu ve yükünü çeken devletlerin başında gelmektedir. Dış politikada olduğu kadar, iç politikada da tartışma konusu olan Suriyeli mülteciler için, özellikle güneydoğu illerinde sığınma kampları kurulmuştur. Ayrıca Suriyeli mültecilerin, Avrupa devletlerine kaçak geçiş için, Ege Bölgesi'ni kullanmalarından dolayı bu mesele, Türkiye ile Avrupa Birliği'ne üye devletleri de karşı karşıya getirmiştir. Arap Baharı bu kaçak göçlerle birlikte farklı devletlerin ortak ve içinden çıkılması zor sorunu haline gelmiştir. Bu çalışmanın konusu, Arap Baharı sonrasında Türkiye'nin karşı karşıya kaldığı mülteci sorununu farklı açılardan irdelemektir. Bu amaçla nitel veri toplama yöntemi kullanılmış, belge incelenmesi üzerinde durulmuştur. Konuyla ilgili kaynaklar incelenmiş, farklı yayın organlarında yer alan röportaj ve haberlerden de kaynak olarak faydalanılmış, nitel veri analiziyle sonuca ulaşılmaya çalışılmıştır ; The Arab Spring, which was triggered by a young boy's burning himself up in Tunusia, has had an impact on most of the other countries in the same region deeply through turning into a social, political and economic crisis. The movement starting in Tunusia and spreading into the surrounding countries through domino effect, first made the political elitists governing the countries for a long time feel uneasy and then led to governmental changes in the following period. 4 million people had to leave their home country Syria, which had been influenced by the Arab Spring since 2011 and then turned into a battle field gradually day by day. These people had to immigrate to other regions. Due to its being close to the area, Turkey has been in the target of the majority of these immigrants. Owing to this fact, Turkey is one of the major countries which have experienced the negative effects, consequences and the burden of the Arab Spring the most. Refugee camps have been established especially in the Southeast provinces in the country for the Syrian refugees, who have been at the core of the discussion continuously in not only domestic policy but also foreign policy. Apart from that, this issue has created a big conflict between Turkey and the members of European Union since Syrian refugees have been using The Aegean Sea as a passage to enter European countries illegally. With the accompaniment of these illegal migrations, The Arab Spring has turned out to be a very big issue which is difficult to be resolved for a lot of different countries. The subject of this paper looks into the refugee problem Turkey has been facing as a result of the Arab spring in different aspects. With this aim in mind, qualitative data collection method and qualitative data analysis has been used. The resources regarding the subject have been analyzed and the interviews and the news found in various media resources have been utilized as a resource in order to reach conclusions through the qualitative data analysis method
Besides terrorism is a serious national problem that we face in the modern world, it has gained a global dimension. Terrorist attacks are increasingly being organized by using modern weapons as to damage the human health and threaten the life. Terrorism is begun to be preferable rather than legal means to resolve social, national, religious and other conflicts. All these has led to a more careful research of the phenomena of "international terrorism" in the scientific field. The reason for the differences of opinion on the concepts of terror and terrorism, which could not be defined on a universal scale up to now, is not technical but political. In the framework of the non-existence of a generally accepted definition in international law, different approaches to the concepts of terror and terrorism are included in our study. Terrorism has become a transnational phenomena that surpasses national borders and gains an international dimension. Due to this fact, the concept of international terrorism has constituted the important part of our study. Global measures to be taken against terrorism are often taken through the United Nations, as it has global and accessible multilateral mechanisms. In addition, the fight against, terrorism is carried out at regional level in cooperation with international organization such as Shanghai Cooperation Organization, Commonwealth of Independent States and Collective Security Treaty Organization. The treaties and documents on the fight against terrorism adopted by the United Nations and the Shanghai Cooperation Organization form the basis of the issue in our study. On the basic of these documents and agreements, the statutes which are in effect for struggling against terrorism in Kazakhstan, such as the Criminal Code, the Law on the Suppression of Terrorism, the Law on the Suppression of Terrorism, the Law on the Suppresion of Extremism, The Prevention of Legalization of the Illegitimate Incomes and the Finansing of Terrorism will be evaluated. Besides, within the framework of the legal basis that emerged during our study, Kazakhstan's attitude in the struggle against terrorism will be discussed. ; Terörizm, modern dünyada ulusal nitelikte karşılaştığımız ciddi bir sorun olmanın yanında küresel bir boyut da kazanmıştır. Terör saldırıları gittikçe daha kapsamlı bir şekilde, modern silahlar kullanılarak insan sağlığına zarar verme ve ciddi yaşam tehdidi oluşturma amacıyla düzenlenmektedir. Toplumsal, milli, dini ve diğer çatışmaları çözmek için yasal yollardan ziyade terör tercih edilmeye başlanmıştır. Bütün bunlar, "uluslararası terörizm" olgusunun bilimsel alanda daha dikkatli araştırılmasına yol açmıştır. Bugüne kadar evrensel bir ölçekte geçerli tanımı yapılamayan terör ve terörizm kavramları konusunda görüş farklılıklarına rastlanmasının sebebi teknik değil siyasi bir nitelik taşımaktadır. Uluslararası hukukta genel kabul gören bir tanım yapılamamış olması çerçevesinde terör ve terörizm kavramları hakkındaki farklı yaklaşımlara çalışmamızda yer verilmiştir. Terörizm, ulusal sınırları aşarak uluslararası boyut kazanan ulusötesi bir olgu haline gelmiştir. Bu sebeple uluslararası terörizm kavramı da çalışmamızın önemli bir parçasını oluşturmaktadır. Küresel ve ulaşılabilir çok taraflı mekanizmalara sahip olduğu için terörizme karşı alınması gereken önlemler, en çok Birleşmiş Milletler aracılığıyla alınmaktadır. Ayrıca terörizmle mücadele, bölgesel düzeyde Şangay İşbirliği Örgütü, Bağımsız Devletler Topluluğu, Kollektif Güvenlik Antlaşması Örgütü gibi uluslararası örgütlerin işbirliğiyle de yerine getirilmektedir. Çalışmamızda, Birleşmiş Milletler ve Şangay İşbirliği Örgütü bünyesinde kabul edilen terörizmle mücadele ile ilgili antlaşma ve belgeler, konunun temelini oluşturmaktadır. Ayrıca bu belgelere ve antlaşmalara dayanarak, Kazakistan'ın iç hukukundaki terörizmle mücadele alanında yürürlükte bulunan Ceza Kanunu, Terörizmle Mücadele Kanunu, Aşırılıkçılıkla Mücadele Kanunu, Kanun Dışı Yollarla Ele Geçirilen Gelirlerin Yasallaştırılması ve Terörizmin Finansmanının Önlenmesine İlişkin Kanun ile ilgili değerlendirmeler yapılacaktır. Bunun yanı sıra, çalışmamız boyunca ortaya çıkan hukuki zemin çerçevesinde, Kazakistan'ın terörizmle mücadeledeki tutumu ele alınacaktır.
