The article highlights some aspects of Plato's scientific heritage, taking into account his generalizing ideas, which are formalized in the doctrine of the state, laws, social justice, restraint, the most "desirable" model of social structure, the process of education, gender equality, the hierarchy of mass consciousness, condemnation of contrasting poverty and wealth, advantages and disadvantages of the most common forms of government. In addition, research interest is focused on noteworthy episodes of his biography, the philosopher's absolute faith in the educational mission and the progressive nature of scientific knowledge. Attention is focused on the activities of Plato's "Academy" and its graduates – academicians – Lycurgus, Aristippus, Antisthenes, Aristotle, which was founded by Plato and has almost a thousand-year history. Special attention is focused on the personality of Lycurgus, who, in our opinion, most fully implemented in Sparta some of the ideas of the philosophical doctrine of the classic. At the same time, the strengths and weakness, according to the philosopher's view, of democracy are highlighted. The researcher's concepts regarding the danger and pathogenic nature of tyranny, timarchy and oligarchy are detailed. His utopian ideas on the construction of an "ideal state" are revealed, the basis of which, according to the philosopher, should be structurally isomorphic to a rational soul. In other words, the three social estates of society – the rulers-wise men, warriors, artisans-farmers should be relevant to the three components of the soul-wise, strong-willed and willing. It is noted that despite the aristocratic origin of Plato and his apologetics for the slave-owning system, in his treatises he still worried about the fate and hardships of average, ordinary people. The philosopher designed the "ideal state" based primarily on their interests. At the same time, Plato's socio-economic thoughts on private property, division of labor, various forms of economic deviation are panoramicly illuminated. The conclusion is made about the utopianism, the contradictory nature of some of the scientist's ideas, but at the same time the relevance of his vision of certain terminal and instrumental goals of state building is emphasized. It is mainly about the desire to achieve the common good (that is, taking into account the interests of all citizens of the state), non-acceptance of the principles of inheritance of social (class) status, as well as the importance and relevance of the values of meritocracy in the mass consciousness. ; Проанализированы некоторые аспекты научного наследия Платона обращая внимание на его обобщающие идеи, которые оформлены в учение о государстве, правовой системе, социальной справедливости, конструктивном наборе «золотой середины», наиболее «желательной» модели социальной структуры, процессе воспитания, гендерном равенстве, аксиологической иерархии массового сознания, невосприятии контрастной бедности и богатства, преимуществах и недостатках самых распространённых тогда форм государственного правления. Кроме того, исследовательский интерес сосредоточен на примечательных эпизодах его биографии, абсолютной вере философа в просветительскую миссию и прогрессивный характер научного знания. Акцентировано внимание на деятельности платоновской Академии, которая была основана Платоном и насчитывает почти тысячелетнюю историю, и ее выпускниках: Ликурге, Аристиппе, Антисфене, Аристотеле. Отдельное внимание сфокусировано на личности Ликурга, который, по нашему мнению, наиболее полно воплотил в Спарте некоторые идеи философского учения классика. Вместе с тем выделены сильные и слабые стороны демократии. Детализированы концепты исследователя касательно опасности и патогенной природы тирании, тимархии и олигархии.Охарактеризованы утопические идеи Платона по поводу построения «идеального государства». Его основа, по мнению философа, должна быть структурно изоморфна разумной душе. Другими словами, три социальных сословия общества – правители-мудрецы, воины, ремесленники-землеробы – должны быть конгруэнтны трем составляющим души – мудрой, волевой и желающей. Отмечено, что, несмотря на аристократическое происхождение Платона и его апологетику рабовладельческого строя, в своих трактатах он переживал по поводу судьбы и мытарств среднестатистического, простого человека. Философ проектировал «идеальное государство», исходя прежде всего из их интересов. Вместе с тем панорамно освещены социально-экономические мысли Платона касательно частной собственности, разделения труда, разнообразных форм хозяйственной девиации. Сделан вывод про утопичность и противоречивый характер некоторых идей ученого, но в то же время подчеркнута актуальность его видения отдельных терминальных и инструментальных целей государственного строительства. Речь идет главным образом о стремлении достичь общего блага (то есть учета интересов всех граждан государства), невосприятии принципов наследования социального (классового) статуса, а также значимости и востребованности в массовом сознании ценностей меритократии. ; Проаналізовано окремі аспекти наукової спадщини Платона з огляду на його узагальнювальні ідеї, які оформлені у вчення про державу, правову систему, соціальну справедливість, затребуваність конструктивного набору «золотої середини», «найбажанішу» модель соціальної структури, процеси виховання, гендерну рівність, аксіологічну ієрархію масової свідомості, несприйняття контрастної бідності та багатства, переваги і недоліки найпоширеніших форм державного правління. Зокрема, увагу сфокусовано на найприкметніших епізодах його біографії, абсолютній вірі філософа у просвітницьку місію та прогресивний характер наукового знання. Акцентовано на освітній діяльності Академії, яка була заснована філософом і налічує майже тисячолітню історію, та її випускниках: Лікурзі, Арістіппі, Антисфені, Аристотелі. Особливо зауважено постать Лікурга, який, на нашу думку, найповніше намагався втілити у Спарті окремі ідеї філософського вчення Платона. Крім того, зазначено сильні сторони і недоліки демократії. Деталізовано думки класика щодо небезпеки та патогенної природи тиранії, тимархії й олігархії. Окрему увагу зосереджено на утопії Платона стосовно побудови «ідеальної держави». Її основа, на думку дослідника, має бути структурно ізоморфною розумній душі, тобто три соціальні стани суспільства – правителі-мудреці, воїни, ремісники-землероби – мають бути конгруентними трьом частинам душі – мудрій, вольовій і бажаючій/пристрасній. Зауважено, що, попри аристократичне походження Платона та його апологетику рабовласницького порядку, він переймався у своїх дослідженнях долею та поневіряннями звичайної людини. Філософ проєктував «ідеальну державу» з огляду саме на її інтереси. Водночас панорамно висвітлено соціально-економічні думки Платона стосовно приватної власності, розподілу праці, різноманітних форм господарської девіації тощо. Зроблено висновок щодо утопічності та суперечливого характеру деяких ідей ученого, але одночасно підкреслено актуальність його бачення окремих термінальних і інструментальних цілей у процесах державного будівництва. Ідеться насамперед про прагнення до досягнення загально блага суспільства (тобто врахування інтересів усіх громадян держави), несприйняття принципів спадкоємності соціального (класового) статусу, а також значущості та затребуваності у масовій свідомості цінностей меритократії.

