The purpose of this work is to define the concept of functions of the state power constitutional mechanism through the study of doctrinal positions of function in various branches of social sciences. Methodology for the functions' study of the state power constitutional mechanism consists of the methods of cognition, discovered and developed by philosophy, history, sociology, theory of law and state, specialized legal sciences and approved by legal practice. Thus, the role of the historical method in the analysis of the functions of the constitutional mechanism of state power, in addition to explaining the nature of origin and development, is to ensure a systematic study of the evolution of this category. The semantic method was used to clarify the meaning of the term "function", its scientific and practical meaning, the possibility of using it in constitutional law to refer to such legal categories as "constitutional mechanism of state power". The comparative method was applied to reveal the general in such terms as "functions", "goals" and "tasks". The results of the study show that the function is a kind of "a pattern", "a standard", "an ideal model" of the system's work, in particular, of the constitutional mechanism of state power, and therefore, it must be, on the one hand, differentiated from the goals and tasks that face the system, and on the other hand – from the real, actual activity of its institutions (competences). When determining the functions of the constitutional mechanism of state power, it must be assumed that, firstly, the functions are the directions of influence of a certain socially significant phenomenon or circumstance on certain legal relations, and secondly, the functions are the activity of certain subjects of the constitutional mechanism of state power within the limits of the powers specified in the Constitution and laws; thirdly, functions reflect the essence of the phenomenon, its purpose and patterns of development. The theory of functions of the constitutional mechanism of state power should proceed from the social purpose of the state, its tasks and goals, the legislation of Ukraine, as well as the experience of practical activity of the state apparatus and the achievement of scientific opinion in the field of constitutional law and a number of theoretical and applied legal sciences. Actually the system of functions of the state determines the need to study the functions of the constitutional mechanism of state power, but if the functions of the state are the directions of influence on public relations, then the functions of the constitutional mechanism of state power are the directions of the state functions within the competence of individual institutions that make up the structure of the constitutional mechanism of the state power. On the basis of this research, the author comes to the conclusion that the functions of the constitutional mechanism of state power should be defined as the directions of activity of the subjects of the constitutional mechanism of state power within the competence defined in the Constitution and laws aimed at achieving the goals and tasks of the state. ; Метою даної роботи є визначення поняття функцій конституційного механізму державної влади через дослідження доктринальних позицій функції у різних галузях суспільних наук. Методологію дослідження функцій конституційного механізму державної влади складають методи пізнання, виявлені та розроблені філософією, історією, соціологією, теорією права і держави, галузевими юридичними науками та апробовані юридичною практикою. Так, роль історичного методу у дослідженні функцій конституційного механізму державної влади, окрім з'ясування природи виникнення і розвитку, полягає у забезпеченні систематичного вивчення еволюції даної категорії. Семантичний метод було застосовано для з'ясування змісту терміну «функція», її наукового та практичного значення, можливості застосування в конституційному праві для позначення таких правових категорій як «конституційний механізм державної влади». Метод порівняльного аналізу застосовувався для розкриття загального в таких поняттях як «функції», «цілі» та «завдання». Результати дослідження показують, що функцією є своєрідний «взірець», «еталон», «ідеальна модель» роботи системи, зокрема конституційного механізму державної влади, а отже, її необхідно, з одного боку, відрізняти від цілей і завдань, які постають перед системою, а з іншого – від реальної, фактичної діяльності її інститутів (компетенції). При визначенні функцій конституційного механізму державної влади слід виходити з того, що, по-перше, функції – це напрями впливу певного соціально значущого явища чи обставини на певні правовідносини, по-друге, функції – це діяльність окремих суб'єктів конституційного механізму державної влади в межах повноважень, визначених у Конституції та законах; по-третє, функції відображають сутність явища, його призначення та закономірності розвитку. Теорія функцій конституційного механізму державної влади має виходити з соціального призначення держави, її завдань та цілей, законодавства України, а також враховувати досвід практичної діяльності державного апарату та досягнення наукової думки у галузі конституційного права та низки теоретичних та прикладних юридичних наук. Саме система функцій держави детермінує необхідність дослідження функцій конституційного механізму державної влади, але якщо функції держави є напрямами впливу на суспільні відносини, то функції конституційного механізму державної влади є фактично напрямами реалізації функцій держави в межах компетенції окремих інститутів, що складають структуру конституційного механізму державної влади. На підставі даного дослідження, автор доходить до висновків, що функції конституційного механізму державної влади визначати як напрями діяльності суб'єктів конституційного механізму державної влади в межах компетенції визначеної в Конституції та законах, що спрямовані на досягнення цілей і завдань держави

The subject of research. The issue of reliability (unreliability) of information (data) included in the Unified State Register of Legal Entities has increased after the amendments made to the Russian Civil Code in 2013 and to the Russian legislation on state registration of legal entities in 2015. The legislation, introducing the principle of public reliability of information included in the Unified State Register of Legal Entities does not clearly define what is meant by such reliability. Accordingly, the question arises about what is meant by "unreliability" of information. Although legal norms contain the concept of "error"; the legislation does not contain a single legal regime of "error". This is expressed in the presence of several independent cases described in the legislation, including, among other things, an independent procedure for correcting an error. It is also not clear how the presence of an "error" correlates with the requirements for the reliability of the data of the Unified State Register of Legal Entities. The author shows the evolution of the concepts of "error" and "technical error" in the legislation on state registration of legal entities, as well as ways to eliminate it for the first time in the Russian doctrine.The purpose of the article is to: (a) analyze the current regulation and qualify various cases of "errors" in the information included in the Unified State Register of Legal Entities; (b) specify the objectives of regulation in each identified case of "errors"; (c) identify the main contradictions in the regulation; (d) form a new model of the reliability of the information included in the Unified State Register of Legal Entities and specific legal decisions based on the goals of the legislator to "whitewash" the Russian economy, strengthen the principle of good faith, and ensure the certainty of legal norms. The scientific hypothesis is that the "error" in the information included in the Unified State Register of Legal Entities, whatever its cause, is a special case of unreliability of information. Accordingly, all cases of "error" should be settled within the framework of the general model of reliability of information included in the Unified State Register of Legal Entities. The current regulation does not provide real public reliability of the information; in fact, such public reliability today is nothing more than an illusion. Approaches to determining the reliability (unreliability) of information included in the Unified State Register of Legal Entities do not provide such reliability.Description of research methods and methodology. The research is based on a systematic and teleological interpretation of normative material (legal norms, explanations of a normative nature, judicial legal positions). Information about the main scientific results. Conclusions. The conducted