The migration is widely discussed phenomena, with multiple approaches and problematic areas. The author of this research will address the problems that migrating women and girls face. There are gaps in the political perspective, as well as legislative gaps, affecting the situation of migrant women and their children, especially girls, who find it difficult to migrate. Gender-sensitive measures to address violence and other violations of migrating women and girls, including gender-sensitive law enforcement measures, shelters, counselling services and prevention programmes are absent. Migrant girls also face gender-specific challenges, risks and vulnerabilities. Migrant girls due to their migration status, age and gender, are even more at risk and more vulnerable during the migration process, thus putting them at greater risk of violating their rights. Gender discrimination is present in countries of origin and destination, as well as during migratory journey. Gender inequalities, including violence against women and girls, can be both a root cause for migration and a violation of their rights during the migratory process. Therefore, the purpose of the research is to detect the legal gaps in international legal regulation, causing the inadequate protection of the rights of migrant women and girls, focusing more specific attention on the rights of the migrant girls and indicating the fundamental rights that due to lack of political will are kept outside the scope of protected areas.

The twentieth century has brought the tremendous development of multilateral or global agreements regarding global environmental challenges. The growth of the international environmental legal regulation requires the increase of institutionalization in the governance of legal and administrative mechanisms of international environmental law, consequently the number of different international organizations acting in the fields of negotiation, adoption, implementation, and enforcement of the rules, are being established during last twenty – thirty years. However, despite the impressive development of international environmental regulation there is still no single institution or organization that would play a role of the supervisor or would have the authorization of the highest hierarchical institution. Nonetheless, international environmental organizations may contribute to the legislation processes and implementation of international environmental law. They may raise concern about certain environmental problems, share information, present reports, lobby governmental actors to take actions on international environmental policy issues, act as an implementation and enforcement subjects of the multilateral or regional environmental agreements. Therefore the object of the research is the impact of the activity of international environmental institutions on development and implementation of international environmental law. The objective of this research therefore is to disclose the system of international environmental organizations and to analyze the impact of international environmental institutions on international environmental law. ; XX amžius atnešė didžiulę daugiašalių ar globalių susitarimų įvairiais aplinkos apsaugos klausimais plėtrą. Tarptautinio aplinkosaugos teisinio reguliavimo augimas suponuoja ir teisinių bei administracinių institucinių mechanizmų aplinkos apsaugos teisės srityje skaičiaus didėjimą, atitinkamai pastaruosius dvidešimt – trisdešimt metų gausėja įvairių su aplinkosaugos teise ir teisės normų priėmimu, įgyvendinimu, vykdymu susijusių tarptautinių ir regioninių institucijų. Tačiau nepaisant įspūdingos tarptautinio aplinkosaugos reguliavimo plėtros vis dar nėra vieningos institucijos, kuri atliktų tarptautinio administratoriaus vaidmenį ar turėtų aukščiausios hierarchinės institucijos įgaliojimus. Vienok tarptautinės aplinkos apsaugos organizacijos gali prisidėti prie teisės aktų kūrimo procesų, o taip pat daryti įtaką teisės normų įgyvendinimo priežiūrai. Šios institucijos gali kelti klausimus dėl tam tikrų aplinkosaugos problemų, dalintis informacija, pateikti įvairias ataskaitas, vykdyti lobistinę veiklą vyriausybių atžvilgiu, veikti kaip tarptautinių daugiašalių ar regioninių susitarimų įgyvendinimo ir priežiūros subjektai.taigi šio tyrimo objektas yra tarptautinių aplinkos apsaugos institucijų įtaka aplinkosaugos teisei. Šio darbo tikslas yra atskleisti tarptautinių aplinkosaugos institucijų sistemą ir išanalizuoti šių institucijų įtaką tarptautinei aplinkos pasaugos teisei.