Розглянуто проблеми функціонування та розвитку наднаціональних інституцій Європейського Союзу (далі – ЄС) у сфері безпеки та оборони на фоні змін військово-політичної ситуації у світі. Проаналізовано діяльність безпекових структур, визначено їх організаційно-правовий статус та обсяг завдань із забезпечення обороноздатності ЄС. Охарактеризовано їх повноваження стосовно національних систем безпеки та оборони. Розкрито основні напрямки забезпечення інституціональної стійкості оборонних структур у контексті зміни позиції Сполучених Штатів Америки (далі – США) як основи військової могутності Північноатлантичного альянсу (далі – НАТО) та охарактеризовано можливості створення Європейського оборонного союзу. Доведено, що ЄС необхідно кардинально переглянути свої підходи до забезпечення безпеки передусім у сфері взаємодії збройних сил країн-членів при проведенні спільних операцій і їх ресурсного забезпечення. Встановлено, що для України розвиток автономних наднаціональних європейських оборонних структур відкриває можливість для додаткового поглиблення співпраці із ЄС і паралельного посилення обороноздатності. ; Problem setting. Ukraine's implementation of the strategy of integration into the European Union necessitates taking into account the experience of countries that have already transformed security institutions in accordance with the European democratic tradition, as well as their adaptation to the nature of threats to EU member states. Ukraine's security is based on strengthening the Ñommon European security in all its dimensions. In the conditions of Russian armed aggression and "hybrid war", Ukraine faces the task of creating a modern and effective system of state defense and integrating into international systems. Solving this problem, the successful implementation of defense reform require examining foreign experience in the organization of the EU defense system, peculiarities of development of the security and defense sector in the context of expanding democracy. Ukraine is not a member of NATO and, under the current conditions of counteracting Russia's armed aggression is forced to develop national defense forces which are necessary to restore territorial integrity.Recent research and publications analysis. Due to Ukraine's Euro-Atlantic aspirations, the study of experience of the leading EU and NATO member states in the field of defense has recently received more and more attention. Thus, a significant contribution into the study of the evolution of European security and defense policy was made by such foreign scholars as R. Gardner, K. Gill, M. Craig, S. Morsch, D. Navarette, M. Smith, B. Tonra, and others. The analysis of the processes of creation and formation of the common foreign security policy of the EU were covered in the works of such domestic scientists as S. Voloshchuk, O. Vonsovych, M. Hladysh, V. Govorukha, Y. Gonchar, A. Grubinko, V. Rud, O. Snigir, V. Streltsov, O. Turchenko, L. Falaleyev, N. Fesenko, V. Shatun, A. Sheludchenkova and others. O. Bodruk, M. Yezheev, V. Gorbulin, O. Litvinenko, V. Gorovenko, M. Lobko, O. Izhak, A. Lobanov, V. Grubov, F. Saganyuk, I. Romanov, V. Trotsko, I. Veshchytsky, M. Sungurovsky and other authors dedicated their works to the development of the defense sectors in the conditions of expansion and deepening of democracy.Highlighting previously unsettled parts of the general problem. The variability of the political situation, new challenges and threats lead to a constant search for new approaches to addressing security issues. This is what actualizes the problematics of the article.Paper main body. The purpose and the task of the article is to study the system of public management of the EU defense sphere and identify opportunities and areas of cooperation between Ukraine and EU defense structures at the supranational level.The activity of security structures is analyzed, their organizational and legal status and the scope of tasks to ensure the defense capabilities of the union are determined, their powers in relation to national security and defense systems are characterized. The main directions of ensuring the institutional stability of defense structures in the context of changing the position of the United States as the basis of NATO's military power are described and the possibilities of creating a European Defense Alliance are described. It is proved that the EU needs to radically reconsider its approaches to security, first of all, in the field of cooperation of the armed forces of the member states while conducting joint operations and their resource provision. It is established that for Ukraine the development of autonomous supranational European defense structures opens the possibility for further deepening of cooperation with the EU and parallel strengthening its defense capabilities.Conclusions of the research and prospects for further studies. For Ukraine, the development of autonomous supranational European defense structures opens a possibility for further deepening of cooperation with the EU and parallel strengthening of defense capabilities. Such cooperation is a mutually beneficial process, during which Ukraine contributes to the security of the Euro-Atlantic region, and on the other hand, gains the necessary experience in the process of training and exercises.The partnership approach to the further development of Ukraine's cooperation with the EU in the field of foreign policy and security demonstrates three directions:– cooperation between Ukraine and the EU in the international and regional dimensions for the sake of common security;– EU assistance in strengthening the stability and security of Ukraine;– Ukraine's contribution to the security of Europe.It is obvious that in the future the international and regional dimensions of cooperation between Ukraine and the EU will be based on the full support of Ukraine by the European Union in matters relating to sovereignty, territorial integrity, protection of national interests, state and human security. In return, Ukraine must support EU policy, adhere to European values and become their proponent in the regional dimension. Ukraine's main contribution to Europe's security is to strengthen its own defense capabilities and deter Russian aggression on its eastern borders.EU-Ukraine cooperation can be developed both on a large scale and through individual initiatives. The EU Global Strategy provides an opportunity to develop proactive cooperation, for example between the Visegrad Group and Ukraine, or the countries of the Black Sea region in a wide range of issues related to security, crime prevention, terrorism, exchange of information on security issues.

La presente investigación explora a las empresas B, "empresas con propósito", y a la propiedad por parte de trabajadores con el fin de aportar a posibles soluciones a graves problemas socioeconómicos en México y abordar lagunas importantes en la literatura científica acerca de este tipo de empresa. Por un lado, se analizan los imaginarios, vivencias, tensiones, límites y potencialidades con respecto a los valores de ser B-Corps y sus efectos en sus grupos de interés y, por otro, se explora el fenómeno de la propiedad en dichas organizaciones. Se realizaron cuatro estudios de caso de empresas certificadas por B-Lab y localizadas en la ciudad de Guadalajara, México. Se trata de una investigación con un enfoque cualitativo (Maxwell, 2019) y con la aplicación de estudios de caso (Stake, 1995; Yin, 2009, 2018). La metodología y herramientas aplicadas, si bien con límites propios, resultaron adecuadas para analizar de fondo cómo las empresas con propósito viven el ser empresas B y la propiedad por parte de los trabajadores. Dentro de los principales hallazgos se encontró que ser empresa B es relevante para las organizaciones estudiadas y cumplen con su propósito, pero en diferentes grados y de formas muy diversas. Asimismo, dada su particularidad híbrida, con búsqueda de múltiples objetivos (Battilana, 2018), las empresas se encuentran con diferentes retos y tensiones para transmitir a sus stakeholders internos, los significados e implicaciones relacionados con ser una empresa B. Esta certificación sigue siendo parte de estrategias gerenciales que vienen de arriba hacia abajo, y que queda, para muchos participantes, sin una real apropiación al interior y exterior de la organización. Por último, en cuanto al tema de la propiedad por parte de trabajadores, se encontraron factores que se concatenan y permiten la apertura de la propiedad en las empresas con propósito, esto último se da de manera frágil, limitada, heterogénea y hasta selectiva, sin representar ejercicios amplios de democracia y/o de economía social (Defourny & Nyssens, 2010; Díaz, 2015; Mugarra, 2004). Si bien existen varias limitantes al presente estudio como investigación cualitativa, y se requiere seguir investigando a futuro, la presente investigación aporta una nueva perspectiva en la búsqueda de soluciones empresariales innovadoras en un contexto de crisis sistémica. ; The study presented here explores B-Corporations, "corporations with purpose", and employee ownership, in order to contribute possible solutions to serious socioeconomic problems in México and address important gaps in the academic literature on this kind of enterprise. We analyze participants' perceptions, experiences, tensions, limitations and possibilities with respect to B-Corp values and their effects on stakeholder groups. We also investigate the phenomenon of employee participation in capital ownership in these organizations. Four case studies were carried out of companies certified by B-Lab in the city of Guadalajara, México. The study has a qualitative focus (Maxwell, 2019) and uses a case study approach (Stake, 1995; Yin, 2009, 2018). The methods and tools applied, though not without certain natural limitations, were adequate to the task of analyzing in depth the lived experience of being "corporations with purpose" and of employee share ownership. Among the principal findings, it was discovered that being B-Corps was relevant to the participants in the organizations studied and that they fulfilled their "purpose", though to varying degrees and in very diverse ways. Further, given their particular hybrid nature and thus seeking to realize multiple objectives (Battilana, 2018), the firms encounter different challenges and tensions in transmitting to their internal stakeholders the full meaning and implications of being a B-Corp. This certification continues to be part of the tradition of top-down management strategies and, for many participants, it is not genuinely appropriated by agents inside or outside the organization. Finally, as regards employee ownership, we found different factors that, intertwined, permitted the opening of capital ownership to employees in these firms "with purpose", but that this opening up was somewhat fragile, limited, heterogeneous in its application, even selective, and that it did not represent a broad exercise of democracy and/or social economy (Defourny & Nyssens, 2010; Díaz, 2015; Mugarra, 2004). While