Este artículo se centra en la problemática de la protección de los derechos sociales y los nuevos paradigmas de la gobernanza económica de la eurozona. Como resultado de las reformas de los últimos años de los tratados y de las recientes modificaciones en la gobernanza económica de la UE, a los gobiernos estatales no les es posible elaborar su propio sistema político y jurídico en asuntos económicos y sociales. Este trabajo analizará estas particularidades así como las limitaciones legales e institucionales que han coartado la soberanía económica de los Estados miembros.This article focuses on the issue of protection of social rights and the new paradigms of economic governance in the euro area. As a result of the recent treaty reforms and recent changes in EU economic governance, it is not possible for state governments to develop their own political and legal systems in economic and social affairs. This paper will analyze these particularities as well as the legal and institutional constraints that have curtailed the economic sovereignty of the Member States.
One of the factors determining the development of the securities market in the country is the level of corporate governance. It is clear that without respect for the rights of small shareholders of the company, is not created for them the possibility of effective enjoyment of these rights and on the possibility of leaving the company, and similar factors make it difficult to attract funding through the securities market. From this point of view, the effect of creating a mechanism to protect investors' rights legislation of the country on the development of the securities market significantly. The financing of the national economy the main role belongs to the market for corporate securities. Securities market creates additional opportunities for financing firms. This creates an incentive for the company's development and corporate management firm. This fiscal squeeze in many cases firms to refrain from taking effective financial decisions, which in turn negatively affects economic development. Emerging in the country system of corporate governance is to ensure equal and fair treatment of all shareholders, including small shareholders, shareholders and foreign shareholders who do not participate in managing the company.
The quality is a degree of excellence, and what is excellent is new. The evaluations of the quality of the organizations, departments, functional areas, activities, products and services have been recognized by the goodness of their results beginning to be mandatory and of increasingly strict application in the search of the fulfilment of its purposes. The quality has been a goal of many countries. In Ecuador, the Constitution establishes that the public administration is governed by principles, among others: the quality. This involves the participation of the people to ensure the actions in the organizational context. The quality has an impact on people, activities, processes and outcomes; all guided toward excellence. An intention of quality (not exclusive from the point of view of the analysis of other models) and at the same time of the Government of the TSI is the application of good practices of the Ibero-American Model [3] and of the standard ISO/IEC 38500 [4], respectively. The proposed quality assessment model exposes the government of TIS as a functional team at the service of the organization of TIS. Therefore, the model is a response to the value-based quality concept on value due to the extent that Ecuador is gaining a growth in the use of technology. The existing literature on EFQM models, Malcolm Baldrige and other authors who support it, was available for this work [5] [6] [7] [8]. Energy is linked to economic development and national security. Governments have often understood energy as an area of «high politics» where national interests are above collective interests. However, the evolution of the concept of energy security, the growing awareness of the need to improve access to modern energy and to avoid dangerous climate change transformed the way of confronting energy issues. Global energy governance has become the concept for analyzing international collaboration. Conceiving of global energy governance demands understanding the nature and magnitude of energy. Equally important is to know who is responsible for taking the decisions. Only then we will be able to make appropriate steps. This article focuses on both elements: why energy is a global issue and who governs it. ; La energía está ligada al desarrollo económico y la seguridad nacional. A menudo los gobiernos han entendido la energía como un área de la «alta política» donde los intereses nacionales predominan sobre los intereses colectivos. Sin embargo, la evolución del concepto de seguridad energética, la creciente conciencia de que es necesario mejorar el acceso a los servicios de energía modernos así como evitar un cambio climático peligroso, modificó esa aproximación hacia los problemas energéticos. La gobernanza energética global se ha convertido en el concepto de análisis de la colaboración internacional. Entender el concepto de gobernanza energética global precisa conocer la naturaleza y la magnitud del ámbito energético. Igualmente importante es conocer quién es el responsable de tomar las decisiones. Sólo entonces seremos capaces de tomar las medidas adecuadas. Este artículo se centra en analizar dos elementos: por qué la energía es un problema mundial y quién la gobierna.
