This volume sheds light upon the omnipresent discussion of `crisis' in our times by returning to the thought of the two philosophers upon which much of this talk is consciously (or unconsciously) based, namely, Edmund Husserl and Martin Heidegger. By tracing the narrative of the `crisis' from Husserl's early treatment of arithmetic and logic through to Heidegger's meditations on the essence of technology, the author not only proposes a unified reading of both Husserl's and Heidegger's work, but points to important elements of the often underplayed continuity between these phenomenologists. At the same time, the concept of `crisis' also illustrates the difference between Husserl and Heidegger. Though both define the crisis as one of `forgetting', and both view this `forgetting' as a matter of philosophical responsibility, essential divergence emerges in their interpretation of this phenomenon. Three questions uncover these points of convergence and divergence. First, does not the `forgetfulness' reveal itself as a type of felix culpa, a necessary decay that now reveals itself in a positive light, indeed, as the precondition of history itself? Second, what is presupposed when the subjects is held responsible for forgetting? Third, what are the political consequences of such `crisis'-philosophy? This last question allows access not only to hidden political aspects of Husserl's thought, but opens a further perspective for considering Heidegger's overt political activities. Husserl, Heidegger and the Crisis of Philosophical Responsibility reveals the presuppositions about history, the subject, and the subject's relationship to a community that lie at the heart of any `crisis-thinking'. While demonstrating in scholarly fashion that the notion of `crisis' forms a hermeneutical key to the work of both Husserl and Heidegger, this work also grapples with questions of considerable contemporary significance: for what is philosophy `responsible' in this age of the crisis of reason, and in a broader sense, what does it mean to be `responsible' for that which we do not fully control? The author's suggestion of a `non-calculative' philosophical responsibility moves away from any notion of philosophical `crisis-management', while still maintaining that philosophy can have practical effects and that certain elements of the Husserlian plea for philosophical responsibility retain their value

"The aim of this treatise has been the construction of a true system of political philosophy, the determination of the ultimate nature of the State and the grounds upon which its authority may be justified. Philosophy has been defined as a criticism of categories, and thus, in the present work, the task has been to subject the principal terms and concepts of political science to as careful an examination, and as rigid a definition, as is possible. Beyond all previous periods, the present century has been prolific in the creation of new and complex political conditions. With the appearance of the modern constitutional State with its functions and organization reduced to definite written statement, with the formation of the greatest variety of federal unions between States formerly independent, with the rise of international relations into technical definiteness, with the clearer distinction between public and private rights, between moral and civic obligations, -with all these new phases of political life, problems in theory have arisen, which require for their solution the keenest of philosophical analysis, and the highest degree of accuracy in the application of the terms used. It is, therefore, with the greatest diffidence that the present work is offered as an attempt to afford some slight assistance in this direction. By no one better than by the author, is it appreciated that deficiencies may appear, and that his work will be subject to criticism from many sides. From the nature of the case, this must be so, where, as in the following pages, positions have been assumed that vary so widely from those held by other writers. Lying, as this inquiry does, within the field of pure political speculation, the introduction of historical or descriptive matter has not been necessary, except for purposes of explanation and illustration. Aus der Einleitung: In den letzten Jahren sind die politische Bedeutung des Öko-Landbaus und die Nachfrage nach Bio-Produkten in Deutschland deutlich gestiegen. 