there are certainly limitations to the present study as a piece of qualitative research, and more investigation is required in the future, the study does contribute a new perspective to the search for innovative business solutions in a context of systemic crisis. ; Ikerketa honek, B enpresak, "helburua dauzkaten enpresak", eta langileen jabetza aztertu ditu, Mexikoko arazo sozioekonomiko larriei irtenbideak emateko eta enpresa mota horri buruzko literatura zientifikoan dauden hutsune garrantzitsuak ikertzeko. Uno de los estándares esenciales para la construcción de un Estado Constitucional y Social de Derecho, es la protección de los derechos fundamentales de todas las personas. Este propósito demanda la existencia de unas fuentes materiales y formales del derecho dinámicas, en constante replanteamientos ante la velocidad de los acontecimientos y de las transformaciones sociales y políticas, de modo que, superen los criterios ortodoxos, restrictivos, estáticos y mecanicistas en la producción, interpretación y aplicación de lo jurídico a la realidad concreta. La trascendencia de la cuestión impone resolver crítica y reconstructivamente, el siguiente problema: ¿Es la jurisprudencia un instrumento para la protección de los derechos fundamentales? En este contexto, se necesitan recursos, instrumentos, estrategias y medios, para lograr la materialización de los derechos. Entre las herramientas más relevantes se halla la jurisprudencia, cuyo rol entre la órbita de las fuentes formales del derecho es hoy de incalculable valor, el cual se halla demostrado en esta investigación. Al interior de este formante de lo jurídico, se ha desarrollado la doctrina probable con una larga historia en nuestra formación jurídica, pero también, la doctrina del precedente recepcionado desde 1991 por la Corte Constitucional colombiana, institutos que para los fines de este estudio, son su objeto, pero principalmente, las emanadas de los Tribunales de Cierre. Por supuesto, la forjada por los otros tribunales o jueces, tiene importancia, pero su impacto es menor a la de las altas cortes. De consiguiente, las páginas que siguen constituyen un esfuerzo para determinar críticamente el grado de eficacia y el alcance de las decisiones judiciales para el amparo de las prerrogativas constitucionales. Se analizan los postulados de autores nacionales y extranjeros, desgajando ideas centrales, teorías, escuelas, para luego ir procediendo con sumo cuidado en el tejido argumental para demostrar que la jurisprudencia es un medio eficaz de la protección de los derechos fundamentales, que recupera su real puesto y valor, como arma de los jueces, ante el déficit de Estado de Derecho en nuestros intentos de labrar democracia constitucional en pos de proteger los derechos de las personas. Se demuestra que la judicatura, por encargo y designio de la Constitución a través de la voz más clara y resonante que le da la Carta como atribución política, a una autoridad: la sentencia judicial, va fundiendo todo un arsenal jurídico que crea derecho, llenando los vacíos de la ley y materializando la Constitución. El trabajo emprende el análisis de ese constructo por medio de las decisiones de la Corte Suprema de Justicia y la Corte Constitucional colombianas, junto a las sucesivas leyes alusivas a la producción jurisprudencial. Mediante los métodos analítico, sintético, dialéctico y crítico de la bibliografía y de las sentencias seleccionadas, y con apoyo en la evolución legislativa nacional, bordeando las tradiciones jurídicas del common law y del civil law, se defiende que la unificación de la jurisprudencia por vía del precedente y de la doctrina probable, cuando el juez en forma real y auténtica encarna la Constitución a través de sus decisiones, se torna en actor para proyectar una sociedad más justa e inclusiva. ; Universidad Libre – Facultad de Derecho -- Doctorado en Derecho ; One of the essential features of a constitutional and social rule of law is the protection of fundamental rights of every person. This requires the existence of dynamic sources of law – formal and material- not only to deal with the rapid political and social transformation, but to overcome the orthodox, restrictive, static and mechanistic criteria characterizing the production, interpretation and application of law. Transcendence to resolve the question of the reconstructively critical question and the following problem: Is jurisprudence a tool for the protection of fundamental rights? In this context, the realization of constitutional rights requires a different array of strategies, resources and instruments. Among them is the jurisprudence as a formal source of law; which has been invaluable to the pursuance of rights. Particularly, via jurisprudence judges have developed the long standing probable doctrine ("doctrina probable"); and they have also given value to precedent. The Colombian Constitutional Court very active in the advancement of the latter. As for this study, it focuses both in the Supreme Court and the Constitutional Court as institutions that have given value to jurisprudence as a source of law; this without overlooking the relevant contributions of lower courts. Hence, this paper constitutes an effort to critically determine the degree that judicial decisions have had in the realization of constitutional rights. To such purpose, this text analyzes national and foreign scholars, and it breaks down their central ideas and theories, to demonstrate the relevance of jurisprudence as an effective mean to protect constitutional rights. Furthermore, the paper shows the relevance of jurisprudence as a weapon available to judges, in a context of deficit of the rule of law, to consolidate a constitutional democracy that protect the rights of people. The conclusion of this paper is that the judiciary through its judicial decisions -the clearest and most resonant voice of the Constitutional Charter- fills the gaps of the legislative, creates law and ultimately realizes the Political Constitution. To arrive to such conclusion, the text undertakes an analysis of different decisions from the Colombian Supreme Court and the Constitutional Court, together with the successive laws alluding to jurisprudential production. Particularly, through synthetic, dialectical and critical manner of the selected bibliography and judicial decisions. In this very guise, this paper also studies the national legislative evolution; which borders the legal traditions of common law and civil law. It is in this manner that the unification of jurisprudence via precedent and the probable doctrine, and competent judges that incarnate the constitution, become the keystones to forge a more just and inclusive society.

학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 정치외교학부(외교학전공), 2020. 8. 신범식. ; 본 논문은 테러와의 전쟁에서 많은 피해를 입은 미국과 러시아의 테러조직 리스트가 예상과 달리 왜 유사점보다 차이점을 더 많이 가지고 있는가를 밝히고자 하였다. 이를 위해 러시아와 미국이 테러조직을 지정하는 과정을 비교함으로써 양국의 테러조직 지정에 영향을 미치는 요인들을 규명하고자 하였다. 우선 미국과 러시아의 국가 안보전략 문서들을 분석함으로써 양국이 시기별로 중요하게 여긴 관심사와 이러한 관심사에 대한 위협이 무엇인지 분석하였다. 그 다음으로, 미국과 러시아의 대통령들이 1993년부터 2017년까지 발표한 테러 관련 연설문, 인터뷰, 공문서들 가운데 제목이나 본문에 'terror' 및 'террор'라는 어근이 포함된 다양한 형태의 텍스트 자료들을 대상으로 워드분석을 함으로써 양국이 테러를 어떠한 위협으로 상정하는지, 국내외의 어떤 안건들과 연결하는지를 파악하였다. 그리하여 본고는 테러에 대한 역사적 경험과 인식, 안보에 대한 이해, 국제 질서와 상황 파악 등 많은 요인들이 테러조직 지정에 영향을 미치면서 양국이 테러에 대한 기본적인 인식, 즉 초국가적인 테러조직들이 한 국가만이 아닌, 국제사회 전체에 위협이 될 수 있다는 인식 면에서는 시간이 지나면서 비슷해졌지만 양국의 안보개념, 안보와 관련된 국익의 우선 순위, 테러에 대한 인식에 영향을 미친 역사적 경험이 상이하기 때문에 테러조직의 지정에서 유사점보다는 차이점이 더 많이 나타나게 되었다는 결론에 도달하였다. 본고는 일견 미국과 러시아가 테러조직을 공동의 적으로 간주하는 것처럼 보이지만 실제로는 다양한 요인들로 인해 테러와 테러조직의 지정에서 서로 다르게 접근한다는 사실을 보여주었다는 데 그 의의가 있다. ; Russia and the United States have been on the front line of the fight against terrorism for a long time, and at first glance it may seem that they are fighting against the same enemy. However, upon careful comparison of the U.S. Department of State list of Foreign Terrorist Organizations(FTO) and corresponding list of the Russian Federation the distinctions are strikingly obvious. The organizations designated by each country outnumber the ones that were appointed by both. This study aims to examine the factors behind the differences in the approaches that Russia and the U.S. took to defining the enemy. It is argued that the designation method is mainly determined by two broad aspects – the security concept and the perception of terrorism. Through the analysis of the national security strategies from 1997 to 2015, this study investigated several crucial issues: the ways Russia and the United States had been perceiving the international order, their place and role in it, as well as changes in their national interests over time, and most importantly, what constituted the perceived threats to the national security. Supporting this with the examination of the perception of terrorism through the word frequency analysis of Russian and American presidents' speeches, the study concluded that despite the fact that both countries claim terrorism to be their main threat, the approach to defining it is not the same as each country bases it on their own historical experience and national priorities. The United States views terrorism largely as a part of the global security framework, inseparably associated with other issues (such as the threat of WMD proliferation) that are claimed to emanate from rogue states and tyrannies. Consequently, the strategy in the fight against terrorism has been derived from the desire to converse these regimes to democracy. On the other hand, Russia was found to view terrorism as a more direct threat to the country's national security. For Russia, terrorist organizations are separate entities that try to violate the country's constitutional order through separatist and extremist slogans. Unlike the United States, Russia does not view terrorist organizations as an instrument in the hands of tyrannical regimes, therefore it condemns the American unilateral approach that is structured around interference into the internal affairs of other states. These differences are reflected in the formation of the terrorist organizations lists. The list of the United States is more comprehensive and geographically global. The FTO list includes not only the organizations that directly threaten US security, but also the ones that harm the partners and allies of the United States. At the same time, Russia is focused on designating the organizations that directly threaten the security of the country and the nearest region like Central Asia. There are also organizations on the list that do not commit terrorist acts, but undermine the values of Russia's constitutional system through the conduct of propaganda on the Internet. After September 11 and the Beslan school siege in 2004, there is a convergence in the perception of the US and Russia on the rise of terrorist organizations network as a major transnational threat in the 21st century. This explains why there are the same ten organizations on both lists. The vast majority of the organizations that have been designated by both countries are affiliates of al-Qaeda, which are fighting