The pandemic caused by COVID-19 led governments in most countries around the world, including Spain, to decree the confinement of citizens. This confinement involved, in families with separate parents, a direct impact on the visitation and exchange schemes of children, directing parents to reach an agreement or, failing that, a judicial decision. In order to know the reasons why the parents would suspend the exchanges, and the changes that had been made to the stays and communications. A total of 226 Spanish parents in the situation of partner break with sons or daughters subject to exchanges, responded to an online questionnaire (google form). The results showed that the parents admitted a multi-causality for the suspension of exchanges; than about 3/4 (70.8%) cases changed the time of stay and communication with children with a decrease in the exchange rate of 83%, compensated with more telephone/telematic contact (92.1%); that statistically in half of cases visits were suspended (44.2%), generally remaining (85.0%) in the custody of the mother; in statistically half of cases (47.8%), the changes were agreed between the two parents; that the causes that significantly motivated the changes were legal, the best interest of the child (46%; safeguarding his health), the protection of public health (16.1%; not favouring the transmission of COVID-19) and regulations (11.2%; displacement is not allowed). The implications of results for child welfare and parental competence for conflict resolution are discussed. ; La pandemia ocasionada por la COVID-19 llevó a los gobiernos de la mayoría de los países del mundo, entre ellos España, a decretar el confinamiento de los ciudadanos. Este confinamiento implicaba, en las familias con progenitores separados, repercusiones directas en los regímenes de visitas e intercambios de los hijos/as, encaminando a los progenitores a llegar a un acuerdo o, en su defecto, a una resolución judicial. Con el objetivo de conocer los motivos por los que los progenitores suspenderían los intercambios, y los cambios que se habían efectuado en las estancias y comunicaciones. Un total de 226 progenitores españoles en situación de ruptura de pareja con hijos o hijas sujetos a intercambios, respondieron a un cuestionario online (google form). Los resultados mostraron que los progenitores admitieron una multi-causalidad para la suspensión de los intercambios; que en alrededor de ¾ (70.8%) de los casos se modificó el tiempo de estancia y comunicación con los hijos con un decremento en la tasa de intercambios del 83%, compensado con más contacto telefónico/telemático (92.1%); que estadísticamente en la mitad de los casos se suspendieron las visitas (44.2%), quedando generalmente (85.0%) bajo la custodia de la madre; que los progenitores consensuaron los intercambios en el 47.8% de los casos; que las causas que motivaron significativamente los cambios fueron las legales , el mejor interés del menor (46%; salvaguarda de su salud), la protección de la salud pública (16.1%; no favorecer la transmisión de la COVID-19) y normativas (11.2%; no estar permitidos los desplazamientos). Inspired by a long-time professional activity in the field of sanitation, and more precisely by wastewater and sludge treatment, this thesis is focusing on the issue of human excreta in urban areas through a double approach based on history and technology. The problem addressed in this research is dealing with the long-term evolution of sanitation systems in urban areas developed by human beings to remove and handle their feces and urine excretion. The study is considering the evolution of latrines and the process of excreta management, from the first and simple equipment such as urinal and chamber pot, then the piping system and the storage tanks. This research is also addressing the issue of water carriage and of how to define the most efficient sewerage network, having in mind it has to cope with the different characteristics of the various effluents to be managed (grey water, runoff water…). The ambition behind this work is to explain and analyze the misunderstood profession of workers in charge of dealing with human waste. Based upon a novel approach of analyzing scientific papers, this research is exploring the timeline of human dejections management in the context of circular economy and energy transition. The period covered in this study, starting at the end of the XVIIIth century until the beginning of the XXth century, corresponds with the extension of sanitation, a new industrial activity connected with numerous other activities (technology, science, public policy, justice…). This historical approach corresponds with major changes in urban areas, with