AbstractThis article aims to establish whether the Pacific Alliance truly configures a pragmatic regionalization scheme in Latin America. It approaches the study of its Constitutive Treaty to interpret its provisions—in light of the economic and legal theories of integration—and addresses its developments, so we can consider if the member countries intend willfully to achieve a deep integration or if these plans are merely baseless statements. We analyze the ostentatious challenges imposed by the preamble and its attractive—or perhaps wishful—objectives. Then, we verify or question the institutional framework to determine if it is strong enough. Finally, we consider if the Alliance has legal personality as an international organization. The inevitable conclusion is that, despite the noble and lofty objectives laid out in the Constitutive Treaty of the Pacific Alliance, its member countries have made little to no effort to materialize them with each other or in their relationships with third‐party countries—observer countries and those located in the Asia‐Pacific region.

Adding more than 50 years of Andean integration, it is worth asking how complex, cohesive and coherent is your organization? if you have achieved sufficient development and maturity, what guarantees the effectiveness of its rules? and if the right produced by its organs is an immediate source of rights and obligations for all those affected? To answer these questions, we will go through the scientific theories of economic integration, through the structure of the Andean ordering system and its rules of application, and we will end up with its political institutions. ; Al sumar más de 50 años de existencia de integración andina, conviene preguntarse ¿qué tan compleja, cohesionada y coherente es su organización? si ha alcanzado un desarrollo y una madurez suficiente ¿qué garantiza la eficacia de sus normas?, y si el derecho que producen sus órganos ¿son fuente inmediata de derechos y obligaciones para todos aquellos a quienes afecta? Para responder estos interrogantes, transitaremos por las teorías científicas de la integración económica, por la estructura del ordenamiento andino y sus reglas de aplicación, y finalizaremos con sus instituciones políticas.

Costa Rica and Nicaragua, that rarely reach direct agreements, had not delimited the maritime areas in the Caribbean Sea and the Pacific Ocean, nor the land boundary in the northern part of Isla Portillos. Thus, Costa Rica first initiated an action in the International Court of Justice in 2014 regarding the maritime issue, and later, in 2017, requested the definition of the land boundary of that area in Isla Portillos and that it be noted that Nicaragua had set up anew military camp on its beach.This text – in view of the parties' proposals- will analyze the recent judgment of the Court in the joined procedures, studyingthe proceedings followed, the relevant geography and history, the theses of the Parties and the reasoning of the Court. ; LA RECIENTE DELIMITACIÓN TERRESTRE Y MARÍTIMA DE LA CORTE DE LA HAYA (2 DE FEBRERO DE 2018) EN LOS ASUNTOS DE COSTA RICA CONTRA NICARAGUA A LA LUZ DE SUS PLANTEAMIENTOS Costa Rica y Nicaragua, que difícilmente llegan a arreglos directos, no habían delimitado los espacios marítimos en el mar Caribe y en el océano Pacífico, como tampoco el límite de tierra en la parte norte de Isla Portillos. Así, Costa Rica inició primero un procedimiento ante la Corte Internacional de Justicia en 2014 por el asunto marítimo, y más tarde, en 2017, solicitó la definición del límite terrestre de esa área de Isla Portillos y que se constate que Nicaragua había establecido un nuevo campamento militar en su playa. Este escrito –a la luz de los planteamientos de las Partes– analizará la reciente sentencia de la Corte que resolvió unidos los dos procedimientos, estudiando el trámite seguido, la geografía e historia relevantes, las tesis de las Partes y el razonamiento de la Corte. ; L'ARRÊT DE LA COUR INTERNATIONALE DE JUSTICE DANS LES AFFAIRES DE DÉLIMITATION MARITIME ET TERRESTRE (COSTA RICA C. NICARAGUA), À LA LUMIÈRE DE LEURS PROPOSITIONS RESPECTIVES (2 FÉVRIER 2018) Le Costa Rica et le Nicaragua, qui difficilement arrivent à des accords directs, n'ont pas délimité les espaces maritimes de la mer des Caraïbes et de l'océan Pacifique, ni la frontière terrestre dans la partie nord d'Isla Portillos. Ainsi, le Costa Rica a d'abord engagé une procédure en matière maritime devant la Cour internationale de justice en 2014, puis en 2017, a demandé la définition de la frontière terrestre de cette zone d'Isla Portillos et qu'il soit établi que le Nicaragua avait établi un nouveau Camp militaire sur sa plage.

Perú, Chile, México y Colombia están configurandouna organización interestatal denominada Alianza del Pacífico, que se presenta como un nuevo esfuerzo de integración regional, que además de estimular intercambios comerciales y sinergias entre sus socios, sería una herramienta idónea para la inserción de Colombia en la región Asia-Pacífico, de ahí que el escrito aborde por un lado, el estudio de Asia-Pacífico como región, los acuerdos que están negociando los países que la configuran y el relacionamiento de estos con los países latinoamericanos. Por otra parte, analiza qué estamento de integración económica está configurando la Alianza del Pacífico y si su institucionalidades consecuente con los propósitos que persigue

La relación conflictiva entre integración y Constitución nace tempranamentecon el surgimiento de las Comunidades europeas a causa delconflicto entre la dinámica de la integración, fundada en un límite a lasoberanía de los Estados, y la constitucional, destinada a la regulaciónorganizativa y la determinación de los derechos. Las cláusulas constitucionalesde apertura ofrecían el marco para la cesión de competenciasen los procesos de integración sin que se entendiera que se trataba de uncheque en blanco en favor de instituciones supranacionales.La solución de la tensión se resuelve con la distinción entre jerarquía yaplicación, la reducción de los ámbitos supranacionales a las competenciasexplícitamente cedidas en el marco constitucional, y el mantenimientode la Constitución como norma de normas. De esta manera el derechocomunitario puede gozar de primacía sobre la Constitución en cuantoa su aplicación, pero la legitimidad del derecho comunitario, en últimainstancia, reside en la propia Constitución. Se soluciona así el posibleconflicto entre derechos constitucionalmente protegidos e integración.

The troubled relation between integration and Constitution comesearly with the emergence of the European Communities as a result ofthe integration dynamic, based on a limit to the states sovereignty, andthe constitutional dynamic, aimed to the organizational control andthe determination of the rights. The opening constitutional clauses provided the framework for the cession of competences within integration processes without being understood that it was a blank check in favor of supranational institutions. The solution to the tension is resolved with the distinction between hierarchy and implementation, the reduction of the supranational sphere to the competences explicitly assigned within the constitutional framework, and the maintenance of the Constitution as supreme law. Thus the Community Law may have precedence over the Constitution in its application, but the legitimacy of the Community Law, ultimately resides in the Constitution itself.
