The teaching of the Catholic religion in Spain: some aspects of its regulation after the constitution of 1978 ; La enseñanza de la religión católica en España: algunos aspectos de sus regulaciones tras la Constitución de 1978
Firstly, article 27.3 of the Constitution of Spain, 1978, is studied, in order to examine the reach and nature of the law it guarantees (that of parents to choose religious and moral education for their children in agreement with their convictions). Therefore some doctrinal stances are reviewed, fundamentally those particularly significant ones which were stated in the debates of the constituent Spanish Parliament. Secondly, we describe the models which, after the 1978 Constitution, have followed in the regulation of the teaching of Catholicism in public centers of education in Spain. The first of these models was that of the centrist governments, based, fundamentally, on choice between Religious Education or Ethics classes (although this choice was not available at all levels and stages of education). The Socialist governments tried out a first system in which the alternative to Religious education class was proctored study of the basic subjects on the school curriculum. This system was found to be unconstitutional by the Supreme Court in several legal sentences which are also analyzed. Therefore, a second system was tested in which the alternative was other activities which did not include study of the basic subjects. The third model has not been put into practice, because of the political ups and downs which occurred after the March 2004 elections. This model is stated in the regulation for development of the 2002 Ley Orgánica de Calidad de la Enseñanza (Organic Law on the Quality of Education), in which the most relevant change, which we consider correct, was that of withdrawal of the system of teaching alternative subjects, and the establishing of a choice between denominational or non-denominational religious studies. ; Se analiza, en primer lugar, el artículo 27.3 de la Constitución Española de 1978, para ver el alcance y la naturaleza del derecho que en él se garantiza (el de los padres a elegir la educación religiosa y moral acorde con sus convicciones). Para ello se pasa revista a algunas posiciones doctrinales y, fundamentalmente, a intervenciones especialmente significativas de las que tuvieron lugar en los debates de las Cortes constituyentes. En segundo lugar, se describen los modelos que, tras la Constitución de 1978, se han sucedido para regular la enseñanza de la religión católica en los centros docentes públicos españoles. El primero de esos modelos fue el de los gobiernos centristas que se basaba, fundamentalmente, en la elección entre las clases de religión y las de ética (aunque no estaba previsto para todos los cursos y etapas educativas). Los gobiernos socialistas ensayaron un primer sistema en el que la alternativa a la clase de religión consistía en un estudio dirigido de las materias fundamentales del currículo escolar. Ese sistema fue declarado contrario a la Constitución por el Tribunal Supremo en diversos pronunciamientos jurisdiccionales que son también objeto de análisis. Por ese motivo, se ensayó un segundo sistema en que la alternativa recaía sobre otras actividades distintas a la del estudio de las asignaturas fundamentales. El tercer modelo, que no ha llegado a ejecutarse en la práctica, por los avatares políticos acaecidos tras las elecciones de marzo de 2004, se contiene en la normativa de desarrollo de la Ley Orgánica de Calidad de la Enseñanza del año 2002, cuya novedad más relevante, y que se juzga como un acierto, fue la de abandonar el sistema de enseñanzas de materias alternativas, para hacer recaer la opción entre una enseñanza del hecho religioso en clave confesional o no confesional.
