Globalisierung im Lichte von Corporate Social Responsibility
Die vorliegende Arbeit unternimmt den Versuch, mit dem Konzept der deliberativen Corporate Social Responsibility einen alternativen Lösungsansatz zu den globalen Herausforderungen des 21. Jahrhunderts zu bieten und den Zugang der wirtschaftlichen Praxis zu selbigem anhand eines ausgewählten Beispiels darzulegen. Zunächst wird herausgearbeitet, welche teils radikalen Veränderungen der Globalisierungsprozess im wirtschaftlichen, sozialen, technologischen, ökologischen und politischen Gefüge der Welt hervorgerufen hat. In all diesen Dimensionen werden Kernproblemstellungen formuliert, wobei ein besonderer Schwerpunkt auf die politische Dimension gelegt wird. Anschließend wird ? nach einer allgemeinen Erläuterung der Grundprinzipien von Corporate Social Responsibility ? darüber diskutiert, inwieweit im Konzept der deliberativen Corporate Social Responsibility ein Lösungsvorschlag abseits der territorialpolitischen Neugestaltung der Welt gesehen werden kann. Der Ansatz sieht eine Rekonzeptualisierung des Unternehmens als politischen Akteur vor, welches neben anderen Akteuren der Globalisierung ? wie den Regierungen, den internationalen Organisationen, den NGOs und der sogenannten Zivilgesellschaft ? am globalen politischen Diskurs teilnehmen soll. Schließlich wird mit der OMV das größte börsennotierte österreichische Unternehmen hinsichtlich seines Selbstbildes und seiner Praktiken im Bereich der Corporate Social Responsibility untersucht. Die OMV verfolgt hierbei einen Stakeholder-Ansatz und kann - sowohl was CSR-Management als auch was CSR-Praktiken anlangt - zum unternehmerischen Spitzenfeld Österreichs gezählt werden. Eine politische Verantwortung wird jedoch seitens des Unternehmens abgelehnt, politische Handlungen werden allerhöchstens innerhalb der eigenen Einflusssphäre als solche betrachtet. Dieses Selbstbild greift freilich zu kurz, um den Anforderungen der Konzeption der deliberativen Corporate Social Responsibility zu genügen. ; By describing the conception of deliberative Corporate Social Responsibility in theory as well as in business practice, this thesis attempts to offer an alternative solution for the global challenges of the 21st century. At first, there will be an analysis of the process of globalization and the radical changes it lead to in terms of the economic, social, ecological, technological and political balance of the world. Central problems are formulated in each of these dimensions of globalization; a special emphasis will is on the political dimension. After a general explanation of the concept of Corporate Social Responsibility, the thesis discusses how deliberate Corporate Social Responsibility can be a solution to the problems described above. This concept calls for a reconceptualization of the company as a political actor: The company is ? according to this proposal ? supposed to participate at the global political discourse. Finally, OMV (which is the biggest Austrian company listed on the stock market) will be examined regarding its CSR-practices as well as its self-image about CSR. OMV sticks to a Stakeholder-Approach und can be called one of the leading companies of Austria with regard to CSR-management and practices. Any political responsibility is strictly rejected though; political actions are only treated as such, when it is about OMVs proper sphere of influence. Dogmatik der Verlängerung der Verjährungsfrist und deren kriminalpolitische Gründe
Das Rechtsinstitut der strafrechtlichen Verjährung sowie dessen konkrete Ausgestaltung war in den letzten Jahren immer wieder Gegenstand gesetzlicher Novellierungen. Die vorgeschalteten politischen Debatten wurden ? etwa in Hinblick auf den besonders sensiblen Bereich des Sexualstrafrechts ? zum Teil sehr emotional geführt und führten zumeist zu Verschärfungen der geltenden Rechtslage. Als Instrument zur Regelung des Verjährungsrechts dienen zunächst die Verjährungsfristen des § 57 StGB, die sich an den Strafdrohungen der Delikte im Einzelnen orientieren. Ergänzt werden diese um die Verlängerungstatbestände des § 58 StGB, welche unter gewissen Voraussetzungen den An-, Fort- oder Ablauf der Verjährungsfrist hemmen. Die vorliegende Arbeit gibt zunächst einen Überblick über die geltende Rechtslage der Verfolgungsverjährung des § 57 StGB; anschließend sollen die einzelnen Tatbestände des § 58 StGB tiefergehend diskutiert und analysiert werden. Die Arbeit beschränkt sich dabei nicht darauf, eine rein materielle Erläuterung der geltenden Rechtslage zu bieten, vielmehr soll diese in eine dogmatische Aufarbeitung eingebettet und anhand von Gesetzesmaterialien, Literatur, Judikatur sowie Hilfsliteratur aus dem Bereich der Psychologie dargestellt werden. Einen Schwerpunkt stellt dabei das bereits erwähnte 2. Gewaltschutzgesetz 2009 dar, welches aufgrund seiner Aktualität von besonderem Interesse erscheint. Andere Schwerpunkte werden auf ausgewählte Problemstellungen im Zusammenhang mit der Verlängerung der Verjährungsfrist gelegt; etwa dem Problem der Rückwirkung neuer Verjährungsvorschriften oder der psychologischen ratio legis einer Anlaufhemmung bei Sexualdelikten. ; The statutory limitation as a legal institution of criminal law has been well discussed and frequently modified during the last couple of years. The political debates that preceded these modifications tended to be rather emotional and mostly (especially when it was about the very sensitive topic of