research fully confirmed the correctness of the proposed scientific hypothesis. Systematic proposals for changing existing approaches to regulation and specific legal solutions are formulated. Conclusions. It is noted that the current regulation regarding the criteria for the reliability/unreliability of information (data) of the Unified State Register of Legal Entities is confusing and creates uncertainty in the legal regulation. The necessity of changing the norms of the Civil Code of the Russian Federation and other federal laws, the abolition of the most odious explanations of a regulatory nature, the foundations of a new regulatory model and proposals for reforming the existing regulatory framework are formulated. ; В статье впервые в отечественной доктрине показана эволюция понятий «ошибка» и «техническая ошибка» в законодательстве о государственной регистрации юридических лиц, а также способы их устранения. Цель статьи состоит в том, чтобы: а) провести анализ текущего регулирования и квалифицировать различные случаи «ошибок» в сведениях, включенных в ЕГРЮЛ; б) указать цели регулирования в каждом выявленном случае «ошибки»; в) обнаружить основные противоречия в регулировании; г) сформировать новую модель достоверности сведений, включенных в ЕГРЮЛ, а также конкретные правовые решения, учитывающие цели законодателя по «обелению» российской экономики, усилению действия принципа добросовестности, и обеспечивающие определенности правовых норм. Основная научная гипотеза автора состоит в том, что «ошибка» в сведениях, включенных в ЕГРЮЛ, чтобы ни было ее причиной, – это частный случай недостоверности сведений. Соответственно, все случаи «ошибки» должны быть урегулированы в рамах общей модели достоверности сведений, включенных в ЕГРЮЛ. Действующее регулирование не обеспечивает реальной публичной достоверности сведений, включенных в ЕГРЮЛ, которая остается, по существу не более чем иллюзией. Подходы к определению достоверности (недостоверности) сведений, включенных в ЕГРЮЛ, фактически ее не обеспечивают. Отмечается, что законодательство, вводя принцип публичной достоверности сведений, включенных в ЕГРЮЛ, ясно не определяет, что понимается под такой достоверностью. Соответственно, не ясно, какие явления охватываются понятием «недостоверность» сведений. Правовые нормы содержат понятие «ошибка», но единого правового режима «ошибки» законодательство не предусматривает. Законодательство описывает несколько самостоятельных примеров ошибок с отдельным порядком исправления каждой из них. Не ясно, как наличие «ошибки» соотносится с требованиями о достоверности сведений ЕГРЮЛ. Констатируется, что действующее регулирование в части критериев достоверности (недостоверности) сведений (данных) ЕГРЮЛ является запутанным и создает неопределенность в правоприменении. Отмечается необходимость изменения норм ГК РФ и иных федеральных законов, отмены наиболее «одиозных» разъяснений нормативного характера (например, о так называемых «массовых» адресах»); сформулированы предложения по реформированию существующего нормативной регламентации и определены основы новой модели регулирования.

Lorsqu'il est question de violence politique, la manière dont les femmes sont représentées trahit très souvent des représentations genrées problématiques, car essentialistes. L'idée que les femmes, en raison de leurs capacités reproductives, sont naturellement opposées à la violence et intrinsèquement pacifiques a ainsi longtemps prévalu. À la différence des hommes pour qui le recours à la violence dans un objectif politique a largement été accepté comme rationnel, ce n'est pas le cas pour les femmes, qui voient leurs actions violentes dépolitisées. Cette dépolitisation des actions passe alors soit par une privatisation du domaine d'action (de la sphère publique à la sphère privée), soit par une déresponsabilisation de l'auteure de l'action (pathologisation de la personnalité et donc des causes). Encore aujourd'hui, cette justification biologisante persiste, consciemment ou inconsciemment, tendant non seulement à favoriser une invisibilisation de la dimension politique de l'action des femmes, mais plus spécifiquement une invisibilisation de la violence politique féminine. Celle-ci se caractérisant par une assimilation presque automatique des femmes à la catégorie de " victimes ". C'est particulièrement le cas dans les cas de conflits armés où cette invisibilisation est renforcée par ce qui est perçu comme une participation très minoritaire des femmes. À partir des cas d'étude des conflits nord-irlandais (1968-1998) et palestinien (1967-2000), l'objectif de cette thèse est de questionner cette représentation de la participation féminine en analysant les multiples manières dont elle s'est exprimée, dans l'espace et dans le temps. Ainsi, empruntant une approche interactionniste symbolique dans une orientation interprétative de la réalité sociale, nous nous sommes intéressées à l'engagement politique féminin en période de conflit armé à travers la méthodologie des histoires de vie. Plus spécifiquement, à partir d'entretiens réalisés avec femmes ayant - directement ou indirectement - fait l'expérience du conflit, ainsi que des témoignages autobiographiques recueillis dans la littérature, nous avons analysé les processus de politisation et trajectoires féminines au cours de ces conflits. Nous l'avons fait d'une part fait à travers leur dimension spatiale, et d'autre part à travers leur dimension temporelle. Ainsi, c'est tout abord à partir des espaces de la maison et de rue, nous permettant d'interroger la traditionnelle dichotomie entre sphère privée et sphère publique, puis de l'espace de la prison, en tant qu'institution totale que nous avons appréhendé l'engagement féminin dans sa dimension spatiale. Par la suite, c'est en ayant recours au concept de disponibilités biographique et aux concepts de répertoire d'actions et d'opportunité politique que nous avons examiné l'engagement féminin dans sa dimension temporelle. Ensemble, les deux dimensions nous permettent de mettre de l'avant la capacité agentielle des femmes en période de conflit armé, celle-ci s'exprimant de manière complexe et enchevêtrée. ; When it comes to political violence, the way in which women are represented very often betrays problematic, essentialist gendered representations. The idea that women, because of their reproductive capacities, are naturally opposed to violence and inherently peaceful has long prevailed. Unlike men, for whom the use of violence for political purposes has been widely accepted as rational, women are often depoliticized in the event of violent action. This depoliticization of actions then passes either by a privatization of the field of action (from the public sphere to the private sphere), or by a disempowerment of the author of the action (pathologization of the personality and thus of the causes). Even today, this biological justification persists, consciously or unconsciously, tending not only to favor an invisibilization of the political dimension of women's action, but more specifically an invisibilization of female political violence. This is characterized by an almost automatic assimilation of women to the category of "victims." This is particularly the case in situations of armed conflict where this invisibilization is reinforced by what is perceived as a very minor participation of women. Based on the case studies of the Northern Irish (1968-1998) and Palestinian (1967-2000) conflicts, the objective of this thesis is to question this representation of female participation by analyzing the multiple ways in which it has been expressed, in space and in time. Thus, borrowing a symbolic interactionist approach in an interpretive orientation of social reality, we are interested in women's political engagement during armed conflict through the methodology of life stories. More specifically, based on interviews with women who have - directly or indirectly - experienced the conflict, as well as autobiographical testimonies collected in the literature, we have analyzed the processes of politicization and female trajectories during these conflicts. We have done so both through their spatial and temporal dimensions. Thus, it is firstly from the spaces of the house and the street, allowing us to question the traditional dichotomy between private sphere and public sphere, then from the space of the prison, as a closed institution, that we apprehended the female commitment in its spatial dimension. Then, using the notion of biographical availabilities and the concepts of repertoire of actions and political opportunity, we examined women's commitment in its temporal dimension. Together, the two dimensions allow us to put forward the agential capacity of women in times of armed conflict, which is expressed in a complex and entangled manner.