Tarihsel süreçte devletler terörle mücadeleyi daha çok kendi varlığına yöne- len terör içerikli tehditleri veya tehdidin kaynağı terör örgütünü silahlı müca- dele yöntemiyle ortadan kaldırma anlayışı üzerine kurgulamışlardır. Ancak terörle, teröre neden olan ekonomik, sosyal, kültürel, etnik ve siyasi genel koşulları da dikkate alarak topyekûn mücadele etmeden kapsamlı ve kalıcı bir başarı elde edilemeyeceğinin zamanla anlaşılması, bir üst tanımlama ola- rak terörizmle mücadele olgusununu ortaya çıkarmıştır. Bu gelişmeyle bir- likte, çoğu zaman çatışmanın alternatifi olarak düşünülen müzakere olgusu, terörizmle mücadelede bir yöntem olarak önem kazanmaya başlamıştır. Yine devlet aktörleri resmi ya da gayri-resmi kanallar vasıtasıyla terör ör- gütleriyle konuşup görüşmeyi sürdürseler de, bu faaliyetler çoğu zaman bir giz perdesi arkasına saklanmış veya yalanlanmıştır. Müzakereleri değişik gerekçelerle kamuoyundan saklama çabası da, bu olguya ilişkin teorik bir yaklaşım geliştirme çabalarını olumsuz yönde etkilemiştir. Dolayısıyla, geç- miş dönemlerin aksine terörün gerçek anlamda küresel etkiler meydana ge- tirebildiği, devletlerin de bu sorunu artık ivedilikle çözme niyet ve gayretine girdikleri günümüzde, teröristle müzakere olgusunun terörizmle mücadele- nin bir unsuru olarak nasıl bir akademik analize tabi tutulabileceği sorusuna yanıt verilmesi bir gereklilik halini almıştır. Ortaya konulan gerekçeler ışığında bu çalışmanın ilk bölümünde, terörizmle mücadele stratejileri kapsamında gündeme gelen teröristle müzakere olgusu; teröristle müzakere edilmeli mi edilmemeli mi, kiminle müzakere edilmeli, ne zaman ve nasıl müzakere edilmeli soruları kapsamında akademik disipli- ne, koşullara, sınırlamalara uygun genel bir analitik çerçeveye oturtulmak- tadır. Çalışmanın ikinci bölümünde ise; Türkiye'de açılım süreci olarak baş- layan ve daha sonra çözüm süreci olarak yeniden tanımlanan müzakereler, müzakereler bağlamında yürütülen tartışmalar kapsamı ilk bölümde belirle- nen analitik çerçevede değerlendirilmektir. ; Throughout history state actors have largely constructed their counter- terrorism strategy on the notion of eliminating terrorist threats or terrorist organizations that have become the source of such threats. However, with the realisation that there can be neither a comprehensive, nor a lasting success without considering the economic, social, cultural, ethnic and political con- ditions of terrorist threats, combating-terrorism has emerged as a superse- ding notion. Hence, negotiating with terrorists, a concept which has hitherto been deemed alternative to conflict, has begun to increase in significance as another instrument for countering-terrorism. Meanwhile, despite continuing to talk and deal with the terrorist groups through official or non-official channels, state actors have preferred to con- ceal their activities behind secrecy or total denial. Such attempts as to hide negotiations from the public for whatever reasons there may be, in time has proved to be a negative impact over efforts to develop a theoretical appro- ach for the very same concept. Thus, contrary to the past in today #8217;s world as terror holds the potential to produce global impacts and states are just showing serious intentions as well as taking genuine steps towards resolving the terror problem, it is essential to present an explanation for the question of how to subject the issue of negotiating with terrorist, as a component of combating-terrorism, to an academic analysis. In view of all that, the first part of this study has been reserved for; placing the concept of negotiating with terrorist over an analytical framework which is developed within the confines of such questions of whether, with whom, when and how to negotiate, whilst adhering to the rules of academic discip- line, conditionality and restrictions. In the second half of the study; the so called #8220;Kurdish opening process #8221; and then #8220;resolution process #8221;, both of which have been underway in Turkey for some time now, are assessed accor- ding to the previously set out analytical framework.
Günümüzde teknolojik gelişmelere paralel olarak kişilerarası iletişim hızla artmış ve bu yoğun iletişim süreci birçok uyuşmazlığın ortaya çıkmasına neden olmuştur. Ticari ilişkilerin gelişmesi ve artan rekabet karşısında yetersiz kalan hukuk sistemleri, adalet etkinliğinin sağlıklı bir şekilde yürütülmesi ve toplumsal barışın sağlanması adına farklı arayışlara yönelerek alternatif çözümler üretmeye başlamıştır. Her toplum kendi sosyal norm ve değerleri çerçevesinde çatışmaların çözümünü adına çalışmalar yapmaktadır. Küresel ekonomilerin gelişmesi ile kişiler arasındaki soyut mesafe kalkmış, dünyanın herhangi bir yerinde yaşanan sorun tüm toplumları etkiler hale gelmiştir. Nitekim, birçok ülkenin yapmış olduğu araştırmalar sonucunda ortak bir anlayış oluşmuş ve uyuşmazlıklara alternatif olarak arabuluculuk yöntemi geliştirilmiştir. Türk hukuk sisteminde de dünyadaki gelişmeleri takiben 2013 yılında 6325 sayılı "Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu" kabul edilmiştir. Kanunun 20.maddesinin öngördüğü şarta göre, arabulucu olabilmek için hukuk fakültesi mezunu ve en az beş yıllık mesleki deneyime sahip olmak gerekmektedir. Ancak arabulucu olarak göreve başlamadan önce adaylar bir eğitime tabi tutulmaktadırlar. Eğitim sonrasında yazılı ve uygulamalı sınavlardan başarılı olabilmeleri halinde arabuluculuk görevlerini yerine getirmeleri beklenmektedir. Temelinde iletişimin kilit faktör olduğu arabuluculuk sisteminin başarılı bir şekilde yürütülmesi arabuluculuk yapacak kişilerin nitelikli eğitim almasına bağlı olarak gelişmektedir. Bu kapsamda Türkiye'de iletişim alanında arabuluculuk eğitimlerine ilişkin yüksek lisan ve doktora düzeyinde bir çalışma yapılmadığı görülmektedir. Bundan hareketle bir ilk olarak arabuluculuk eğitimlerine ilişkin çalışma yapılmıştır. Çalışmanın temel amacı, daha etkin arabuluculuk hizmeti verilmesi amacına yönelik gerçekleştirilen arabuluculuk eğitimlerinin var olan durumunun geliştirilmesi ve zenginleştirilmesinde ortaya çıkabilecek seçenekleri eğitmen tutum ve görüşlerinden yararlanarak değerlendirmektir.Çalışmanın birinci bölümünde arabuluculuk sisteminin genel çerçevesi başlığı altında, arabuluculuk sürecinin içeriği ve işlevleri, uluslararası arabuluculuk modelleri ve Türkiye'deki arabuluculuk uygulaması kanunda belirlenen esaslara göre ele alınmıştır. İkinci bölümde arabuluculuk eğitimlerinin uluslararası örnekleri ve Türkiye'deki mevcut arabuluculuk eğitim sistemi iletişim kavramı ile ilişkilendirilerek irdelenmiştir. Son bölümde ise Türkiye Barolar Birliği çatısında eğitim veren eğitmenlerin arabuluculuk eğitimleri hakkında tutum ve görüşlerine yönelik bir araştırma yapılmıştır. Bu çalışma, nitel araştırma tekniği kullanılarak gerçekleştirilmiştir. Veri toplama tekniği olarak görüşme yöntemi uygulanmıştır. Kalıtımcılarla yapılan yarı yapılandırılmış açık-uçlu görüşmeler sonucunda elde edilen veriler değerlendirilerek yorumlanmıştır. Today, interpersonal communication has increased rapidly in parallel with technological developments. This intensive process of communication has led to the emergence of many disputes. Inadequate legal systems in the face of increased competition and development of trade relations, has focused on different paths and began to produce alternative solutions in order to conduct justice in a healthy way and to establish social peace. Every society works to solve the resolutions of conflicts within the framework of their social norm and values. But the abstract distance between people has been removed with the effects of globalization, and problems that occur in any part of the world has started to affect all societies. A common understanding has evolved based on the results of research conducted by many countries and a mediation method has been developed as an alternative in dispute resolution. Following the developments in the world, "Mediation in Legal Disputes Act" Numbered 6325, was adopted in the Turkish legal system in 2013. According to the conditions stipulated by Article 20 of the Law, in order to become a mediator, one has to be a graduate from law school and must have at least five years of professional experience. But before starting to serve as a mediator, candidates are subjected to a training. If they succeed in the written and practical exam after the training, they are expected to fulfill their duty as a mediator. Successful development of the mediation system, with communication as a key factor in its basis, happens due to mediators receiving a quality education. In this context, it can be seen that there are no studies related to mediation training in the field of communications in Turkey. From this point, the first study on mediation trainings has been conducted.The main objective of the study is to evaluate the options that may arise during the improvement and enrichment of the existing situation of the performed mediation training for providing more effective mediation services, by benefiting from instructor attitudes and opinions.In the first part of the study, under the title of the general framework of the mediation system, the contents and functions of the mediation process, international mediation models and application of mediation in Turkey and functions are addressed according to the principles set out in law. In the second part, international best practices of mediation trainings and existing mediation training system in Turkey is examined with relation to the concept of communication. In the last part, a research is made about the attitudes and opinions of instructors teaching under to roof of the Bar Association of Turkey about the mediation trainings. This study was conducted using qualitative research techniques. Interviews were administered as data collection techniques. Data obtained from the semi-structured openended interviews made with participants were evaluated and interpreted.