sexual offenses) led to an aggravation of the current legal status. The most important instruments to regulate the law of statutory limitation are the actual periods of limitation that are laid down in § 57 StGB and depend on the range of punishment for the crime. These periods of limitation are completed by the facts of extension in § 58 StGB, that can prevent the statutory limitation or at least hinder the periods of limitation to run out under certain circumstances. At first, this thesis shall give an overview on the current legal situation of the criminal statutory limitation of § 57 StGB; then each of the facts of extension of § 58 StGB will be deeply analyzed and discussed. Doing so, this thesis is not only going to give pure legal explanations but will also discuss the ratio legis, the opinions in literature (party from a psychological point of view) and jurisdiction as well as the dogmatic background of the rules for statutory limitation. One main emphasis shall be put on the 2. Gewaltschutzgesetz 2009, which seems to be of particular interest because of the recent and important changes that were involved with it. This report outlines the rules on the taking and using of evidence in Austrian civil procedure law. On the basis of principles such as the free disposition of parties, the attenuated inquisitorial principle or the principles of orality and directness, the judge and the parties form a "working group" when investigating the matter in dispute. The Austrian concept of an active judge, however, goes along with the judge's duty to do case-management and especially to induce a truthful fact-finding using judicial discretion. While only five means of proof (documents, witnesses, expert opinions, evidence by inspection and the examination of parties) are explicitly listed the Austrian civil procedure code, there is no numerus clausus regarding the means of evidence. Evidence may be freely assessed by the judge.
General principles in European small claims procedure ; Osnovna načela evropskega postopka v sporih majhnih vrednosti
The European Small Claims Regulation has been offering an alternative proceeding for small claims litigation in cross-border cases for almost four years now. Along with several important procedural simplifications, however, came considerable restrictions regarding the principles of public and oral proceedings established in the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union. Critics claim especially that the court's power to omit any oral hearing in a Small Claims Procedure cannot fulfill the requirements of the Convention and the Charter. This question is going to be further investigated in the course of this paper. Before doing so, however, a rough overview of the scope, of some general principals and of the conduct of the European Small Claims Procedure shall be provided. ; Uredba o evropskem postopku v sporih majhne vrednosti že skoraj štiri leta ponuja alernativni postopek v čezmejnih sporih majhnih vrednosti. Poleg številnih pomembnih postopkovnih poenostavitev pa vendarle obstajajo znatne omejitve glede načela javnosti in ustnega postopka, kot je to predvideno v Evropski konvenciji o človekovih pravicah in v Listini o temeljnih pravicah Evropske unije. Kritiki zlasti menijo, da pristojnost sodišča po neupoštevanju kakršnegakoli ustnega zaslišanja v postopku o sporih majhne vrednosti ni v skladu z zahtevami omenjene Evropske konvencije in Listine. Avtorja se v prispevku ukvarjata predvsem s tem vprašanjem, prav tako pa tudi orišeta vsebino posameznih splošnih načel in delovanje evropskega postopka v sporih majhnih vrednosti.

Einstweilige Kontenpfändung im Europäischen Zivilverfahrensrecht ; Provisional Account Preservation Measures in European Civil Procedure Law
Mit der Europäischen Kontenpfändungsverordnung einerseits und der revidierten EuGVVO andererseits baute der Europäische Verordnungsgeber jüngst die Instrumente des grenzüberschreitenden einstweiligen Rechtsschutzes deutlich aus: Während die neue EuGVVO Anerkennung und Vollstreckung für nationale Maßnahmen des einstweiligen Rechtsschutzes in anderen Mitgliedstaaten vereinfacht, schafft die Kontenpfändungsverordnung eine genuin europäische Sicherungsmaßnahme (den Europäischen Kontenpfändungsbeschluss), die verhindern soll, dass der Schuldner Gelder von seinem Bankkonto abhebt oder überweist. Der Beitrag vergleicht diese beiden Schienen des einstweiligen Rechtsschutzes auf Europäischer Ebene in Bezug auf ihre jeweiligen Anwendungsvoraussetzungen, die dem Schuldner zur Verfügung stehenden Rechtsbehelfe und ihre erheblich divergierenden Wirkungsweisen. ; With the Regulations 1215/2012 (Brussels Ia Regulation) and 655/2014 (EAPO Regulation), the European legislature has created two new and distinct instruments to facilitate cross-border debt recovery in civil and commercial matters. While the Brussels Ia Regulation provides an easier recognition and enforcement of national interim measures in other EU Member States, the EAPO Regulation creates a single provisional and protective measure enabling creditors to prevent the transfer or withdrawal of the debtors' assets from any bank account located in the EU. This paper provides a comparative analysis of these European creditor-friendly legal instruments by evaluating the rules on preconditions, legal remedies and the different effects of national interim measures that shall be recognised and enforced within the Brussels Ia regime and the new EAPO.