This article focuses the attention to the right to peaceful assembly and the freedom of expression in the European region, basically, the region that is covered by the European Convention For the Protection of Human Rights and Fundamental Freedoms (hereinafter The European Convention on Human Rights, or the Convention), which was signed on 4 November 1950 in the scope of the Council of Europe. Without a broad guarantee of the rights to peaceful assembly and the right to freedom of expression protected by all governmental institutions and independent courts there could be no democratic country in full meaning of this word. The Article 11 of the Convention foresees that - Everyone has the right to freedom of peaceful assembly and to freedom of association with others, including the right to form and join trade unions for the protection of his interests‖. The protection given by Article11 extends to any assembly, notwithstanding its content, disseminated by any individual, group as long as it is peaceful. As a qualified right it is for the concerned persons to establish the activity that they wish to carry out or that is being restricted falls within the protection of Article 11 Paragraph 1 and that there has been an interference with it. The object of the research is the content of the right to peaceful assembly, the obligations of the states in respect of this right and possible derogations in the conditions of public safety protection. The objective of this research therefore is to disclose the scope of right to freedom of assembly foreseen in Article 11 of the European Convention on Human Rights and to discuss the possible circumstances in which a state may legitimately interfere with the exercise of the freedom of assembly. ; Europos žmogaus teisių ir pagrindinių laisvių apsaugos konvencija, pasirašyta 1950 m., tapo itin svarbiu žmogaus teisių apsaugos mechanizmu visose Europos Tarybos šalyse narėse. Europos žmogaus teisių konvencijos (toliau –Konvencija) 11 straipsnis įtvirtina, kad "Kiekvienas turi teisę į taikių susirinkimų laisvę, taip pat laisvę jungtis į asociacijas kartu su kitais, įskaitant teisę steigti profesines sąjungas ir stoti į jas, kad būtų ginami savi interesai. Straipsnyje taip pat numatyti ir apribojimai, kurie gali būti taikomi valstybės įgaliotų institucijų ar pareigūnų: "Naudojimuisi šiomis teisėmis netaikomi jokie apribojimai, išskyrus tuos, kuriuos nustato įstatymas ir kurie yra būtini demokratinėje visuomenėje dėl valstybės saugumo ar visuomenės apsaugos, siekiant užkirsti kelią viešosios tvarkos pažeidimams ar nusikaltimams, apsaugoti žmonių sveikatą ar moralę arba kitų asmenų teises ir laisves. Šis straipsnis nekliudo įvesti teisėtų naudojimosi šiomis teisėmis apribojimų asmenims, tarnaujantiems ginkluotosiose pajėgose, policijoje ar valstybės tarnyboje. Be abejo, susirinkimų laisvė tiesiogiai susijusi su teise laisvai reikšti nuomonę viešai ir susirinkimuose, Konvencijos 10 straipsnis numato, kad kiekvienas turi teisę laisvai reikšti savo mintis ir įsitikinimus, nepaisant valstybės sienų ir netrukdant valstybės pareigūnams. Neginčytina, kad tarp nuomonės reiškimo laisvės bei susirinkimų laisvės pagal Konvencijos 11 straipsnį yra neatskiriamas ryšys, todėl yra prasminga, nagrinėjant teisės į taikius susirinkimus apribojimus, remtis ir Europos žmogaus teisių teismo praktika saviraiškos teisės ribojimo atžvilgiu. The role of the police is pivotal in a democratic society if the concept of human rights remains meaningful and human rights are still to be protected in the light of international terrorism, unconventional and civil wars, crisis of refugees and other challenges to the existence of the rule of law principle in modern democracies. Because of the repressive nature of the work of the police, sometimes because of the lack of philosophical view to human rights and the role of the police, also make the police responsible for human rights abuses, especially those connected to right to life, prohibition of torture, inhuman or degrading treatment, illegal detainment of persons (through excessive use of force, discriminatory practices), etc. The right to life (Article 2 of the Convention) is one of the most fundamental provisions in the Convention. Together with the protection from torture, it enshrines the basic values of democratic societies, and its interpretation must be guided by a recognition of its importance. In this article the violations of the right to life that occur during police activities, most precisely by using force by police officers, are analyzed. The aim of this article is to disclose the scope of the right foreseen in Article 2 of the European Convention on Human Rights and to discuss the possible circumstances in which a state through actions of its officials (particularly – police officers) may legitimately interfere with the exercise of this right depriving right to life by using lethal force. The deprivation of life caused by actions of state authorities and the obligation of the states to investigate such actions by the form of independent and public scrutiny determining whether the force used was or was not justified in a particular set of circumstances are discussed. ; Demokratinėje visuomenėje policijos vaidmuo yra esminis, jei žmogaus teisių apsaugos principas yra laikoma esminiu valstybės veiklos teisėtumo