Significant parts of the EU's legislative process remain shrouded in secrecy. In informal trilogues, representatives of the three main institutions negotiate compromises behind closed doors which are subsequently rubber-stamped in public meetings. While most research on (EU) transparency focuses on the availability of documents, this article investigates how much information on trilogue proceedings is shared with the general public through European Parliament (EP) committee meetings as the only forum to which public account must be rendered during the negotiation process. This article analyses the degree to which trilogues are reported back on, and the quality of feedback provided. Although the EP requires its trilogue negotiators to report back to its committees after each trilogue, the majority of trilogues is not reported back on at all, or not in time. Where feedback is given, its quality is often only poor. The EP thus does not deliver on its promises, which seriously undermines the legitimacy of the EU's legislative process.

Dans le présent article, nous nous intéressons à un nouveau type de règles que l'Union européenne peut adopter : les actes législatifs pris par délégation. Même si cet instrument est nouveau, il est le résultat d'une controverse déjà ancienne à propos des moyens dont dispose le Parlement européen pour obliger la Commission européenne à s'expliquer quand elle adopte des règles d'exécution. Notre article se fonde sur des entretiens et des preuves documentaires pour vérifier dans quelle mesure le nouveau système remplit sa promesse, à savoir renforcer l'imputabilité. Même si le nouveau système en est encore à ses balbutiements, nous allons voir que les règles formelles, les normes internes et les pratiques sont déjà révélatrices d'un contrôle législatif renforcé. Les problèmes de capacités au sein du Parlement européen ainsi que l'absence de transparence publique pourraient cependant bien s'avérer préjudiciables lorsque le nombre d'actes délégués augmentera. Remarques à l'intention des praticiens Dans le présent article, nous évaluons la mesure dans laquelle le Parlement européen (PE) est en mesure de demander à la Commission de s'expliquer lorsqu'elle adopte des actes législatifs pris par délégation. Les actuels systèmes et méthodes d'imputabilité en sont toujours à leurs balbutiements, mais on observe déjà clairement des signes d'un renforcement du contrôle législatif sur la Commission. Les problèmes de capacités au sein du PE et l'absence de transparence des actes législatifs pris par délégation vont cependant compromettre l'imputabilité lorsque le nombre d'actes délégués augmentera.

This article focuses on a new type of rules that the European Union may adopt: delegated legislation. Although this instrument may be new, it follows from a long-standing controversy over the means by which the European Parliament can hold the European Commission to account when it adopts executive rules. On the basis of interviews and documentary evidence, this article aims to test to what degree the new system delivers on its promise of stronger accountability. Although the new system is still in its infancy, the article concludes that formal rules, internal norms and practices are already indicative of stronger legislative control. However, capacity issues within the European Parliament, as well as a lack of public transparency, may well prove to be detrimental when the number of delegated acts increases. Points for practitioners This article assesses the degree to which the European Parliament is equipped to hold the European Commission to account when it adopts delegated legislation. Current accountability systems and practices are still in their infancy, but there are already clear signs of stronger legislative control over the European Commission. However, capacity issues within the European Parliament and a lack of transparency of delegated legislation will jeopardize accountability as the number of delegated acts increases.

Informal trilogues have become a standard operating procedure in the European Union's ordinary legislative procedure. Generally, their occurrence is seen as a trade-off in which speed is prioritized over inclusive decision making. Hence, a relationship is assumed between intra-institutional processes and inter-institutional interactions. This article therefore tries to explain the number of informal trilogues in first readings. The contribution of this analysis is twofold. First, it shows that intra-institutional political processes such as contestation of the rapporteur's preferences, politicization inside the Council and the number of shadow rapporteurs matter. Second, it for the first time measures the number of informal trilogues directly for the full population of post-Lisbon legislative files.

Résumé Le Parlement européen, comme tout parlement, a besoin d'informations pour pouvoir surveiller les décisions de l'exécutif. Mais comment traite-t-il ces informations dans la pratique ? Dans cet article, nous nous intéressons à l'influence grandissante du Parlement européen sur la procédure dite de « comitologie » : des comités composés de fonctionnaires nationaux, qui produisent des mesures exécutives qui sont adoptées par la Commission européenne. Nous allons aborder deux types de changements : les changements organisationnels et les changements dans les méthodes de travail du personnel du PE. Notre analyse révèle que le Parlement européen est parvenu à mettre en place un système de surveillance décentralisé de type policier, mais non pas en raison d'un accroissement de ses droits d'information proprement dit, mais plutôt d'un renforcement de ses compétences politiques. Nous en conclurons que l'information n'influence le comportement du Parlement européen que lorsqu'elle s'accompagne de droits politiques bien précis, par opposition à des droits politiques relativement généraux ou diffus. Remarques à l'intention des praticiens Dans cet article, nous analysons l'influence de l'information sur le fonctionnement du Parlement européen en tant qu'instance tenue de rendre compte de son action. Nous verrons que les informations n'ont d'influence que lorsqu'elles s'accompagnent de droits politiques bien précis, par opposition à des droits politiques très généraux ou diffus.

The European Parliament, like any parliament, needs information for scrutinizing executive decision-making. But how does it process this information in practice? This article focuses on the European Parliament's increasing grip on 'comitology' decision-making: committees composed of national civil servants, producing executive measures that are adopted by the European Commission. Two types of changes are addressed: organizational changes and changes in working methods of EP staff. The analysis shows that the European Parliament has effectively built up a system of decentralized police-patrol oversight, but not following more information rights as such but rather as a result of its increasing political powers. The article concludes that information only affects the behaviour of the European Parliament in combination with very specific as opposed to quite general or diffuse political rights. Points for practitioners This article traces the effects of information on the functioning of the European Parliament as an accountability forum. It concludes that information only makes a difference when coupled with very specific as opposed to very general or diffuse political rights.