Taking into account the methodology of Ukrainian and interdisciplinary studies, the available research on the theory and practice of identification processes, the article considers the phenomenon of civilizational identity of Ukrainians, its origins, formation, and current state from the standpoint of civilizational, anthropological, and sociocultural approaches. The concept of "civilizational identity" indicates the affiliation of an individual, ethnic group, or state to a particular civilization and is interpreted as a set of symbols, ideas, feelings, and self-awareness of their belonging to the Ukrainian cultural and civilizational community, which is based on national and universal values within the space of European civilizations and interaction with them. The author analyzes theoretical and methodological foundations of civilizational identity presented in the works by A.Bergson, M.Weber, К.Wolf, S.Huntington, E.Gellner, I.Hoffmann, E.Husserl, J.Derrida, K.Eder, E.Erikson, G.Simmel, A.Camus, E.Cassier, A.Kuna, K.Levi-Strauss, G.Rickert, E.Smith, A.Toynbee, S.Freud, C.Jung, K.Jaspers, and others. He considers itsUkrainianfeatures andstructure: ethnic, national, cultural, religious, political, civic, European, and other components, shown in connection with the mentality and global nature against the background of historical progress and post-Soviet transformations, beginning from the Middle Ages, Kyivan Rus, the Renaissance, modernism and ending with postmodernism; emphasizes the historical mission of Ukrainian Cossacks as a national carrier of a new identity, tracks civilizational self-determination of the Ukrainian identity at the turn of the 19th–20th centuries, as well as the role of consciousness, social psychology, and the national idea in the civilizational transformation of identity; highlights the causes of the identity crisis and schism in the conditions of totalitarianism, its devastating consequences for the identification process of Ukrainians in general. The main focus is put on the study of the specifics of the civilizational identity formation in the conditions of independence of Ukraine; the role of its components– ethnic, religious, national, civic, and European; the contribution of T.Bevz, T.Voropaieva, M.Kozlovets, I.Kutsyi, L.Nahorna, M.Obushnyi, Yu.Pavlenko, Yu.Polishchuk, M.Popovych, O. Rafalskyi, V.Tkachenko, M.Shulha, M.Yurii, and others to the study of key aspects of the problem; the influence on the civilizational identification processes, European integration, and globalization of the modern world, Revolution of dignity, democratization of the society, interethnic relations, aggressive policy of Russia. The article highlights ways to preserve Ukrainian identity in the alien environment, the role of Ukrainians abroad in shaping civilizational identity. Significant attention is paid to the importance of Ukrainian studies as an academic synthesis of historical, philosophical, ethnological, cultural, and psychological knowledge in the elaboration of scholarly bases for building the civilizational identity and summarizing the relevant accumulated practical experience. Основне місце відведено дослідженню особливостей становлення цивілізаційної ідентичності в умовах незалежності України, ролі її складових– етнічної, релігійної, національної, громадянської та євроідентичності, розкрито внесок Т. Юрія та ін. в дослідження ключових аспектів проблеми, з'ясовано вплив на процеси цивілізаційної ідентичності, євроінтеграції та глобалізації сучасного світу, Революції гідності, демократизації суспільства, міжнаціональних відносин, агресивної політики Росії. Висвітлюються шляхи збереження української ідентичності в чужоземному середовищі, роль зарубіжного українства у формуванні цивілізаційної ідентичності. Значна увага приділена ролі українознавства як наукового синтезу історичних, філософських, етнологічних, культурологічних, психологічних знань в опрацюванні наукових засад формування цивілізаційної ідентичності та узагальненні нагромадженого практичного досвіду у цій справі. Висловлено низку пропозицій щодо подальшого дослідження проблеми, підвищення ролі держави та громадянського суспільства в активізації цивілізаційної ідентифікації українства та його перспектив.

We search for the baryon acoustic oscillations in the projected cross-correlation function binned into transverse comoving radius between the SDSS-IV DR16 eBOSS quasars and a dense photometric sample of galaxies selected from the DESI Legacy Imaging Surveys. We estimate the density of the photometric sample of galaxies in this redshift range to be about 2900 deg−2, which is deeper than the official DESI emission line galaxy selection, and the density of the spectroscopic sample is about 20 deg−2. In order to mitigate the systematics related to the use of different imaging surveys close to the detection limit, we use a neural network approach that accounts for complex dependences between the imaging attributes and the observed galaxy density. We find that we are limited by the depth of the imaging surveys that affects the density and purity of the photometric sample and its overlap in redshift with the quasar sample, which thus affects the performance of the method. When cross-correlating the photometric galaxies with quasars in the range 0.6 ≤ z ≤ 1.2, the cross-correlation function can provide better constraints on the comoving angular distance DM (6 per cent precision) compared to the constraint on the spherically averaged distance DV (9 per cent precision) obtained from the autocorrelation. Although not yet competitive, this technique will benefit from the arrival of deeper photometric data from upcoming surveys that will enable it to go beyond the current limitations we have identified in this work. © C 2021 The Author(s). ; PZ would like to thank John Helly for his help modifying TWOPCF. V.; Zhao, X.; Fan, Y.; Xin, Y. ; We present and perform a detailed analysis of multiwavelength observations of GRB 140102A, an optical bright GRB with an observed reverse shock (RS) signature. Observations of this GRB were acquired with the BOOTES-4 robotic telescope, the Fermi, and the Swift missions. Time-resolved spectroscopy of the prompt emission shows that changes to the peak energy (Ep) tracks intensity and the low-energy spectral index seems to follow the intensity for the first episode, whereas this tracking behaviour is less clear during the second episode. The fit to the afterglow light curves shows that the early optical afterglow can be described with RS emission and is consistent with the thin shell scenario of the constant ambient medium. The late time afterglow decay is also consistent with the prediction of the external forward shock model. We determine the properties of the shocks, Lorentz factor, magnetization parameters, and ambient density of GRB 140102A, and compare these parameters with another 12 GRBs, consistent with having RS produced by thin shells in an interstellar medium like medium. The value of the magnetization parameter (RB ≈ 18) indicates a moderately magnetized baryonic dominant jet composition for GRB 140102A. We also report the host galaxy photometric observations of GRB 140102A obtained with 10.4 m GTC, 3.5 m Calar Alto Astronomical Observatory, and 3.6 m Devasthal optical telescope and find the host (photo z = 2.8+0.7 −0.9) to be a high-mass, star-forming galaxy with a star formation rate of 20 ± 10 M yr−1. © 2021 The Author(s). ; RG, SBP, AA, DB, KM, and VB acknowledge BRICS grant DST/IMRCD/BRICS/PilotCall1/ProFCheap/2017(G) funded by Department of Science and Technology (DST), India, for the financial support. The article studies classifications of the models of the state-church relations, which are available in scientific sources, and carries out their critical analysis and determines features of the models of the state-church relations in Ukraine. It is established that a classification of the state-church relations should, first, uses one division criterion, second, be of scientific-methodological importance and, third, take into account the status of the state-church relations in the modern world. The research proves the majority of the classification available in sci- entific literature has the following