Article describes the issues of shaping the structures of local government administration considering new concepts of public management. Attention will be focused on governance, which determines two paradigms of public administration: public administration aimed at cooperation and organized in a network manner. Will evaluate the degree of their impact on the structure of local government administration in Poland. Further considerations will aim to identify the relationship between the quality of governance and administrative structure of local government. The quality of governance is recognized (by the World Bank) in six dimensions of good governance, which is a function of appropriately shaped bodies. Striving to meet the criteria of good governance may involve restrictions on the use of cooperation and networking paradigms. ; Artykuł podejmuje problematykę kształtowania struktur administracji samorządowej w świetle nowych koncepcji funkcjonowania sektora publicznego. Uwaga została skoncentrowana na współzarządzaniu, które wyznacza dwa paradygmaty administracji publicznej: administrację publiczną ukierunkowaną na współpracę oraz zorganizowaną w sposób sieciowy. Ocenie poddany został stopień ich wpływu na kształtowanie struktury administracji samorządowej w Polsce. Dalsze rozważania miały na celu identyfikację związku pomiędzy jakością rządzenia a strukturą administracyjną samorządu terytorialnego. Jakość rządzenia ujmowana jest (za Bankiem Światowym) w sześciu wymiarach dobrego rządzenia, które z kolei jest funkcją odpowiednio ukształtowanych instytucji. Dążenie do spełnienia kryteriów dobrego rządzenia może wiązać się z ograniczeniami w stosowaniu paradygmatów współpracy i sieci.

Šport je z modernizacijo družbe in intenzivnejšo globalizacijo postal visoko organiziran in strukturiran globalni fenomen. Na njegov razvoj so vplivali različni dejavniki, vodenje na globalni ravni pa so prevzele mednarodne športne organizacije, v prvi vrsti Mednarodni olimpijski komite (MOK), okrog katerega se je izoblikoval t. i. reguliran olimpijski sistem. Disciplina Mednarodnih odnosov v primerjavi z ostalimi družbenimi vedami zaostaja pri proučevanju globalnega športa, ki tako ostaja eden manj vidnih in proučevanih vidikov globalnega vladanja. Eden od razlogov za to je tudi odsotnost resne in sistematične teoretske analize. Za zapolnitev te vrzeli je cilj magistrskega dela odgovoriti na vprašanje, kako lahko z uporabo teorij mednarodnih odnosov in analizo olimpijskega sistema z značilnostmi globalnega vladanja razumemo nastanek, obstoj in delovanje globalnega vladanja na področju športa kot enega izmed področij globalnega vladanja. Opredelitev reguliranega olimpijskega sistema kot globalnega vladanja na področju športa omogoča uporabo prevladujočih teorij mednarodnih odnosov (realizma, liberalizma, konstruktivizma, marksističnih teorij) na tem področju. Te v okviru svojih zmožnosti razlagajo in pojasnjujejo delovanje globalnega vladanja na področju športa, skupno pa izpostavijo pomembne elemente in pojave globalnega športnega vladanja. Analiza ponudi razmislek o nadaljnjem teoretičnem raziskovanju tega področja. ; The modernisation of society and intensive globalisation led sport to become a highly organised and structured phenomenon. Its development was influenced by various factors, while management at a global level has been taken over by international sport organisations, primarily by the International Olympic Committee (IOC), around which a regulated Olympic System has developed. In the examination of global sport, as one of the less visible and explored aspects of global governance, the discipline of International Relations falls behind other social sciences. One of the reasons for this is also the absence of a systematic theoretical analysis of this area. In order to fill this gap, this master thesis aims to answer the question: how can the use of the theories of international relations and an analysis of the Olympic System with features of global governance help us understand the emergence, the existence and the functioning of global governance in the field of sport as one of the fields of global governance? The identification of the regulated Olympic System as global governance in the field of sport enables the application of dominant theories of international relations (realism, liberalism, constructivism and Marxist theories) onto this field. The theories, within the limits of their capacities, interpret and explain the functioning of global governance in the field of sport, and, as a set of theories, they highlight the important elements and phenomena of global sport governance. The analysis offers a reflection on the further theoretical exploration of this field.