pagrindu. Žmogaus teisių apsaugos doktrina patiria didžiulių transformacijų globalizacijos, tarptautinio terorizmo, nekonvencinių ir civilinių karų, pabėgėlių krizės ir kitų socialinių bei politinių iššūkių kontekste. Dėl represinio policijos veiklos pobūdžio, kartais dėl filosofinio požiūrio į žmogaus teises (ypač susijusias su teise į gyvybę, teisę nebūti kankinamam ir nepatirti kitokio žeminančio elgesio, apsaugos nuo neteisėto sulaikymo teisę) bei policijos vaidmenį visuomenėje stokos, nuolat susiduriama su neteisėta ir netinkama policijos veiksmų praktika (naudojant perteklinę jėgą, diksriminacijos apraiškos, ir pan.). Europos žmogaus teisių ir pagrindinių laisvių apsaugos konvencijos (toliau – ir Konvencijos) 2 straipsnyje įtvirtinta teisė į gyvybę yra viena iš fundametaliausių žmogaus teisių, kuri kartu su teise nebūti kankinamam ir nepatirti žeminančio elgesio indikuoja pamatines demokrtainės visuomenės vertybes, šios teisės gynimo priemonės, metodai, praktika turi atspindėti jos reikšmę. Šiame straipsnyje analizuojami žmogaus teisės į gyvybę pažeidimai, susiję su policijos naudojama jėga. Šio straipsnio tikslas yra atskleisti Konvencijos 2 straipsnyje numatytos teisės sampratą, apimtį, ribas, aptarti galimas aplinkybes, kurioms esant valstybės pareigūnai gali teisėtai riboti šios teisės įgyvendinimą naudodami mirtiną jėgą. Valstybė turi pareigą vykdyti efektyvų bylų tyrimą, o tie atvejai, kai gyvybę atima pareigūnai, turi būti kruopščiai nagrinėjami nepriklausomų ir nešališkų instiucijų. Europos žmogaus teisių teismas savo gausioje praktikoje įtvirtino, jog neteisėtas bus jėgos panaudojimas, kuris nėra didesnis nei neišvengiamai būtina (2 straipsnio 2 punktas). Ši Konvencijos 2 straipsnio nuostata nenustato aplinkybių, kurioms susidarius gyvybės atėmimas tampa teisėtu, jame tik apibūdinami atvejai, kai panaudojus jėgą gyvybės atėmimas yra neplanuota pasekmė. Bet koks jėgos panaudojimas turi būti "neišvengiamai būtinas", o tai suponuoja jėgos panaudojimo proporcingumo siekiamam tikslui reikalavimą. Straipnyje analizuojama negausi bylų prieš Lietuvą praktika, akcentuojami pažeidimai, dėl kurių nustatyti teisės į gyvybę pažeidimai.
The world's forests are one of the most important ecosystems sustaining the whole global environment. Their biological diversity distinguishes as the most heterogeneous and versatile. As the World Bank notices, nearly 90 percent of terrestrial biodiversity is found in the world's forests, with a disproportionate share in the forests of developing countries. From one hand, forests are important in many different areas – they provide climate regulation, protection of soil, ensure the recovery of water resources, their ecosystems create a living surrounding for billions of species, forest products are essential to existence of more than billion people. Forest resources directly contribute to the livelihoods of 90 percent of the 1.2 billion people living in extreme poverty and indirectly support the natural environment that nourishes agriculture and the food supplies of nearly half the population of the developing world. On the other hand, the world's forests are also under enormous pressure: from conversation to agricultural and other uses, from illegal and unsustainable harvesting of forest products and from climate change. It could seem unbelievable, but the world-wide problem of degradation of the world's forest has became a focus of international environmental law only a few decades ago. The deforestation began to attract the attention of international society only after the first intimidated studies reflecting the situation were presented. They disclosed tremendous facts about rising problems in the field of forests' protection, as many factors may be presumed as a threat to forest ecosystems; those threats are diverse and include different aspects of human activity (population growth, measures for poverty reduction, industrial activities, road construction, consumption, agriculture, usage of forest products, etc.) and environmental situation (climate change, acid rain, ozone depletion, toxic chemicals, water reduction) of the world in general. The protection of forests is a very precise example of conflicting interests between environmental issues and economic, industrial, political, social ones. Global environmental forest policies most clearly disclose the tension between the needs of developed countries and developing ones, between environment protection and development processes, between need to preserve and sustain nature and degradation of poverty. Understanding of those phenomenons may explain the present situation in the legislation of international legal documents regarding forest protection. Although the twentieth century has brought the tremendous development of multilateral or global agreements regarding global environmental challenges, and the growth of the number of multilateral environmental agreements, as well as the scope of covered by them issues, is dramatic, however there is no binding global agreement on forest protection, conservation and management. The specific feature of international legal instruments in the field of forest protection is their non – binding nature, and this circumstance is worth of a deep and more precise analysis. The object of the research is the system of international legal instruments