not one specific country, but the entire modern international society. Luego de un tortuoso proceso de paz que terminó con una confrontación armada con la guerrilla Farc-EP-, una vez firmado el acuerdo en septiembre de 2016, se desencadenaron posturas álgidas que derivaron en tensiones de diversa índole (las que hasta hoy persisten) sin que se vislumbren escenarios de paz; al contrario, Colombia atraviesa por uno de los momentos más complejos y violentos de su historia, atrapada en una polarización política que roza el fundamentalismo, el cual permea a sus instituciones judiciales, policiales, medios de comunicación y a la sociedad en general, lo que hace prácticamente imposible el diálogo reflexivo entre las diferentes posiciones ideológicas, que han hecho aún más notorios los clivajes sociales que han caracterizado a la nación colombiana como una de las más fragmentadas del hemisferio. En virtud de lo anterior, en este artículo se propone, mediante un enfoque constructivista y con el apoyo de una metodología cualitativa como la entrevista semi-estructurada y el análisis de columnistas que abordan el tema, examinar así la ecuación Justicia-Medios-Polarización, para identificar los riesgos de instrumentalización de los medios -y/o periodistas-, y de cómo, una especie de entramado de componentes los aparta de su deber ontológico. Esto confluye en un avivamiento de la polarización, hecho desgastante para la democracia y amenaza al Estado de derecho cuando al acudir a la descalificación, desvirtuando así cualquier escenario de debate equilibrado y provocando un alto grado de afectación al sistema judicial, en especial la búsqueda de desprestigio de más alto ente: La Corte Suprema de Justicia. ; Après un processus de paix tortueux qui s'acheva par une confrontation armée avec la guerrilla Farc-EP- et l'accord de paix signé en septembre 2016, des postures critiques s'élevèrent donnant lieu à des tensions de toutes sortes qui perdurent, sans que l'on puisse voir se dessiner le moindre scénario en faveur de la paix. Bien au contraire ! La Colombie traverse l'un des moments les plus complexes et violents de son histoire, engluée dans une polarisation politique proche du fondamentalisme qui s'étend aux institutions judiciaires, policières, aux moyens de communication et à la société en général, rendant pratiquement imposible un dialogue réflexif entre les différentes positions idéologiques, et plus aigüs encore les clivages sociaux qui font de la nation colombienne l'une des plus fragmentées de l'hémisphère. Ceci étant, à partir d'une approche constructiviste et en nous fondant sur une méthodologie qualitative (entretien semi-structuré) et l'analyse d'articles émanant d'éditorialistes, notre article se propose d'examiner la question Justice-Media-Polarisation, afin d'identifier les risques d'instrumentalisation par les media et/ou les journalistes et la façon dont un réseau de facteurs les écarte de leur devoir ontologique, accroissant ainsi une certaine polarisation. Ces facteurs pervertissent la démocratie et représentent une menace pour l'État de droit lorsque l'on se sert de la disqualification pour dénaturer tout scénario menant à un débat équilibré. Cela affecte aussi, grandement, le système judiciaire, tout particulièrement lorsque l'on s'attaque à son institution la plus prestigieuse : la Cour Suprême de Justice. ; Após um tortuoso processo de paz que culminou em confronto armado com a guerrilha das FARC-EP, a partir da assinatura do acordo em setembro de 2016, desencadearam-se posições críticas que geraram tensões de diversos tipos (que persistem até hoje) sem que cenas de paz sejam vislumbradas; ao contrário, a Colômbia vive um dos momentos mais complexos e violentos de sua história, presa em uma polarização política que beira o fundamentalismo, que permeia suas instituições judiciárias, policiais, os meios de comunicação e a sociedade em geral, o que torna praticamente impossivel o diálogo reflexivo entre as diferentes posições ideológicas, evidenciando ainda mais as clivagens sociais que caracterizaram a nação colombiana como uma das mais fragmentadas do hemisfério. Em virtude do exposto, este artigo propõe, por meio de uma abordagem construtivista e com o apoio de uma metodologia qualitativa como a entrevista semiestruturada e a análise dos colunistas que se referem ao tema, examinar a equação Justiça-Mídia-Polarização para identificar os riscos de instrumentalização da mídia -e / ou jornalistas-, e como uma espécie de rede de componentes os separa de seu dever ontológico. Isso converge para um ressurgimento da polarização, fato desgastante para a democracia e ameaça o estado de direito quando da desqualificação, distorcendo qualquer cenário de debate equilibrado e causando um alto grau de danos ao sistema judiciário, principalmente a busca por descrédito do órgão máximo: O Supremo Tribunal de Justiça. ; Once the peace agreement was signed in September 2016 by Colombian President Juan Manuel Santos, after a critical peace process that temporarily ended with an armed confrontation with the insurgent group Farc-EP-, tense positions were unleashed that friction of various kinds resulted, which to this day persist with no foreseeable scenarios of peace; on the contrary, Colombia is going through one of the most complex moments of its history, trapped in a political polarization that borders on fundamentalism which permeates its institutions, the media and society in general, which makes reflective dialogue between the different ideological positions, which have made the social cleavages that have characterized the national society as one of the most fragmented in the hemisphere even more noticeable. Given this precedent, this article proposes, using a constructivist approach supported by qualitative methodologies such as the semi-structured interview plus the analysis of columnists who address the issue, examine the Justice-Media-Polarization equation, to identify the risks of instrumentalization of the media -and / or journalists-, and how, a kind of network of components separates them from their ontological duty, which converges in a revival of polarization, an exhausting fact for democracy and threatens the rule of law when resorting to disqualification, thus distorting any scenario of balanced debate, a phenomenon that observes a high degree of damage to the judicial system, especially the search for discredit from the highest entity: the Supreme Court of Justice.

Con sus luces y sombras, sus renovadas luchas y reivindicaciones y también sus crisis, debilidades, injusticias y exclusiones recurrentes (para una porción ciertamente mayoritaria de la población mundial), podemos ciertamente reconocer que mucho se ha discutido e implementado en poco más de medio siglo en términos de la institucionalización de garantías de acceso "a" y del goce (idealmente pleno e igualitario) "de" los derechos fundamentales (DF). No obstante, es innegable la crisis global actual de la democracia, la paz y de los propios DF, en el contexto del desarrollo in-sostenible pregonado por el capitalismo global y sus lógicas mercantilizadoras, maximizadoras y extractivistas reinantes. Ante estas dificultades, se ha propuesto que una de las expansiones necesarias del constitucionalismo global ha de ser el capítulo relativo a los bienes fundamentales. En este breve ensayo, intentaremos poner de resalto la comunión estratégica que cabe advertir entre los aportes de las epistemologías "del sur" - propias del pensamiento social que "tensiona" el desarrollo - y las mentadas ampliaciones constitucionales. Se plantean algunas bases para repensar una simbiosis crítica entre la Justicia social, la Ambiental y la Ecológica, postulando que el desarrollo de mayores instituciones de garantías (que "desmercantilicen" los derechos y bienes fundamentales, que creen las condiciones necesarias para su armónico desarrollo y que remuevan los obstáculos de sus actuales ataduras y fisuras) exige adoptar "normas de tareas" correlativas, dentro de una visión complementaria y estructural entre el "enfoque de derechos" y el "enfoque de los bienes fundamentales", reforzando en un todo la misión fundamental a cargo del Estado de garantizar la justicia social. ; With its lights and shadows, its renewed struggles and demands and also its recurring crises, weaknesses, injustices and exclusions (for a majority of the world's population), we can recognize that much has been discussed and implemented in little more than half a century in terms of the institutionalization of guarantees of "access to" and the (ideally full and equal) enjoyment "of" fundamental rights (FD). Nevertheless, the current global crisis of democracy, peace and the DF itself is undeniable, in the context of the unsustainable development advocated by global capitalism and its prevailing mercantilizing, maximizing and extractivist logics. Faced with these difficulties, it has been proposed that one of the necessary expansions of global constitutionalism should be the chapter on fundamental goods. In this brief essay, we will try to highlight the strategic communion that can be noticed between the contributions of the "southern" epistemologies - characteristic of the social thought that "stresses" development - and the mentioned constitutional expansions. The competitive environment encourages organizations to find ways to increase the efficiency of their activities. A new approach to A. Comte sociocracy paradigm, which was oriented towards the creation of a new type of state governance, has been transformed and adapted to the practice of improving organizational management. The article analyses the paradigm of sociocracy as a comprehensive management system that enables employees to be involved in the decision-making process to work together. To identify and formulate the nature of sociocracy as a new paradigm for management of organization, the fundamental principles were supported by theoretical research based on scientific literature sources and publications of management practices. The methods of collecting, analysing, comparing and summarising of information as well as logical generation of conclusions were used for the research. The benefit of new management paradigm for organization and its employees, confirming the effectiveness of the practical application of sociocracy was found in the course of the research.The concept of sociocracy was created by the philosopher A. Comte (Auguste Comte 1798–1857) in the context of a new model of state governance (John-Stuart Mill, 2005). On the basis of sociocrasy a new concept holocracy was created in the US, which exaggerates the "benefits" of the organization and calls to forget personal needs and to devote to a higher goal in the US (Hallas, 2013). The Dutch pacifist and educator Kees Bioke (Boeke) (Hall, 2013) has practically implemented a sociocracy management model at the Bilthoven School in the Netherlands, which has existed till nowadays. Beginning around 1970, Gerard Endenburg developed a management and governance method called Sociocracy while managing his electrical