The article focuses on the theoretical and practical analysis of various levels of governance in higher education - at the systemic level, at the institutional level and at the level of public policy making in higher education system and universities. Both Poland and Ukraine are facing the common challenges of the urgent need to diminish bureaucracy at universities and to deregulate the system of higher education, which requires the necessary changes to the legal framework at the institutional and systemic levels. The article considers which tools in the process of transformation of higher education, both at the macro (governance in HES and public policy) and micro (governance and management in HEI) levels can be used in order to find effective solutions in the areas of management, governance and public policy in the higher education system. ; Artykuł poświęcony analizie teoretycznej oraz praktycznej różnych poziomów rządzenia (governance) w szkolnictwie wyższym - na poziomie systemowym, instytucyjnym i na poziomie polityki państwa wobec systemu szkolnictwa wyższego oraz uniwersytetów. Zarówno Polska, jak i Ukraina stają wobec wspólnego wyzwania konieczności odbiurokratyzowania działania uczelni i deregulacji systemu szkolnictwa wyższego, co wymaga niezbędnych zmian reguł ładu instytucjonalnego i systemowego. W artykule pokazano, jakie narzędzia w procesie transformacji szkolnictwa wyższego zarówno na poziomie makro (governance in HES i polityka publiczna), jak i mikro (governance i management in HEI) mogą być wykorzystane w celu podejmowania skutecznych rozwiązań w obszarach: zarządzanie, governance i polityka publiczna w systemie szkolnictwa wyższego.

The article discusses current dilemmas of the European Union policy with regard to the development of competitive and low emission transport in the context of good governance principles. The first part discusses selected assumptions of the idea of public governance reflected in the EU transport policy. Then the current degree of development of the EU transport was assessed. The assessment of consequences of increased demand for transport confirmed the need to efficiently deliver on the strategy for the development of low emission transport. It is also stressed that the implementation of the assumptions of the public governance idea may be seen as an innovative solution in managing a complex network of ties and coordination of policies at different levels and support the shift towards low emission, circular economy model in transport. However, attention has been paid to the need to continue studies on the assessment of efficiency and effectiveness of good governance principles. ; Artykuł jest poświęcony prezentacji aktualnych dylematów polityki Unii Europejskiej dotyczących rozwoju konkurencyjnego i niskoemisyjnego transportu w kontekście realizacji zasad dobrego rządzenia (good governance). W pierwszej części artykułu omówiono wybrane założenia koncepcji współrządzenia (public governance), mające odzwierciedlenie w polityce transportowej Unii Europejskiej. Następnie dokonano oceny obecnego stanu rozwoju transportu Unii Europejskiej. Ocena konsekwencji wzrostu popytu na transport potwierdziła potrzebę efektywnej realizacji strategii na rzecz rozwoju niskoemisyjnego transportu. Podkreślono, że wdrażanie założeń koncepcji public governance może stanowić nowatorskie rozwiązanie w zakresie zarządzania skomplikowaną siecią powiązań i koordynacji polityk na wszystkich szczeblach, wspierając przejście transportu do modelu gospodarki niskoemisyjnej o obiegu zamkniętym. Zwrócono jednak uwagę na potrzebę kontynuacji badań nad oceną skuteczności i efektywności realizacji zasad good governance.

There are two distant conceptual cousins that analyse the external mobilisation of subnational entities, one being European Studies – Multi-Level Governance and the other International Relations – Paradiplomacy. The article first aims to analyse each concept against the dimensions of the politik to determine the conceptual focus and find more pronounced differences in the policy and politics dimensions. The second aim is to identify the theoretical bedrock underpinning both concepts. This article proposes the analogous theory of Neo-Medievalism, establishing that it has some application here; in this sense, the two concepts may be better at explaining wider territorial reconfiguration underway in Europe. The paper offers a case study of the Marianske Lazne administration as an example of the New Public Governance (NPG) approach ed in the Czech Republic. The focus is on the particular pillars representing the features of NPG. Until now, five months after the general election, the particular attention of the Pirate Party on the determinants of NPG objectives could be observed through: making all meetings of the board's expert commissions accessible for the general public; publishing all documents discussed by the town's council on the internet; making all the town's banking accounts transparent; creating a department of internal audit separated from the rest of the administration; granting the status of a permanent guest at the board's meetings to a representative of the opposition; doubling the frequency of the council's meetings; preparing new rules of procedure facilitating the participation of citizens in the council's meetings; strengthening the communication channels between the council on the one hand and the chairpersons of expert commissions and directors of municipal organisations on the other; cancelling the positions with unclear benefits for the town; and making the rules of using municipal funds more transparent. There are still mo re evident measures expected in the areas of the second and third pillars of the Pirates' program, that is the provision of quality services for citizens and vicular and the positive development of tfie town's spa industry.