downsides: a) they are outdated because they do not reflect the real state of re- lations in modern countries; b) they are not really useful for explaining the current changes that are taking place in the state-church relations (i.e. the classification has become methodologically irrelevant); c) they exaggerate the formal aspects and neglect the finer points of the re- lationship between the state and religious organizations; d) they do not take into account the legal rights of commu- nities of believers and mechanisms for the implementa- tion and protection of these rights. The article concludes that in the context of integration of European countries and globalization of cultures and economies of different countries, the only model of the state-church relations, which will not have a destructive impact on national cultures and, at the same time, ensure the human right to freedom of religion is the model of autonomy of the state and the church in which the church is an institution of civil society by its status. All other historical models of the state-church relations – in particular, the model of the state with the officially authorized and de facto dominant church (state church) or the model of the state with a certain traditional religion (denomination) of society, which takes pride of place among other religions – will be violating the autonomy of the state and the church in society in a greater or lesser degree, and at the same time, restrict the human to freedom of religion. It is reasoned that there are two important factors which stipulate the need to change the state-church relations in Europe and Ukraine: 1) the essence of the state as a political-territorial organization of society, as well as its role in public life, human devel- opment and population protection, has changed; 2) the church and its place in society have transformed. The evo- lution of the state and the church inevitably affects the models of relations between them. Based on the above, the author concludes that in the context of the functioning and prosperity of secular states, building democratic, constitutional and social states, the model of autonomy of the state and the church is the most considered and balanced to avoid religious-based disputes in Ukraine. ; У роботі досліджено класифікації моделей відносин держави та церкви, які пропонуються в наукових джерела, здійснено їх критичний аналіз та визначені особливості моделі відносин держави та церкви в Україні. Встановлено, що класифікація відносин держави та церкви повинна, по-перше, використовувати один критерій поділу, по-друге, мати науково-методологічне значення, та, по-третє, враховувати стан відносин держави і церкви в сучасному світі. Доведено, що більшість класифікацій, які пропонуються в науковій літературі мають наступні вади: а) є застарілими, адже не відображають реального стану відносин в сучасних державах світу; б) є малокорисними для пояснення сучасних змін, які відбуваються в стосунках між державою та церквою (тобто класифікація втратила методологічне значення); в) є такими, що перебільшують формальні аспекти і не помічає нюансів відносин держави і релігійних організацій; г) не враховують юридичні права громад віруючих та механізми реалізації і захисту цих прав. Зроблено висновок, що в умовах інтеграції країн Європи, в умовах глобалізації культур і економік різних країн, єдиною моделлю відносин держави та церкви, яка не буде мати руйнівного впливу на національні культури і, в той же час, забезпечувати право особи на свободу віросповідання, є модель автономії держави і церкви, де церква за своїм статусом є інститутом громадянського суспільства. Всі інші історичні моделі відносин держави та церкви, зокрема, модель держави з офіційно узаконеною і фактично панівною церквою (державною церквою) або модель держави з визначеною традиційною релігією (конфесією) в суспільстві, яка посідає пріоритетне становище серед інших віросповідань, будуть в більшій чи меншій мірі порушувати автономність держави і церкви у суспільстві, а разом з цим, обмежувати право особи на свободу віросповідання. Обґрунтовано, що існує два важливі чинники, які обумовлюють необхідність змін відносин держави та церкви взагалі в Європі та безпосередньо в Україні: 1) змінилась сутність держави як політико-територіальної організації суспільства, а також її роль у суспільному житті, розвитку людства та захисті населення; 2) змінилась церква та її місце і роль у суспільстві. Еволюція держави та церкви неодмінно позначається і на моделях відносин між ними. На підставі цього зроблено висновок, що в умовах функціонування і процвітання світських держав, в умовах розбудови демократичних, правових і соціальних держав, модель автономії держави і церкви є найбільш вивіреною та виваженою для уникнення в Україні конфліктів на релігійному ґрунті.

Taking into account the methodology of Ukrainian and interdisciplinary studies, the available research on the theory and practice of identification processes, the article considers the phenomenon of civilizational identity of Ukrainians, its origins, formation, and current state from the standpoint of civilizational, anthropological, and sociocultural approaches. The concept of "civilizational identity" indicates the affiliation of an individual, ethnic group, or state to a particular civilization and is interpreted as a set of symbols, ideas, feelings, and self-awareness of their belonging to the Ukrainian cultural and civilizational community, which is based on national and universal values within the space of European civilizations and interaction with them. The author analyzes theoretical and methodological foundations of civilizational identity presented in the works by A.Bergson, M.Weber, К.Wolf, S.Huntington, E.Gellner, I.Hoffmann, E.Husserl, J.Derrida, K.Eder, E.Erikson, G.Simmel, A.Camus, E.Cassier, A.Kuna, K.Levi-Strauss, G.Rickert, E.Smith, A.Toynbee, S.Freud, C.Jung, K.Jaspers, and others. He considers itsUkrainianfeatures andstructure: ethnic, national, cultural, religious, political, civic, European, and other components, shown in connection with the mentality and global nature against the background of historical progress and post-Soviet transformations, beginning from the Middle Ages, Kyivan Rus, the Renaissance, modernism and ending with postmodernism; emphasizes the historical mission of Ukrainian Cossacks as a national carrier of a new identity, tracks civilizational self-determination of the Ukrainian identity at the turn of the 19th–20th centuries, as well as the role of consciousness, social psychology, and the national idea in the civilizational transformation of identity; highlights the causes of the identity crisis and schism in the conditions of totalitarianism, its devastating consequences for the identification process of Ukrainians in general. The main focus is put on the study of the specifics of the civilizational identity formation in the conditions of independence of Ukraine; the role of its components– ethnic, religious, national, civic, and European; the contribution of T.Bevz, T.Voropaieva, M.Kozlovets, I.Kutsyi, L.Nahorna, M.Obushnyi, Yu.Pavlenko, Yu.Polishchuk, M.Popovych, O. Rafalskyi, V.Tkachenko, M.Shulha, M.Yurii, and others to the study of key aspects of the problem; the influence on the civilizational identification processes, European integration, and globalization of the modern world, Revolution of dignity, democratization of the society, interethnic relations, aggressive policy of Russia. The article highlights ways to preserve Ukrainian identity in the alien environment, the role of Ukrainians abroad in shaping civilizational identity. Significant attention is paid to the importance of Ukrainian studies as an academic synthesis of historical, philosophical, ethnological, cultural, and psychological knowledge in the elaboration of scholarly bases for building the civilizational identity and summarizing the relevant accumulated practical experience. In this article the author considers the concept of restriction of individual rights in civil law, as well as the re-lationship between the concepts of restriction and encumbrance of civil rights. First of all, the lack of a legislative definition of the concept of restriction of individual rights