The authors points out that there are several objective prerequisites for supranational mechanism to be implemented. These include a well-developed economy, high degree of internationalization and substantal level of economic interdependence. The growing contradictions between the national regulation and transnational economy can be eased by recourse to supranational mechanisms. The globalization opens the way for supranational solutions on a broad international scale.

Der Autor gibt eine Einführung in den vorliegenden Sammelband, der die Legitimität der supranationalen Institutionen in der EU-Debatte in den neuen und alten Mitgliedstaaten zum Thema hat. Die Forschungsarbeiten wurden auf einer Tagung in Prag präsentiert, an der Experten sowohl aus den neuen als auch aus den alten Mitgliedstaaten sowie aus Norwegen und der Schweiz teilgenommen haben. Die Vielfalt ihrer Erfahrungen und Schwerpunkte sowie der vertretenen Ansichten spiegelt nicht nur verschiedene Aspekte dieser öffentlichen Debatte wider, sondern unterwirft sie auch einer reflexiven Untersuchung. Der Autor erläutert die theoretischen Vorarbeiten zur Tagung und stellt einzelne Forschungsergebnisse kurz vor. Er bezieht sich dabei auf den Vergleich der Ansichten der alten und neuen Mitgliedstaaten über die Legitimität der Europäischen Union sowie auf das Problem von Anerkennung und Interaktion in der reflexiven Analyse. Security: a supranational legal asset
This paper discusses the concept of security as a manysided, multifunctional and multilevel regulation topology which requires its several actors to view legal assets from a polygonal perspective worthy of legal protection from local to global and from global to local space. The concept of security as a supranational legal asset requires criminal legislation which defines the principles of criminal policy and the intervention of criminal Law, barriers to security trends and to the attempt to enhance the principle of presumed hazard as a basis for criminal intervention. We contend that the obstacle to "human self-objectification" in the global polygon is a (new) world legal order as humanity's future balance.

Ce texte tente d'expliquer pourquoi on assiste actuellement à un pourrissement de l'espace public et à une « ethnicisation » des rapports sociaux au Québec. L'évocation de la primauté du droit et l'affirmation des droits des minorités s'inscrivent dans le mouvement de judiciarisation des rapports sociaux et de constitutionnalisation des droits, mouvement propre à la situation du Canada après 1982. Ainsi, une série de choix politiques effectués au Canada ont eu pour effets de fragmenter les identités et de soumettre les instances législatives au tribunal. On assiste dès lors à la naissance d'une citoyenneté particulariste d'inspiration bioculturelle et à une régression des débats démocratiques dans un espace qui n'est plus qu'un lieu d'affrontement des droits particularistes. Après avoir montré comment cette situation esquive la question, fondamentale en démocratie, de la communauté politique, les auteurs analysent les situations canadienne et québécoise. Le Canada, transformé en une communauté juridique, se voit empêché de construire une véritable communauté politique pancanadienne, alors que le Québec arrive difficilement à faire s'épanouir une culture politique francophone commune au sein d'une société désormais pluriculturelle et multinationale. Les auteurs proposent, face à l'urgence actuelle de la démocratie à l'échelle planétaire, de réinventer la communauté politique sur une base plus large et de repenser l'exercice de la démocratie dans des institutions supranationales fondées sur la pérennité d'unités de base nationales.

With the European Economic Interest Grouping, the European Company, the European Cooperative and the nascent European Private Company, the series of supranational corporate forms has now attained a scope which invites critical-comparative stock-taking. This article examines the foundations, the development and the architecture of the European Union's own legal creations. Taking a comprehensive approach, it attempts to synthesize existent legal material and thus provide impetus for the elaboration of a theory on supranational corporate forms in Europe. The article looks at the regulatory instruments which the European legislature has used to overcome resistance by the Member States with regard to the development of supranational corporate statutes. It also assesses the EU-wide exchange of ideas and models in the context of the development of supranational corporate forms. Finally, attention is paid to the key characteristics and elements of supranational corporate forms, including: legal personality; corporate purpose and company object; cross-border involvement; registered and head offices and company members from third countries.