engineering corporation, Endenburg Electrotechnik, in the Netherlands. G. Endenberg developed a management system as an alternative to the classical hierarchical management system. The sociocracy decision-making method has grown in cybernetics, systemic thinking organizations that have had a tremendous impact on commercial activity in America (Mirzagitova, 2014). In Lithuania, the developers of the websites "Meetings", "Talent Safari", and "Primum Esse" disseminate the ideas of sociocracy and teach company leaders about the new paradigm of management that enables employees to be involved in the decision-making process.The essence of sociocracy is to allow people to delegate decisions to expert groups. As all groups of professionals have to report to the whole community, and are selected with the consent of each member, the decision-making process takes place both from the bottom to the top and from the top to the bottom. This creates feedback circles, and thus ensures good communication throughout the organization. The groups of experts act as partly independent in discussing all issues in the meetings of their members, in which each member has equal rights. The groups (referred to as small circles, called Endenberg's rings) have frequent meetings for tactical issues. The decisions made in the group must be in line with the general organization policy. Big groups (big rings) rarely meet and deal with only very important issues. The group leader usually organizes decision-making process by taking operational decisions unilaterally. The method of sociocracy enables all members of an organization to be involved in the organization's management process, where everyone can express their opinion.One of the essential aspects of sociocracy is its dynamism, and therefore sociocracy can be called dynamic management, as it emphasizes the abundance of challenges in today's business environment, where the need for quick and just solutions is necessary. The demand for dynamic management creates some important general constraints on any techniques used: speed and coordination. One of the most important tasks of the company is to organize teamwork and decision making in accordance with the principles of dynamic management. Dynamic management logic considers human power to be an essential element of progress, and effective human collaboration is necessary for the results of the organization. Dynamic management is needed in order to be able to respond flexibly and act in each situation (for example, when it comes to changing opinions because new information is received or previous solutions failed) to enable people to act on their own, quickly and independently, in the same harmonious manner with others. The goal of dynamic management is to combine the paradox: to operate in a harmoniously changing environment, while moving forward quickly and dynamically; to save what works and change what does not work immediately as soon as the "voltage" is identified. The following are demonstrated by the dynamic management of the organization: the decentralization of individual areas of activity; human resources realize their potential freely; setting priorities for action; the involvement of members of the organization in decisionmaking.The introduction of sociocracy as a new organizational management paradigm in the business sector would provide the following benefits: improving decision-making quality throughout the organization, problem solving and teamwork communication, enhancing leadership quality, and increasing the efficiency of meetings. The content analysis revealed the fact that autocracy is not suitable for collective bargaining, and voting as a way of democracy does not allow to make good decisions; therefore, the new organizational management paradigm – sociocracy of practical application helps to improve company management and improve effectiveness. ; Konkurencinė aplinka skatina ieškoti organizacijas moksliškai pagrįstų veiklos efektyvumo ir rezultatyvumo didinimo būdų. In order to prolong the Russian imperial tradition in a new format, at the beginning of the twentieth century. Small marginal union of the Bolsheviks instrumentally used the communist doctrine and made a coup in Pertograd. It's postulates were applied not only to the usurpation of power in Russia, but also for the annexation of neighboring states that have just proclaimed independence. Among them also was destroyed by Russian Bolsheviks the Ukrainian People's Republic. Thus, the ideology of communism in the USSR was transformed into a dogmatic doctrine, which enabled the functioning of the state under the conditions of internal support of the security forces and aggressive foreign policy. Strength Union, which formed the political core of the country was the ruling CPSU and its republican units, such as the Communist Party, considered as a whole.Throughout the century, Communist Party autocracy has caused a significant number of political, socio-economic, national and religious problems, which cast doubt on the viability of the communist doctrine as a state ideology. Being the initiator of numerous crimes, the party turned into a deep-seated bureaucraticloke state structure, which, as a result of the destructive action of the key party principle of «democratic centralism», ceased to be a voluntary union of like-minded people. She rigorously controlled all aspects of the life of a multi-ethnic and multi-religious Soviet society. In the political context, the democratic foundations of the councils of people's deputies were replaced by the leadership of the CPSU, in the economic segment, the planned market economy replaced market instruments, in the national segment there was a total russification of annexed societies; the religious segment was dominated by the ideology of atheism.At the end of the century, the synthesis of these permanent problems in the USSR gained such a «critical mass» that it was impossible to conceal. The CPSU became a key brake on the steady development of not only scientific and technological progress, but also the social development of the country as such. Caused by the party low material status of citizens in symbiosis with politic al injustice, national pressure and religious persecution turned into an «explosive mixture» which could deprive the party of its monopoly position, and therefore cause a collapse of the state, where the Russian ethnos was dominant.As a result, in 1985-1991, the Communist Party topped the «cosmetic repair» of the first economic, and later the political core of the country, calling it «perestroika». In fact, it was a partial «annex» of democratic and market methods to the autocratic and planned background of the Soviet Union. In the opinion of the Central Committee of the CPSU, «perestroika» was to distance the party from Stalin's atrocities, to renew its social status, to increase the powers of the Soviet institutions, to prevent a growing economic crisis, to resolve national and religious problems, and most importantly, to maintain its own pro-government positions. Therefore, the leadership role in the Soviet society of the CPSU remained in its place.However, the natural incompatibility of democracy and autocracy, the market and the plan naturally weakened the communist regime, led to the disintegration of the regional Communist Party cells, restored the national liberation movement and accelerated the collapse of the USSR. On the eve of its fiasco the brightest examples of intraparty decay were illustrated by the regional committees of the western regions of the Ukrainian SSR, among which the most notable was the cessation of the activities of the Communist Party organization of the Ternopil region. ; З метою пролонґування російської імперської традиції у новому форматі, на початку ХХ ст. малочисельна маргінальна спілка більшовиків інструментально використала комуністичну доктрину й здійснила державний переворот у Петрограді. Її постулати було застосовано не тільки для узурпації влади в Росії, а й для анексії сусідніх держав, щойно проголосивших незалежність. Серед них була і знищена російськими більшовиками Українська Народна Республіка. Відтак, ідеологія комунізму в СРСР трансформувалася у догматичне вчення, яке уможливлювало функціонування держави за умов внутрішньої підтримки силових структур та агресивної зовнішньої політики. Стрижневою спілкою, котра становила політичне ядро країни була осібно правляча КПРС та її республіканські підрозділи, такі як КПУ, що розглядалися як одне ціле.Упродовж століття компартійна автократія спричинила значну кількість політичних, соціально-економічних, національних та релігійних проблем, що ставили під сумнів життєздатність комуністичного учення як державної ідеології. Будучи ініціатором чисельних злочинів, партія перетворилася у глибоко одержавлену бюрократичну структуру, яка внаслідок руйнуючої дії ключового партійного принципу «демократичного централізму» перестала бути добровільною спілкою однодумців. Вона жорстко контролювала усі аспекти життя поліетнічного та різнорелігійного радянського суспільства. У політичному контексті демократичні засади рад народних депутатів було замінено на керівну роль КПРС, в економічному сегменті на зміну ринковому інструментарію прийшло планове господарювання, у національному річищі відбувалося тотальне зросійщення анексованих соціумів, у релігійному сегменті домінувала ідеологія атеїзму.Наприкінці століття синтез цих перманентних проблем в СРСР набрав такої «критичної маси», приховати яку було уже неможливо. КПРС стала ключовим гальмом поступального розвою не тільки наукового-технічного прогресу, а й соціального розвитку країни як такого. Продуковане нею низьке матеріальне становище громадян у симбіозі із їх політичним безправ'ям, національним тиском та релігійним переслідуванням перетворилися у «вибухову суміш», що могла позбавити партію її монопольного становища, а тому спричинити розпад держави, де російський етнос був домінантним.Як наслідок, у 1985–1991 рр. компартійна верхівка наважилася на «косметичний ремонт» спочатку економічного, а згодом й політичного осердя країни, назвавши його – «перебудова». Насправді це була часткова «прибудова» демократичних й ринкових методів до автократичного та планового тла Радянського Союзу. На думку союзного ЦК «перебудова» повинна була дистанціонувати партію від сталінських злодіянь, оновити її суспільний статус, контрольовано збільшити повноваження радянських інституцій, запобігти наростаючій економічній кризі, вирішити національні та релігійні проблеми, а головне – зберегти власні провладні позиції. Тому керівну роль у радянському суспільстві КПРС і надалі залишала за собою.Однак, природна несумісність демократії та автократії, ринку і плану закономірно ослабили комуністичний режим, спричинили дезінтеграцію регіональних компартійних осередків, відновили національно-визвольний рух і прискорили крах СРСР. У переддень його фіаско найбільш яскраві зразки внутрішньопартійного розпаду ілюстрували обкоми західних областей УРСР, серед яких особливо помітним було припинення діяльності компартійної організації Тернопільської області.