in civil law, as well as the ambiguity of the position of the legislator on the use of the term restriction and its place among related conceptsIn writing this work, first of all, attention was paid to the Constitution of Ukraine, which is the Basic Law, which serves as a guide that establishes the general boundaries of human and civil rights. The connection of the provisions of the Constitution with the norms of the Civil Code of Ukraine within the framework of the chosen topic was presented. Emphasis is placed on the fundamental principle according to which the national legal system is built, namely: "everything is allowed that is not expressly prohibited by law."The views of some scholars who adhere to their vision of the concepts under study are given. In addition, in this study, the relationship between the concepts of restriction and encumbrance of individual rights in civil law. In the process of writing this work, the positions of legal scholars who had relatively similar positions were given. They distinguish between the above concepts, and provide the relevant features. However, outside the scope of this study were many works of scientists who do not see a difference in these concepts.None of this was left out of the regulatory framework for the definition of the above concepts at the legislative level. In particular, it was found that in contrast to the concept of restriction of individual rights, including in civil law, the current legislation contains a definition of encumbrance. There are several acts that provide this definition. And in all cases, the definition is different.Based on the analysis of regulations, it was found that the legislator does not consistently approach the definition of encumbrance. In particular, in some cases the latter includes the encumbrancer's right to the debtor's movable property or restriction of such right, in others - prohibition or restriction of disposal and / or use of real estate, and in some cases the legislator identifies encumbrances and restrictions.According to the results of the study, the conclusions on the failure to define in national law the concept of re-strictions on the rights of persons in civil law, as well as the lack of a clear distinction between the concept of restric-tion of the right of person and encumbrance, in particular under civil law. There is a position on the need for further research on relevant topics, which will ensure clarity and clarity of the law, and promote its effective application, as well as consensus on this issue among scholars. ; У даній статті автором розглянуто поняття обмеження прав особи у цивільному праві, а також співвід-ношення понять обмеження та обтяження цивільних прав. Насамперед виявлено відсутність законодавчого визначення поняття обмеження прав особи у цивільному праві, а також неоднозначність позиції законодавця з приводу вживання терміну обмеження та його місце серед суміжних понять При написанні даної роботи, в першу чергу, увага була приділена Конституції України, яка є Основним Законом, який виступає тим орієнтиром, що встановлює загальні межі прав людини і громадянина. Було наведено зв'язок положень Конституції з нормами Цивільного кодексу України в рамках обраної теми. Ак-центовано увагу на основоположному принципі, згідно з яким побудована національна правова система, а саме: «дозволено все, що прямо не заборонено законом». Наведені погляди деяких науковців, які дотримуються свого бачення з приводу понять, які досліджу-ються. Кім цього, в рамках даного дослідження було розглянуто співвідношення понять обмеження та обтя-ження прав особи, в рамках цивільного права. У процесі написання вказаної роботи, було наведено позиції вчених-правників, які мали відносно схожі позиції. Вони розмежовують вищенаведені поняття, та наводять відповідні особливості. Однак, поза рамками вказаного дослідження залишились безліч робіт науковців, які не вбачають в наведених поняттях різниці. Кім цього не залишилось поза увагою нормативно-правове регулювання, щодо визначення вищевказаних понять на законодавчому рівні. Зокрема було встановлено, що на відміну від поняття обмеження прав осо-би, у тому числі в цивільному праві, норми чинного законодавства містять визначення поняття обтяження. Існують декілька актів, в яких наводиться вказана дефініція. І у всіх випадках, визначення відрізняється.На основі проведеного аналізу нормативно-правових актів, було встановлено, що законодавець не послі-довно підходить до визначення поняття обтяження. Зокрема в одних випадках в останнє закладається право обтяжувача на рухоме майно боржника або обмеження такого права , в інших – заборона або обмеження розпорядження та/або користування нерухомим майном, а в окремих випадках законодавець ототожнює обтяження та обмеження.За результатами проведеного дослідження, наведено висновки щодо не визначення в національному законодавстві поняття обмежень прав осіб у цивільному праві, а також відсутності чіткого розмежуван-ня поняття обмеження права особи, та обтяження прав, зокрема у рамках цивільного права. Наведено позицію, щодо необхідності подальшого дослідження відповідної тематики, що забезпечить ясність і чіткість закону, та сприятиме ефективному його застосуванню, а також консенсусу з даного питання серед науковців.

The purpose of this work is to define the concept of functions of the state power constitutional mechanism through the study of doctrinal positions of function in various branches of social sciences. Methodology for the functions' study of the state power constitutional mechanism consists of the methods of cognition, discovered and developed by philosophy, history, sociology, theory of law and state, specialized legal sciences and approved by legal practice. Thus, the role of the historical method in the analysis of the functions of the constitutional mechanism of state power, in addition to explaining the nature of origin and development, is to ensure a systematic study of the evolution of this category. The semantic method was used to clarify the meaning of the term "function", its scientific and practical meaning, the possibility of using it in constitutional law to refer to such legal categories as "constitutional mechanism of state power". The comparative method was applied to reveal the general in such terms as "functions", "goals" and "tasks". The results of the study show that the function is a kind of "a pattern", "a standard", "an ideal model" of the system's work, in particular, of the constitutional mechanism of state power, and therefore, it must be, on the one hand, differentiated from the goals and tasks that face the system, and on the other hand – from the real, actual activity of its institutions (competences). When determining the functions of the constitutional mechanism of state power, it must be assumed that, firstly, the functions are the directions of influence of a certain socially significant phenomenon or circumstance on certain legal relations, and secondly, the functions are the activity of certain subjects of the constitutional mechanism of state power within the limits of the powers specified in the Constitution and laws; thirdly, functions reflect the essence of the phenomenon, its purpose and patterns of development. The theory of functions of the constitutional mechanism of state power should proceed from the social purpose of the state, its tasks and goals, the legislation of Ukraine, as well as the experience of practical activity of the state apparatus and the achievement of scientific opinion in the field of constitutional law and a number of theoretical and applied legal sciences. Actually the system of functions of the state determines the need to study the functions of the constitutional mechanism of state power, but if the functions of the state are the directions of influence on public relations, then the functions of the constitutional mechanism of state power are the directions of the state functions within the competence of individual institutions that make up the structure of the constitutional mechanism of the state power. On the basis of this research, the author comes to the conclusion that the functions of the constitutional mechanism of state power should be defined as the directions of