This open access book contains 13 contributions on global animal law, preceded by an introduction which explains key concepts and methods. Global Animal Law refers to the sum of legal rules and principles (both state-made and non-state-made) governing the interaction between humans and other animals, on a domestic, local, regional, and international level. Global animal law is the response to the mismatch between almost exclusively national animal-related legislation on the one hand, and the global dimension of the animal issue on the other hand. The chapters lay some historical foundations in the ius naturae et gentium, examine various aspects of how national and international law traditionally deals with animals as commodity; and finally suggest new legal concepts and protective strategies. The book shows numerous entry points for animal issues in international law and at the same time shifts the focus and scope of inquiry.

En particulier, l'auteure se livre à une critique des critiques faites au modernisme. S'il y a de vrais apports de la part de la critique post-moderne, elle y voit également des limites, contradictions et exagérations. Il faudrait donc tenir compte de ce mouvement pour le dépasser pour un "post-postmodernisme" qui emprunte ce qu'il ya de bon dans les divers courants de doctrine(s). Deux des directions proposées sont une nouvelle approche du constitutionnalisme mondial et une reformulation du droit international fondée sur le respect des droits de la personne humaine."

Mit dieser Studie liegt erstmals eine systematische europäische Verfassungstheorie mit einer 'konstitutionalistischen' Integrationstheorie vor, die mit einer neuen Legitimationstheorie verbunden wird. Anne Peters zeigt, daß grundlegende europäische Normen das materielle Verfassungsrecht der EG/EU bilden. Die Institution der Verfassung ist vom Staat ablösbar, weil die - von der Verfassung zu verrechtlichende - Hoheitsausübung durch den Staat nicht (mehr) kategorial verschieden von der Hoheitsausübung durch die EG/EU ist. Die europäische Verfassung entwickelt sich kontinuierlich in einem pluralen und mehrseitigen Prozeß weiter, in dem die Bürgerbeteiligung verbessert werden muß. Im Hinblick auf die Legitimität der europäischen Verfassung erweisen sich die gängigen Legitimationsstrategien, insbesondere die Theorie der doppelten Legitimation der europäischen Verfassung, als kritikwürdig. Das neue Modell der Legitimation durch Bewährung integriert die konstitutionelle Unwissenheit als zentrales Element und legt eine weiterhin reformistische Verfassungsentwicklung und den Verzicht auf eine Finalitätsdiskussion nahe. Das existierende demokratische Defizit der EG/EU ist durch institutionelle Reformen behebbar, weil diesbezüglich keine unüberwindrlichen metarechtlichen Hindernisse bestehen. Die aufscheinende europäische Perspektive ist eine teilparlamentarisierte Verhandlungsdemokratie.

A principle of friendliness towards international law can mitigate the national bias of law appliers in the coordination of domestic law with international law that they need to perform. This is particularly important in times of populism, nationalism and a new authoritarianism. This contribution examines the legal theory and legal policy dimensions of the principle as well as some doctrinal aspects that hinge between theory and politics. My claim in legal theory is that the global network of norms and the plurality of perspectives espoused by the various actors can only function if all the legal systems involved (especially the national legal systems) develop a principle of "friendliness" towards the other legal systems. My claim regarding legal policy is that changes in the political context have radically altered the background conditions of the principle of friendliness towards international law, and that it has thus acquired a new important symbolic function. In order to fulfil the legal policy goal and pay more than mere lip service, law appliers should utilise old and new doctrines as techniques de réglage. Thereby, loyalty to the international community can be actually lived. The community's stability is in the long-term self-interest of each and every state.