strong impacts in the privacy of housing buildings. Marked by various innovations, tensions and crisis, the system of human excreta management in dense territories is controlled by a large variety of stakeholders, and constrained by the progress of technology, the legal framework and also by available financing mechanisms.Second major characteristic of this research, along with its historical framework, a geographical dimension has been adopted to focus on a major town of France that has not been much studied, the city of Lyon, located on the powerful Rhône and Saône rivers, offering a very different context compared to Paris and the Seine river.In order to make this analysis digest despite the natural repulsive attitude towards human excreta and the enormous corpus of data along with the large diversity of systems, an appropriate structure has been implemented. After considering the technical structure of sanitation systems, the work addresses the relationships between sanitation and health issues, including legal and financial aspects. Then, considering an education in agricultural science, a special attention is paid to the different ways to recycle humanure, and more precisely to treatment technologies and land application practices.The conclusion intends to demonstrate that the conditions of human excreta management in urban areas are becoming more and more complex in time, with a large variety of treatment processes and an increasing number of by-products with the victory of water carriage at the beginning of the XXth century. ; Inspirée par l'exercice d'une longue activité professionnelle dans le domaine de l'assainissement, et plus particulièrement dans l'épuration des eaux usées domestiques, cette thèse a pour objet d'apporter un éclairage sur les conditions de gestion des déjections humaines dans une double réflexion technique et historique. La problématique étudiée porte sur les conditions d'évolution des systèmes d'assainissement des villes développés par les êtres humains pour gérer leurs matières excrémentielles et les soustraire à leur environnement immédiat. Il s'agit d'étudier plus précisément les moyens adoptés pour procéder à l'éloignement des déjections humaines. Le sujet est appréhendé depuis les premiers équipements destinés à recueillir les matières solides et liquides, en passant par les conduites et les fosses de stockage, jusqu'aux opérations logistiques d'extraction, de déplacement et de transformation, pour conclure sur la victoire du tout-à-l'égout. Soulevant le voile sur la part de secret qui caractérise tout ce qui touche aux déjections humaines, ce travail tente d'apporter un éclairage nouveau sur ce secteur d'importance, en particulier dans un contexte d'économie circulaire et de transition énergétique.Sur l'échelle de temps d'une part, si la période retenue pour orienter les investigations conduites est relativement longue, couvrant la fin du XVIIIe jusqu'au début du XXe s., c'est parce qu'elle permet d'appréhender l'essor d'une activité aux multiples connexions (techniques, scientifiques, politique publique, justice…). Cet intervalle caractérise une radicale transformation des activités de gestion des déjections humaines produites par les habitants des grandes villes. Dans une progression rythmée par des tensions et des crises, le système d'évacuation des déjections humaines de la cité se structure en réseau, contrôlé par un nombre croissant d'acteurs, mais également de procédés techniques, de règlementations, et bien sûr pour en assurer le fonctionnement, de mécanismes financiers. Second point déterminant d'autre part, après l'ancrage chronologique et dans le contexte très centralisateur de la France, la recherche porte géographiquement un intérêt marqué pour la ville de Lyon, qui bénéfice d'un contexte particulier par rapport à Paris, avec la présence du Rhône, et qui est restée jusqu'ici relativement peu considérée sous l'angle des déjections humaines. Pour rendre digeste un sujet caractérisé par la profusion de données et la diversité de systèmes, hier et aujourd'hui, un découpage parmi d'autres a été adopté. Après l'analyse des enjeux techniques, puis des aspects liés à la santé, la thèse aborde les aspects juridiques et financiers de la gestion des matières. A la suite, motivé par une formation d'ingénieur agronome, le travail se poursuit avec la question du devenir des déjections, et plus précisément leurs conditions de retour au sol. La conclusion cherche à mettre en évidence que les conditions d'éloignement des déjections humaines en milieu urbain se complexifient au fil du temps, avec la mise en œuvre d'opérations supplémentaires de séparation de phases, et la victoire du tout-à-l'égout au XXe siècle.