activity of the subjects of the constitutional mechanism of state power within the competence defined in the Constitution and laws aimed at achieving the goals and tasks of the state. ; Метою даної роботи є визначення поняття функцій конституційного механізму державної влади через дослідження доктринальних позицій функції у різних галузях суспільних наук. Методологію дослідження функцій конституційного механізму державної влади складають методи пізнання, виявлені та розроблені філософією, історією, соціологією, теорією права і держави, галузевими юридичними науками та апробовані юридичною практикою. Так, роль історичного методу у дослідженні функцій конституційного механізму державної влади, окрім з'ясування природи виникнення і розвитку, полягає у забезпеченні систематичного вивчення еволюції даної категорії. Семантичний метод було застосовано для з'ясування змісту терміну «функція», її наукового та практичного значення, можливості застосування в конституційному праві для позначення таких правових категорій як «конституційний механізм державної влади». Метод порівняльного аналізу застосовувався для розкриття загального в таких поняттях як «функції», «цілі» та «завдання». Результати дослідження показують, що функцією є своєрідний «взірець», «еталон», «ідеальна модель» роботи системи, зокрема конституційного механізму державної влади, а отже, її необхідно, з одного боку, відрізняти від цілей і завдань, які постають перед системою, а з іншого – від реальної, фактичної діяльності її інститутів (компетенції). При визначенні функцій конституційного механізму державної влади слід виходити з того, що, по-перше, функції – це напрями впливу певного соціально значущого явища чи обставини на певні правовідносини, по-друге, функції – це діяльність окремих суб'єктів конституційного механізму державної влади в межах повноважень, визначених у Конституції та законах; по-третє, функції відображають сутність явища, його призначення та закономірності розвитку. Теорія функцій конституційного механізму державної влади має виходити з соціального призначення держави, її завдань та цілей, законодавства України, а також враховувати досвід практичної діяльності державного апарату та досягнення наукової думки у галузі конституційного права та низки теоретичних та прикладних юридичних наук. Саме система функцій держави детермінує необхідність дослідження функцій конституційного механізму державної влади, але якщо функції держави є напрямами впливу на суспільні відносини, то функції конституційного механізму державної влади є фактично напрямами реалізації функцій держави в межах компетенції окремих інститутів, що складають структуру конституційного механізму державної влади. На підставі даного дослідження, автор доходить до висновків, що функції конституційного механізму державної влади визначати як напрями діяльності суб'єктів конституційного механізму державної влади в межах компетенції визначеної в Конституції та законах, що спрямовані на досягнення цілей і завдань держави

The study is devoted to the analysis of the main normative legal acts, regulating the holding of elections within the European Union, linked to the evolution of Ukrainian Constitutionalism and the integration of Ukrainian law into the European legal space. It has been proved, that the correct choice of an electoral system creates a suitable environment for the citizens to exercise one of the fundamental democratic rights, namely to elect their authorized representative who in their turn represent their interests. The article states that despite the growing role of the European Parliament, the election procedure has been only partially coordinated due to the lack of the universal election procedure for all EU members. At present some fundamental principles, regulating this procedure, are stipulated by the 1976 Election Law, however a lot of aspects are regulated by the national legal systems. The lack of universal election law for all EU members potentially deprives European elections of a real European dimension. The recent years have witnessed several attempts to reform the EU election system. However not all of them have led to the adoption of relative Directives. In particular, there are disputes regarding the transnational constituency. The supporters believe it to be the step in the right direction, while the opponents express fears that it will increase the distance between the public and its elected representatives. The author points out that the outcomes of the spring 2019 European Parliamentary elections have common features with the outcomes of Parliamentary and local elections in Ukraine. Problems, related to the European Parliament elections in 2019 and existing in Ukraine, have been identified, such as restrictions for the exercise of voting rights by persons with disabilities due to various reasons, the use of digital technologies and related cybersecurity issues in the election process, protection of personal data and so on ; Исследование посвящено анализу основных нормативно-правовых актов, регламентирующих проведение выборов в Европейском Союзе, что обусловлено проблемами практического и теоретического характера, связанных с развитием украинского конституционализма и интеграции национального правопорядка в европейское правовое пространство. Отмечено, что правильный выбор избирательной системы создает среду, в которой граждане реализуют один из основных принципов демократии – голосуют за своих демократически уполномоченных представителей, а как политические представители отстаивают их интересы. Установлено, что, несмотря на возрастающую роль Европарламента, регулирования проведения выборов в него остается согласованным только частично, поскольку нет общего избирательного процесса для всех государств-членов. Сейчас некоторые фундаментальные принципы, по которым происходит этот процесс, закреплены в Акте о выборах 1976 года, но многие аспекты регулируются национальным законодательством. Отсутствие общего, единого для всех государств-членов ЕС избирательного законодательства потенциально лишает европейские выборы действительно европейского измерения. За прошедшие годы было сделано несколько попыток реформирования избирательной системы ЕС, но не все они привели к принятию соответствующих директив. Symbolic and Ritual Practices in the Post-Soviet Urban World: Symbolic Space and Festivity in the Cities of Eastern and Southern Ukraine, 1990s–2010sThe article examines symbolic and ritual practices in five cities of southern and eastern Ukraine – Dnipro, Donetsk, Zaporizhzhia, Odesa, and Kharkiv – during the 1990s to 2010s. The author considers the ways in which urban symbolic and ritual practices (primarily expressed in such symbolic forms as municipal ceremonies and festivals) are connected with the cultural and symbolic space of cities. First and foremost, these practices represent a kind of "symbolic mediators" of urban cultural memory and participate in the preservation, broadcasting, and actualization of the cultural semantics of the city. During the 1990s to 2010s, urban symbolic and ritual practices in Ukraine were characterized by efforts to leave behind the most objectionable manifestations of the Soviet culture of festivity and create a fundamentally new festive canon. To an extent, these developments were part of the so-called "decolonization of historical memory," initiated by the central government and urban communities. Undoubtedly, they were facilitated by the ongoing socio-political transformations, particularly those connected with the Orange Revolution (2004) and Euromaidan Revolution (2013–2014), the Russian aggression against Ukraine, etc. At the same time, the transformation of the Soviet complex of symbolic and ritual practices progressed only slowly; the change of political regime did not lead to a large-scale "ceremonial revolution." Modern Ukrainian festive culture involves a combination, often quite eclectic, of at least several elements: a "new" style of festivity, generally based on borrowed "Western" cultural patterns; "traditional" forms, stressing national aspects and attempting to revive pre-Soviet cultural models; and "Soviet" forms, which preserve the Soviet festive canon, often adapted and rethought within the framework of the new urban tradition. Overall, the process of constructing a new model of urban festivity in Ukraine is far from complete; this emerging cultural complex remains fluid and capable of "turning" towards the festive traditions of different historical periods. Символічні та ритуальні практики в пострадянському міському середовищі: символічний простір і святкування в містах Східної та Південної України протягом 1990–2010-х рр.