1990'larda Türkiye, Balkanlarda istikrarsızlık ve çatışmalardan dolayı doğal olarak güvenlik odaklı politika izlerken 2000'lerde bölgenin göreli istikrara kavuşmasından sonra AK Parti döneminde yumuşak güç odaklı toplumsal-kültürel etkinliğini artırma politikası izlemeye başlamıştır. Buradan hareketle, AK Parti hükümetlerinin Balkan politikasının ağırlıklı olarak tarihi ve kültürel miras üzerinden formüle edildiği ileri sürülebilir. Bu çerçevede 'AK Parti dönemi Türkiye'nin Balkan politikası, kamu diplomasisi temelli, kültürel odaklı ve yumuşak güç araçlarına dayanan bir diplomasi' olarak tanımlanabilir. Türkiye'nin Balkanlarda etkinliğini ortak tarih ve kültüre özellikle Osmanlı mirasına vurgu yaparak artırma politikası hem bölgede hem de akademik camiada bir tehdit ve yayılmacı-hegemonik bir politika olarak Yeni-Osmanlıcılık algısına yol açmıştır. Nitekim Ekim 2009 yılında Dışişleri Bakanı Davutoğlu'nun Bosna'da Yunus Emre Türk kültür merkezinin açılışında Osmanlı tarihine vurgu yaparak bölge ülkelerini Türkiye'nin liderliğinde bütünleşmeye çağıran konuşması, Yeni-Osmanlıcı algının temel dayanağı olmuştur. Oysa Türkiye'nin bölge ülkelerini AB ve NATO ile entegrasyona teşvik etmesi ve desteklemesi, Yeni-Osmanlıcı iddialarla çelişmektedir. Diğer taraftan AK Parti döneminde açılan yumuşak güç kurumları olan Yunus Emre Enstitüsü Türk kültür merkezleri, Yurtdışı Türkler ve Akraba Toplulukları Başkanlığı, daha önce açılan fakat daha etkin hale getirilen TİKA, Kamu Diplomasisi Koordinatörlüğü ve Diyanet, TRT, Anadolu Ajansı Balkanlarda Türkiye'nin tarihi ve kültürel bağlarının yeniden güçlendirilmesine yönelik önceki dönemlerden farklı kamu diplomasisi olarak tanımlayabileceğimiz bir politika izlenmeye başlamıştır. Kamu diplomasisi yaklaşımı çerçevesinde Türkiye, Balkan toplumlarıyla doğrudan ilişki kurma politikasına geçmiştir. Bu da Türkiye'ye bölgede hem çok daha geniş bir etkinlik ve hareket alanı sunarken hem de bölge halklarıyla derin ilişkiler inşa etmesini sağlamaktadır. Bu bağlamda, Türkiye'nin Balkan politikasının kamu diplomasisi kurumlarının etkinlikleri üzerinden toplumsal ve kültürel boyutu analiz edilmiştir. Bu makalede AK Parti döneminde Türkiye'nin Balkan politikası, eğitim diplomasisi, diaspora diplomasisi, kültürel diplomasisi, TV diplomasisi ve hepsini içeren kamu diplomasisi çerçevesinde ele alınmıştır. ; In 1990s Turkey had intrinsically pursued security-focus policy due to instability and conflicts in the Balkans, but it has unlikely adopted a soft power-oriented policy for enhancing societal-cultural effectiveness during AK Party era after the relative stabilization in the region in 2000s. From this point of view, it could be assert that the ruling government has principally formulated Balkan policy through the historical and cultural legacy. In this context,'Turkey's Balkan strategy during AK Party decade defines as "public diplomacy-based, cultural diplomacy-focus and the instruments of soft power-oriented'. Turkey's policy for enhancing its influence by accentuating common culture and history in particular the legacy of Ottoman has led to a perception of threat as Neo-Ottomanist, revisionist and hegemonic policy both in the region and in academic circle. Therefore, the Foreign Minister Davutoğlu's speech of calling for Turkey's leadership to the integration of countries of the region by underling the Ottoman history in the inauguration of the Yunus Emre Institute Turkish Cultural Center in Bosnia has been a mainstay of the Neo-Ottoman perception. Whereas, Turkey's encouraging and supporting the integration of the countries of region with the EU and NATO is in contradiction with the Neo-Ottoman claims. On the other hand, this policy can be defined as public diplomacy that is quite different from the previous periods of Turkey's Balkan policy. Ak Party has initiated to implementation of soft power institutions such as Yunus Emre Institute Cultural Centers and the Office of Public Diplomacy, The Presidency for Turks Abroad and Related Communities opened by the ruling government and previously opened but made more effective institutions of TİKA, TRT, Anadolu Agency and Diyanet Foundation in order to strengthen Turkey's historical and cultural ties in the Balkans by AK Part. In the framework of public diplomacy approach Turkey has maintained a policy of building direct relations with the Balkan people. To that effect, this policy provides Turkey both a much wider sphere of influence and building deeper relations with the living people of the region. In this context, Turkey's social and cultural dimension of the Balkan policy is analyzed in terms of the activities of public diplomacy institutions. In this article, Turkey's Balkan policy is scrutinized within the framework of education diplomacy, diaspora diplomacy, cultural diplomacy, TV diplomacy and public diplomacy comprising all of them.