This dissertation consists in three essays with complementary approaches on the economics of social integration in an urban setting. The first essay analyzes the emergence of ethno-cultural hierarchies in a multi-cultural context, typical of nowadays large metropolises. This emergence is studied using an evolutionary game theory model according to which, in a society, a common hierarchy view emerges from a multitude of independent interactions between members of the different ethno-cultural groups. The originality of the model lies in the featuring of several minorities and hierarchical views (i.e. multi-group and multi-strategy model) and in the reciprocal effects that minorities may have on each others' social statuses. These effects allow to explain the non-linear relationship between a minority's size and its status suggested by the empirical literature, as well as the complex impacts of a new minority's arrival on the other minorities. The evolutionary process implies that the adopted ethno-cultural hierarchy is, in most cases, too inegalitarian and thus economically inefficient. The second essay presents an urban economics model adapted to the sub-Saharan African city context where land ownership is often informal and uncertain and where land transactions are often hampered by important information asymmetries between buyers and sellers. The model allows to theoretically study the impact of two institutions aimed at reducing transaction uncertainty. The first one consists in a formal land registration system administered by the government, the second is a traditional social trust norm that links specific social groups. This model is, to the best of our knowledge, the first one to study the effects of a social norm on the functioning of an urban housing market and the urban structure. It shows that the land registration system is more efficient than the traditional trust norm if registration costs are limited, but also that the two institutions are partly substitutable. The model predicts that, with the gradual decrease of registration costs, land registration will progressively replace social trust norms in the future.Eventually, the third essay consists in an econometric analysis of a large urban renewal program launched in France in 2003 for the renovation of 600 deprived neighborhoods (i.e. the « Programme National de Rénovation Urbaine », PNRU). In order to avoid possible biases linked with heterogeneities in the program's effects across neighborhoods and across time periods, we rely on the very novel DID_M estimator developed by De Chaisemartin and D'Haultfoeuille (forthcoming) and complement its results with a more traditional difference-in-differences estimation. Our results suggest that the program had non-significant and, in any case, very limited effects (i.e. smaller than 3.5%) on housing prices in renovated neighborhoods. The program's effects on transaction volumes are also non-significant. However, the program led to a sizable upward evolution in the socio-professional status of housing buyers as compared to sellers, suggesting some improvement in the attractivity of renovated neighborhoods. ; Cette thèse se compose de trois essais aux approches complémentaires portant sur l'économie de l'intégration sociale en milieu urbain. Le premier essai analyse l'émergence de hiérarchies ethno-culturelles dans un contexte multi-culturel, typique des grandes métropoles actuelles. Cette émergence est étudiée au moyen d'un modèle de théorie des jeux évolutionnaires selon lequel une vision hiérarchique commune émerge, dans une société, à partir d'une multitude d'interactions indépendantes entre membres des différents groupes ethno-culturels en présence. L'originalité du modèle proposé tient à l'inclusion de plusieurs minorités et conceptions hiérarchiques (i.e. modèle multi-groupes et multi-stratégies) et à la prise en compte des effets réciproques que plusieurs minorités peuvent avoir sur les statuts sociaux des autres. Ces effets permettent d'expliquer la relation non-linéaire entre taille d'une minorité et statut social suggérée par la littérature empirique, ainsi que les effets complexes de l'arrivée d'une nouvelle minorité sur les autres minorités. Le processus évolutionnaire étudié suggère que la hiérarchie ethno-culturelle adoptée est, dans la plupart des cas, économiquement sous-efficace car trop inégalitaire. Le deuxième essai présente un modèle d'économie urbaine adapté au contexte des villes d'Afrique sub-Saharienne où la propriété foncière est souvent informelle et incertaine et où les transactions foncières sont souvent entravées par d'importantes asymétries d'information entre acheteurs et vendeurs. Le modèle permet d'étudier théoriquement l'impact de deux institutions visant à réduire l'incertitude liée aux transactions. La première consiste en un système d'enregistrement formel des terrains dans un cadastre géré par l'administration, la deuxième en une norme sociale traditionnelle de confiance liant certains groupes sociaux. Le modèle qui est, à notre connaissance, le premier à étudier l'effet d'une norme sociale sur le fonctionnement d'un marché immobilier urbain et la structure urbaine, montre que le système d'enregistrement est plus efficace que la norme sociale si les coûts d'enregistrements sont limités, mais que les deux institutions sont en partie substituables. Il prédit que l'enregistrement des terrains remplacera progressivement les normes traditionnelles de confiance dans le futur, à mesure que les coûts d'enregistrement décroîtront.Enfin, le troisième essai consiste en une analyse économétrique des effets du Programme National de Rénovation Urbaine (PNRU), lancé en France en 2003 pour la rénovation de 600 quartiers défavorisés. Afin d'éviter certains biais liés à l'hétérogénéité des effets du programme entre les différents quartiers et entre les différentes périodes temporelles, nous mobilisons le tout récent estimateur DID_M développé par De Chaisemartin and D'Haultfoeuille (forthcoming) et complémentons ses résultats par une plus traditionnelle estimation de différences-de-différences. Nos résultats indiquent que le programme a eu des effets non-significatifs et, de toute façon, très limités (moins de 3.5%) sur les prix immobiliers dans les quartiers rénovés. Les effets sur les volumes de transactions sont aussi non significatifs. Toutefois, le programme a engendré une sensible évolution à la hausse du profil socio-professionnel des acheteurs de logement par rapport aux vendeurs, suggérant une certaine amélioration de l'attractivité des quartiers rénovés.