that have impact in international environmental law of forest protection. The objective of this research therefore is to disclose the system of international legal instruments that have impact in international environmental law of forest protection, to analyze the most important reasons that influenced the formation of this system, and to reveal the peculiarities of the system. ; Miškų apsauga yra itin puikus konfliktuojančių aplinkosauginių, politinių, ekonominių, industrinių interesų pavyzdys. Globalinės miškų aplinkosaugos politikos atskleidžia esančią įtampą tarp besivystančių šalių poreikių užtikrinimo ir išsivysčiusių šalių siekių, tarp aplinkos apsaugos ir vystymosi procesų, tarp būtinybės saugoti gamtą ir skurdo mažinimo. Suprantant šiuo probleminius aspektus, galima paaiškinti situaciją tarptautinėje aplinkosaugos teisėje priimant miškų apsaugos sričiai reguliuoti reikalingus dokumentus. Nors dvidešimtame amžiuje buvo priimtas milžiniškas skaičius įvairius aplinksauginius klausimus reguliuojančių tarptautinių teisinių instrumentų, tačiau vis dar nesama globalinio teisiškai įpareigojančio tarptautinio dokumento, kuris užtikrintų miškų apsaugą, valdymą ir tvarųjį naudojimą. Specifinė tarptautinių teisinių instrumentų, priimtų miškų apsaugos srityje, ypatybė yra jų neįpareigojantis, neprivalomas pobūdis. Ši aplinkybė yra verta atskiros mokslinės analizės. Šio tyrimo objektas yra tarptautinių teisinių instrumentų, turinčių įtakos miškų apsaugai, sistema. Šio tyrimo tikslas yra atskleisti tarptautinių teisinių instrumentų, priimtų mišlų apsaugos srityje, sistemą, išanalizuoti svarbiausias priežastis, nulėmusias tokios sistemos formavimąsi, ir atskleisti šios sistemos ypatybes.

The aim of this article is to disclose the scope of the right foreseen in Article 2 of the European Convention on Human Rights and to discuss the possible circumstances in which a state through actions of its officials (particularly – police officers) may legitimately interfere with the exercise of this right depriving right to life by using lethal force. The deprivation of life caused by actions of state authorities and the obligation of the states to investigate such actions by the form of independent and public scrutiny determining whether the force used was or was not justified in a particular set of circumstances are discussed.
The role of the police is pivotal in a democratic society if the concept of human rights remains meaningful and human rights are still to be protected in the light of international terrorism, unconventional and civil wars, crisis of refugees and other challenges to the existence of the rule of law principle in modern democracies. Because of the repressive nature of the work of the police, sometimes because of the lack of philosophical view to human rights and the role of the police, also make the police responsible for human rights abuses, especially those connected to right to life, prohibition of torture, inhuman or degrading treatment, illegal detainment of persons (through excessive use of force, discriminatory practices), etc. The right to life (Article 2 of the Convention) is one of the most fundamental provisions in the Convention. Together with the protection from torture, it enshrines the basic values of democratic societies, and its interpretation must be guided by a recognition of its importance. In this article the violations of the right to life that occur during police activities, most precisely by using force by police officers, are analyzed. During the last twenty – thirty years there has been unprecedented demand for new legal regulation in the field of environmental protection, which influenced the immense growth in both the body of environmental legislation and in re-thinking the idea and principles of the environmental protection itself. The provisions of environmental law are passed, accepted and obeyed with a great resistance in the society. On the one hand, environmental law may be defined as a value system that seeks to induce humans to act as stewards of nature rather than only its exploiters, and therefore the environmental provisions are construed in a manner that the main instruments are limitations of different activities in order to prevent the disruption of natural systems. On the other hand, by doing so the environmental law places nature and future generations (those categories commonly do not have any legal personality) and not the human (the sole addressee and the beneficiary of the traditional legal system) in the centre of environmental regulation. This concept radically transforms the relationship between nature and mankind by subordinating the initiative to benefit from legal regulation. By doing so, the environmental provisions make the opposite and evolve tension in respect of such rights as the right to property, the right to personal life, or individual welfare. In the present research the aim is to disclose the origins and the most important principles of international and regional legal regulation of environmental protection, and to analyse the essence of environmental law in the context of public interest. The environmental law is analysed in the context of such human rights as the right to property and the right to personal life. ; Pastarieji dvidešimt–trisdešimt metų pasižymėjo beprecedenčiu naujo teisinio