Uyuşmazlıkların eskiye göre daha karmaşık ve uzmanlık isteyen hale gelmesi ve insanların ilişkilerini koruma ve devam et-tirme istekleri gibi nedenlerle uyuşmazlık tarafları, ihtiyaçları olan çözüme erişebilmek için yargısal süreçler dışında alternatif yöntem-ler aramışlardır. Bu arayış alternatif uyuşmazlık yöntemlerini do-ğurmuştur. Arabuluculuk, en hızlı yayılan ve tercih edilen alternatif uyuşmazlık yöntemi olmuştur. Arabuluculuk, işçi ve işveren arasında yaşanan anlaşmazlıkların kısa bir zaman zarfında ve düşük maliyet-lerle çözümlenmesini sağlayacak adil ve dostane bir yöntemdir. 5521 sayılı İş Mahkemeleri Kanunu kabul edildiği 1950 yılından günümüze kadar çalışma hayatında yaşanan köklü dönüşümler kar-şısında iş uyuşmazlıklarının çözüm yöntemlerinin yetersiz kaldığı gerekçesiyle, mahkemelerin iş yükünü azaltacak alternatif uzlaşma yöntemlerini benimseyen yeni bir kanun (7036 sayılı İş Mahkemeleri Kanunu) getirilmiştir. 7036 sayılı Kanun'un genel gerekçesinde, alternatif uzlaşma yöntemlerine olan gereksinim, iş mahkemelerinde artan iş yükünün ve işin yapılma şeklinde yaşanan değişim, nüfus artışı, teknolojide yaşanan olağanüstü gelişim, sosyal güvenlik hukuku alanın genişle-mesi ve işçi-işveren uyuşmazlıklarının çeşitlenmesi nedenlerine bağ-lanmıştır. 01.01.2018 itibariyle yürürlüğe girmiş olan "Dava Şartı Olarak Arabuluculuk" sistemini de içeren 7036 sayılı İş Mahkemeleri Kanu-nu bu anlamda çalışma hayatının önemli bir ihtiyacını karşılamış ola-caktır. Dava şartı olarak arabuluculukta, uyuşmazlık taraflarının bir araya getirilerek alanında uzman arabulucuların objektif bir şekilde taraflarla görüşme sağlayarak kendi çözüm yöntemlerini geliştirme-leri sağlanmakta ve iletişim kurmalarına aracı olunmaktadır. Arabuluculuk, Türk hukuk sistemi içerisinde tarafların ihtiyari başvurduğu bir çözüm yöntemiyken, 7036 sayılı Kanun'la yapılan dü-zenlemeyle işçi-işveren uyuşmazlıklarında dava şartı olarak ilk defa yer almıştır. Bireysel veya toplu iş sözleşmesine dayanan işçi veya işveren alacağı ve tazminatı ile işe iade talebiyle açılan davalarda, arabulucu-ya başvurulmuş olması dava şartı olarak kabul edilecek ve mahkeme öncelikli olarak arabulucuya başvurmuş olma koşulunu arayacaktır. 7036 sayılı İş Mahkemeleri Kanunu ile getirilen yeni düzenle-meye göre dava açılmadan önce arabulucuya gitmek zorunlu, ancak tarafların arabulucuda uzlaşmaları zorunlu değildir. Taraflar arasında anlaşma sağlanamazsa anlaşmazlık konusunun iş mahkemelerine götürülmesine herhangi bir engel bulunmamaktadır. Ancak ilgili kanunla yapılan düzenlemede bazı belirsizliklerin olduğu görülmektedir. Belirsiz konuların başında, arabuluculuk tuta-nağında yer alan boşta geçen süreye ait ücretle ilgili Sosyal Güvenlik Kurumu'na yapılacak bildirimlerin usul ve esaslarının belirlenmemiş olması gelmektedir. Bu çalışmada, söz konusu belirsizliklere neden olan hususlara yer verilerek, konuya ilişkin değerlendirmelerimiz ak-tarılmaya çalışılmıştır. ; As the conflicts are becoming more complex and de-manding expertise than the previous practices and as people are re-quiring to maintain their relations, the parties to disputes have star-ted to sought alternative methods outside of the judicial procedures in order to access the solution they need. This search has led to the emergence of alternative dispute resolution methods. Mediation has become the fastest-spreading and most-preferred alternative dispute resolution method. Mediation is a fair and amicable way to ensure the resolution of disputes between the employees and emp-loyers within a short period of time and at low costs. A new act (Act No. 7036 Regarding Labour Courts) has been introduced, which adopts alternative methods of resolution to redu-ce the workload of the courts, with the reason that the conventional methods of resolving labour disputes are inadequate in the face of radical transformations occurring in the labour life since 1950, when the Act No. 5521 on Labour Courts was adopted. On the general reason of The Act No. 7036, the need for alter-native methods of reconciliation has been attributed to the increa-sing workload in the labour courts, the radical changes in the ways of doing business, the population growth, the extraordinary deve-lopments in technology, the expansion of social security law, and the diversification of employee-employer disputes. The Act No. 7036 Regarding Labour Courts No. 7036, which includes "the practice of mediation as a condition of trial", which has come into effect as of 1st of January, 2018, is expected to meet the important needs of working life in this sense. In the practice of mediation as a condition of trial, the parties to the dispute are brought together, and experts in the field are ensuring an objective negotiation between the parties to develop their own solution met-hods through communication. While previously, the practice of mediation was a discretionary solution for the disputing parties in the Turkish legal system, for the first time the regulation is being regulated as a condition of trial for all labour disputes between employee and employers. In the labour disputes arising from an individual or collecti-ve labour agreement (employment contract) and based on the employee's or the employer's claim or a compensation demand or a demand for return to work, the application for mediation first will be applied as a precondition for filing a claim at a labour court. According to the new regulation introduced by the Act No. 7036 on Labour Courts, applying to mediation is compulsory before file the suit however to reach a common ground is not compulsory. If there is no agreement between the parties at the end of the medi-ation procedures, there is no obstacle for the dispute to be brought to relevant labour court. However there seems to be some uncertainty in the regulation made with the applicable law. One of the most important uncerta-in topics is the procedures and principles of the notifications to be made to the Social Security Institution regarding the wages for the idle time passed during the mediation sessions are not being deter-mined. In this study, it has been tried to convey our evaluations abo-ut the issue by mentioning the subjects that cause the uncertainties.
Somali, merkezi Somali Cumhuriyeti'nin Ocak 1991'de çökmesinden bu yana politik ve ekonomik bir karmaşa içindedir ve tarım sektörü etkili bir şekilde büyümemiştir. Kuraklık, kıtlık ve yerel çatışmalar, Somali'nin de dahil olduğu birçok Afrika ülkesinde ekonomik, sosyal ve politik krizleri tetiklemiştir. Gıda güvencesinde sürekliliğin sağlanamadığı bu ülkelerde halkın önemli bir bölümü halen yeterli beslenememektedir. Yetersiz beslenme dünyanın yoksul ülkelerinin çoğu için kritik bir konudur. Afrika nüfusunun dörtte birinden fazlasının (yaklaşık 333 milyon insan) bu sorunla yüzleştiği de bilinmekte, Birleşmiş Milletler dünya çapında beş yaşın altındaki yaklaşık 151 milyon çocuğun yetersiz beslenmeye bağlı olarak büyüme ve gelişme geriliği yaşadığını tahmin etmektedir. Birleşmiş Milletler, Gıda ve Tarım Örgütü (FAO) tavukçuluğun yoksul ülkelerde açlık ve yetersiz beslenme ile mücadelede önemli bir rol oynayabileceğini düşündürmektedir. Özellikle çok yüksek kalitede saf protein içeren tavuk yumurtasının, B12 vitamini ve kolin başta olmak üzere küçük çocuklar için gerekli esansiyel besinlerin neredeyse tümünün alımı sağlar. Dünya genelinde oldukça popüler bir besin olan yumurta uygun maliyetle üretilebilir. Tavuk eti de uygun maliyetli bir başka hayvansal protein kaynağıdır. Bu realite tavukçuluğu dünya çapında bir sektör, yumurta ve beyaz eti de en çok tüketilen besin haline getirmiştir. Hali hazırda çiftliklerde yetiştirilen tavuklar dünyadaki 30 milyar kara hayvanının yaklaşık 23 milyarını oluşturmaktadır. Güçlü bir kümes hayvanı endüstrisi mükemmel bir gıda arzının yanı sıra iyi bir istihdam yaratma kaynağı olarak da görülmektedir. Uluslararası kalkınma örgütleri ve yardım vakıfları başta olmak üzere birçok kişi, kurum ve organizasyon tavukçuluğun acil açlık sorununa ekonomik ve uygulaması kolay bir çözün olduğu konusunda hemfikirdir ve Afrika'nın birçok bölgesinde benzer girişimler yaşanmaktadır. Proje kapsamında uluslararası kalkınma örgütleri ve yardım vakıfları tarafından teşvik edilen tavukçuluğun Somali'ki mevcut durumu, gelişim değişim sürecinin stratejik değerlendirmesi yapılarak geleceğe ilişkin yeni bir perspektif oluşturulmaya çalışılacaktır. Bu çalışmadan elde edilecek sonuçlar tavukçuluğun desteklenmesi ve sağlıklı bir şekilde gelişimine ışık tutabilecek, yerel gıda pazarının büyümesini ve ürün çeşitliliğinin artmasını sağlayacak bilgi ve bulgulara veri tabanı oluşturacaktır. Bu çalışma hali hazırda büyük bir tavuk çiftliğini inşa eden Somalili girişimcilerin karşılaştığı sorunların da tespiti adına büyük önem arz etmektedir. Somali'de tavukçuluğun gelişmesi ve yaygınlaşması ithal kümes hayvanlarına bağımlılığını sona erdirerek, gıda güvencesinin sürdürülebilirliğini sağlayabilecek potansiyele sahiptir. ; Somalia has been in a political and economic chaos since the Central Republic of Somalia collapsed in January 1991, and the agricultural sector has not grown effectively. Droughts, recurrent famines and local conflicts triggered economic, social and political crises in many African countries, including Somalia. In these countries, where sustainability in food security cannot be achieved, a significant portion of the population is still not sufficiently fed. Malnutrition is a critical issue for most poor countries in the world. It is also known that more than a quarter of the African population (about 333 million people) face this problem, and the United Nations estimates that approximately 151 million children under the age of five experience slow growth and development retardation due to malnutrition worldwide. The United Nations, Food and Agriculture Organization (FAO) suggests that poultry can play an important role in fighting hunger and malnutrition in poor countries. Chicken egg containing very high quality pure protein provides the intake of almost all the essential nutrients necessary for young children, especially vitamin B12 and choline. Egg, which is a very popular food worldwide, can be produced cost-effectively. Chicken meat is another cost-effective source of animal protein. This reality made eggs and poultry meat the most consumed food globally. The chickens currently grown on farms make up about 23 billion of the 30 billion land animals in the world. A strong poultry industry is seen as a source of good employment as well as excellent food supply. Many people, institutions and organizations, especially international development organizations and charities, agree that poultry is an economic and easy-to-apply solution to the emergency hunger problem, and similar initiatives are taking place in many parts of Africa. Within the scope of the project, the current situation of poultry in Somalia, which is encouraged by international development organizations and charities, will try to create a new perspective for the future by making a strategic assessment on the development change process. The results obtained from this study will create a database of information and findings that can shed light on the support and healthy development of poultry sector and increase the local food market and increase product range. This study is of great importance in order to detect the problems faced by Somali entrepreneurs who are building large poultry farms. The development and spread of poultry in Somalia has the potential to end its dependence on imported poultry and ensure the sustainability of food security.
