The role of urban development activity in the regulation of land use is defined, as well as the actual disputable issues concerning the ambiguity of the role of urban development law and activity in land use regulation are highlighted. Controversial issues were considered from the point of view of determining the purpose of the land and functional use (designation) of the territory; the notion of "territorial zone", the definition of restrictions on the land use. A comparative analysis of the concept of "territorial zone" in accordance with the land and spatial planning legislation was conducted. Administrative and territorial reform in Ukraine is coming to an end. In the socio-economic life of the country, this reform contributed to the establishment of local self-government, in urban planning activities began spatial planning, the main task of which is the development of comprehensive plans for spatial development of the territories of united territorial communities. According to the current legislation, the main subject of local self-government in Ukraine is a united territorial community. Adoption of the Law 711-IX "On Amendments to Certain Legislative Acts of Ukraine on Land Use Planning" provides for the development of special urban planning documentation, which extends its effect to the community, which in turn allows the united territorial community to determine the planning and development of its own territory. Law 711-IX also introduces a new type of urban planning documentation - a comprehensive plan for the spatial development of the territory of the united territorial community. In order to successfully implement this project, it is necessary to assess all the challenges and risks in the field of administrative services, medicine, education, road and engineering infrastructure, environmental protection and cultural heritage when drawing up a community spatial development plan in modern conditions. The main problem in drawing up comprehensive plans is the spatial organization of agricultural areas and the interests of the peasant farmer, a representative of the middle class, whose opinion should be taken into account through surveys and analysis of his social and industrial activities, including taking into account his domestic and economic interests. When drawing up comprehensive spatial development plans, the project team should involve community specialists (architect, land surveyor), as well as community proxies (priests, teachers) who know regional issues, history and traditional crafts of the territories and will defend their development. As many community residents as possible should participate in the discussion and approval of project proposals for a comprehensive plan, in order to prevent resistance and understand the need to implement it. ; Адміністративно-територіальна реформа в Україні завершується. В соціально-економічному житті країни ця реформа посприяла утвердженню місцевого самоврядування, в містобудівній діяльності започаткувала просторове планування територій, основне завдання якого розробка комплексних планів просторового розвитку територій об'єднаних територіальних громад. Відповідно до чинного законодавства основним суб'єктом місцевого самоврядування в Україні є об'єднана територіальна громада. Прийняття Закону 711-IX «Про внесення змін до деяких законодавчих актів України щодо планування використання земель» передбачає розроблення спеціальної містобудівної документації, яка поширює свою дію на територію громади, що в свою чергу дозволяє об'єднаній територіальній громаді визначати напрямки планування та забудови власної території.Закон 711-IX також запроваджує новий вид містобудівної документації — комплексний план просторового розвитку території об'єднаної територіальної громади. Для успішної реалізації цього проекту необхідно при складання плану просторового розвитку громади в сучасних умовах передбачити усі виклики та ризики у сфері адміністративних послуг, медицини, освіти, дорожньої та інженерної інфраструктури, охорони навколишнього середовища та пам'яток культурної спадщини. Основною проблемою при складанні комплексних планів залишаються просторова організація аграрних територій та інтереси селянина-господарника, представника середнього класу, думка якого повинна бути врахована через опитування та аналіз його соціальної та виробничої діяльності, зокрема врахування його побутових та господарчих зацікавлень та надання їм пріоритетів. При складанні комплексних планів просторового розвитку до проектної групи необхідно залучати спеціалістів громади (архітектора, землевпорядника), а також уповноважених від громади довірених осіб (священика, учителя), які знають регіональні проблеми, історію та традиційні промисли територій та стануть на захист їх розвитку. В обговоренні та погодженні проектних пропозицій комплексного плану повинні брати участь якнайбільше мешканців громади, для запобігання супротиву та розуміння необхідності його виконання.
