The article demonstrates how Library of Congress Subject Headings (LCSH) geographic headings for the Southern Levant mirror the political investment of Congress and the American public in Middle East politics over the last thirty years. The headings' evolution as well as Library of Congress rules governing their creation is charted in detail. These LCSH headings contrast markedly with those established in other national libraries (BnF, DNB) and independent value vocabularies (TGN, GeoNames), and global opinion regarding the legal status of the occupied territories. I sketch the historical context of their formation and offer suggestions as to how libraries can "decolonize" their metadata in service of Sanford Berman's "access and equity."
The note comments on a judgment of the Court of Cassation of 4 December 2009 ruling on the matrimonial property regime of foreign couples married without a contract before the entry into force of the Code of Private International Law. The judgment held that reference should be made to the common nationality which the couple holds, even if that nationality is foreign, whereas one of the spouses also has the nationality of the court. ; La note commente un arrêt rendu par la Cour de cassation le 4 décembre 2009, statuant sur le régime matrimonial de couples de nationalité étrangère mariés sans contrat avant l'entrée en vigueur du Code de droit international privé. L'arrêt retient qu'il y a lieu de se référer à la nationalité commune que le couple possède, cette nationalité commune fût-elle même étrangère, alors que l'un des époux possède par ailleurs la nationalité du for.

Deux époux placés dans une situation internationale ont les raisons suivantes de changer de loi applicable à leur régime matrimonial : 1) s'adapter à leur environnement juridique actuel; 2) assurer la continuité des lois du régime et de la succession; 3) lever toute incertitude sur la loi applicable, car le critère par défaut (qui désigne la loi de la première résidence habituelle du couple) est affecté d'un élément de doute et peut entraîner des discussions s'il est éloigné du lieu de vie actuel des intéressés; 4) enfin, pour les couples mariés de longue date, mettre fin autant que faire se peu à la relativité des solutions en droit international privé, chaque Etat membre de l'Union utilisant autrefois des critères différents pour désigner la loi applicable à un même couple (cette dernière raison peut s'avérer très importante pour des époux possédant des biens ou recueillant des héritages sur le territoire de plusieurs Etats). Le règlement (UE) n° 2016/1103, d'application depuis le 29 janvier 2019, permet aux époux de changer de loi applicable à leur régime matrimonial. Ils doivent pour cela se conformer, dans la forme, aux conditions prévues par le droit de l'Etat membre sur le territoire duquel ils sont établis et dont ils choisissent la loi comme loi applicable à leur régime matrimonial. Cela passe en Belgique, sans surprise, par un acte notarié. Les époux déterminent à cette occasion s'ils changent seulement pour l'avenir ou s'ils donnent à ce changement une portée rétroactive, comme s'ils avaient toujours été mariés, depuis le jour de leur mariage, sous le régime de la loi nouvelle. Although the trend of opening up marriage to same-sex couples is largely increasing, it remains legally difficult in view of the cultural and sociological disparities that persist in this area. This contribution starts from a practical case with links with Belgium and Switzerland to present the multiple controversy that pave the way for same-sex couples who wish to divorce after choosing to marry in a state that recognises this right, although they nevertheless have links with one or more other states that do not know this type of marriage. ; Bien que la tendance consistant à ouvrir l'institution du mariage aux couples de même sexe soit largement croissante, elle reste juridiquement malaisée au regard des disparités culturelles et sociologiques qui persistent en la matière. La présente contribution part d'un cas pratique présentant des liens avec la Belgique et la Suisse pour présenter les multiples controverses qui jalonnent le parcours des couples de même sexe désirant divorcer après avoir fait le choix de se marier dans un État qui leur reconnaît ce droit, alors qu'ils présentent néanmoins des liens avec un ou plusieurs autres États qui ignorent ce type de mariage.
This post presents a working paper on the collective private enforcement of data subjects in the EU (Article 80 GDPR). While the first part of the paper examines the national adaptations of Article 80 GDPR in France, Belgium, Spain and Germany, the second part deals with private international law questions regarding international jurisdiction. ; L'article 80 du Règlement 2016/679 relatif à la protection des données (RGPD) prévoit que la victime subissant un dommage ayant pour cause la violation des dispositions dudit Règlement peut mandater un organisme, une organisation ou une association afin qu'il/elle la représente dans l'exercice de ses droits devant les tribunaux ou l'autorité de contrôle.Avec l'entrée en vigueur du RGPD, certains États membres ont « transposé » l'article 80 dans leur ordre juridique. En droit français, par exemple, en cas de manquement aux dispositions du RGPD, une action de groupe peut être intentée (article 43 ter de la loi relative à l'informatique, aux fichiers et aux libertés). S'il est vrai qu'en principe, l'application des règlements européens ne dépend d'aucune transposition, la présence de clauses dites « ouvertes » au sein du RGPD crée une situation juridique inédite, en ce sens que la participation des législateurs nationaux est requise. De surcroît, l'adaptation des règles de procédure sera parfois nécessaire, dans la mesure où l'article 80 RGPD exige qu'une action permettant la représentation des victimes puisse être intentée.Le working paper que nous présentons dans ce post analyse les conditions de l'article 80 RGPD. This Working Paper builds on the scientific discourse on valuation of SSH research as well as SSH-integration in EU framework programmes and aims at summarizing the key findings from the November 2018 Austrian EU Presidency Conference "Impact of Social Sciences and Humanities for a European Research Agenda - Valuation of SSH in mission-oriented research". It deals with the topic in three instalments. First, it will discuss recent trends in research funding. Second, it provides a brief historical overview of the efforts of integrating SSH into the EU Research Framework Programme. It then adds some observations about continued challenges in SSH. Finally, it will conclude with some suggestions for SSH scholars, based on the discussions from the conference. In that regard the Working Paper is also a document for further reading for those who have read earlier, shorter texts that were published in preparation of that conference.