Uluslararası sistemde temel örgütlenme birimi olarak kabul edilen ulus devlet sistemi Ortaçağ döneminde Avrupa'dan tüm dünyaya yayılarak gelen bir yapıya karşılık gelmektedir. Bu yapının 1648 Westphalia Antlaşmasından başlayarak bir dizi siyasi, ekonomik ve sosyal gelişmeler sonucunda özellikle Fransız İhtilali sonrasında tüm dünyaya yayıldığı ve uluslararası politikada hakim siyasal örgütlenme biçimi olduğu kabul görmektedir. Modern devlet sistemi olarak adlandırılan bu yapıda tüm devletlerin sınırları belirli bir toprak parçası üzerinde vatandaşları üzerinde son sözü söyleme yetkisine sahip oldukları ve meşru güç kullanma tekelini elinde bulundurdukları genel kabul gören bir anlayıştır. Söz konusu bu modern devlet sistemi tüm devletlerin aynı özelliklere sahip olduğu veya olması gerektiği ön kabulüne dayanmaktadır. Tüm ulus devletlerin benzer gelişmeler neticesinde kurulduğunu öngören bu yaklaşım sistemde var olan tüm devletlerin bazı asgari standartlara sahip olduğunu ve standart kalıplar içinde var olduklarını ifade etmektedir. Bir başka deyişle modern ulus devlet modeli esasında tek tip ve standart bir devlet modeli öngörmektedir. Oysaki ulus devlet sistemi Avrupa dışındaki bölgelerde Avrupa'da yaşanan sürece benzer bir gelişim süreci göstermemiştir. Bu nedenle dünyanın birçok bölgesinde ortaya çıkan ulus devlet modelleri bir ulus devlette olması gereken şartları taşımadan ortaya çıkarak varlıklarını sürdürmektedirler. Özellikle Birleşmiş Milletler Sisteminin kurulmasının ardından bağımsızlıklarını kazanan birçok eski sömürge devleti bir ulus devlette olması gereken asgari standartlara sahip olmadan devletleşme sürecine girmişlerdir. Bu devletler hukuki olarak uluslararası toplum tarafından ulus devlet formunda kabul edilmiş olmalarına rağmen fiili olarak bir ulus devlette olması gereken özelliklere sahip olamadıkları için standart bir ulus devlette olması gereken işlevleri yerine getiremedikleri görülmektedir. Gelinen noktada bu tür devletler başarısız olarak adlandırılarak diğer devletlerden olumsuz olarak ayrışmaktadırlar. ii Bu durum bu devletlerin başarısız ve uluslararası sistemin hatalı veya bozuk parçaları olarak görülmelerine neden olmaktadır. Çünkü bu devletler vatandaşlarına diğer başarılı devletlerin sağladığı güvenlik, sağlık, eğitim gibi temel hizmetleri sağlayamadıkları gibi ülke içinde yaşadıkları silahlı çatışmalar nedeniyle gerek komşuları gerekse küresel sistem için kitlesel göçler, salgın hastalıklar, küresel terörizm gibi birçok soruna neden olmaktadır. Bu çalışma uluslararası politikada başarısız devlet sorununa odaklanarak başarısız devletselliğe neden olan unsurları tartışmaya açmaktadır. Bu noktada çalışmanın ortaya koyduğu tez; başarısız devletselliğin başarısız devletlerin kendilerinden kaynaklanan bir sorun olmasının yanında bu durumun aynı zamanda küresel kapitalist sistem ve sömürge devletlerinin uyguladıkları yanlış politikalardan kaynaklanmasıdır. Bu açıdan çalışma öncelikli olarak modern ulus devletin oluşum süreci ve unsurlarını inceledikten sonra başarısız devletlerin temel özelliklerini ortaya koyarak bu duruma neden olan sebepleri incelemeyi amaçlamaktadır. Ayrıca başarısız devletlerin neden olduğu uluslararası sorunlara dikkat çekerek bu sorunun çözümü için yeni yaklaşımlara ihtiyaç olduğunu vurgulamaya çalışmaktadır. ; The nation state system, which is accepted as the basic organization unit in the international system, corresponds to a structure that has spread from Europe to the whole world starting from in the middle ages. It is accepted that this structure has spread all over the world especially after the French Revolution as a result of a series of political, economic and social developments starting from the 1648 Treaty of Westphalia. It is a dominant form of political organization in today's international politics. In this structure, which is called the modern state system, it is generally accepted that all states have the authority to say the last word on the territory of a certain territory and hold the monopoly of using legitimate power. This modern state system is based on the assumption that all states have or must have the same characteristics. This approach, which envisages that all nationstates are established as a result of similar developments; states that all the states in the system have some minimum standards and exist within standardized patterns. In other words, the modern nation-state model provides a uniform and standardized state model. However, the nation-state system has not shown a similar development process in the regions outside Europe. Therefore the nation-state models that emerged in many parts of the world continue to exist without having to meet the requirements of a nation-state. Especially after the establishment of the United Nations System, many former colonial states, which gained their independence, entered the process of state building process without having the minimum standards required in a nation state. Although these states were legally accepted by the international community in the form of nation-state, they cannot fulfill the functions they should have in a standardized nation-state because they do not actually have the characteristics that should be in a nation-state. At this point, such states are considered to be unsuccessful and they are negatively differentiated from other states. This causes these states to fail and be seen as faulty or damaged parts of the international system. Because these states do not provide basic services to their iv citizens like other successful states, such as security, health and education and also they cause many problems such as mass immigration, epidemics, global terrorism for both the neighbors and the global system due to the armed conflicts in the country. This study focuses on the problem of the failed state in international politics and discusses the factors causing failed statehood. At this point, the thesis of the study; Besides the fact that the failed statehood is a problem arising from the failed states themselves, this is also due to the false policies implemented by the global capitalist system and the colonial states. In this respect, the study primarily aims to examine the main features of the failed states after examining the formation process and elements of the modern nation-state and to examine the reasons that cause this situation. It also tries to emphasize the need for new approaches to solve this problem by drawing attention to the international problems caused by the failed states. Avrupa Birliği (AB) 2004 yılından bu yana Orta ve Doğu Avrupa ülkelerinin büyük çoğunluğunu resmi olarak birliğe kabul etti ve Batı Balkanlarda geriye kalan üye olmayan ülkeler AB'nin yeni hedefi haline geldi. Ancak, Birlik AB politik üyelik koşulları yoluyla kurallarını Orta ve Doğu Avrupa ülkelerine kıyasla Batı Balkanlardaki diğer üye olmayan ülkelere aktarırken birtakım zorluklarla karşılaşmıştır. Burada akla iki soru gelmektedir: Birinci soru, "Hangi