South Africa owns more than 70% of the world's known chromite reserves. Chromite has historically been the most feasible source of chromium suitable for ferrochrome production, which in turn is an essential raw material for stainless steel production. Stainless steel has a myriad of applications in modern society. The South African ferrochrome industry was developed on the foundation of abundant raw material; historically cheap electricity and labour; and investment into industry research and infrastructure. The industry, like other mineral industries, has made a significant contribution to the socio-economic development of South Africa. The South African government, through the Department of Mineral Resources, has drafted a mineral beneficiation strategy that is focused on developing the downstream industry to leverage the abundant mineral resource for prolonged and increased benefit to the South Africa. Yet while the ferrochrome and stainless-steel value chains have been identified as strategic, their mining and processing is resource intensive and a significant contributor to emissions that have the potential of causing environmental degradation. In order to have meaningful engagement between stakeholders, there must be reliable information. This has resulted in the development of sustainability indicators to facilitate engagement. Of the various types of sustainability indicators, resource intensity, which is the ratio of the resource used to the unit product, was selected for this study. This was because resource intensity trends can be used to show the effects of environmental constraints quantitatively and qualitatively, such as ore grade and the effects of technological innovation on processing a mineral resource. In this way, decisions can be made regarding the environmental impacts and the technology required to mitigate these. From a review of similar studies, it was found that approach for a similar included gathering data from mining company reports and, where possible, collaborating with companies. These data were then compiled to identify trends showing whether industries have improved in certain aspects. The causes of those variations were also reported in conjunction with the trends. In certain instances, expert insights were used to support the investigations. Most studies found that ore grades gradually decline, which increases input into the industry. However, technology improvements and improved process improvements have the potential to mitigate the effects of these declining ore grades. This observation informed the development of the hypothesis for this study, which is that process and technology improvements could avert an increase in resource input when an ore grade declines. The methodology adopted for this study included compiling resource intensity trends from publicly available sources over the period 2007-2017 (and on one occasion data were shared by a ferrochrome producing company), mapping major industry projects over this period, and conducting interviews with eight industry experts to verify trends and establish the impact of technology choice in relation to observed resource intensity trends. It was assumed that the quality of the data was uniform and of a sufficiently high quality for comparison and analysis. Although ore grade trends could not be obtained, it was inferred that ore grade is decreasing. This is due to increased usage of Upper Group 2 (UG2) seam chromium concentrate, which has a lower grade than the conventional higher ore grade, Lower Group 6 (LG6), or Middle Group 1 and 2 (MG1/2) seam ore. Moreover, the chrome source raw material quality used in ferrochrome production was found to be improving with the advent of pelletising and sintering technology, which makes it possible to use UG2 ore. This technology increases the durability of the ore, which also improves the efficiencies. This has led to the development of industrial symbiosis, whereby platinum group metal (PGM) producers generate UG2 tailings, which are sent to co-located ferrochrome producers to produce chromium concentrate. Chromium concentrate forms part of the raw material to produce sintered pellets which are used to produce ferrochrome. Electricity intensity was also observed to decrease over time due to improvements in process energy integration. The increased application of closed furnaces allows the use of flue gas from smelting for combustion to generate electricity and heat transfer of the hot gas to be used to heat up other process streams. The addition of a prereduction increased energy efficiency, in addition to improving ore efficiencies, collectively reduced the electricity requirements. Furthermore, the increased use of chrome sintered pellets has contributed to the decline in electricity intensity. Water intensity trends could not be conclusively determined due to evolving water accounting. It was inferred that if the water accounting remained constant from when it was reported to change, the water intensity was also decreasing. This has been attributed to increased water efficiency investments such as increased paving of water canals to increase recycling. Reductant intensities could not be confirmed as there were insufficient data to draw the trends and consequently review them. It was mentioned that new Glencore proprietary furnace technology has reduced the requirement of expensive coke reductant. The impetus of most of these projects was remaining profitable. The continual increase in the price of electricity in South Africa has propelled ferrochrome producers to reduce their electricity usage, as electricity accounts for up to 50% of ferrochrome production costs (Pan, 2013). Legal compliance has also motivated some technology implementations. For instance, in preparation for the carbon tax, manufacturers reduced their electricity use and started to increase the combustion of carbon monoxide off-gas from smelting for electricity production and other applications such as heat integration and prereduction. There has also been an increase in awareness of climate change and greenhouse gases, and the need for more responsible and sustainable mineral processing. The public perception of a company can significantly affect its profitability, with environmental protests affecting operations and consequently profits.