The content of the Ukrainian national idea in the era of transition from industrial to post-industrial(informational) type of society is revealed. It is demonstrated that in the transition to a post-industrial society, thenational idea as a product of an industrial society requires a significant transformation. In a post-industrial society,the national idea should be focused on the production of post-economic values and active social regulation, themaximum use of the creative (creative) potential of members of the national community, the formation of anew type of family and new forms of social partnership, the increasing role of knowledge (scientific and parascientific)and changes in the education system. It is determined that the national idea, taking into account theetymology of the components of this construct, acts as a key idea in understanding the nature of the nation andthe prospects for its development.It is determined that the national idea must be understood in the context of the special conditions of lifeof the people throughout its history. It reflects the deep level of national consciousness, advocates all forms ofreflection of the nation (person) over issues of the essence of the national community and the meaning of itsexistence. Throughout its history, Ukraine has sought to build its own state on a democratic, legal and socialbasis and, having gained independence in 1991, these value dominants were entrenched at the constitutionallevel. At the present stage of nation-building, the key direction in the formation of a national idea is to determinethe optimal model that should underpin state-building – ethno-cultural or civic.It is proved that the Ukrainian national idea, having passed the difficult historical path of aging and formation,today requires substantial modernization, adaptation to the realities of the transitional society, civilizational,geopolitical, economic challenges of the 21st century. The national idea should take into account the changesthat occur in the social and economic structure of society, and incorporate into the body of the nation-buildingstrategy those goals and ways to achieve them that actualize post-material values, pay attention to the needsof self-development and self-improvement of the individual. The formula of the Ukrainian national idea isproposed, which consists of strategic and operational-tactical components, designed for different time periods– short, medium and long term. The strategic components of the modern Ukrainian national idea include theslogans 'Ukraine is a conciliar, European, decent state and a nation', 'Equality of all citizens before the law,freedom of life strategies, respect for the national and cultural traditions of the Ukrainian people and ethniccommunities living on its territory', 'Democracy in all spheres of public life, the embodiment of moral standardsin social relations'. The operational-tactical components of the modern Ukrainian national idea include theslogans 'Knowledge, information, movement (action)'. ; Раскрыто содержание украинской национальной идеи в эпоху перехода от индустриального к по-стиндустриальному (информационному) типу общества. Продемонстрировано, что в условиях переходак постиндустриальному обществу национальная идея как продукт индустриального общества требуетсущественной трансформации. В постиндустриальном обществе национальная идея должна быть ори-ентирована на продуцирование постэкономических ценностей и активного социального регулирования,максимальное использование творческого (креативного) потенциала членов национальной общности,формирование нового типа семьи и новых форм социального партнерства, повышение роли знания (на-учного и паранаучного) и изменения системы образования. Определено, что национальная идея, учиты-вая этимологию составляющих этого конструкта, выступает как ключевая мысль в понимании природынации и перспектив ее развития. Доказано, что украинская национальная идея, пройдя сложный исто-рический путь вызревания и становления, сегодня требует существенной модернизации, адаптации креалиям переходного общества, цивилизационных, геополитических, экономических вызовов XXI века.Национальная идея должна учитывать те изменения, которые происходят в социальной и экономиче-ской структуре общества, и инкорпорировать в «тело» стратегии нациестроительства те цели и путиих достижения, которые актуализируют постматериальные ценности, уделяют внимание потребностямсаморазвития и самосовершенствования индивида. Предложена формула украинской национальнойидеи, которая состоит из стратегических и оперативно-тактических компонентов, рассчитанных на раз-ные временные отрезки – кратко-, средне- и долгосрочную перспективу. К стратегическим компонентамсовременной украинской национальной идеи отнесены лозунги «Украина соборное, европейское, до-стойное человека и нации государство», «Равенство всех граждан перед законом, свобода жизненныхстратегий, уважение национально-культурных традиций украинского народа и этнонациональных сооб-ществ, проживающих на ее территории», «Демократия во всех сферах общественной жизни, воплоще-ние моральных норм в социальных отношениях». К оперативно-тактическим компонентам современнойукраинской национальной идеи отнесены лозунги «Знание, информация, движение (действие)». ; З'ясовано зміст української національної ідеї в добу переходу від індустріального до постінду-стріального (інформаційного) типу суспільства. Продемонстровано, що в умовах переходу до постін-дустріального суспільства національна ідея як продукт індустріального суспільства потребує суттєвоїтрансформації. У постіндустріальному суспільстві національна ідея має бути орієнтована на продуку-вання постекономічних цінностей і активного соціального регулювання, максимальне використаннятворчого (креативного) потенціалу членів національної спільноти, формування нового типу родини інових форм соціального партнерства, посилення ролі знання (наукового і паранаукового) і зміни системиосвіти. Визначено, що національна ідея, враховуючи етимологію складників цього конструкту, постаєяк ключова думка щодо розуміння природи нації та перспектив її розвитку. Доведено, що українськанаціональна ідея, пройшовши складний історичний шлях визрівання і становлення, сьогодні потребуєсуттєвої модернізації, адаптації до реалій перехідного суспільства, цивілізаційних, геополітичних, еко-номічних викликів ХХІ ст. Національна ідея має враховувати ті зміни, які відбуваються в соціальній таекономічній структурі суспільства, та інкорпорувати в «тіло» стратегії націєтворення ті цілі та шляхиїх досягнення, які актуалізують постматеріальні цінності, приділяють увагу потребам саморозвитку тасамовдосконалення індивіда. Запропоновано формулу української національної ідеї, яка складається ізстратегічних та оперативно-тактичних компонентів, розрахованих на різні часові відрізки – коротко-,середньо- і довгострокову перспективу. До стратегічних компонентів сучасної української національноїідеї віднесено гасла «Україна соборна, європейська, гідна людини і нації держава», «Рівність усіх грома-дян перед законом, свобода життєвих стратегій, повага до національнокультурнихтрадицій українського народу та етнонаціональних спільнот, що мешкають на її теренах», «Демократизм у всіх сферах суспіль-ного життя, втілення моральних норм у соціальних відносинах». До оперативно-тактичних компонентівсучасної української національної ідеї віднесено гасла «Знання, інформація, рух (дія)».