El presente texto aporta una serie de reflexiones sobre el fenómeno del nuevo populismo a partir de una metodología cualitativa descriptiva, estructurando su contenido en 6 epígrafes. En primer lugar, se desarrolla la operativización del concepto populismo avanzando progresivamente en su concepto antagónico, principalmente, el paradigma de la gobernanza democrática desde un enfoque plural y complejo, hasta las conclusiones y la bibliografía consultada para la realización del mismo. Durante los últimos años, el populismo es el resultado de la crisis de la democracia representativa y de la desafección política de la ciudadanía. Además, hay una serie de hechos que en nuestra opinión favorecen de forma notable el populismo, entre ellos son: los efectos de la crisis económica, la progresiva exclusión social, el empobrecimiento imparable de las clases medias, la trivialización de la política, etc. Por este motivo, la finalidad este artículo es reflexionar sobre el peligro para la democracia que el populismo representa en todas sus manifestaciones y modalidades, y la necesidad de fortalecer e impulsar a la democracia a través del paradigma de la gobernanza democrática, lo cual significa, la preminencia de la sociedad civil, Tercer Sector y de la ciudadanía, y su participación en los asuntos públicos para reclamar transparencia, rendición de cuentas y cultura y valores de lo público para lograr un avance hacia la democracia de calidad. ; This text provides a series of reflections on the phenomenon of the new populism from a descriptive qualitative methodology, structuring its content in 6 epigraphs. In the first place, the operationalization of the populism concept is progressively progressing in its antagonistic concept, mainly, the paradigm of democratic governance from a plural and complex approach, to the conclusions and bibliography consulted for its realization. During the last years, populism is the result of the crisis of representative democracy and the political disaffection of citizenship. In addition, there is a series of facts that in our opinion favor populism in a remarkable way, among them are: the effects of the economic crisis, the progressive social exclusion, the unstoppable impoverishment of the middle classes, the trivialization of politics, etc. For this reason, the purpose of this article is to reflect on the danger to democracy that populism represents in all its manifestations and modalities, and the need to strengthen and promote democracy through the paradigm of democratic governance, which means, the pre-eminence of civil society, the Third Sector and citizenship, and their participation in public affairs to demand transparency, accountability and public culture and values in order to achieve progress towards quality democracy.

El espigado ascenso del Estado de bienestar y el Estado desarrollista dieron paso a una generación de ilusiones sobre la prosperidad económica interminable. Las crisis económicas de finales de los setenta e inicios de los ochenta acabaron rápidamente con estos sueños, reestructurar el Estado era inminente. Los choques económicos fueron el pretexto para iniciar la reestructuración del sistema económico mundial (que mostraba signos de moderación en las tasas de crecimiento) con la implementación del recetario homogéneo del neoliberalismo. De esta forma, el mundo abría paso a la globalización económica (financiera) a gran escala.Más de treinta años después, el neoliberalismo ha demostrado que con su llegada no solucionó, sino que agravó problemas que ya aquejaban al Estado de bienestar. Con sus políticas de austeridad, el neoliberalismo solo logró precarizar las condiciones de vida humana, llevando los beneficios estatales al suelo por medio de la privatización; reduciendo los ingresos fiscales para implementar futuras políticas estatales; y disminuyendo considerablemente los beneficios individuales del grueso poblacional con las políticas de flexibilización laboral.Esto lleva a pensar en la función del Estado en tiempos de la globalización neoliberal, en la que su soberanía se ve limitada por el proceso de liberalización económica, dependencia de grandes inversiones y préstamos extranjeros, resultando la obstaculización del ejercicio político en pro de la formación ciudadana y los mecanismos de control.El texto abordará las problemáticas derivadas de los principales modelos estatales del siglo XX, en contraste con la reciente gran recesión y los retos del Estado para solucionar las desigualdades. ; The fast rise of the welfare state in its developed and developing version paved the way to a generation filled of illusions about the endless economic prosperity. What it is more, the economic crisis at late 70`s and early 80`s ended these illusions rapidly; restructuring the state was imminent. The economic recession was the pretext to start restructuring the global economic system (that had showed low economic growth rates) with the homogeneous neoliberalist policies. In this sense, the world was now opened to a massive economic (financial) globalization.Thirty years after, neoliberalism has proved that its arrive has not solved but sharped the welfare state inherited problems. With its austerity policies, neoliberalism just undermined humane life conditions, bringing the state benefits down by means of privatization; decreasing fiscal revenue to implement future state policies, and weakening substantially individual incomes of the population with labor flexibility policies.This process leads to think about the state`s role in times of neoliberal globalization, where state sovereignty is limited by the economic liberalization process, huge private investment dependency and international loans, resulting in the obstruction of the political exercise in favor of citizenship educational process and accountability mechanisms.This article will outline the problems inherited from the XX century most important state models, welfare and neoliberalist, in contrast to the recent major recession and the state`s task to reduce inequalities.