Archiviato il periodo più oscuro della crisi globale del 2008, opportune scelte di politica economica avrebbero dovuto consentire all'Italia di intraprendere una nuova traiettoria di sviluppo, superando la condizione di debole incremento del PIL che, sin dagli anni Novanta e per oltre un quindicennio, aveva caratterizzato la crescita economica del Paese (Draghi, 2009). Tuttavia, nonostante la presenza di un mix di fattori che la letteratura ritiene strettamente correlati allo sviluppo, le aspettative sono andate deluse e la crescita attesa si è ridota ad un modesto incremento strutturale della ricchezza prodotta (Research*eu, 2018). In un simile scenario d'incertezza e instabilità, la posizione dell'Italia, seconda potenza manifatturiera in Europa, appare pericolosamente vulnerabile in termini di "sopravvivenza" del proprio assetto produttivo, anche in ragione dell'accelerato ricambio che caratterizza la struttura del tessuto imprenditoriale nazionale, indissolubilmente dominato dalla diffusa prevalenza di aziende medio-piccole (Pagano, Schivardi, 2003). Un segnale incoraggiante di apparente dinamismo positivo traspare, a valle del 2015, dall'emergere della riduzione della forbice che misura il saldo tra iscrizioni e cancellazioni di nuove attività imprenditoriali; forbice dipendente dal capovolgimento, in senso positivo, del valore tendenziale dei relativi tassi del turnover netto delle imprese attive registrate. Nell'interpretare il fenomeno in termini di potenziale indicatore di una nuova fase di riequilibrio del sistema, diversi studiosi (Fantozzi, Marotta, 2006; Holmes et Al., 2009; Del Bosco, 2014; Rullani, 2014) suggeriscono l'opportunità di un'esplicita attenzione da rivolgere agli aspetti "territoriali" del modello imprenditoriale per meglio leggere le concrete prospettive di complessivo riassetto del sistema, attraverso l'introduzione di processi d'innovazione tecnologica, da un verso, e di più esplicita sensibilità sociale ed ambientale, dall'altro. Accogliendo tale suggestione, la ricerca che qui si presenta, muovendo da una rappresentazione delle geometrie del dimensionamento aziendale e dalla distribuzione in termini di attività settoriali, ne proietta gli andamenti recenti a scala geografica, allo scopo di pervenire ad un raffronto di natura diacronica tra assetti antecedenti gli anni della grande crisi e realtà successive, evidenziate dalle più recenti risultanze statistiche*. Il percorso di analisi, pertanto, si snoderà attraverso diversi passaggi: in primo luogo affronterà una rapida ricognizione della letteratura nell'intento di identificare le più importanti variabili esplicative del fenomeno in esame; seguirà, quindi, l'analisi diacronica della demografia d'impresa italiana nella prospettiva dimensionale e settoriale, confrontandone gli esiti con una riflessione sulle proiezioni geografiche dell'implementazione di progetti innovativi da parte delle compagini imprenditoriali che, espressione diretta dei territori, contribuiscono al radicamento delle diverse attività produttive perseguendo un esplicito progetto di sviluppo "endogeno", incentrato, cioè, sull'utilizzo e sulla valorizzazione delle risorse e delle competenze locali. Il quadro che emerge sembra svelare una tendenza ad un progressivo riequilibrio territoriale del tasso di "sopravvivenza" aziendale. Il netto regresso della "mortalità d'impresa", sensibile più che altrove nel Mez-zogiorno, è associabile ad incoraggianti prospettive di modernizzazione del sistema produttivo nazionale definibili in termini di più diffuso accesso a contenuti di R&S e dinamismo nella propensione all'inter-nazionalizzazione. Tale fenomeno caratterizza in misura maggiore le imprese medio-grandi e quelle di minori dimensioni tuttavia legate a forme di startup industriali sostenute da interazioni virtuose stabilitesi tra università e imprese tecnologicamente avanzate (Ross, 2016). Di conseguenza, data l'estrema disomogeneità territoriale nella distribuzione geografica delle aziende di dimensioni maggiori, del tutto marginali in termini di consistenza numerica e settoriale nella regione meridionale del Paese, il nodo di una più equa ed opportuna localizzazione delle attività produttive nello spazio geografico resta, comunque, del tutto irrisolto, nonostante le convergenti valutazioni