Taking the increasing importance of the EU in cultural matters as a starting point, this article attempts to assess to what extent the right to participate in cultural life (as defined based on various human rights instruments) is protected under EU law. Second it discusses the impact of EU law and policies on the enjoyment of this right. It highlights that the respect, protection and promotion of the right to participate in cultural life within EU law are obstructed by the asymmetry that exists at the European level and which favors on the one hand, non-political decision-making over political processes, and, on the other hand, negative on positive integration. This asymmetry indeed weakens national cultural policies without allowing space for specific European policies for positive integration. Third, it explores avenues for a better protection of the right to participate in cultural life under EU law.

This article argues that there is no normative conflict between IIL and international cultural law, but a conflict between the cultural interest of host states and the interest of foreign investors ( the culture-investment conflict of interests ) instead. Beyond, this article puts forth, and aims at shedding light on, the 'sensitiveness' of IIL to cultural heritage, i.e. the fact that the conventional granting of rights to foreign investors does not result in a regulatory chill with respect to the protection/promotion of cultural heritage. Summary In this article I reflect on the possibility of conceptualising human rights as institutional facts, making it possible to place them in a broader perspective than purely legal and moral ones. The proposal is based on John Searle's social ontology, but attempts to rethink it from the phenomenology of Edmund Husserl and the theory of social events in Adolf Reinach. In the final part I introduce problems related to the role of national states in the institutionalisation of human rights. To this end, I support Hannah Arendt's idea that human rights presuppose the right to rights and I refer to more recent comments from specialists. ; Resumen En este artículo reflexiono sobre la posibilidad de conceptualizar los derechos humanos como hechos institucionales, lo cual permite enmarcarlos en una perspectiva más amplia que las meramente jurídicas y morales. La propuesta se basa en la ontología social de John Searle, aunque intento replantearla desde la fenomenología de Edmund Husserl y la teoría de los actos sociales de Adolf Reinach. En la parte final introduzco problemáticas relacionadas con el papel de los Estados nacionales en la institucionalización de los derechos humanos. The article demonstrates how Library of Congress Subject Headings (LCSH) geographic headings for the Southern Levant mirror the political investment of Congress and the American public in Middle East politics over the last thirty years. The headings' evolution as well as Library of Congress rules governing their creation is charted in detail. These LCSH headings contrast markedly with those established in other national libraries (BnF, DNB) and independent value vocabularies (TGN, GeoNames), and global opinion regarding the legal status of the occupied territories. I sketch the historical context of their formation and offer suggestions as to how libraries can "decolonize" their metadata in service of Sanford Berman's "access and equity."