The article attempts to provide a theoretical discussion on territorial governance by presenting both the neo-institutionalist position and the De Sousa Santos' alternative models, with a view of highlighting the dimensions that can be relevant to understanding the territorial dynamics of Local Agro-food Systems (LAFS). The paper aims to build up a system of indicators, structured in four dimensions, concerning the territorial governance of LAFS: (i) multi-level coordination; (ii) democratic participation and accountability; (iii) cooperation among producers and other stakeholders and (iv) relationships with the environment. We verify, as a hypothesis, that the typology of markets to which the identity-based products are directed plays a decisive role in the way that processes of territorial governance of LAFS are constructed. The results of an empirical research, developed in four LAFS in Mexico, are presented: prickly pear cactus in Morelos, blackberry in Michoacán, cuitlacoche (corn smut) in Tlaxcala and coffee in Veracruz. Two types of territorial governance of LAFS may be distinguished: those that can be strengthened by the geographical and organisational proximity of the markets and the action of local stakeholders and governments—prickly pear cactus and cuitlacoche—versus those which are devoted to export and are conducted by large companies in which marketing networks involve certification mechanisms and a large number of institutions—coffee and blackberry. El hegemón es un actor fundamental en la gobernanza internacional. No obstante, mientras que el comercio, poder y guerra han sido temas ampliamente abordados desde los estudios sobre hegemonía en las Relaciones Internacionales, se ha avanzado poco en análisis de las ideas que orientan el comportamiento del hegemón. La hipótesis aquí planteada es que las hegemonías recorren a lo largo de su existencia cinco fases (emergencia, despliegue, apogeo, declive y extinción) y, durante cada una de ellas, el Estado hegemónico asume ideologías específicas que orientan su comportamiento internacional, lo cual se traduce en la promoción de ciertas políticas internacionales, así como de alianzas y organizaciones internacionales con vocaciones específicas. Sin embargo, en la medida que evoluciona su poder nacional y el hegemón transita de una fase a otra, éste tiende a cambiar ideológicamente, abandonando ideas previas y asumiendo otras nuevas. Si bien dicha transición ideológica es pragmática -en función de las necesidades de su poder nacional- este cambio resulta discordante y criticable por otros actores del sistema. Este documento se compone de dos grandes partes: en la primera se establecen las cinco fases de un ciclo hegemónico y, luego, se exponen las ideologías que orientan el comportamiento del Estado hegemónico en ellas; la segunda parte se orienta a comprobar empíricamente las transiciones ideológicas durante las hegemonías neerlandesa, británica y estadounidense. Abstract: The hegemon is a fundamental actor in international governance. However, while trade, power and war have been topics widely discussed from studies on hegemony in International Relations, little progress has been made in analyzing the ideas that guide the behavior of the hegemon. The hypothesis proposed here is that the hegemonies pass through five phases during their existence (emergence, deployment, apogee, decline and extinction) and, during each of them, the hegemonic State assumes specific ideologies that guide its international behavior. However, as the national power evolves, and the hegemon moves from one phase to another, it tends to change ideologically, abandoning previous ideas and assuming new ones. Although this ideological transition is pragmatic - depending on the power needs of the hegemon- this change results discordant and is criticized by other actors in the system. To demonstrate this, the following document is composed of two major parts: the first presents the five phases of a hegemonic cycle and, along with it, the ideologies that guide the behavior of the hegemonic State; the second part aims to empirically verify the ideological transitions during the hegemonies that have existed: the Dutch, the British and the American. European society is mostly urban. However, metropolitan areas do not enjoy political recognition at European level and, in most cases, neither at a national level. In this article we make a comparative analysis of metropolitan governance models in Europe based on four variables: the territorial fragmentation, the powers of a metropolitan nature, the sources of financing and the type of political representation. In most European countries there are no metropolitan governments with exclusive competences and fiscal autonomy, although the recent reforms in Italy, England and France are framed in a greater recognition of the metropolitan reality. The absence of strong metropolitan governments contrasts with the evolution of the design of European funds, in which the urban dimension of policies has gradually been included. Nevertheless, the management of European funds by metropolitan authorities is a minority option, which poses a challenge for metropolitan governance. ; La sociedad europea es mayoritariamente urbana. A pesar de ello, las áreas metropolitanas no gozan de reconocimiento político a escala europea y, en la mayoría de los casos, tampoco a escala nacional. En este artículo hacemos un análisis comparado de los modelos de gobernanza metropolitana en Europa a partir de cuatro variables: la fragmentación del territorio, las competencias de naturaleza metropolitana, el tipo de financiación y el tipo de representación. En la mayoría de países europeos no existen gobiernos metropolitanos con competencias exclusivas y autonomía fiscal, aunque las tendencias recientes de reformas en Italia y Francia se enmarcan en un mayor reconocimiento de la realidad metropolitana. La ausencia de gobiernos metropolitanos fuertes contrasta con la evolución del diseño de los fondos europeos, en el que se ha ido incluyendo progresivamente la dimensión urbana de las políticas. A pesar de todo, la gestión de fondos europeos por parte de autoridades metropolitanas sigue siendo minoritaria, lo que plantea un reto para la gobernanza metropolitana.