Стаття присвячена дослідженню символічних і ритуальних практик п'яти міст Південної та Східної України – Дніпра, Донецька, Запоріжжя, Одеси та Харкова – протягом 1990–2010-х рр. Відзначається, що міські символічні та ритуальні практики (передовсім, виражені у таких символічних формах, як міські урочисті церемонії та свята) особливим чином пов'язані з культурно-символічним простором міста. Насамперед, вони являють собою своєрідні «символічні медіатори» культурної пам'яті міста та беруть участь у зберіганні, трансляції та актуалізації культурних смислів міста. Протягом 1990–2010-х рр. для міських символічних і ритуальних практик в Україні були характерними спроби позбутися найбільш одіозних проявів радянської святкової культури та створити принципово новий святковий канон. Частково ці процеси відбувалися в межах так званої «деколонізації історичної пам'яті», ініціаторами якої була центральна влада та міські спільноти. Безперечно, сприяли цьому суспільно-політичні трансформації, зокрема, пов'язані з Помаранчевою революцією (2004 р.) та Єврореволюцією (2013–2014 рр.), російською збройною агресією проти України тощо. Водночас, процеси трансформації радянських символічних і ритуальних практик були помірними: зміна політичного режиму не призвела до масштабної «церемоніальної революції». Сучасна українська святкова культура передбачає поєднання, часто доволі еклектичне, щонайменше кількох складових: «нової» святкової традиції, що загалом базується на запозичених «західних» культурних зразках; «традиційної», що містить національні акценти та являє собою спробу відродження дорадянських культурних зразків; «радянської», що зберігає радянський святковий канон, часто він адаптований та переосмислений у нових міських традиціях. Загалом, маємо підстави казати про незавершеність процесу конструювання нової міської святкової культури в Україні, що характеризується невизначеністю та можливостями «повороту» до святкових традицій різних історичних епох.Praktyki symboliczne i rytualne w postsowieckim środowisku miejskim: przestrzeń symboliczna i obchody świąt w miastach wschodniej i południowej Ukrainy w latach 90. i na początku XXI w.Artykuł jest poświęcony badaniu praktyk symbolicznych i rytualnych w pięciu miastach południowej i wschodniej Ukrainy: Dnieprze, Doniecku, Zaporożu, Odessie i Charkowie, w latach 1990-2010. Symboliczne oraz rytualne praktyki miejskie (wyrażone przede wszystkim przy użyciu takich form symbolicznych jak miejskie święta, uroczystości) są szczególnie związane z kulturową i symboliczną przestrzenią miasta. Są one przede wszystkim swego rodzaju "symbolicznymi mediatorami" kulturowej pamięci miasta i uczestniczą w utrwalaniu, transmitowaniu i aktualizowaniu jego kulturowych znaczeń. W latach 90. i dwóch pierwszych dekadach XXI w. miejskie praktyki symboliczne i rytualne w Ukrainiecharakteryzowały się próbami pozbycia się najbardziej odrażających przejawów sowieckiej kultury świętowania oraz stworzenia zupełnie nowego kanonu świąt. Po części procesy te odbywały się w ramach tzw. dekolonizacji pamięci historycznej, inicjowanej przez władze centralne i społeczności miejskie. Niewątpliwie ułatwiły to przemiany społeczno-polityczne, w szczególności związane z pomarańczową rewolucją (2004) oraz Euromajdanem (2013-2014), rosyjską agresją zbrojną na Ukrainę itp. Jednocześnie procesy transformacji sowieckich praktyk symbolicznych i rytualnych były umiarkowane: zmiana ustroju politycznego nie doprowadziła do "rewolucji ceremonialnej" na dużą skalę. Współczesna ukraińska kultura świąteczna łączy, często dość eklektycznie, przynajmniej kilka elementów: "nową" tradycję świąteczną, która na ogół opiera się na zapożyczonych "zachodnich" wzorcach kulturowych; element "tradycyjny", zawierający akcenty narodowe i będący próbą ożywienia przedsowieckich wzorców kulturowych; "sowiecki", który zachowuje sowiecki kanon świąteczny, jest często adaptowany do nowych tradycji miejskich. Ogólnie rzecz biorąc, można zauważyć, że proces budowy nowej miejskiej kultury świętowania w Ukrainie nie jest ukończony i charakteryzuje się niepewnością i możliwością "zwrócenia się" do tradycji świątecznych różnych epok historycznych.

Linked Art ( https://linked.art/ ) is an emerging community of museum and information science specialists working to establish a common profile for the exchange of cultural heritage data by means of current Linked Open Data (LOD) and Application Programming Interface (API) methodologies. Building on similar principles outlined by the International Image Interoperability Framework (IIIF: https://iiif.io/ ), Linked Art is a particular implementation of the CIDOC Conceptual Reference Model (CRM) rendered in the JSON-LD syntax. Linked Art aims to strike a balance between completeness and usability, and while not all possible permutations of human knowledge are intended to be represented in the Linked Art profile, the minimum level of detail, with respect to both the data model and controlled vocabulary integration, is greater than more generalized aggregation models, such as those used for Europeana ( https://www.europeana.eu ) or the Pelagios Network ( http://commons.pelagios.org/ ). The aim of Linked Art is to achieve Linked Open Useable Data (LOUD), lowering the barriers for developers to reuse data for a variety of research contexts. Many of the member institutions of the Linked Art steering committee hail from fine arts museums, but there exists some overlap between several members and archaeological materials, particularly among encyclopedic museums and research institutes, such as the Getty Museum and Smithsonian. The American Numismatic Society is among the earliest of implementers of the Linked Art API specification, extending the open-source Numishare software framework for its online collection of coins and similar objects to output JSON-LD conforming to a numismatic model proposed by the author. In a similar vein, the Kerameikos.org project has aligned its aggregation model nearly completely with the Linked Art CIDOC-CRM profile. Kerameikos.org is a collaborative effort to define the intellectual concepts of ceramics studies following the principles of Linked Open Data, focusing initially in Archaic and Classical Greece (c. 700-330 BCE) (Gruber and Smith 2014, 205-214). The project is developing workflows to incorporate vase data from across archaeological and museum datasets in order to facilitate new types of query and visualization. This paper addresses recent developments in the harvesting and normalization of Linked Art-compliant JSON-LD data into both Kerameikos.org and Nomisma.org's LOD ecosystems. Findspots for Greek vases implement a proposal to the Linked Art community based on the ARIADNE Plus model that extends CIDOC-CRM for archaeological context (PIN 2019; Gruber 2019). While many artifacts held by museums were not scientifically excavated and cataloged according to modern standards for data recording, the database records for these artifacts may still include very basic metadata corresponding to the place of finding and general context of the place (e.g., a tomb) or techniques used (metal detecting, as is the case for many coin finds). The prototype of this data harvesting system in Kerameikos.org was built primarily upon test data provided about several Greek vases held by the Indianapolis Museum of Art at Newfields; one of these has a findspot of Vulci, an Etruscan settlement in Italy, which would serve as a proof of concept for processing the Linked Art implementation of the ARIADNE archaeological data model. This paper details the intricacies of this workflow: 1) using XForms to request and process JSON-LD, 2) coreference concept URIs in the JSON-LD (typically, Getty vocabularies) with applicable Kerameikos.org ones, 3) normalize gazetteer URIs associated with findspots to Wikidata.org entities, and