2001 wurde im Zuge der BSE-Krise unter der damaligen Bundesverbraucherministerin Renate Künast die Agrarwende beschlossen. Ziel der Agrarwende ist es, den Anteil ökologisch bewirtschafteter Fläche bis 2010 von damals 3 % auf 20 % zu steigern. Damit einher ging die Förderung der ökologischen Landwirtschaft. Die staatliche Förderung führte zu größeren Anbaumengen, einer Preissenkung und einer Ausweitung von Distribution und Sortiment von Bio-Lebensmitteln. In diesem Zusammenhang wurde auch das staatliche Bio-Siegel eingeführt. Mit dieser einheitlichen Kennzeichnung für Bio-Lebensmittel wurde die Zeichenvielfalt verringert und die Transparenz am Markt für Bio-Produkte erhöht, um so deren Absatz zu stimulieren. Das Ergebnis ist, dass der deutsche Bio-Markt boomt. Deutschland hat sich zum größten Bio-Markt in Europa entwickelt. Aus diesem Grund ist die Betrachtung des deutschen Marktes sehr interessant und wurde daher auch für diese Arbeit gewählt. Dennoch ist der Marktanteil von Bio-Lebensmitteln noch von den politischen Zielen entfernt und das Nachfragepotenzial für Bio-Produkte nicht ausgeschöpft. Die politischen und rechtlichen Rahmenbedingungen für eine Ausweitung des Bio-Marktes sind gegeben. Auch von der Nachfragerseite erhalten Bio-Lebensmittel einen immer stärkeren Zuspruch und die Bedeutung von Seiten der Konsumenten nimmt stetig zu. Doch trotz dieser Entwicklungen handelt es sich beim deutschen Markt für Bio-Lebensmittel um einen Nischenmarkt. Daher hat diese Arbeit das Ziel zu untersuchen, wie eine weitere Ausweitung des Absatzes von Bio-Lebensmitteln in Deutschland durch das Marketing möglich ist. Genauer gesagt verfolgt diese Arbeit das Ziel zu zeigen, wie es mit Unterstützung des Marketings möglich ist, den Sprung aus der Öko-Nische zu schaffen, d.h. den Marktanteil von Bio-Lebensmitteln auf mindestens 5 % zu steigern. Dabei legt diese Arbeit den Schwerpunkt darauf, die Ausweitung des Absatzes mittels Überwindung der Kaufbarrieren zu erzielen. Daher setzt das Marketing hier gezielt bei den Gründen an, die zum Nichtkauf von Bio-Lebensmitteln führen und damit eine Erhöhung des Absatzes von Bio-Lebensmitteln verhindern. Der Auseinandersetzung mit dem Thema 'Betrachtung des Marktes für Bio-Lebensmittel in Deutschland unter Berücksichtigung der besonderen Kaufbarrieren und den Konsequenzen für das Marketing' wird zunächst Kapitel 2 vorangestellt, das sich mit den theoretischen Grundlagen dieser Arbeit beschäftigt. Dabei erfolgt zunächst eine theoretische Auseinandersetzung mit dem Qualitätsbegriff. Diese Begriffsbestimmung ist erforderlich, da sich Bio-Lebensmittel vom Vergleichsangebot auf dem Markt durch ihre besondere Qualität differenzieren. Nachdem die Bio-Lebensmittel anhand des Kriteriums Anbauverfahren abgegrenzt wurden, erfolgt die Anwendung des Qualitätsbegriffs auf die Bio-Lebensmittel. Hier wird gezeigt werden, dass sich die besondere Qualität von Bio-Lebensmitteln aus ihren ökologischen Eigenschaften ergibt und dass diese ökologische Qualität einen Zusatznutzen darstellt. Da der Lebensmitteleinzelhandel durch stagnierende Umsätze geprägt ist, ist er auf der Suche nach neuen ertragsreichen Geschäftsfeldern. Dabei sind Lebensmittel mit Zusatznutzen von besonderer Bedeutung, wodurch die Thematik dieser Arbeit an Relevanz gewinnt. Um einen gezielten Einsatz des Marketinginstrumentariums planen zu können, ist zunächst eine Betrachtung des Marktes für Bio-Lebensmittel in Deutschland erforderlich. Nur wenn die Gegebenheiten des Marktes bekannt sind, ist es möglich die Marketinginstrumentarien optimal miteinander zu kombinieren, um so auf die Bedingungen des Marktes reagieren zu können. Daher werden in Kapitel 3 die Marktbedingungen vorgestellt, die für die weiteren