The article focuses upon the problem of political affiliation in corporate governance. It aims to provide insights into theoretical and methodological aspects of the problem applied to the Russian corporate environment. The author evaluates the academic relevance of the problem in international studies, reviews the underpinning fundamental theories, provides an insight into the construct of political affiliation through the lens of corporate governance, outlines the methodology used in the studies of political affiliation to eventually assess the relevance of the problem to the Russian corporate environment.
Los seres humanos son seres de emociones que defienden posturas individualistas frente a un narcisismo marcado con serias consecuencias económicas y sociales. El presente artículo está dirigido a mostrar como desde la actuación de los gobernantes en Colombia y como frente a la ética se han perdido varias de las bases morales que se predicaban en Grecia, como cuna de la Ética, y de qué manera el gremio contable debe solidificar sus bases en la formación de futuros contadores y profesionales de la contaduría pública. Se inicia con los conceptos de gobernanza y de ética y se analizan desde la práctica en algunos gobernantes. Se termina con cifras sobre corrupción en ámbito contable. Hay preocupación muy abierta por mejorar la credibilidad en la profesión contable como asesores de la alta dirección debido al grado de responsabilidad en la ética social. La metodología utilizada fue revisión documental y analítica. Como conclusiones están la valoración de lo público en efectos éticos de la profesión contable y la transformación de prácticas centradas en la escasa responsabilidad social y el retorno de valores como compromiso indispensable para el devenir social. ; Human beings are beings of emotions that defend individualistic positions against a narcissism marked with serious economic and social consequences. The present article is aimed at showing the performance of the rulers in Colombia and how, in the face of ethics, some the moral bases that were preached in Greece, as the cradle of Ethics, have been lost. 1. Introducción o motivación de la tesis Si existe alguna institución jurídica peculiar es, sin duda, la Fundación. El objeto del ente fundacional ha evolucionado, desde la primitiva finalidad funeraria y su posterior actividad benéfico-asistencial, hasta llegar, especialmente a partir del siglo XX, a un amplio elenco de posibles fines, los cuales, bajo el nexo común del interés general, van a posibilitar que las fundaciones puedan estar presentes en, prácticamente, todos los campos de la sociedad, incluido el espectro económico y comercial. La versatilidad de los fines fundacionales ha permitido un importante auge de las fundaciones y, paralelamente, un desarrollo normativo de estas entidades que, respondiendo a las demandas sociales, va a dar lugar a una relación cada vez más estrecha entre la Fundación y otras figuras jurídicas. La regulación de esta institución en al ámbito del Derecho privado, su entrada en la esfera económica y el uso que ha hecho de ella la Administración Pública, han sido los estímulos que han propiciado la elaboración de esta Tesis, la cual se estructura en dos bloques bien diferenciados que esbozan los trazos característicos de esta institución, así como las diversas opiniones doctrinales y jurisprudenciales que han sido vertidas al respecto. El primer bloque, dedicado a las fundaciones en general, comienza con un breve excurso histórico sobre el fenómeno fundacional para, acto seguido, proceder a una delimitación conceptual de esta figura que permita diferenciarla de otras colectividades de naturaleza asociativa que conforman el llamado Tercer Sector. Partiendo de la misma, se extraerán sus principales elementos característicos que servirán como criterio clasificador de los distintos tipos de fundaciones. Tras ello, se analiza el régimen jurídico vigente, prestando especial atención a la constitucionalización del derecho de Fundación, que consagra el artículo 34 de nuestra Carta Magna, y a su posterior desarrollo legislativo, tanto en la esfera estatal, a través de la vigente Ley 50/2002, de 26 de diciembre, de Fundaciones, como en la autonómica, destacando la Ley 10/2005, de 31 de mayo, de Fundaciones de la Comunidad Autónoma de Andalucía. Asimismo, también se aprovecha el excurso normativo para bosquejar el régimen jurídico de las fundaciones en Derecho comparado tomando como referencia la regulación vigente en ciertos Estados de nuestro entorno. Por