reguliavimo poreikiu aplinkos apsaugos srityje. Tai prisidėjo prie nepaprasto aplinkos apsaugos teisės aktų skaičiaus augimo ir pačios aplinkosaugos koncepcijos transformavimosi bei aplinkosaugos principų raidos. Aplinkos apsaugos teisės aktų nuostatos dažnai yra leidžiamos, priimamos ir joms paklūstama su dideliu visuomenės pasipriešinimu. Viena vertus, aplinkos apsaugos teisė gali būti apibrėžiama kaip vertybių sistema, kuri siekia, kad žmogaus veikla būtų gamtą saugojanti ir tausojanti, o ne tik savo privačius interesus tenkinanti nepaisant visuomenės interesų ir gamtos apsaugos problemų. Todėl aplinkos apsaugos nuostatos dažniausiai pasižymi tuo, kad pagrindinės reguliavimo priemonės yra įvairūs žmogaus veiklos apribojimai siekiant užkirsti kelią įvairių gamtos sistemų sutrikimui. Kita vertus, nustatydama veiklos apribojimus aplinkosaugos teisės transformuoja įprastinę teisės subjektų subordinaciją reguliavimo centru įvardindama ne asmens privačius interesus (vienintelį adresatą ir tradicinį teisinės sistemos naudos gavėją), bet gamtą ir ateities kartų poreikius (šios kategorijos dažniausiai neturi jokio teisinio subjektiškumo). Ši koncepcija iš esmės transformuoja gamtos ir žmogaus santykį ir todėl aplinkos apsaugos teisės normos dažnai sukuria priešpriešą ir kelia įtampą tokių asmens teisių kaip teisė į nuosavybę, teisė į asmeninį gyvenimą, teisė į asmeninę gerovę atžvilgiu. Todėl šiame tyrime siekiama atskleisti, kokios priežastys ir idėjinės nuostatos nulėmė būtent tokią aplinkosaugos teisės raidą, kokie yra pagrindiniai aplinkos apsaugos teisės šaltiniai. Šio tyrimo tikslas – atskleisti tarptautinio ir regioninio aplinkos apsaugos teisinio reguliavimo ištakas ir svarbiausius principus bei išanalizuoti aplinkos apsaugos teisės aktų esmines ypatybes.
Higher education is being criticized for its poor quality, insufficient participation of social partners in the management of universities, too-detailed study programmes, insufficient pedagogical staff and scientific research not society oriented. In the changing political, social and economic surroundings of higher education, the relation between higher education institutions and the state is influenced by changes as well. A common tendency of many countries is the weakening of the state influence and control towards higher education institutions, however the state, while still remaining the main financial source for higher education is interested in optimizing the effectiveness of higher education institutions, sustain a certain quality of higher education, and ensure its focus on the needs of society and market. A state which seeks to implement the mission of higher education, also society which has ambitions to become intellectual, competitive, economically capable in the context of modern political, economical, socio-cultural changes has to create necessary conditions (financial, legal, administrative), that would not conflict with the traditional and modern values of institutions of higher education, and would help universities improve and modernise their activity, become more competitive, and ensure implementation of the needs of the state and society. Higher education in Lithuania and its legal regulations constantly undergo various changes—necessary, timely, quite chaotic and fragmented. It is also important to note that legal regulation of higher education is harmonized and correlates with other means of state regulation—financing, quality (licensing, accreditation, external evaluation), formation and development of political activity strategy. There have recently been a number of reforms implemented in the field of higher education, related to financing of higher education, management, quality control and assurance, transformations of influence of the state institutions. Therefore, scientific research of these processes is relevant, important and timely. The quality assurance system of higher education in Lithuania was and still is one of the essential issues of higher education. The legal regulation of different aspects of quality assurance of higher education is insufficient, and certain dysfunctions and ineffectiveness may be preserved. The object of this research is the system of higher education quality assurance in Lithuania and dysfunctions of its legal regulation. The aim of this research is to analyze the problems of the state regulation in the field of higher education quality assurance. In this research models and ways of ensuring quality of higher education are analyzed, as well as influence of the scope of the autonomy of higher education institutions and state regulation on the quality of higher education in Lithuania. ; Lietuvos aukštojo mokslo kokybės užtikrinimo sistemos kūrimas buvo ir yra vienas iš aktualiausių aukštojo mokslo klausimų. Lietuvos aukštąjį mokslą reglamentavusiuose teisės aktuose kokybės užtikrinimas buvo nepakankamai reglamentuojamas, tam tikrų teisinio reglamentavimo disfunkcijų bei neveiksmingumo pastebima ir šiuo metu galiojančiuose teisės aktuose. Todėl tyrime analizuojama Lietuvos aukštojo mokslo kokybės užtikrinimo sistema ir jos teisinio reguliavimo disfunkcijos, nagrinėjami aukštojo mokslo kokybės užtikrinimo būdai ir modeliai, tiriama aukštojo mokslo institucijų autonomijos ir valstybinio reguliavimo apimties įtaka Lietuvos aukštojo mokslo kokybės užtikrinimui.