In a relatively short time the Internet has become one of the main and the most important media of our times. The increasing number of users, as well as the growth of its role and importance in almost every aspect of social and economic life have led in recent years to the intensification of the discussion on the future of the Internet and the way it should be governed. From the very beginning the Internet developed bottom-up without a decision-making center responsible for its development. There are many organizations in the world operating at local, regional and global levels, that focus on different aspects of its operation and development. This process called "Internet governance" is the process within which governments, information and communication technology (ICT) companies and civil society work together to set standards, values, norms and decisions that shape the way we use the World Wide Web. This article attempts to explain this phenomenon, shows the origins of the dispute between the supporters of the multistakeholder model of the Internet governance. It also presents the proposals of some states to strengthen the role of governments in this process and presents the position of the European Union, which in this discussion may play a key role as a mediator in the debate about the future of the Internet governance. ; Internet w stosunkowo krótkim czasie stał się jednym z głównych i najistotniejszych mediów naszych czasów. Wzrastająca liczba jego użytkowników, jak również wzrost jego roli i znaczenia w niemalże każdym aspekcie życia społeczno-gospodarczego spowodowały w ostatnich latach nasilenie się dyskusji na temat przyszłości internetu i sposobu w jaki powinien być zarządzany. Internet od samego początku rozwijał się oddolnie bez centralnego ośrodka decyzyjnego. Na świecie funkcjonuje wiele organizacji działających na poziomie lokalnym, regionalnym i globalnym, które skupiają się na różnych aspektach jego działania i rozwoju. Proces nazywany "zarządzanie Internetem" (Internet Governance), to proces, w którym rządy, przedsiębiorstwa z branży technologii informacyjnych i komunikacyjnych oraz społeczeństwo obywatelskie wspólnie wypracowują standardy, wartości, normy i decyzje, które kształtują sposób, w jaki użytkowana jest sieć. Niniejszy artykuł podejmuje próbę wyjaśnienia tego zjawiska, przedstawia genezę sporu pomiędzy zwolennikami wielostronnego modelu zarządzania internetem oraz państwami postulującymi wzmocnienie roli rządów w tym procesie oraz prezentuje stanowisko Unii Europejskiej, która może w tej dyskusji odegrać kluczową rolę stając się mediatorem w debacie o przyszłym modelu zarządzania internetem.

The article presents the way that governance has formed in Poland after winning the independence in 1918. It also includes the discussion on first legal acts with institutional meaning such as decree law dated on 22nd November 1918 about the supreme representative authority of the Republic of Poland and the act of Parliament's ordinance of 20th February 1919 entrusting Józef Piłsudski with further execution of the office of Chief of state. These documents became the basis for reborn country and enabled to rebuild institutions in historically difficult period. In the opinion of author, the experiences of first years of independence had ultimatelly influenced the solutions that were adapted in so called March Constitution from the year of 1921. ; Artykuł przedstawia kształtowanie się systemu rządów w Polsce po odzyskaniu niepodległości w 1918 r., w tym pierwsze akty prawne o znaczeniu ustrojowym – dekret z 22 listopada 1918 r. o najwyższej władzy reprezentacyjnej Republiki Polskiej oraz uchwałę Sejmu Ustawodawczego z 20 lutego 1919 r. o powierzeniu Józefowi Piłsudskiemu dalszego sprawowania urzędu Naczelnika Państwa. Stały się one podstawą funkcjonowania odrodzonego państwa polskiego, umożliwiając w trudnym okresie historycznym odbudowę państwowości. Zdaniem Autorki doświadczenia pierwszych lat niepodległości wpłynęły ostatecznie na rozwiązania, które przyjęto w tzw. Konstytucji marcowej z 1921.

