"The mediation of the balance between vigilance and restraint is a fundamental feature of judicial review of administrative action in the anglocommonwealth. This balance is realised through the modulation of the depth of scrutiny when reviewing the decisions of ministers, public bodies and officials. while variability is ubiquitous, it takes different shapes and forms. Dean R. Knight explores the main shapes and forms employed in judicial review in England, Canada, Australia and New Zealand over the last fifty years. Four schemata are drawn from the case law and taken back to conceptual foundations, exposing their commonality and differences, and each approach is evaluated. The article presents a case of successful constitutional change in Switzerland, the "re-assignment of responsibilities between the federal government and the cantons and the new fiscal equalization scheme," which was adopted in 2004 by referendum. By starting from the general assumption that ways and means are needed to strengthen general interests at the expense of distributive interests in constitutional discussions, the article endeavors to identify favorable conditions for successful constitutional change. By using insights from "constitutional political economy" and "actor-centered institutionalism," four such conditions are revealed: the procedural separation of problem solving and bargaining interaction modes; the importance of ideational factors like "frames," "causal theories," and focal points; active agenda-crafting; and the structuring of constitutional debates by earlier decisions. In addition, this article highlights that other conditions, more directly linked to interest and interest struggle, can help to mitigate the intensity of distributive conflicts and are therefore indirectly conducive to a problem-solving interaction orientation of actors. This article critically examines the contemporary 'securitization paradigm' adopted throughout the Chilean jurisdiction. Emphasis is placed on its explicit misuse and its arbitrary effects on the Mapuche people in light of Chile's anti-terrorism legislation. The law thereby assumes a twofold function. 'Judicialization strategies' are employed by different organs of the State, resulting in the criminalization and ultimately the silencing of indigenous protest and forms of representation in the public space. These potentially transform relations between the State and its subjects, demanding a repositioning of indigenous agendas and representation under the constitutional umbrella. Conversely, judicialization also assumes a mediating role through the virtuous effects of international law and Inter-American human rights jurisprudence. The newly commencing constitutional era may further spur such developments, potentially exerting essential decolonizing effects on State institutions and society at large.

Over seventy years ago it would have seemed inconceivable in the aftermath of a calamitous war that a complete reorientation of Japan into a pacifist society, modeled on Western principles of individual rights and democracy, would succeed in upending a deeply entrenched political order with roots dating back centuries. The post-war Japanese constitution lies at the heart of this transformation. Drafted, negotiated and promulgated a mere fourteen months after Japan's formal surrender, it has remained a model of stability amidst transformational changes in the domestic and international political landscape. In the seventy-plus years since its adoption, it has not been amended once.