şartlar altında bu koşullar etkili olabilir?" iken; ikinci soru, "AB üyelik koşulları neden Batı Balkanlarda bulunan ülkelerin iç politikasında kısmen sınırlı bir rol oynar?" şeklindedir. Bu meseleyi açığa kavuşturmak için Schimmelfennig ve Sedelmeier (2004) tarafından "dış teşvik modeli" benimsenmiştir. Bu çalışma "dış teşvik modelinin" bu soruları tam anlamıyla cevaplandıramadığını ve ulusal kimliğin Batı Balkan devletleri olan Hırvatistan ve Sırbistan'da AB üyelik koşullarının etkililiğini belirleme noktasında önemli bir role sahip olduğunu ileri sürmektedir. Çalışmanın Hırvatistan ve Sırbistan'ı durum çalışmaları olarak ele almasının sebepleri; bu iki ülkenin eski Yugoslav Sosyalist Federal Cumhuriyeti olmaları ve 1990'lı yıllarda ortak bir savaş tarihi paylaşmalarıdır. Belirtilen bu ortak özelliklere rağmen bu iki ülkenin Birliğe olan üyelik sürecine ilişkin tutumlarının birbirinden farklılık arz ettiği dikkat çekmiştir (Massari, 2010). Hırvatistan AB üyeliğini hâlihazırda 2013 yılında elde etmiş olmasına rağmen, Sırbistan'ın bu üyeliği gerçekleştirme noktasında kat etmesi gereken daha çok yol vardır ; The European Union (EU) has formally initiated the vast majority of the Central and Eastern European Countries (CEECS) into the Union and Western Balkans' remaining non-EU countries have became the new target of EU enlargement since 2004. The Union, however, has faced some difficulties in transferring its rules to non-member countries in Western Balkans by means of the EU political accession conditionality in comparison to Central and Eastern European Countries. Here are two questions to mind: 'Under what circumstances could the conditionality be effective?' and 'why does the EU conditionality play relatively limited role in the domestic politics of the Western Balkan states?' An "external incentive model" is adopted by Schimmelfennig and Sedelmeier (2004) to articulate the issue. This study addresses this contestation, arguing that the "external incentive model" is incapable of fully answering these questions and that national identity has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. The reasons why the paper has chosen Croatia and Serbia as case studies are that they are republics of former Yugoslavia and that they have shared war history in the 1990s, however act differently on the way to the European Union (Massari, 2010). Although Croatia has become a member of the Union, Serbia still has got a long way to go The European Union has utilised political conditionality as one of the most significant strategies to export its governance and to encourage non-member countries to obey the rules of the EU (Schimmelfennig and Sedelmeier, 2004). Political conditions, which are necessitated by the Union from the very beginning, can be described as a competitive party system, and free and fair elections. As for the essential political conditions of EU accession that the EU confirmed in 1993, which are also defined as the Copenhagen Criteria, they are the stability of democratic institutions, rule of law, liberal market economy, human rights and lastly the protection of minority rights (Bieber, 2013:2). The required political conditions are flexible. By which it means that some specific requirements could be added to the conditions. For instance, the UE required cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY) in the context of Western Balkans (Frerburh and Richter, 2010:269-71). Predominant studies select "external incentive model" to articulate the logic of EU conditionality and political conditions. This model is based on a rationalist cost-benefit calculation that assumes that states are regarded as rational actors, seeking to boost their interests (Schimmelfennig and Sedelmeier, 2004). The tool of conditionality is perhaps the most significant instrument that the EU external governance applies to force would-be member states to obey the rules of the EU. That is, the Union decides its instructions as conditions and would-be member states are expected or required to accept these conditions to receive rewards. Consequently, the target government would face three various pressures namely from the Union, domestic and international politics in return for EU external incentives (Trauner, 2011:8). It is therefore the credibility of the EU conditionality plays a key role in evaluating the pros and cons of EU rewards as opposed to domestic compliance (Schimmelfennig and Sedelmeier, 2004:663-7). This model is, however, unsuccessful in fully articulating why the EU political conditionality could perform better in states like Croatia than in states like Serbia in the context of Western Balkan despite the fact that the Union has provided these countries with rewards. At this point, national identity, as a constructivist variable, has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. National identity is the main theme that determines whether conditionality can be effective or not. Constructivists argue that wouldbe member states would acknowledge the influence of the Union by means of socialisation and persuasion processes. It is these processes internalizing identities with the help of domestic actors (Trauner, 2011). Considering the rules of the EU appropriate and compatible with political conditionality helps domestic actors to stick to given EU rules (Schimmelfennig et al., 2006:27-52). In this sense, national identity, as a filter actor, influences EU conditionality. It is, therefore, crucial to note that states, as social actors, often shape and reshape national identity when they face or interact with different social structures. The EU political conditionality has raised doubts about its effectiveness in the countries in question. This is because they had ethnic conflicts in 1990s that shaped their national identities. It is this historic background affecting the effectiveness of EU political conditionality in Croatia and Serbia in different lights. Although Croatia has become a member of the Union, Serbia still has got a long way to go.Cooperation with the ICTY has been very sensitive issue in both Croatia and Serbia where these countries had to comply with it as a result of being tied to EU accession. The way in which the transformation of the EU rules, however, quite varied from one another. Croatian elites saw the cooperation with ICTY as indispensable part of EU accession and in line with Croatian respect of European organizations. Croatia met EU requirements. This is simply because the country was one of the European countries in which the rule of law is respected and obeyed. As far as Serbia is concerned, the cooperation with the ICTY was ensured by Serbian elites who felt forced and oppressed to do so. But they rejected the Hague tribunal. Even though they rejected it, a sense of obligation arising from the fear of being punished by the international community through the cancellation or postpone of EU talks took place regarding detaining suspects. This problematic issue resulted in different images of the EU in the eyes of these two countries. Serbia regards the European Union as a punisher and a superior force that inclined to in Serbia. This could be one of the reasons why there is distance between Belgrade and Brussels. As for Croatia, the image of Europe in the eyes of Croatian people is related to high democratic standards, liberty and civilization (Subotic, 2011:326-7). This could be one of the reasons why there is close cooperation between Croatia and the European Union. The rational incentive model is important for explaining the choice of would-be member states. It is crucial to clarify that this model is valid once the rules of the European Union are compatible with national identity of the would-be member states. Once the national identity of the target state is incompatible with the rules of the EU, it is fair to say that any material condition does not serve a very useful purpose. Therefore, national identity matters