use Wikidata APIs to extract geographic coordinates and hierarchy (following the CIDOC-CRM spatiotemporal extension), and 4) serialize these data into CIDOC-CRM RDF/XML and post into the Kerameikos.org SPARQL endpoint. This is an extension of the data integration workflow developed in Nomisma.org in 2015, and the processes outlined in this paper may be of interest to others working to aggregate data in other sectors of cultural heritage. In conclusion, this paper is a demonstration of the development of a bridge between museum and archaeological data best practices. While Linked Art continues to evolve toward a version 1.0 specification, the application of ARIADNE's principles for CIDOC-CRM representation of archaeological context will hopefully enable museums to align their digital collections to the research questions of researchers who are interested in the patterns of distribution of materials over time and space. Likewise, the JSON-LD oriented approach to the Linked Art API may serve as a use case to the archaeological community to promote optimal data reuse through increasingly common serializations of Linked Open Data. Moreover, the hierarchical self-organization of such complexes is unique. Here, we introduce a water-soluble, facially amphiphilic, amphoteric, chiral, asymmetric, and hetero-tritopic ligand derived from natural bile acid, ursodeoxycholic acid. We show that via the supramolecular transmetalation reaction, using nitrates of Cu(II) or Fe(III), and subsequently Pd(II), a superchiral Pd3L6 complex can be obtained. Even though several possible constitutional isomers of Pd3L6 could be formed, because of the ligand asymmetry and relative flexibility of carbamate-pyridyl moieties attached to the steroid scaffold, only a single product with C-3 rotational symmetry was obtained. Finally, we demonstrate that these amphiphilic complexes can self organize into hexagonal microparticles in aqueous media. This finding may lead to the development of novelself-assembled metal-organic functional materials made of natural, abundant, and relatively inexpensive steroidal compounds. ; Peer reviewed

The topicality of the research is substantiated by the fact of recent global energy crisis. We analyzed trends in the processes of crisis solution that took place in domestic and global bioenergy and its impact on energy security of Ukraine. An assessment of the current state of energy security of Ukraine is conducted. The concepts of energy security solution are taken into account, based on the experience of biofuel production in the European Union. The necessity of state stimulation of agrarian business of Ukraine for the purpose of its modernization and overcoming the problems in the field of bioenergy is provided. This trend will promote the decision of economic, social, ecological problems and achievement of national strategic purposes. The objective preconditions for the development of Ukraine's agrarian business are revealed. They are aimed at formation of energy security as one of the main factors of national security. The author proposed methodological approaches which are focused on analysis of ensuring and implementing energy security in Ukraine due to the bioenergy potential of agribusiness. The research analyzes trends in the formation and development of energy security, which determine the structural and quantitative changes in the production and consumption of biofuels. The aim of the article is to reveal the main factors and trends that affect the implementation of energy security in Ukraine through biofuels, and identify in this process the key opportunities and challenges for domestic agricultural business. It is determined in the article that biomass is a promising source of energy both in the world and in Ukraine. Biomass ranks fourth in the world in terms of its energy use currently. Ukraine has seen a gradual increase in the number of facilities and installed capacity for the production of heat and electricity from biomass in recent years. The main purpose of the study is to analyze the opportunities and challenges associated with the development and modernization of agribusiness in Ukraine aimed at increasing biofuel production. The term "energy security" is described as a process of managing the national security system, in which the competent public authorities in cooperation with agribusiness ensure the transition to renewable energy sources, including biofuels, which will promote regional development and local economy through taxes and fees. Energy security at the national level will be increased through improving the trade and balance of payments by reducing energy imports. The factors influencing the formation of energy security are systematized. Prerequisites for the implementation of projects for the production of biofuels in Ukraine have been identified, which will give a positive socio-economic effect by creating new jobs, reducing tariffs for thermal energy and improving the reliability of heat supply. The research has been proved that biofuel projects already implemented in Ukraine are economically feasible. At the same time state support and promotion of bioenergy development stimulate investors and financial organizations to implement new bioenergy projects in Ukraine. ; Актуальність дослідження обумовлена тим, що на тлі світової енергетичної кризи проаналізовано тенденції процесів, що відбувалися у вітчизняній та світовій біоенергетиці та їх вплив на енергетичну безпеку України. Подано оцінку сучасного стану забезпечення енергетичної безпеки України. Висвітлено концепції вирішення енергетичної безпеки з урахуванням досвіду виробництва біологічних видів палива країн Європейського Союзу. Доведено необхідність державного стимулювання аграрного бізнесу України з метою його модернізації та подолання проблем в галузі біоенергетики, що сприятиме вирішенню економічних, соціальних, екологічних проблем та досягненню національних стратегічних цілей. Розкрито об'єктивні передумови розвитку аграрного бізнесу України для формування енергетичної безпеки як одного з основних чинників національної безпеки держави. Запропоновано методологічні підходи до аналізу забезпечення та реалізації енергетичної безпеки в Україні за рахунок біоенергетичного потенціалу агробізнесу. Проаналізовано тенденції становлення та розвитку енергетичної безпеки, що визначають структурні та кількісні зміни у виробництві та споживанні біологічних видів палива. Визначено, що біомаса є перспективним джерелом енергії як у світі, так і в Україні. Метою статті є розкриття основних факторів та тенденцій, які впливають на реалізацію в Україні енергетичної безпеки за рахунок біопалива, та визначення у цьому процесі ключових можливостей та проблем для вітчизняного аграрного бізнесу. На даний час біомаса займає четверте місце у світі за обсягами її енергетичного використання. Протягом останніх років в Україні спостерігається поступове зростання кількості об'єктів і встановленої потужності для виробництва теплової та електричної енергії з біомаси. Основною ціллю дослідження є аналіз можливостей та викликів, пов'язаних з розвитком та модернізацією аграрного бізнесу в Україні для нарощування виробництва біопалива. Охарактеризовано термін «енергетична безпека» як процес управління системою національної безпеки, за якого компетентними органами державної влади у співпраці з аграрним бізнесом забезпечується перехід на відновлювані джерела енергії, включно з біопаливом, що буде сприяти розвитку регіонів і місцевої економіки за рахунок надходження податків та зборів, а на державному рівні – покращення торговельно-платіжного балансу за рахунок зменшення обсягів імпорту енергоносіїв. Систематизовано чинники, що впливають на формування енергетичної безпеки. Визначено передумови впровадження проєктів з виробництва біопалива в Україні, що дасть позитивний соціально-економічний ефект за рахунок створення нових робочих місць, зниження тарифів на теплову енергію та покращення надійності теплопостачання. Встановлено, що проєкти з виробництва біопалива, що вже впроваджені в Україні, є економічно доцільними, а державна підтримка та сприяння розвитку біоенергетики стимулюють інвесторів та фінансові організації до реалізації нових біоенергетичних проєктів в Україні.