último, se concluye este primer bloque con un estudio más detallado de los elementos esenciales de la Fundación, los cuales pondrán de manifiesto la importancia de una buena gestión del ente fundacional. A saber: el fin, que necesariamente ha de perseguir el interés general, la voluntad de la persona fundadora plasmada en el negocio jurídico fundacional, la dotación, que, si bien forma parte del patrimonio de la Fundación, no podemos confundir con este último, y la organización, la cual será objeto de desarrollo pormenorizado en el segundo bloque de la Tesis. En concreto, en la segunda parte de la Tesis se profundiza en el elemento organizativo, el cual se estructura, principalmente, en Patronato y Protectorado, sin olvidar el aún pendiente de materialización Consejo Superior de Fundaciones. Mientras que el Patronato se configura como el órgano de gobierno ordinario de la Fundación, el Protectorado actúa como nexo de unión entre la actividad privada del ente fundacional y la intervención administrativa pública, es decir, entre Derecho privado y Derecho público, idiosincrasia propia y específica de la figura objeto de esta Tesis. En este contexto, el Protectorado supervisará la actividad del Patronato, modulando y matizando, por tanto, la acción de gobierno de este último. Por su parte el Consejo Superior de Fundaciones, órgano de naturaleza consultiva diseñado por la normativa que aún no se constituido, se configura como un órgano asesor del sistema de fundaciones que debería prestar una importante labor de apoyo tanto a Patronato como Protectorado. En relación con el Patronato, se analiza su imperativa composición colegiada, la capacidad necesaria para formar parte del mismo, su organización y funcionamiento, el régimen aplicable a la aceptación y cese del cargo de patrono, la gratuidad en su desempeño y la posible exigencia de responsabilidad derivada de su ejercicio. Por su parte, el estudio del Protectorado comienza con el fundamento que justifica la intervención pública en la actividad fundacional para, seguidamente, abordar sus principales funciones y su organización a nivel estatal y autonómico, donde prestaremos especial atención a la coexistencia de múltiples Protectorados, a su naturaleza única o múltiple y a la determinación de cuál de ellos resultaría de aplicación en cada supuesto. Asimismo, tanto en el estudio del Patronato como del Protectorado, se analiza brevemente la regulación de sus figuras análogas en el fallido Proyecto de Reglamento comunitario mediante el que se pretendía aprobar un Estatuto de Fundación Europea. Por último, el segundo bloque concluye con el análisis del Consejo Superior de Fundaciones y sus figuras afines en las distintas Comunidades Autónomas. Finalmente, como colofón, se exponen las conclusiones obtenidas, así como la relación jurisprudencial y bibliográfica que han sido objeto de consulta.
La actuación de las ciudades como fuerza política eficaz e influyente en la gobernanza global multinivel cobra cada vez más relevancia a partir del nuevo milenio. Una de las manifestaciones del potencial de la ciudad está, por ejemplo, en la provisión de soluciones a problemas locales que pueden ser escalables globalmente, y viceversa. De ahí el oportuno planteamiento de una agenda de investigación más allá de las establecidas por la paradiplomacia y la ciudad global que identifique categorías/variables clave queayuden en la propuesta de trabajos de corte empírico, como puede ser la imagen, la agencia e identidad, tan necesarios para asentar y confirmar los presupuestos en torno a la ciudad en la gobernanza global multinivel. ; The performance of cities as an efficient and influential political force in multilevel global governance is becoming more and more relevant in this millennia; for example, in the provision of solutions to local problems that can be tailored globally, and vice-a-versa. This is one of the manifestations of the potential of cities within global governance, and from there the opportune approach of an agenda of investigation of the context of the city in relation to its role in the global context beyond the Paradiplomacy and the Global City approaches. That in turn implies an identification and analysis of categories of key investigation such as: image, agency, and identity, with the objective to generate not only points of debate, but more importantly a theoretical proposal that later supports the approach of empirical work that is necessary to set and confirm the budgets of the city within the context of multilevel global governance.