This paper is a short commentary on Elinor Ostrom's criticism of 'The Tradegy of Commons', which is part of her research on Common Pool Resources (CPR) institutions. She delivered an institutional theory of Common Pool Resources governance and also seriously undermined so called social paradoxes, as Olsons' logic of collective action or prisoners dilemma as a model of social situations. The core of these social paradoxes and Garett Hardin's Tragedy of Commons respectively, is an assumption of rational choice taken by an isolated, selfish and egoistic individual. In Ostroms opinion such theories are not really wrong, but are very special cases in the World of interpersonal communication, customs and institutions. Ostrom has developed an institutional analysis of CPR governance and formulated basic rules of a good and durable CPR Institution. Ostroms' works takes account of both laissez-faire and centralized, government-run allocation as the wrong approach toward management of the Commons. These analyses seem useful in Poland, where nowadays CPR governance is highly centralized.

Autor opracowania stawia sobie za cel zbadanie usytuowania OLAF-u w systemie wielopoziomowego zarządzania UE (Multi-level Governance - MLG) wraz z określonymi interinstytucjonalnymi zależnościami i konsekwencjami takiego usytuowania, przy założeniu, że OLAF nie jest klasyczną instytucją ponadnarodową. Skoro OLAF jako agent i supervisor posiada kompetencje kontrolne nad instytucjami ponadnarodowymi, w tym nad swoim mocodawcą, jakim jest ponadnarodowa Komisja Europejska, to mało prawdopodobne jest, aby był także instytucją ponadnarodową.W badaniach wykorzystano dwa narzędzia teoretyczno-metodologiczne: Principal/Agent Theory oraz Principal/Supervisor/Agent Theory. ; The author of the study aims to investigate the location of OLAF in the multi-level governance system (MLG) of the European Union with specific interinstitutional consequences of such location, assuming that OLAF is not a classical supranational institution. If OLAF as an agent and supervisor has control powers over supranational institutions, including its principal, a supranational European Commission, it is unlikely that it would also be a supranational institution.Two theoretical and methodological tools were used in this research: Principal/Agent Theory and Principal/Supervisor/Agent Theory.

This article seeks to identify and detail the most important determinants that shaped the position of Poland's President in the system of governance during the country's period of transformation extending from 1989 through to 1997. The conditioning presented determined the position of the office of President by reference to four legal instruments, i.e. the new proposal of April 1989, the 1990 Act on universal suffrage in electing the President of the Republic of Poland (Ustawa o powszechnych wyborach prezydenta RP), the so-called "Small Constitution" of 1992, and the (still-binding) 1997 Constitution of the Republic of Poland. It is claimed here that this conditioning underpinning the establishment of the post of President within Poland's system of governance, on the basis of these different instruments of law, remained similar (sometimes in fact identical), with the overriding, repeated determinant being the political situation at the given time.

W ślad za Lawrence'em Lessigiem omówione zostały trzy warstwy Internetu: fizyczna, logiczna i treści. W tym kontekście przedstawiono dokonania Grupy Roboczej ds. Zarządzania Internetem (WGIG) powołanej przez Sekretarza Generalnego ONZ oraz rolę Forum Zarządzania Internetem (IGF). Zaprezentowano rozbieżne preferencje państw w wyborze suwerennego, wielostronnego lub międzyrządowego modelu zarządzania Internetem. W szczególności ukazano przeciwstawne działania USA i Unii Europejskiej oraz Chin i Rosji oraz podkreślanie przez te dwa ostatnie państwa zagadnienia cyberbezpieczeństwa i cybersuwerenności, co prowadzi do ograniczenia wolności słowa w Internecie i treściowej fragmentacji sieci. Autor proponuje wydzielenie kwestii możliwych do regulacji w drodze porozumień międzyrządowych. Zarazem dochodzi do wniosku, iż mechanizmy wielostronnego zarządzania siecią mogą uzyskać legitymację, jeżeli będą bardziej rzetelne i reprezentatywne niż system międzyrządowy. ; The purpose of this article is to present contemporary dilemmas in the management of the Internet as a new common good of mankind and an example of so called "new commons". In the wake of the Lawrence Lessig's writings discussed are the three layers of the Internet: physical, logical and content. In this context, presented are the achievements of the Working Group on Internet Governance (WGIG) initiated by the UN Secretary General and the role of the Internet Governance Forum (IGF). Presented are divergent preferences of states in choosing a sovereign, multi-stakeholder or multilateral model of Internet governance. In particular, the article demonstrates conflicting actions of the US, European Union and China, Russia and issues of cybersecurity and cyber sovereignty highlighted by the latter two countries, which lead to restrictions on freedom of speech in the Internet and fragmentation of the network in its content layer. The author proposes to separate issues for feasible regulation by multilateral agreements. At the same time he concludes that the mechanisms of multilateral network management can gain legitimacy if they are more reliable and representative than the intergovernmental system.