ÖZET10 Kasım 1938 tarihinde Mustafa Kemal Atatürk'ün hayatını kaybetmesi ile bir-likte Cumhurbaşkanı olan İsmet İnönü ülke yönetiminde en yetkili kişi haline gelmiştir. İnönü'nün CHP ve ülke yönetimindeki adete tek kişilik hakimiyeti ( Milli Şef ) Celal Bayar başta olmak üzere dönemin CHP'li milletvekili ve yöneticilerinde tepkiye neden olmuştur. Bir şahsın parti ve ülke yönetimindeki hakimiyetine İkinci Dünya Savaşı'nın da etkisiyle halkın büyük çoğunluğunda oluşan ekonomik sıkıntının ve iktidarın halkın muhafazakarlığı ile çelişen eğitim ve sosyal alanlardaki uygulamaları CHP ve dışındaki siyasi çevrelerde ve halkın büyük bir bölümünde muhalif bir tutumun oluşmasına neden olmuştur. Bu süreç hükümetin birtakım radikal uygulamaları ile birlikte örgütlü bir mu-halif hareketin doğmasına neden olmuştur. Yukarıda belirtilen nedenlerden kaynaklanan ve açıktan açığa bir söylem ve ey-leme dönüşmeyen CHP milletvekillileri içindeki bireysel tavırlar ilk defa Çiftçiyi Top-raklandırma Kanunu teklifi sırasında ortaya çıkmıştır. CHP milletvekilleri Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan, 14 Mayıs 1945 tarihinde bu kanun teklifinin TBMM'de görüşülmeye başlaması ile birlikte hükümetin bu uygulamasına karşı tavırlarını yaptıkları konuşmalar ile ortaya koymuşlardır. Fakat esasen bu kanun tasarısının TBMM'ye sunulmasından önce CHP içinde muhalif bir grubun oluşması Tevfik Rüştü Aras'ın evinde yapılan perşembe toplantılarıyla başlamıştır. 1945 yılının Nisan ayından itibaren Tevfik Rüştü Aras'ın evinde bir araya gelen Emin Sazak, Adnan Menderes ve Fuat köprülü CHP'nin, İsmet İnönü'nün otoritesi altında olduğunu ifade etmişler ve bu durumu değiştirmek gerektiği üzerinde durmuşlardır. İkinci defa bir ara-ya gelen Adnan Menderes ve Fuat Köprülü demokratik bir merkez oluşturma konusun-da görüş birliğine varmışlardır. Daha sonraki toplantılara Refik Koraltan da katılmıştır. Adnan Menderes, partide ve toplum içinde etkili olan Celal Bayar'ı bu gruba katmak gerektiğini açıklamıştır. Celal Bayar ile yapılan toplantı sonunda o da gruba dahil ol-muştur. Grup üyeleri 18 Mayıs 1945 tarihinde yapılan toplantıda CHP Meclis Grubuna vermeyi düşündükleri Dörtlü Takriri hazırlamışlardır.Takrir verilmeden önce TBMM'de 1945 yılı devlet bütçesinin oylamasına katı-lan üç yüz yetmiş üç milletvekilinden İzmir Milletvekili Celal Bayar, Aydın Milletve-kili Adnan Menderes, İçel Milletvekili Refik Koraltan, Kars Milletvekili Fuat Köprülü ve Eskişehir Milletvekili Emin Sazak bütçeye karşı aleyhte oy kullanmışlardır. Cumhu-riyet Dönemi'nde ilk defa bir bütçeye karşı aleyhte oy kullanılmıştır. Böylece muhalif tavırlarını ikinci defa ortaya koymuşlardır. Grup üyeleri 7 Haziran 1945 tarihinde Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan'ın imzası ile Dörtlü Takrir'i CHP Meclis Grubu Başkanlığı-na vererek muhalif tutumlarını somutlaştırmışlardır. Takrirde CHP'nin işleyişinin de-mokratik ilkelere uygun hale getirilmesini ve TC. Anayasası'nda var olan vatandaş hak ve hürriyetlerinin tanınması talep etmişlerdir. Bu takrir 12 Haziran 1945 tarihinde CHP Meclis Grubu'nda görüşülmüş ve red-dedilmiştir. Takririn reddedilmesi ile birlikte devam eden süreçte bu kadronun CHP içinde siyaset yapma imkanı kalmadığı gibi takrirde talep edilen bir düzenin kurulma-sının CHP içinde mücadele edilerek olamayacağı ortaya çıkmıştır. Takririn, CHP Meclisi Grubuna verildiği günlerde Cumhurbaşkanı İsmet İnönü, Rauf Orbay ile görüşmüş yeni parti kurulması fikrini ona açmıştır. Bu görüşmeden, İnönü'nün yaptığı diğer konuşmalardan cesaret alan grup üyelerine karşı CHP'li yöne-tici ve milletvekillerinin olumsuz tavrı, partinin yayın organı Ulus gazetesindeki ağır sözlerle dolu yazılar grup üyelerinin CHP'den ayrılmalarına neden olmuştur. Zaten Adnan Menderes ve Fuat Köprülü Vatan gazetesinde yayınlanan yazıları nedeniyle CHP Divanı tarafından 25 Eylül 1945 tarihinde CHP'den ihraç edilmişlerdir. Diğer isimlerde istifa etmişlerdir. Partisiz kalan grup üyeleri parti kurma çalışmalarına başla-mışlar ve Demokrat Parti 7 Ocak 1946 tarihinde resmen kurulmuştur. Demokrat Parti, Dörtlü Takrir'in imzacıları: Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan tarafından kurulmuştur. Demokrat Parti'nin simgesi "DP", genel merkezi ise Antalya Milletvekili Cemal Tunca'nın Ankara Sümer Sokaktaki sekiz numaralı binası olmuştur. Demokrat Parti'nin kuruluş gerekçesinde ve programında Türkiye'de demok-ratik bir rejimin kurulacağı, TC Anayasası'nda demokrasiye aykırı kanunların kaldırı-lacağı, vatandaşların hak ve hürriyetlerinin anayasal teminat altına alınacağı dile geti-rilmiştir. Muhalefet yıllarında ise CHP ve iktidar demokratik olmayan tutum ve davra-nışlar sergilemekle itham edilmiştir. Muhalefet yıllılarında iki parti arasında demokra-siye aykırı birçok olay yaşanmıştır. Hatta 7 Ocak 1947 tarihinde gerçekleşen Demokrat Parti Birinci Genel Kongresi'nde kabul edilen Hürriyet Misakı'nda TC Anayasası'na aykırı olan kanunların kaldırılması ve demokrasiye uygun kanunların yapılması talep edilmiştir. Bu istekler yerine getirilmez ise Demokrat Parti Genel Yönetim Kurulu'na sine-i millet kararı ( TBMM'den çekilme ) hakkı verilmiştir. Demokrat Parti yönetici-leri iktidara gelmeleri halinde vatandaşlara hak ve hürriyetlerinin tanınacağı, demokra-siye aykırı kanunların kaldırılacağı ve TC Anayasası'nın demokrasiye uyumlu hale ge-tirileceği sözlerini vermişlerdir. 