The article is devoted to some aspects of the development of urban planning systems. In particular, the domestic peculiarities of the development of territories are determined, the international experience of the development of urban planning systems is accumulated and analyzed. In practice, the national urban planning system does not have clear priorities that would be formulated in accordance with the needs of the population and state interests. Accordingly, it cannot be said that the state, through the implementation of management functions, provides strategic reforms in the urban planning system, which determines the need for transformation in accordance with the general planning standards of the European Union. Today, the processes of urbanization continue to develop actively. Territorial management determines the purposefulness of the functions of urban planning systems. An important task of the development of urban planning is to find ways to effectively organize the urban space in accordance with the socio-economic and cultural needs of a growing population. In this context, the article analyzes the issues of theoretical justification of general planning, defines the role of general planning in the system of urban development, analyzes the priorities, trends and prospects for the development of general planning. The national system of urban planning is characterized by the crisis of the model of urban planning management, in particular, it is chaotic. This article is devoted to finding ways to solve these problems. ; Розглянуті окремі аспекти розвитку систем містобудування. Зокрема визначено вітчизняні особливості розвитку територій, акумульовано та проаналізовано міжнародний досвід розвитку систем містобудування. На практиці національна система містобудування не має чітких пріоритетів, що були б сформульовані відповідно до потреб населення та державних інтересів. Відповідно, не можна сказати, що держава шляхом реалізацією функцій управління забезпечує стратегічні реформи у системі містобудування, що визначає необхідність трансформацій відповідно до стандартів генерального планування Європейського Союзу. На сьогодні процеси урбанізації продовжують активно розвиватися. Управління територіями визначає цілеспрямованість реалізації функцій містобудівних систем. Важливими завданням розвитку процесів містобудування є пошук шляхів ефективної організації урбанізованого простору відповідно до соціально-економічних та культурно-побутових потреб населення, що постійно зростає. В цьому контексті у статті проаналізовано питання теоретичного обґрунтування генерального планування, визначено роль генерального планування у системі містобудівного розвитку, проаналізовано пріоритети, тенденції та перспективи розвитку системи генерального планування. Національна система містобудування характеризується кризою моделі управління містобудівним процесом, зокрема має хаотичний характер. Пошуку шляхів вирішення цих проблем присвячена дана стаття.

The need for an environmentally-oriented landscape policy has been noted in the Guiding Principles for Sustainable Spatial Development of the European Continent, declaring that for successful spatial development it is necessary to ensure "the integration of landscape development into spatial planning as well as into sectoral policies", as well as "the implementation of integrated policies aimed at simultaneously protecting, managing and planning landscapes." Thanks to landscape planning, the relations of society and nature are optimized within specific regions, which, in turn, are considered as components of the multi-level spatial "population ↔ environment" system on local, regional, national and transnational levels. In view of Ukraine's accession to a number of international agreements and conventions related to the country's transition to a balanced, sustainable development, there is an urgent need to bring the current legislation of the country, through a gradual transformation, to the fundamentals and requirements in force in the European Community. In this respect, the use of environmental guidelines on sustainable development and tools for landscape planning in the field of urban planning and land use is becoming topical. Based on the experience of European countries, it is also advisable to use strategic environmental assessment when developing spatial planning activities. At the stage of transition of Ukraine, as well as the entire world community, to sustainable, environmentally balanced development, there is a significant advantage of implementing the landscape planning as a separate document as a basis for further developing of spatial planning documentation, since this type of work will help to inform in advance about possible mistakes when making management decisions on spatial development of territories and, considering the results of strategic environmental assessment, will help to reconcile conflict issues with the goals of sustainable development. ; Ландшафтне планування є важливим інструментом європейського просторового планування, який забезпечує впровадження в територіальну політику принципів сталого розвитку. The article is devoted to the analysis of dominant and alternative mobility systems in contemporary world. It is emphasized that mobility can be both real and potential actions in their connection with social relations in space and time. Mobility cannot exist without human need or desire to be at a certain time in a certain place. These factors lead to various types of mobility systems. It is noted that the mobility system is a complex of social relations and material infrastructure that make a certain type of spatial movement possible, repetitive and predictable. Any action or movement is possible only as part of a specific mobility system. In the modern world, there are dominant institutionally fastened mobility systems. One of the most common of these is the tourism system. The article analyzes some theoretical approaches to the study of tourism presented in the works of such scientists as Z. Bauman, J. Urry, T. Veblen and others. The attention is focused on the fact that the tourism system is highly influenced by market relations. Tourism has become a product of conspicuous consumption and one of the factors of social inequality reproduction at the same time. It is emphasized that there are alternative spatial mobility systems that are excluded from market logic. One of the most common alternative spatial mobility systems is hitchhiking, that is, the practice of free travel on passing nonscheduled vehicles with the consent of the driver. The features of the functioning of spatial mobility systems in the modern world are investigated. The properties of the dominant and alternative mobility systems are considered, as well as the differences between them are also analyzed. It has been revealed that alternative spatial mobility systems are built upon personalized trust relationships. Conclusion is made that hitchhiking performs the function of social integration.
