Dissolution of same-sex marriage under private international law: examination in the light of a practical case ; La dissolution du mariage d'un couple de même sexe en droit international privé : examen à lumière d'un cas pratique

Abstract

Although the trend of opening up marriage to same-sex couples is largely increasing, it remains legally difficult in view of the cultural and sociological disparities that persist in this area. This contribution starts from a practical case with links with Belgium and Switzerland to present the multiple controversy that pave the way for same-sex couples who wish to divorce after choosing to marry in a state that recognises this right, although they nevertheless have links with one or more other states that do not know this type of marriage. ; Bien que la tendance consistant à ouvrir l'institution du mariage aux couples de même sexe soit largement croissante, elle reste juridiquement malaisée au regard des disparités culturelles et sociologiques qui persistent en la matière. La présente contribution part d'un cas pratique présentant des liens avec la Belgique et la Suisse pour présenter les multiples controverses qui jalonnent le parcours des couples de même sexe désirant divorcer après avoir fait le choix de se marier dans un État qui leur reconnaît ce droit, alors qu'ils présentent néanmoins des liens avec un ou plusieurs autres États qui ignorent ce type de mariage.