Ausführungen der Arbeit wichtig sind. Zunächst werden kurz die rechtlichen Rahmenbedingungen für Bio-Lebensmittel nach der EG-Öko-Verordnung aufgezeigt. Dadurch wird an einem konkreten Beispiel gezeigt, welchen Rahmen der Gesetzgeber für die Ausweitung des Absatzes von Bio-Lebensmitteln geschaffen hat. Vor allem wird in diesem Kapitel eine einheitliche Definition für Bio-Lebensmittel gegeben. Im Anschluss werden die Absatzkanäle für die Lebensmittel aus ökologischer Landwirtschaft vorgestellt, weil sie für den Bio-Lebensmittelmarkt charakteristisch sind. Dieses Kapitel wird herausstellen, dass ein Wandel von den traditionellen Vertriebswegen hin zu neuen Absatzkanälen zu beobachten ist. Diese neuen Absatzkanäle bringen eine erhebliche Dynamik in den Bio-Markt. Die Wettbewerbsdynamik der Branche für Bio-Lebensmittel wird an der Branchenstrukturanalyse nach Porter aufgezeigt werden. Dabei legt das Kapitel über die Wettbewerbskräfte der Bio-Branche den Schwerpunkt auf den Handel als Gatekeeper und die daraus resultierenden Folgen. Abgeschlossen wird die Marktbetrachtung mit einer Charakterisierung der Bio-Käufer und ihrer Kaufmotive. Die Analyse der Bio-Käufer wird zeigen, welche Zielgruppe das größte Potenzial für die Ausweitung des Absatzes von Bio-Lebensmitteln hat und aus welchen Gründen sie Bio-Lebensmittel kauft. Es ist wichtig die Gründe für den Kauf bzw. die Bedürfnisse der Konsumenten zu kennen, um diese mittels gezielter Marketingmaßnahmen für die Überwindung der Kaufbarrieren nutzen zu können. Im Anschluss an die Marktbetrachtung werden im Kapitel 4 die besonderen Kaufbarrieren bei Bio-Lebensmitteln dargestellt. Dabei wird gezeigt werden, dass das größte Hemmnis für den Absatz von Bio-Lebensmitteln die preis- und informationsbedingten Kaufbarrieren sind. Die informationsbedingten Barrieren ergeben sich aufgrund von Informationsasymmetrie, die insbesondere auf dem Mark für Bio-Lebensmittel herrscht. Diese Informationsasymmetrie ist ursächlich für die Qualitätsunsicherheit der Konsumenten hinsichtlich der ökologischen Qualität von Bio-Lebensmitteln und damit einher geht ein erhöhtes Opportunismusrisiko. Es wird gezeigt werden, dass die Konsumenten aufgrund der Informationsasymmetrie Informationsnachteile haben, aus denen sich ein Wissensdefizit der Verbraucher ergeben kann und dass die Informationsasymmetrie ursächlich für die geringe Transparenz auf dem Markt für Bio-Lebensmittel ist. Nachdem die Zusammenhänge der Kaufbarrieren verdeutlicht wurden, werden in Kapitel 5 die Konsequenzen für das Marketing abgeleitet. In diesem Kapitel werden die Inhalte der vorigen Kapitel zusammengeführt. Juni 1991 über den ökologischen Landbau/die biologische Landwirtschaft und die entsprechende Kennzeichnung der landwirtschaftlichen Erzeugnisse und Lebensmittel' (kurz: EG-Öko-Verordnung). Die EG-Öko-Verordnung bestimmt EU-einheitliche Mindestanforderungen für die Erzeugung, Verarbeitung, Kennzeichnung und Kontrolle von Rohstoffen und Lebensmitteln. Der Anwendungsbereich der Verordnung umfasst pflanzliche und tierische Lebensmittel (siehe Art. 1 EG-Öko-VO). Ziel ist der Schutz der Konsumenten vor Täuschungsversuchen und der Anbieter von Bio-Produkten vor unlauterem Wettbewerb. Darüber hinaus ist die EG-Öko-Verordnung ein Instrument zur Sicherung von Qualitätsstandards. Bio-Lebensmittel unterscheiden sich durch ihre ökologische Qualität, die sich aufgrund ihrer Erzeugung ergibt. Daher wurden die Grundregeln für die ökologische Landwirtschaft bereits in Kapitel 2.2.1.1 dargestellt. Viele Produkte werden nicht als Rohstoffe vermarktet, sondern sind weiterverarbeitet. So liegen zwischen Getreide und Brot weitere Verarbeitungsstufen und Zutaten. Die Verarbeitung von Bio-Lebensmitteln ist im Anhang VI der Verordnung geregelt. So sind für Bio-Lebensmittel im Vergleich zu konventionellen Produkten nur wenige Zusatzstoffe zugelassen. Geschmacksverstärker, Süßstoffe, synthetische Aromen und Stabilisatoren sowie künstliche Farb- und Konservierungsstoffe sind für Bio-Waren nicht zulässig. Um den Käufern die Vermarktung von Bio-Lebensmitteln