AbstractCreativity is an important evolutionary adaptation that allows humans to think original thoughts, to find solutions to problems that have never been encountered before, and to fundamentally change the way we live. Recently, one important area of creativity, namely verbal creativity, has attracted considerable interest from constructionist approaches to language. The present issue builds on this emerging field of study and adds an interdisciplinary perspective to it by also presenting the view from cognitive literary studies as well as psychology. First, however, this introduction surveys the recent issues arising in constructionist studies of verbal creativity.
Abstract In his contribution to the present volume, Uhrig (2020. Cognitive Semiotics 13, 1) focusses on an interesting question: When is a novel utterance considered "creative" and when is it seen as "wrong?" As I will show, Uhrig offers many important answers to this question. At the same time, I argue 1) that deliberateness is not (always) important for linguistic creativity; 2) that appropriateness requires a closer look; and 3) that frequency does not (always) play the most important role.
The fate of the EU-Ukraine Association Agreement – although finally signed between March and June 2014 – shows in a nutshell the nature of the more than 20 years of approximation between the European Union and Ukraine: A series of ambitious leaps towards the west, but few of them strong enough to not to be pulled back by the lack of respective legal implementation, legal reforms and – last not least – the lack of will. Much has been written about the weal and woe of Ukraine's Europeanization, and literature will even increase after the ongoing escalations of this year will hopefully have ended soon. Still, less has been written about what has been achieved already in terms of legal harmonization, especially in a field much less touched by politics, as it is the law of obligations – in spite of an obvious need for both academics and practitioners. This article therefore provides a comparison of the Ukrainian law of obligations with European harmonization initiatives – here represented by the Draft Common Frame of Reference (DCFR) – and aims at pointing out these fields of law, where further approximation could be obtained. ; Доля Угоди про асоціацію, між Європейським Союзом і Україною, підписаної в березні-червні 2014 р. демонструє перебіг більш ніж 20-річного процесу зближення ЄС та України: серія амбітних стрибків на захід, не всі з яких були достатньо сильними, щоб повною мірою відповідати юридичній реалізації правових реформ і, що не менш важливо, – відсутність політичної волі. Багато було написано про плюси і мінуси європеїзації України, і такі публікації будуть навіть частішими після того, як ескалація, що триває сьогодні, нарешті припиниться. Проте було менше написано про те, що вже досягнуто з точки зору юридичної гармонізації, особливо у сфері, набагато менш зачепленою політикою, – сфері зобов›язального права. Die Bereitschaft, sich an Gesetzesinitiativen oder Referenden zu beteiligen, hat sich in Estland, Lettland und Litauen unterschiedlich entwickelt. Obwohl in der Verfassung verankert, haben Volksabstimmungen in Estland nie eine mit lettischen oder litauischen Verhältnissen zu vergleichende praktische Bedeutung gewonnen. Zwar ist die Zahl der Referenden im Vergleich zu anderen europäischen Ländern recht hoch, doch ist auch in Betracht zu ziehen, dass sich bei einer Bevölkerung von jeweils zwischen einer und drei Millionen eine Volksabstimmung sehr viel einfacher und günstiger organisieren lässt als in größeren Staaten. Zudem wurden die meisten Referenden nicht in erster Linie zur Lösung einer konkreten Sachfrage initiiert, sondern dienten vielmehr mittelbar Parteien, Gewerkschaften oder Regierungen zur Demonstration des eigenen Rückhalts in der Bevölkerung gegenüber der Opposition oder anderen Gegenspielern. Insoweit lässt sich feststellen, dass strukturell alle drei baltischen Staaten der sachunmittelbaren Demokratie einen großen Stellenwert einräumen, dieses Potential momentan jedoch noch unzureichend im Sinne des Gesetzgebers genutzt wird.
