The article identifies social, legal, criminological and regulatory grounds that necessitated the criminalization by the domestic legislator in the Criminal Code of Ukraine of 2001 of this type of socially dangerous act as a violation of citizens' equality of rights depending on their racial, nationality, religious beliefs, disability, and other grounds (art. 161). ; В статье определены социальные, юридико-криминологические и нормативные основания, вызвавшие необходимость криминализации отечественным законодателем в УК Украины 2001 г. такого вида общественно опасного деяния, как нарушение равноправия граждан в зависимости от их расовой, национальной принадлежности, религиозных убеждений, инвалидности и по другим признакам (ст. 161). ; У статті визначено соціальні, юридико-кримінологічні та нормативні підстави, які викликали необхідність криміналізації вітчизняним законодавцем у КК України 2001 р. такого виду суспільно небезпечного діяння, як порушення рівноправності громадян залежно від їх расової, національної належності, релігійних переконань, інвалідності та за іншими ознаками (ст. 161).

The plight of the Rohingya, a persecuted minority from western Myanmar, highlights basic yet underexamined links between statelessness and mass atrocities. In turn, the Rohingya case underscores how statelessness matters to law and practice regarding atrocity prevention, and suggests that norms to prevent statelessness and secure nationality rights warrant greater emphasis in the field of atrocity prevention.