transparenter zu machen, schafft die EG-Öko-Verordnung Richtlinien für die Kennzeichnung von Bio-Produkten. So sind z.B. die Begriffe 'Öko' und 'Bio' explizit geschützt. Diese Bezeichnungen geben einen sicheren Hinweis auf Methoden des ökologischen Landbaus. Dies gilt für alle Mitgliedsländer der europäischen Gemeinschaft. Der Gesetzgeber hat weitere Orientierungshilfen für die Konsumenten festgelegt. So muss auf der Verpackung die EU-Kontrollstelle oder deren Code (z.B. DE-000-Öko-Kontrollstelle: DE = Länderkürzel Deutschland; 000 = Nummer der jeweiligen Kontrollbehörde) stehen. Die EG-Kontrollnummer garantiert die Herkunft aus ökologischer Landwirtschaft. Außerdem gibt sie dem Verbraucher Auskunft über die Herkunft des Produkts und die durchgeführte Kontrolle. Hierbei handelt es sich auch um eine Signalling-Maßnahme, die das Sicherheitsbedürfnis des Konsumenten befriedigen soll. In Deutschland gibt es eine Vielzahl an staatlichen, verbands- und unternehmenseigenen Kennzeichnungen für ökologische Produkte. Um den Such- und Informationsaufwand der Bio-Käufer zu reduzieren und um das Vertrauen der Verbraucher in Bio-Produkte zu stärken, wurde 2001 im Zuge der Neuausrichtung der Agrarpolitik das staatliche Bio-Siegel eingeführt. Vor der Einführung des Bio-Siegels war es für den Konsumenten schwer, Bio-Ware von Nicht-Bio-Ware zu unterscheiden. Dadurch waren die Konsumenten stärker verunsichert und die Qualitätsunsicherheit bezüglich der Bio-Lebensmittel stieg. Folglich stellt das Bio-Siegel eine Verbesserung der Verbraucherinformation dar. Das Bio-Siegel garantiert, dass Produkte, die dieses Siegel tragen, nach den Standards der EG-Öko-Verordnung produziert wurden. Es ist ein wesentliches und wichtiges Signalling-Instrument, das den Kunden hilft, Öko-Produkte von ihren Substituten zu unterscheiden. Weiter sorgt die EG-Öko-Verordnung für eine einheitliche Definition des Begriffs 'Bio'. Danach gelten Produkte als Bio-Lebensmittel, wenn sie selbst oder mindestens 95 % ihrer Inhaltsstoffe aus ökologischem Anbau stammen (siehe Art. 5, Abs. 3a EG-Öko-VO). Lebensmittel deren Zutaten einen Bio-Anteil zwischen 70 % und 95 % dürfen auch noch die Begriffe 'Öko' und 'Bio' verwenden. Diese Zutaten müssen allerdings in der Zutatenliste hervorgehoben werden. Um einen lauteren Wettbewerb zwischen den Anbietern ökologisch erzeugter Lebensmittel sicherzustellen und um den Verbraucherschutz zu stärken, sind in der EG-Öko-Verordnung auch Kontrollvorschriften erlassen worden. Ziel der Kontrolle ist es zu überprüfen, dass die Erzeugungsvorschriften eingehalten werden. Daher findet eine Überwachung auf allen Stufen der Produktion und über alle Vermarktungsstufen statt. Das Kontrollverfahren unterliegt den Mitgliedsstaaten. Sie bestimmen hierfür eine oder mehrere Kontrollbehörden und/oder lassen die Kontrollen von zugelassenen privaten Kontrollstellen durchführen. In Deutschland müssen sich die kontrollpflichtigen Unternehmen vertraglich an eine der staatlich zugelassenen Kontrollstellen binden. Danach wird mindestens einmal jährlich kontrolliert. Zusätzlich gibt es Stichprobenkontrollen und es kann zu Verdachtskontrollen kommen. Im Rahmen der durchgeführten Kontrollen werden die Bio-Waren regelmäßig auf Rückstände (z.B. Pestizide oder Nitrat in Bio-Lebensmitteln) untersucht. Bei Verstößen gegen die Vorschriften der EG-Öko-Verordnung (z.B. bei Verwendung unzulässiger Mittel) dürfen die Lebensmittel nicht mehr als Bio-Produkte vermarktet werden. Geahndet werden diese Verstöße je nach Schwere mit Geldbußen oder Freiheitsstrafen. So kann es bei einem vorsätzlichen Betrug, wenn bspw. konventionelle Lebensmittel als 'Bio' verkauft werden, zu einer mehrjährigen Gefängnisstrafe kommen. Doch trotz der umfassenden Kontrollen sei darauf hingewiesen, dass auch die Bio-Kontrolle Schwachstellen hat. Es gibt keine 100%ige Sicherheit. Im Vergleich zu konventionellen Produkten sind Bio-Lebensmittel jedoch die strenger kontrollierten Produkte. Absatzkanäle für Bio-Lebensmittel: Charakteristisch für den Bio-Lebensmittelmarkt in Deutschland sind die Absatzkanäle, d.h. die