In order to harmonize the existing land management documentation and documentation, which is both urban planning and land management, proposed by the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Land Use Planning", the main features of state, communal and private land use were analyzed. , their assignment to one or another category of lands, determination of the purpose and type of use within the functional zoning of the territory when planning spatial development.The basic principles of distribution (redistribution) of lands by types of use are offered taking into account requirements of the complex plan of spatial development of territories of territorial communities and the plan of zoning of the territory (zoning). The main features of these principles are taking into account restrictions on land use within certain functional zones, certain categories of land of the formed land plots, functional purpose of the territory and characteristics of the territory.The relevance of developing a classifier of types of land use, types of functional purpose of territories and the relationship between them, as well as the rules of its application with the definition of land categories and types of land use, which can be established within the relevant functional area. ; З метою узгодження існуючої документації із землеустрою та документації, яка одночасно є містобудівною на місцевому рівні та землевпорядною, запропонованої Законом України «Про внесення змін до деяких законодавчих актів України щодо планування використання земель», було проаналізовано основні особливості використання земель державної, комунальної та приватної власності, віднесення їх до тієї чи іншої категорії земель, визначення цільового призначення та виду використання в межах функціонального зонування території при плануванні просторового розвитку.Запропоновано основні засади розподілу (перерозподілу) земель за видами використання з урахуванням вимог комплексного плану просторового розвитку територій територіальних громад та плану зонування території (зонінгу). Головними особливостями вказаних засад є врахування обмежень у використанні земель в межах визначених функціональних зон, визначені категорії земель сформованих земельних ділянок, функціональне призначення території та характеристика території.Також проаналізовано актуальність розроблення класифікатора видів цільового призначення земельних ділянок, видів функціонального призначення територій та співвідношення між ними, а також правила його застосування з визначенням категорій земель та видів цільового призначення земельних ділянок, які можуть встановлюватися в межах відповідної функціональної зони.

The study suggests a typology of planning constraints depending on their spatial determination on graphic materials in conjunction with the contours of the planning elements of urban planning systems - planar, strip and linear.The new DBN B.2.2-12: 2019 "Planning and development of territories" at the legislative and normative level has introduced new regulations in the form of "blue", "yellow" and "green" lines in addition to plans for "red" lines and regulation lines for building. The article presents the results of a study of domestic and foreign practice of spatial determination of "red", "blue", "yellow" and "green" lines in urban planning and design documentation.Using the comparative and graphoanalytical methods of analysis, the development features of the corresponding graphic materials are established.The need for coordination of the legislative and regulatory framework for the development of urban planning documentation has been established; recommendations are given for the formation of a regulatory and methodological base for the development of plans for "blue", "yellow" and "green" lines. ; Одним із завдань містобудівної діяльності є забезпечення раціонального використання територій для містобудівних потреб та створення повноцінного життєвого середовища для населення. Базовим регулятором такої діяльності виступає система планувальних обмежень у складі містобудівної документації на різних територіально-планувальних рівнях. В дослідженні запропонована типологія планувальних обмежень в залежності від їх просторової детермінації на графічних матеріалах в ув'язці з контурами планувальних елементів містобудівних систем – площинні, смугові та лінійні.Новий ДБН Б.2.2-12:2019 «Планування і забудова територій» на законодавчо-нормативному рівні ввів в практику розроблення містобудівної документації крім планів «червоних» ліній і ліній регулювання забудови нові регламенти у вигляді «блакитних», «жовтих» і «зелених» лінійВ статті викладені результати дослідження вітчизняної та закордонної практики просторової детермінації «червоних», «блакитних», «жовтих» та «зелених» ліній в містобудівній та проектній документації. Із застосуванням компаративістського та графоаналітичного методів аналізу встановлені особливості розроблення відповідних графічних матеріалів. Встановлена необхідність узгодження законодавчо-нормативної бази розроблення містобудівної документації; надані рекомендації до нормативно-методичної бази розроблення планів «блакитних», «жовтих» та «зелених» ліній.

Із застосуванням компаративістського та графоаналітичного методів аналізу встановлені особливості розроблення відповідних графічних матеріалів. Встановлена необхідність узгодження законодавчо-нормативної бази розроблення містобудівної документації; надані рекомендації до нормативно-методичної бази розроблення планів «блакитних», «жовтих» та «зелених» ліній.