In order to prolong the Russian imperial tradition in a new format, at the beginning of the twentieth century. Small marginal union of the Bolsheviks instrumentally used the communist doctrine and made a coup in Pertograd. It's postulates were applied not only to the usurpation of power in Russia, but also for the annexation of neighboring states that have just proclaimed independence. Among them also was destroyed by Russian Bolsheviks the Ukrainian People's Republic. Thus, the ideology of communism in the USSR was transformed into a dogmatic doctrine, which enabled the functioning of the state under the conditions of internal support of the security forces and aggressive foreign policy. Strength Union, which formed the political core of the country was the ruling CPSU and its republican units, such as the Communist Party, considered as a whole.Throughout the century, Communist Party autocracy has caused a significant number of political, socio-economic, national and religious problems, which cast doubt on the viability of the communist doctrine as a state ideology. Being the initiator of numerous crimes, the party turned into a deep-seated bureaucraticloke state structure, which, as a result of the destructive action of the key party principle of «democratic centralism», ceased to be a voluntary union of like-minded people. She rigorously controlled all aspects of the life of a multi-ethnic and multi-religious Soviet society. In the political context, the democratic foundations of the councils of people's deputies were replaced by the leadership of the CPSU, in the economic segment, the planned market economy replaced market instruments, in the national segment there was a total russification of annexed societies; the religious segment was dominated by the ideology of atheism.At the end of the century, the synthesis of these permanent problems in the USSR gained such a «critical mass» that it was impossible to conceal. The CPSU became a key brake on the steady development of not only scientific and technological progress, but also the social development of the country as such. Caused by the party low material status of citizens in symbiosis with politic al injustice, national pressure and religious persecution turned into an «explosive mixture» which could deprive the party of its monopoly position, and therefore cause a collapse of the state, where the Russian ethnos was dominant.As a result, in 1985-1991, the Communist Party topped the «cosmetic repair» of the first economic, and later the political core of the country, calling it «perestroika». Problem setting. The purpose and essence of state are issues that have been studying for centuries and do not have the only recognized interpretation nowadays. The creation of a state is determined by the necessity of regulating relations between people, ensuring their conflict-free coexistence and justice by establishing the strong state power that can provide people with security and protection. Actually, these fundamental aspects regarding the purpose and functioning of state are still of immediate interest today. However, the modification of the environment and the transformation of worldviews of humanity have caused the relevant changes in the sociopolitical, economic and social sphere. Changes in the general paradigm of the existence of state cause, without doubt, changes in certain aspects of functioning of state. One of these aspects, which essentially influence on the society, is a social tendency, in particular, and, first of all, a social function which is at the forefront of the state functional hierarchy. Recent research and publications analysis. Scientific developments regarding the emergence, formation and features of the social function of state have been shown in papers of many domestic scientists. In particular, certain aspects of functioning of state in the context of implementation of the social function have been considered by I. Aristova, V. Bulba, S. Gorbatiuk, V. Hoshovska, N. Dieieva, V. Kupriichuk, E. Libanova, A. Petroie, V. Skuratovsky, V. Tropina, V. Troshchynskyi, N. Yarosh and others. The most research studies concerning the implementation of the social function by state are based on paper of such scientists as A. Åslund, J. McGill Buchanan Jr., G. Esping-Andersen, E. Lindahl, W. Lawrence, G. Therborn, R. Titmuss, F. Williams and others.Highlighting previously unsettled parts of the general problem. The rapid development of social, economic, humanitarian relations, globalization processes and accelerated scientific and technical development determine the necessity of continuing of scientific research relating to the implementation of the social function by state under conditions of the neoteric civilization tendencies and ñhallenges. The purpose of the article is to study some aspects of implementation of the social function by state, its development and features at the present phase of the social development, as well as to highlight issues that are important for Ukraine and determine ways of improvement in the social development.Paper main body. The existence of the state is determined by the necessity of implementing relevant activities which must result in the solution of topical issues on the life activity of society. Accordingly, the areas of activity of state, which are represented in its functions, are formed. State functions are characterized by dynamism.The social role of state in the life activity of society is one of the most important aspects. In this regard, the social function is the focus of attention of state, since it is directly associated with the solution of tasks aimed at creating the environment to ensure a proper living standard of the population, the realization of creative, spiritual, cultural and other needs of the person.One of the features of a modern state is that it is not identified with society, but is a separate institution that ensures the functioning of a complex official power mechanism. The current level of development of state as a management system implies such definitions as democracy, humanism, freedom of thought, freedom of will, social freedom, pluralism, etc. As a result, for reasons beyond control, the modern state must ensure the overcoming social contradictions, the coordination and coexistence of various social and gender groups, generate and implement such decisions that would be approved (or, at least, not completely ignored) by all social strata.The characteristic feature of modern democratically oriented states is the expansion of social freedoms and transformation of values-based orientations, which takes place against the background of the accelerated technological development and aggravation of global problems. However, modern economic development and inactivity of the administrative apparatus of state cannot fully satisfy the growing needs of society in additional social benefits, pent-up demands for a new ultramodern level of cultural and educational and other services, and more comfortable economic and social infrastructure. Social needs are always growing faster than the economic capacity of state. Therefore, the change in the traditional idea of the social function as the prerogative and exclusive competence of state can be qualified as one of the modern problems.One of the serious consequences of globalization and economic liberalization has become a certain decrease in the influence of state on social and economic processes and penetration into the traditionally monopoly state areas of the private corporate capital.Conclusions of the research and prospects for further studies. The sociopolitical, technological and economic development forms new ideas and concepts about the essence of state and its functions. The topical contemporary issue is the search of new formats of the existence of state and society. The modern Ukraine is experiencing many problems related to the reformation of state and the modernization of social relations. Among the most topical issues we can highlight social problems. The solution to these problems is directly related to several key factors, including economic growth, optimization of state expenditures, massive improvement in the quality of the state administration, and the restoration of public confidence in power institutions. The social function must be considered and formed simultaneously with the issues of the state-building of modern Ukraine while clearly realizing that these processes have the determining influence on diverse and multifaceted factors caused by historical and cultural development as well as national features. ; Розглянуто наукові підходи до визначення соціальної функції держави. Проаналізовано сучасні тенденції у соціальному та економічному розвитку країн світу. Виокремлено окремі проблеми та особливості реалізації державою соціальної функції в умовах глобалізаційних процесів. Сформульовано авторське бачення стосовно призначення держави у контексті виконуваної нею соціальної функції. Окреслено актуальні для України питання щодо забезпечення виконання соціальної функції державою як інституційним утворенням, що покликане забезпечувати комфортне життєве середовище для проживання своїх громадян.

This study aims to find out how to stimulate Early Childhood Mindset in Theodeosius kindergarten through affective education. This research is qualitative research. Data analysis is done by reducing data, presenting data, and drawing conclusions. The research findings show that students are very enthusiastic about following the activities of the teacher with pleasure, happiness and not feeling burdened from the beginning of the activity to the end, students can take part in the activities of the teacher well. The efforts made by TK Theodosius educators are good, so that it can be said that the teacher's efforts to train children's independence are maximized. The students have begun to instill Pancasila values in their daily lives, namely Godhead, Humanity, the Value of Unity, People's Value, and Social Justice. ABSTRAKTesis ini membahas tentang Koordinasi Pengamanan Perbatasan Berdasarkan Pasal 14 Ayat (1) Undang-Undang No. 2 Tahun 2002 Tentang Kepolisian Negara Republik Indonesia (Studi Terhadap Koordinasi Polri Dengan Instansi Terkait Dalam Penegakan Hukum Perbatasan Badau Kabupaten Kapuas Hulu-Malaysia). Penelitian ini menggunakan pendekatan normatif dengan pendekatan sosilogis., dari hasil penelitian terdapat kesimpulan yaitu Koordinasi Polri Dengan Intansi Terkait Dalam Melakukan Pengamanan Perbatasan Agar Tidak Terjadi Tumpang Tindih Kewenangan Dalam Kaitannya Dengan Penegakan Hukum, koordinasi antar instansi pemerintah yang terkait dalam pengamanan daerah perbatasan, seperti TNI, Polri, Kantor Imigrasi dan Departemen Kehakiman, Departemen Kehutanan, Departemen Kelautan dan Perikanan, Departemen Pertam-bangan dan Energi, Departemen Pertanian dan Pemerintah Daerah dalam Pengamanan Perbatasan Berdasarkan Pasal 14 ayat (1) Undang-Undang No. 2 Tahun 2002 Tentang Kepolisian Negara Republik Indonesia Terhadap Koordinasi Polri Dengan Instansi Terkait Dalam Penegakan Hukum di Perbatasan Badau Kabupaten Kapuas Hulu-Malaysia.Kendala-kendala yang dihadapi oleh Polri dalam melakukan koordinasi terhadap pengamanan perbatasan Badau- Malaysia, ada lima permasalahan yang menjadi kendala yakni : Pertama, semangat otonomi daerah yang pada kondisi penguatan demokrasi lokal relative baik, namun pada pengembangan wilayah kedaulatan, pemerintah setempat melihat bahwa masalah pengamanan perbatasan adalah