Wege, auf denen die Produkte vom Hersteller zum Verbraucher gelangen. Dabei werden die Bio-Produkte traditionell über den Facheinzelhandel und den Direktverkauf distribuiert. Ergänzt wird dieser traditionelle Absatzkanal durch den neueren Vertriebsweg des Bio-Supermarktes. Zunehmend ist die Bio-Vermarktung über den konventionellen Lebensmitteleinzelhandel von Bedeutung. Doch noch immer vermarkten die alternativen bzw. traditionellen Vermarktungswege (Fachgeschäfte, Wochenmärkte und der Ab-Hof-Verkauf) die meisten Bio-Lebensmittel, gemessen am Gesamt-Bio-Absatz. Zusammenfassend kann gesagt werden, dass die Distribution von Bio-Lebensmitteln hauptsächlich über drei Absatzkanäle erfolgt: den Fachhandel, die Direktvermarktung und den konventionellen Lebensmitteleinzelhandel. Für die weiteren Ausführungen dieser Arbeit sind vor allem der Fachhandel und insbesondere der konventionelle Lebensmitteleinzelhandel von Bedeutung. Aus diesem Grund soll hier exemplarisch für den Fachhandel der Naturkostladen vorgestellt werden sowie der konventionelle Lebensmitteleinzelhandel. Die Ausführungen zu den weiteren Absatzkanälen sind im Anhang dargestellt. Der Fachhandel stellt für die Kernkundschaft von Bio-Lebensmitteln den wichtigsten Distributionskanal dar. Zu den klassischen Verkaufsstätten gehören Naturkostfachgeschäfte bzw. Bioläden, Reformhäuser und der Bio-Supermarkt. Rund ein Drittel aller Bio-Lebensmittel werden über diesen Vertriebsweg abgesetzt. Naturkostläden sind neben der Direktvermarktung die ältesten und traditionellsten Verkaufsstätten für Bio-Lebensmittel. Das von ihnen formulierte Ziel lautet, qualitativ bessere und gesündere Lebensmittel als der konventionelle Handel und ein breiteres Sortiment als die Reformhäuser anzubieten. Ihr Sortiment besteht zu fast 100 % aus Bio-Lebensmitteln, Naturkosmetik und umweltverträglichen Naturwaren. Gerade die Produkte der Anbauverbände (z.B. Demeter, Bioland) werden über diesen Weg verkauft. Infolge des steigenden Interesses des konventionellen Lebensmitteleinzelhandels steht der klassische Naturkostfachhandel jedoch zunehmend unter Wettbewerbsdruck. Während die großen Handelsunternehmen Rationalisierungsmaßnahmen realisieren können und damit die bessere Kostenstruktur haben, ist das den eher kleinen und mittelständischen Betrieben des Naturkostfachhandels nicht möglich. Dementsprechend kann der konventionelle Handel die Bio-Produkte preisgünstiger anbieten und ist dennoch gewinnbringend. Wie in Kapitel 4.1 Preisbedingte Kaufbarrieren gezeigt werden wird, ist der Preis das zentrale Hindernis für die Ausweitung der Bio-Lebensmittel. Folglich entspricht das preisgünstigere Angebot eher der Nachfrage und der konventionelle Lebensmitteleinzelhandel kann hier einen Wettbewerbsvorteil erzielen. Als Antwort auf diese Situation versucht der Naturkostfachhandel sich zunehmend über Bio-Feinkost zu profilieren und bietet ein breites Bio-Gourmet Sortiment an. Auch unterscheidet sich der Naturkostfachhandel von seiner Konkurrenz mit großer Marktmacht durch seine Serviceorientierung und sein geschultes Personal, welches Kunden individuell berät. Damit bietet der Naturkostfachhandel seinen Käufern spezifische Vorteile gegenüber den Konkurrenzanbietern. Auch wenn der Naturkostfachhandel zunehmend unter Druck steht, wird er seine wichtige Wettbewerbsrolle nicht verlieren, da hier hauptsächlich die Bio-Intensivkäufer einkaufen, auf die der größte Anteil des Bio-Gesamtumsatzes entfällt.

Tritt die während des Laufes einer Rechtsmittelfrist beantragte und beschlossene Aussetzung des Verfahrens auch dann in Wirksamkeit, wenn der Aussetzungsbeschlvß den Parteien erst nach Ablauf der Rechtsmittelfrist zugestellt ist? -- 10. Kann der Aktionär einen vertraglichen oder außervertraglichen Schadensersatzanspruch gegen die Aktiengesellschaft darauf gründen, daß er infolge eines bewußt rechtswidrigen oder eines gegen Bertragspflichten verstoßenden Verhaltens von Mitgliedern des Vorstandes der Gesellschaft seine Aktien zu veräußern unterlassen und weitere Aktien der Gesellschaft erworben habe? -- 11. 1.