One of the tasks of urban development is to ensure the rational use of territories for urban needs and create a full-fledged living environment for the population. The basic regulator of such activities is the system of planning restrictions in the composition of urban planning documentation at different spatial planning levels. The study suggests a typology of planning constraints depending on their spatial determination on graphic materials in conjunction with the contours of the planning elements of urban planning systems - planar, strip and linear.The new DBN B.2.2-12: 2019 "Planning and development of territories" at the legislative and normative level has introduced new regulations in the form of "blue", "yellow" and "green" lines in addition to plans for "red" lines and regulation lines for building. The article presents the results of a study of domestic and foreign practice of spatial determination of "red", "blue", "yellow" and "green" lines in urban planning and design documentation.Using the comparative and graphoanalytical methods of analysis, the development features of the corresponding graphic materials are established.The need for coordination of the legislative and regulatory framework for the development of urban planning documentation has been established; recommendations are given for the formation of a regulatory and methodological base for the development of plans for "blue", "yellow" and "green" lines. ; Одним із завдань містобудівної діяльності є забезпечення раціонального використання територій для містобудівних потреб та створення повноцінного життєвого середовища для населення. Визначено, що причинами цього є відсутність чітко встановлених суб'єктів розвитку, що позбавляє стратегічні документи з розвитку конкретного вектору їх реалізації. Запропоновано модель аналізу суб'єктів просторового розвитку, за якою визначені представники приватного сектора як основні учасники процесів просторового розвитку України. ; Problem setting. Spatial development of Ukraine today is characterized by the presence of serious problems and negative trends, including inequalities of socio-economic development of some regions and settlements, inconsistency of social, economic, urban and environmental aspects of their development.State and local governments solve these problems by developing and implementing spatial development strategies. However, very few of such strategies met the real challenges and needs of local communities, were implemented or integrated.Recent research and publications analysis. Such Ukrainian scientists as O. Berdanova, B. Bezzubko, V. Vakulenko, G. Vasylchenko, Z. Gerasymchuk, O. Kary, V. Mamonova, O. Karlova, I. Parasyuk, A. Tkachuk and some others should be noted among the researchers of strategic planning and territorial development. Some national scientists devoted their research to relevant aspects of project management in territorial development, such as O. Amosha, V. Babayev, O. Bezugly, Z. Varnaliy, S. Vovkanych, S. Ghazaryan, A. Galchynsky, V. Geets, Z. Gerasymchuk, B. Danylyshyn, M. Dolishniy, T. Zayats, O. Kavtysh, I. Katsai, G. Litosh, O. Medvedeva, V. Molokanova, O. Novikova, O. Pidkuyko, S. Pisarenko, V. Rach, O. Rossoshanska, V. Seminozhenko, S. Chernov and some others.A number of methodological documents for spatial development planning have also been developed as part of EuropeAid technical assistance programs and projects.Highlighting previously unsettled parts of the general problem. Previous research has paid almost no attention to the identification of specific entities that are currently involved in the spatial development of Ukraine. The lack of clearly defined development "recipients" deprives the developed strategic documents of any specific vector of their implementation. This greatly complicates the functioning of the spatial development system in our country and reduces its efficiency. Therefore, the aim of the study is to propose a method of spatial development entities analysis in order to identify the actors who now provide implementation of measures in the field of spatial development in Ukraine.Paper main body. According to the proposed method, the first stage of the spatial development entities analysis is the establishment of landowners as potential assets users for the implementation of development measures. The next analyzed group of participants includes the subjects of urban planning, namely – customers of buildings construction and reconstruction, which are contained in the Unified Register of documents certifying the commissioning of completed facilities. The third group of spatial development entities studied includes investors who provide financing for spatial development activities. Statistical data on capital investments by sources of financing were obtained from the State Statistics Service of Ukraine.Certain spatial development entities are clearly divided into the public or private sphere, as project management approaches and methods in these areas have traditionally differed significantly. According to the developed method, the analysis of current entities in Ukrainian spatial development was carried out.Conclusions of the research and prospects for further studies. Obtained results of the analysis allow us to establish the representatives of the private sector as the main players in the spatial development in Ukraine. They own almost three quarters of Ukraine's land. They are the most active participants in urban development, and they are the ones who provide more than 87% of capital investments with their own funds. That is, spatial development must be strategically attractive primarily for the private sector. Therefore, a topical area for further research may be the search of mechanisms for reconciling the strategic priorities established by the authorities in spatial development strategies with the strategic priorities of private structures as the main actors in spatial development.