14 Mayıs 1950 seçim faaliyetlerinde aynı vaatler tekrarlanmıştır. Hatta 2 Nisan 1950 tarihinde Kasımpaşa'da konuşan Demokrat Parti Genel Başkanı Celal Bayar, grev hakkının demokratik hak olduğunu ve demokrasinin olduğu ülkelerdeki gibi toplumsal düzene ve ekonomiye zarar vermeyecek biçimde işçilere grev hakkının verileceğini ifa-de etmiştir. Seçimleri kazanan Demokrat Parti adına Adnan Menderes 22 Mayıs 1950 tarihinde hükümeti kurmuş ve 29 Mayıs 1950 tarihinde hükümet programı TBMM'de onaylanmıştır.Hükümet programında partinin seçim beyannamesinde olduğu gibi iktidar deği-şikliğinin ülkede maddi ve manevi hiçbir sarsıntıya yol açmasına imkan tanınmayacağı ve özellikle devri sabık yaratılmayacağı vurgulanmıştır. Programda, TC Anayasası'nda vatandaş hak ve hürriyetlerine ve millet iradesine dayanan kararlı bir devlet düzeninin gerçekleşmesini sağlayacak düzenlemelerin yapılacağı ifade edilmiştir. Ayrıca CHP hükümetlerinden ( tek parti dönemi ) kalan, demokratik olmayan kanunların, alışkan-lıkların ve anlayışların değiştirileceği vurgulanmıştır. Programda, işçilere grev hakkının sosyal ve ekonomik düzeni bozmayacak şekilde tanınacağı açıklanmıştır. Demokrat Parti İktidarı Programı'nda sadece vatandaşlara tanınacak haklar yer almamıştır. Ayrıca o tarihlerde azınlıkta olsa da bazıları tarafından hak olarak görülen faaliyetlerin yasaklanacağı da yer almıştır. Cumhuriyet'in ve inkılapların korunması için aşırı sol akımlara ( komünizm ) izin verilmeyeceği ve bunlarla etkin bir biçimde müca-dele edileceği ifade edilmiştir. Bunlara karşı kanuni tedbirlerin alınacağı çünkü bu tür düşüncelerin günün şartlarında fikir ve vicdan hürriyeti olarak görülmediği vurgulan-mıştır. Bu fikir akımların hürriyet maskesi altında yayın yapmalarına izin verilmeyeceği çünkü bu düşünce akımlarının amacının özgürlükleri ortadan kaldırmak olduğu iddia edilmiştir. Komünizm fikir akımının yanı sıra irticai hareketlere de asla müsaade edil-meyeceği vurgulanmıştır. Demokrat Parti Dönemi'nde iktidarın sivil toplum kuruluşları ile ilişkilerine özetlemeden önce sivil toplumun örgütü tanımını yapmak yerinde olacaktır. Sivil top-lum kavramı farklı biçimlerde tanımlanan bir kavramdır. Özellikle devlet ile sivil top-lum arasındaki ilişki farklı tanımlamalara neden olmaktadır. Bu tanımlardan bazılarında sivil toplum, devletten tamamen bağımsız, devleti kontrol eden ve hatta devletin alter-natifi olan örgütlü bir güç olarak tarif edilmiştir. Diğer tanımlarda ise devlet ile sivil toplum arasında bu kadar keskin bir ayrılığın olmadığı, sivil toplumun devlete top-lumsal katılımı sağlama amacının var olduğu ileri sürülmüştür. Modern anlamda sivil toplum kavramı "Non Govern Mental Organizations" ( devletten bağımsız örgütlen-meler ) olarak tanımlamasının yanı sıra "gönüllü kuruluşlar", "kar amacı gütmeyen ku-ruluşlar" gibi ifadelerle de tanımlanmaktadır. Sivil toplum tanımını yaptıktan sonra Demokrat Parti iktidarları öncesi sivil toplum örgütlenmesine devletin müdahalesinin ne zaman kaldırıldığına kısaca yer verelim. Türkiye'de 28 Haziran 1938 tarihinde yürürlüğe giren 3512 sayılı Cemiyetler Kanunu ile Osmanlı Devleti döneminden kalma 1909 tarih ve 121 sayılı Cemiyetler Kanun'u ve bu kanunda yapılan 353 ve 387 sayılı kanunlar yürürlükten kalkmıştır. Bu kanunun dokuzuncu maddesinin h bendiyle "aile, sınıf, ırk, cins" esasına dayalı der-neklerin kurulması yasaklanmıştır. Bu madde ile sendika ve birçok derneğin kurulması yasaklanmıştır. Bu kanunun kabul gerekçesinde, o dönem de bazı ülkelerde var olan ko-münist ve faşist rejimlerin ülkenin yönetimin ele geçirmesini önlemek olduğu ileri sü-rülmüştür. İsmet İnönü'nün 10-11 Mayıs 1946 tarihinde CHP Kurultayı'nda yaptığı konuşmadan sonra 5 Haziran 1946 tarihinde 4919 sayılı Kanun ile dernek kurma işle-mindeki izin alma formalitesi kaldırılmıştır. Sınıf esasına dayalı dernek kurma yasağı da kalkmıştır. Bu kanunun kabulü sırasında Demokrat Parti adına bir konuşma yapan Adnan Menderes, kanunda yapılan değişikliği demokrasiye giden yolda önemli bir aşa-ma olarak adlandırmıştır. Sivil toplum örgütlenmesinin önündeki engeller Demokrat Parti İktidarı öncesinde kaldırılmıştır. Demokrat Parti İktidarı döneminde sivil toplum kuruluşları ile ilişkiler iki bölü-mde ele alınabilir. Birinci bölüm hükümetin sivil toplum alanında yaptığı düzenleme-lerden oluşur. İkinci bölüm ise iktidarın sivil toplum kuruluşlarına yaklaşımı yani onların faaliyetlerine karşı tutumu, ülke yönetimi ile ilgili alınan kararlara ilgili sivil toplum kuruluşlarının tepkileri ve sivil toplum kuruluşlarının kendi alanları ile ilgili alınan kararlarda bu kuruluşların isteklerinin ve itirazlarının dikkate alıp almamasından oluşur.Demokrat Parti İktidarı döneminde sivil toplum alanında birçok düzenleme yapılmıştır. Hükümetin yaptığı bu düzenlemelere günümüzün demokrasi düzeyi ile yaklaşmak zamanın koşullarını ve demokrasi kültürünün oluşum sürecini dikkate almamak anlamına gelir. Hükümetin sivil toplum alanında yaptığı ilk düzenleme 5680 sayılı Basın Kanunu'dur. Kanunun kabulü demokrasi ilkeleri ile bağdaşan bir uygulama olmuştur. Bu nedenle basın ve basın-yayın örgütleri bu yasayı doğru bir adım olarak görmüşlerdir. Hükümetin sivil toplum alanında yaptığı ikinci kanuni düzenleme 5844 sayılı Komünizm İle Mücadele Kanununu çıkarmasıdır. İktidarın programında komü-nizm fikir akımına ve komünist yayınlara karşı mücadele edileceği, bu fikir akımlarının faaliyetlerinin demokratik bir fikir ve vicdan hürriyeti olarak görülmediği aksine de-mokratik rejimi ortadan kaldırmaya yönelik bir tutum ve tavır olduğu vurgulanmıştır. Muhalefetin de bu konuda iktidarla aynı düşünceye sahip olması bu kanunun çıkarıl-masını kolaylaştırmıştır. Demokrat Parti İktidarı'nın bu tür düşünce akımlarına ve onların faaliyetlerine izin vermemesini değerlendirirken zamanın koşullarını ve demok-rasi kültürünün oluşum sürecini göz önünde tutmak yerinde olacaktır. İktidarın sivil toplum alanı ile ilgili yaptığı bir başka uygulama ise 5816 sayılı Atatürk Kanunu'nun çıkarılmasıdır. Atatürk'ün kişiliğine, ilke ve inkılaplarına saldırıların sonucunda kabul edilmiş olan bu kanun günümüzde de geçerlidir. Bu kanunun çıkarılmasına Atatürk'ün kurduğu parti olan CHP'li milletvekillerinin karşı çıkmış olmaları ise üzerinde durul-ması gereken önemli bir husustur. Hükümetin sivil toplum alanında gerçekleştirdiği bir başka düzenleme ise 6761 sayılı Vicdan ve Toplanma Hürriyetini Koruma Kanunu'nun kabul edilmesidir. Kanun, irticai hareketlerin artarak rejimi tehdit eder hale gelmesinin sonucu çıkarılmıştır. İrticai hareketlere izin verilmeyeceğini, demokratik rejimi koruya-cağını programında ilan eden hükümet bunun gereğini yerine getirmiştir. Dinin siyasi veya diğer çıkarlar için kullanılması ve bu tür örgütlenmelerin kurulmasını demokratik ilkelerle bağdaştırmak mümkün değildir. Hükümetin sivil toplum alanına bir başka müdahalesi Neşir Yolu ile veya Radyo ile İşlenecek Bazı Cürümler Hakkındaki Kanun'u çıkarması ile 6732 ve 6733 sayılı basın kanunlarının bazı maddelerini değiş-tirmesi ile olmuştur. Bu kanunlarda yer alan kişilerin şikayeti olmadan savcıların ya-yınlar ile ilgili kendiliğinden harekete geçebilmesi unsuru haber alma ve verme hür-riyetini engelleyen bir koşul oluşturmuştur. Yine gazetecilerin yaptıkları haberler ve köşe yazarlarının yazdıkları yazılar nedeniyle şikayet edilmeleri halinde kendilerini müdafaa edebilmeleri için ispat hakkının onlara verilmeyişi bazı konularda ( iktidar ve mülki amirler ile ilgili yolsuzluk vb) haber yapmalarına, yazı yazmalarına engel olacak ortamı oluşturmuştur. Ayrıca, halkın haber alma özgürlüğüne, gazetecilerin özgür ve bağımsız çalışmasına engel olmuştur.