The author has made an attempt to theoretically – by referring to empirical evidence – formulate the necessary conditions that allow participatory processes to happen. In this perspective, participation is not only an ethical requirement but primarily a mechanism that supports taking up the challenges posed by the increasing complexity of the social world. The examples presented in the article show that participation has a very strong 'competitor': clientelism. In the spaces where the latter forms the base of the relations between the government and society, it is difficult to find a well-rooted and sustainable presence of participatory processes. The author thus presents a hypothesis that the logic of clientelism, together with the lack of the ability to recognise the importance of resource interdependence, has the ability to weaken participation, or in other words, wash it out in a specific way. Clientelism strives to maximise the control over resources. This can, in some cases, support the realisation of development goals or be effective in particular governmental arrangements (e.g. the transformation in Poland in the 90 s of the 20th century), however, it also deepens the passivity and in the long run can lead to a decrease in the value of some resources or even their loss. In this context, participation is thus understood mainly as an expression of caring for the owned and acquired resources and as the recognition of their interdependence. ; Autor podjął próbę sformułowania – na poziomie teoretycznym, odwołując się do przykładów empirycznych – wybranych warunków, umożliwiających zaistnienie procesów partycypacyjnych. Partycypacja w tym ujęciu nie jest tylko postulatem etycznym, ale przede wszystkim mechanizmem sprzyjającym podejmowaniu wyzwań, wiążących się z rosnącą złożonością społecznego świata. Przywołane w artykule przykłady pokazują, że partycypacja ma bardzo silnego "konkurenta" w postaci klientelizmu. Tam, gdzie relacje między władzą a społeczeństwem są na nim oparte, trudno o zakorzenienie się i trwałą obecność mechanizmów partycypacyjnych. Autor stawia hipotezę mówiącą o tym, że w przestrzeni lokalnej partycypację osłabia – czy wypłukuje ją w specyficzny sposób – logika klientelizmu w powiązaniu z niedostrzeganiem znaczenia współzależności zasobów. Klientelizm bowiem oznacza dążenie do maksymalizacji kontroli nad zasobami. Może to sprzyjać realizacji celów rozwojowych, być skuteczne w określonych warunkach systemowych (np. transformacja w Polsce w latach 90. XXw.), jednak pogłębia również pasywność, a w dłuższym okresie oznaczać może zmniejszanie się wartości określonych zasobów czy wręcz ich utratę. Partycypacja w tym kontekście rozumiana jest przede wszystkim jako wyraz dbałości o posiadane i pozyskiwane zasoby oraz dostrzeganie ich współzależności.

The author – using empirical data – claims that a meritocratic approach to public governance in Poland does not seem deeply rooted. The research indicates that since mid-November 2015 until the beginning of November 2017 meritocratic rules have been totally ignored in governmental institutions including state-owned companies.Many legal regulations were enacted inorder tointroduce changes inmanaging bodies responsible for key public institutions as well as companies. The drive toimprove their effectiveness were notof prime importance. The key criterion for promoting was based on the decision-maker's personal trust. There are many implications of the above-mentioned development, including aloss of trust tothe state resulting inamoral degeneration from the perspective of political class as well society as awhole. ; Autorka na podstawie danych empirycznych uzasadnia tezę, że merytokratyczne podejście do metod rządzenia w państwie jest w Polsce słabo zakorzenione. Wskazuje, że w instytucjach zależnych od rządu oraz spółkach skarbu państwa w okresie od połowy listopada 2015 r. do początku listopada 2017 r. doszło do całkowitego zarzucenia tych metod. Większość niezwykle licznie uchwalanych ustaw skupiała się na szybkości i szerokiej wymianie ciał zarządzających kluczowymi instytucjami i spółkami. Na dalszym planie pozostawała zwykle poprawa efektywności działania tych podmiotów. W wielu przypadkach głównym kryterium awansu było zaufanie decydenta. Najważniejszym skutkiem społecznym prowadzenia nieprzejrzystej, nieopartej na merytorycznych zasadach polityki personalnej jest podważanie zaufania do państwa, co jest degradujące zarówno dla klasy politycznej, jak i dla ogółu obywateli.
