National audience ; La laïcité constitue l'un des aspects importants de l'idéologie du parti Baath. Si sa conception ne préconise pas le principe de la séparation de l'Etat et de la religion, elle s'attache à exclure toute implication de la religion dans le politique. C'est au nom d'un nationalisme arabe laïque que le Baath prétend rassembler toutes les communautés syriennes abstraction faite de toute considération religieuse. Le règne des Asad commence avec la prise du pouvoir par Hafez al-Asad (père de l'actuel président) par un coup d'Etat le 16 novembre 1970. Il devient le premier président issu d'une minorité musulmane alaouite, mettant ainsi fin à la tradition syrienne des présidents de la bourgeoisie citadine sunnite. Il règne sur la Syrie pendant trente années jusqu'à sa mort en 2000 où il est succédé par son fils Bachar al-Asad. Le caractère autoritaire et communautaire du régime des Asad débouche sur une séparation entre l'exercice du pouvoir politique et l'idéologie du parti Baath censée l'inspirer. Dans ce contexte, la laïcité revêt une dimension symbolique et devient un moyen et non un objectif à atteindre. In the land of Islam, the religion-Islam couple will cover the entire living space, Islam is the source of politics, that is, the life of here and the spiritual, a confusion that makes Muslims to this day have not yet solved the equation of the political sphere and the religious sphere. Throughout Islamic history, the caliphate jealous of their prerogatives, will do everything to assert their legitimacy and domination, a practice that will create in the Muslim imagination a reference on the art of governance, later an example to follow. In 1925 an 'Alim will mark a break with the confusion of politics and religion, proposing a separation between the two and the search for a new political science, one based on reason. Our research work starts with Ali Abderraziq polemical work, "Islam and the foundations of power", and we wanted to update the theses put forward in this book, which Abdou FILALI-ANSARY describes as a decisive treatise on a major and delicate issue, that of the relationship between political and religious power. We have been interested in this work in the relationship between the two powers in the founding moments of Islamic thought, namely the prophetic period, that of the caliphs and the world of today. The period of birth of the umma was that of the propagation of the divine message but also the creation of a community, which goes quickly, by a natural act seek to unite around a leader once Mohamed is no longer of this world. As a result, the question of succession will punctuate political life in the Muslim world, and often it is in the blood that conflicts will be resolved. We have tried to approach the links between the two powers. Nous nous sommes intéressés dans ce travail aux rapports entre les deux pouvoirs dans les moments fondateurs de la pensée islamique, à savoir la période prophétique, celle des califes et le monde d'aujourd'hui. The place of religion in the Egyptian and Kuwaiti constitutional order has been changing a lot within times. It had little presence in the Egyptian constitution at the beginning but soon, it earned its place, especially with the appearance of extremisms in power, before loosing power. In Kuwait, the religion always has had a major place in the constitutional system and in the political life. This predominant place has left few space for a modern view of legislation. Both Egyptian and Kuwaiti jurisdictions have an important role in the interpretation of laws giving reference to religion. In Egypt, grassroots movements rised against the leadership of religious extremisms in the constitutional order and against their influence on the regulation system. In Kuwait, these grassroots rised against the dictatorship and for democracy. In both states, Islam appears like a standard face to the rights and freedoms included in the constitutions. Islam is a source of law that has been interpreted by the state jurisdictions. The purpose of this thesis is to show that the place of religion takes from the constitutional and legal order of these two states a number of freedoms and establishes a religious vision. ; La place de la religion dans les systèmes constitutionnels égyptien et koweïtien a connu des bouleversements au fil du temps. We assume a generalized heteronomy that promotes the action of multi‑positioned agents reaching to transform and circulate the idea of a "Muslim problem" in several social spaces. In this context, the secular ideas advanced in most drafts of the constitution were in a weak position, since the very principle of laicization was sometimes seen as a Communist principle. In parallel, the bishops who had used anti-Communist arguments seemed to show an indulgence for aspects of the pre-1989 period, as can be seen in the recently published proceedings of the joint government-episcopacy commission. ; Après 1989 en Pologne, les représentants de la gauche ex-communiste sont la cible d'attaques politiques visant leur passé communiste. Ces attaques, formulées notamment par les conservateurs et les hiérarques catholiques, permettent d'entretenir un clivage opposant les « post-dissidents » aux « post-communistes ».