kewenangan pemerintah pusat. Situasi ini memosisikan masalah pengamanan perbatasan menjadi kurang baik dan cenderung terbengkalai. Kedua, strategi dan postur pertahanan Indonesia masih pada visi territorial, sehingga masalah perbatasan non-teritorial tidak terintegrasi dengan baik, karena minimnya Alutsista pendukung. Ketiga, infrastruktur yang ada di wilayah perbatasan terbilang minim. Minimnya infrastruktur jalan dan pendukung lainnya secara luas. Konteks ini pada akhirnya membuat pengamanan wilayah perbatasan dilakukan terbatas dan cenderung seadanya. Keempat, minimnya dukungan anggaran bagi pengamanan perbatasan secara efektif menyebabkan kinerja dan profesionalitas petugas dilapangan menjadi rendah. Kurangnya dukungan dan perhatian dari Pemda setempat juga menjadi masalah yang melemahkan pengamanan perbatasan. Kelima, visi pengamanan yang berorientasi pada pendekatan militer semata menjadi permasalahan tersendiri mengingat ancaman keamanan dan kedaulatan tidak lagi semata-mata berbentuk ancaman agresi militer, tapi lebih banyak pada ancaman non­tradisional yang justru merupakan bagan dari domain penegakan hukum. Upaya-upaya yang dilakukan oleh polri dalam menanggulangi kendala-kendala tersebut yaitu dengan Meningkatkan Pengawasan. Meningkatkan koordinasi antar instansi pemerintah yang terkait. Mengupayakan Peningkatan Kualitas Pengawasan Di Pos-Pos Lintas Batas. Meningkatkan dan membangun jaringan intelijen. Mengupayakan dan meningkatkan pembinaan wilayah, pembinaan territorial serta pembinaan masyarakat di wilayah perbatasan. Membangun jalan inspeksi di sepanjang perbatasan darat dan menambah frekwensi patroli perbatasan di darat maupun laut. Menambah dan meningkatkan kuantitas dan kualitas alat peralatan pengamanan di daerah perbatasan. Mengalokasikan anggaran pengamanan daerah perbatasan secara terpadu. Membangun sarana jalan dan prasarana transportasi, telekomunikasi sepanjang perbatasan untuk membuka keterisolasian wilayah perbatasan. Mengintegrasikan Dan Atau Merevisi Peraturan dan Perundangan yang terkait dengan Pengamanan Daerah Perbatasan.Kata Kunci : Koordinasi, Pengamanan Perbatasan, Penegakan Hukum Perbatasan ABSTRACTThis thesis discusses the Border Security Coordination Based on Article 14 Paragraph (1) of Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia (Study of National Police Coordination with Related Agencies in Badau Border Enforcement of the Kapuas Hulu Regency, Malaysia). This study uses a normative approach with a sosilogis approach. From the results of the study there is a conclusion that the Polri Coordination with Related Intenses in Conducting Border Safeguards to Avoid Overlapping of Authority in Relation to Law Enforcement, coordination between government agencies involved in securing border areas, such as the TNI , Police, Immigration Office and Department of Justice, Ministry of Forestry, Ministry of Maritime Affairs and Fisheries, Ministry of Mining and Energy, Ministry of Agriculture and Regional Government in Border Security Based on Article 14 paragraph (1) of Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia Against the Coordination of the National Police with Related Agencies in Law Enforcement at the Badau Border in the Kapuas Hulu Regency, Malaysia. Constraints faced by the National Police in coordinating the security of the Bada-Malaysia border, there are five problems which become obstacles. : First, the spirit of regional autonomy which is in a relatively good condition of strengthening local democracy, but in developing sovereignty areas, the local government sees that the issue of border security is the authority of the central government. This situation has positioned the border security problem to be unfavorable and tends to be neglected. Second, Indonesia's defense strategy and posture is still in the territorial vision, so that the problem of non-territorial borders is not well integrated, due to the lack of supporting defense equipment. Third, the existing infrastructure in the border region is fairly minimal. Lack of broad road infrastructure and other supporters. This context ultimately makes security in border areas limited and tends to be limited. Fourth, the lack of budget support for border security effectively causes the performance and professionalism of field officers to be low. The lack of support and attention from the local government is also a problem that weakens border security. Fifth, the vision of security which is oriented towards the military approach becomes its own problem considering the threat of security and sovereignty is no longer solely in the form of a threat of military aggression, but more on non-traditional threats which are actually a chart of the domain of law enforcement. The efforts made by the National Police in overcoming these obstacles are by Increasing Supervision. Improve coordination between relevant government agencies. Seek to Improve the Quality of Supervision at Cross Border Posts. Improve and build intelligence networks. Promote and enhance regional development, territorial development and community development in the border region. [spa] Es comúnmente apreciado que el TJUE, junto con los tribunales nacionales, es un importante motor de la integración y constitucionalización de la UE. Este proceso plantea diversos problemas teóricos y prácticos, por lo que necesita una conceptualización cuidadosa para evitar su abuso y reforzar sus potenciales. En el artículo, el papel y la legitimidad de la creación judicial se analizarán en consideración al impacto del "principio de efectividad" en derecho privado a nivel Europeo y nacional. De hecho, de una parte, los jueces están llamados a reforzar el derecho europeo mediante intervenciones negativas y positivas; de otra, están limitados por los principios de separación de poderes, división de competencias, legalidad e igualdad, a menudo en conflicto con los mencionados deberes, quedando entre la espada y la pared. Tal dilema será resuelto indagando por el significado y objetivo del "principio de efectividad", para identificar: (i) en qué condiciones el uso por parte del TJUE puede considerarse legítimo; (ii) en qué medida los jueces nacionales deben aplicarlo, contribuyendo a su realización, en disputas que involucren a sujetos privados. Con este fin, se establecerán dos objetivos preliminares: (a) comprender el significado y la fuerza normativa del "principio de efectividad" en el derecho europeo, y si difiere respecto de la jurisprudencia de los tribunales nacionales; (b) analizar el impacto del derecho a un recurso efectivo (Artículo 47 Carta De Los Derechos Fundamentales de la UE) en disputas horizontales. Partiendo de la metodología ofrecida por la filosofía del lenguaje, el artículo analiza las principales especificidades de la efectividad en la jurisprudencia del TJUE –"efectividad del derecho europeo" y "efectividad de la protección judicial"–, y, de manera crítica, afirma la coherencia y ajuste institucional de cada "Sprachgebrauch", así como sus interacciones. Sucesivamente, el artículo re-conceptualiza la efectividad como un "argumento" que, al ser esencialmente indeterminado, puede ser fácilmente mal utilizado. Mi hipótesis es que a través de una serie de manipulaciones argumentativas, el Tribunal expande sus competencias contra los Estados miembros y otras instituciones de la UE, para fomentar la integración en áreas constitucionalmente sensibles, también mediante la adjudicación de leyes privadas. Este proceso puede ser enmarcado críticamente: según el principio democrático, tal práctica puede aceptarse cuando está legitimada por un consenso preexistente, pero puede ser menos aceptable cuando se necesita una nueva adhesión, configurando un debilitamiento progresivo de la unión política. De acuerdo con una teoría de la justicia en asuntos de derecho privado, las condiciones de legitimidad de tal proceso de creación judicial deben ser re-conceptualizadas, cuestionando así la dimensión regulatoria no restringida atribuida a los casos horizontales en la jurisprudencia del TJUE. En fin, los resultados serán utilizados para evaluar el impacto del principio de efectividad en el derecho privado nacional, así como para guiar su desarrollo en los tribunales nacionales, sugiriendo que los jueces deben desempeñar un papel fuerte y proactivo en su diálogo con el TJUE, obligando a este último a suponer y ponderar más sus decisiones, a fin de abrir nuevos espacios en el proceso deliberativo sobre el proyecto de la UE. ; [eng] It is commonly appreciated that the CJEU, together with national courts, constitute a main driver of the EU integration and Constitutionalization. This process raises various theoretical and practical problems, thus needing careful conceptualization to avoid abuse and reinforce its potentials. This paper analyzes the role and legitimacy of judicial law-making by addressing the impact of the «principle of effectiveness» on private law adjudication at European and national level. Indeed, on the one hand, judges are called to enforce EU law, both through negative and positive interventions; on the other hand, they are constrained by the principles of separation of powers, division of competences, rule of law and equality – often clashing with said duties –, sitting between a rock and a hard stone. Such dilemma shall be addressed by inquiring the meaning and scope of the «principle of effectiveness», to identify: (i) under which conditions its use by the CJEU may be deemed legitimate; (ii) to what extent national judges shall apply it, contributing to its realization, in disputes involving private parties. To this end, two preliminary goals shall be set: (a) understanding the meaning and normative force of the «principle of effectiveness» in EU law, and whether they differ from their national courts' understanding; (b) analyzing the impact of the right to an effective remedy (art. 47 EUCFR) in horizontal disputes. By relying on the methodology offered by the philosophy of language, the paper analyzes the two major specifications of effectiveness in the CJEU case law – «effectiveness of EU law» and «effectiveness of judicial protection» –, and critically assesses the coherence and institutional fit of each "Sprachgebrauch", as well as their interactions. It then re-conceptualizes effectiveness as an «argument» which, being essentially indeterminate, may be easily misused. My hypothesis is that through a series of argumentative twist and turns, the Court expands its competences against MSs and other EU Institutions, to foster integration in constitutionally sensitive areas, also trough private law adjudication. This process shall be critically framed: according to the principle of democracy, such practice may be accepted when sustained by a pre-existing consensus, but might be less acceptable when new adhesion is needed, in the long run weakening the political Union; according to a theory of justice in private law matters, the conditions of legitimacy of such judicial law-making need to be re-conceptualized, thus questioning the unconstrained regulatory dimension attributed to horizontal cases in the CJEU case law. The results is finally used to evaluate the impact of the principle of effectiveness on national private law, as well as to guide its deployment by domestic courts, suggesting that judges shall perform a strong and pro-active role in their dialogue with the CJEU, forcing the latter to second-guess and further weighting its decisions, to open up new deliberative spaces in the EU project.
