The criminal-law protection of religious sentiments: the Spanish case ; La protección penal de los sentimientos religiosos: el caso español
Summary. This study analyses the Spanish criminal legislation on the protection of religious feelings, as well as the criticisms made for its maintenance. An assessment of comparative European law is made, in the light of the German, Italian, Portuguese and French legal systems, and the protection of such feelings is the general rule. Furthermore, it is based on the framework of relations between the State and religious denominations, the different systems are compared and it is concluded that there is a system of positive laicity in Spain. Finally, it is examined whether offenses may constitute a criminal offence, whether feelings are eligible for criminal protection, and whether it is legitimate to protect religious feelings in criminal law. In addition, it responds to the criticisms of the Spanish Criminal Code in this area and proposes, de lege ferenda, the restriction of Article 525 of the Criminal Code. ; Resumen En el presente estudio se analiza la regulación penal española sobre protección de los sentimientos religiosos, así como las críticas que se han efectuado a su mantenimiento. Se hace una valoración del derecho comparado europeo, atendiendo a los ordenamientos alemán, italiano, portugués y francés, y se constata que la protección de tales sentimientos es la regla general. Además, se parte del marco de relaciones entre el Estado y las confesiones religiosas, se comparan los diferentes sistemas y se llega a la conclusión de que en España existe un sistema de laicidad positiva. En último término se estudia si las ofensas pueden ser constitutivas de delito, si los sentimientos son susceptibles de tutela penal, y si es legítimo proteger penalmente los sentimientos religiosos. Además, se responde a las críticas al Código Penal español en esta materia y se propone de lege ferenda la restricción del artículo 525 del Código Penal.
