Résumé L'amélioration de la gouvernance du secteur public est un enjeu de taille pour les pays en développement. Dans cet article, nous prenons l'exemple de l'administration forestière guatémaltèque (Instituto Nacional de Bosque) (INAB) pour analyser une option novatrice dans la réforme du secteur public: la délégation de l'autorité à un organisme indépendant géré conjointement par des professionnels du secteur public, du secteur privé et de la société civile. Nous développerons un cadre analytique basé sur les coûts économiques et politiques des transactions. Notre analyse indique que si la délégation et le partenariat permettent effectivement de réduire l'apparition des intérêts politiques, ils comportent également un risque de « dérive de la délégation » et de « dérive de la légitimité ». Par conséquent, l'avantage comparé de la délégation et du partenariat est influencé par le niveau d'organisation des parties prenantes, par leur capacité de gestion et par l'ampleur de leurs intérêts communs. Nous examinerons également la dimension politique du processus de réforme qui a conduit à la création de l'INAB. Résumé à l'intention des praticiens Dans cet article, nous analysons l'administration forestière guatémaltèque, l'Instituto Nacional de Bosque (INAB), qui représente une option novatrice en matière de réforme du secteur public : la délégation de l'autorité à un organisme indépendant dirigé par un conseil d'administration comprenant des membres du secteur public, du secteur du bois, des ONG à vocation environnementale et des institutions d'enseignement. L'INAB est financièrement indépendant et son personnel n'est pas soumis à la loi sur la fonction publique. L'INAB est parvenu à éviter les problèmes de corruption et d'ingérence politique, deux défis majeurs dans la gestion des forêts tropicales. L'efficacité du modèle de partenariat qui est au centre de la structure de l'INAB est déterminée par la capacité du secteur privé et de la société civile à former des organisations au niveau national et à élire les professionnels qui les représentent au conseil d'administration. Ces conditions peuvent entraîner l'exclusion des groupes qui sont dépourvus d'une telle capacité organisationnelle, comme les utilisateurs locaux des forêts. Cette étude de l'INAB révèle également que la création d'un organisme indépendant n'élimine pas forcément les risques d'ingérence politique au fil du temps. Suite à un changement de gouvernement, les membres du personnel et les parties prenantes ont ainsi dû défendre l'INAB au moyen de manifestations, mais aussi en recourant au tribunaux, afin de maintenir l'indépendance de l'institution.

Improving public sector governance is an important challenge for developing countries. Taking the case of Guatemala's forest administration, the Instituto Nacional de Bosque (INAB), as an example, this article analyses an innovative option for public sector reform: the delegation of authority to an independent agency that is jointly managed by professionals from the public sector, the private sector and civil society. The article develops an analytical framework, based on transaction cost economics and politics. The analysis shows that delegation and partnership have considerable potential to reduce political interest capture, but they involve potential problems of 'delegatee drift' and 'legitimacy drift'. In view of this trade-off, the comparative advantage of delegation and partnership is influenced by the level of organization among the stakeholders, their managerial capacity and the degree to which they share common interests. The article also discusses the political dimension of the reform process that led to the creation of the INAB.

Decentralization and devolution—also referred to as 'rolling back the boundaries of the state'—are important policy trends in natural resource management. Drawing a parallel with the efficient-boundary problem in industrial organization, the authors show how transaction-costs economics can be applied to identify the efficient boundaries of the state in natural resource management. The following extensions of the transaction-cost framework are proposed: (1) introduction of care intensity and contest intensity as additional key attributes of transactions; (2) introduction of cooperative types of organization as a third governance structure besides market and hierarchies; and (3) introduction of natural resource characteristics, social capital, and state capability as contextual variables. The authors also discuss the possibilities for empirical application.

Participation is said to improve decisions on environmental conflicts. When investigating 16 case studies of participatory processes in European Water and Biodiversity Governance, which necessarily is multi-level, the picture becomes blurred: many different forms of participation can be observed, only few of them are well-defined and well organised; most of them are dominated by ad-hoc decisions on whom to include, how to close debates, and how to deal with uncertainty, complexity, and ambiguity. While nearly all of these processes could be improved by a more conscious and careful setting, the application blueprints will necessarily remain out of scope. Natural, cultural and institutional contingencies make each case special and often unique and the multi-level characteristic of European governance of natural resources adds an additional layer of complexity on how to organise participation. The empirical account of whether deliberation can deliver what it promises in theory is still incomplete.