circa l'esigenza improcrastinabile di tale prospettiva virtuosa, ampiamente sostenute dalla letteratura più accreditata (Cappellin et Al., 2014). ; After the darkest period of the 2008 global crisis, appropriate economic policy choices should have allowed Italy to embark on a new development trajectory, overcoming the condition of weak GDP growth which, since the 1990s and for over fifteen years, had characterized the country's economic growth (Draghi, 2009). However, despite the presence of a mix of factors that the literature considers strictly correlated to development, expectations have been disappointed and the expected growth has been reduced to a modest structural increase in the wealth produced. In this scenario of uncertainty and instability, the position of Italy, the second manufacturing power in Europe, appears dangerously vulnerable in terms of the "survival" of its production structure, also due to the accelerated turnover that characterizes the structure of the entrepreneurial fabric national, indissolubly dominated by the widespread prevalence of medium-small businesses. An encouraging sign of apparent positive dynamism shines through from the emergence of the reduction in the gap that measures the balance between registrations and cancellations of new business activities; spread depending on the reversal, in a positive sense, of the tendential value of the relative net turnover rates of the registered active companies. In interpreting the phenomenon in terms of a potential indicator of a new phase of rebalancing of the system, several scholars suggest the opportunity for explicit attention to be paid to the "territorial" as-pects of the business model to better read the concrete prospects for an overall reorganization of the system, through the introduction of technological innovation processes, on the one hand, and more ex-plicit social and environmental sensitivity, on the other. The research presented here, starting from a representation of the ge-ometries of the company sizing and from the distribution in terms of sectoral activities, projects the recent trends on a geographical scale, in order to arrive at a diachronic comparison between structures prior to the years of great crisis and subsequent realities, highlighted by the most recent statistical results.

Purpose of this article is to determine whether the right to remedial secession exists under the contemporary international law. This question is relevant because intense legal debates concerning an existence of this right has not come to conclusion. Moreover, it is important to answer this question because of a vast number of separatist movements worldwide that base their claim for independence on self-determination and the concept of remedial right to secede. In order to answer the question whether the right to remedial secession exists under the contemporary international law relevant judicial decisions, state practice and opinio juris were analysed. It was concluded that there is no remedial right to secede under the contemporary international law. First, it was determined that international community is reluctant to recognise unilateral attempts of secession. Therefore, consent of parent state is still considered to be an important factor for acceptance of new states. Secondly, there was no single instance of acceptance of entitlement to remedial secession in state practice. Also, there is a split in states opinio juris concerning an existence of remedial right to secede. Furthermore, there is no strong and united opinio juris supporting this notion. Accordingly, weak opinio juris and lack of practical implementation show that remedial secession cannot be considered as a part of the binding international law. ; Šios publikacijos tikslas yra nustatyti ar tarptautinėje teisėje egzistuoja teisė į gynybinę secesiją. Tautų apsisprendimo principas yra svarbi modernios tarptautinės teisės dalis. Ši teisė įtvirtinta įvairiose tarptautiniuose dokumentuose, tarp jų ir Jungtinių Tautų Chartijoje. Jos svarbą ir erga omnes statusą yra pabrėžęs Tarptautinis Teisingumo Teismas. Dažnai teigiama, jog post-koloniniame pasaulyje ši teisė turėtų būti įgyvendinama valstybės viduje. Nepaisant to, egzistuoja gynybinės secesijos teorija, kuri teigia, jog tauta, negalinti įgyvendinti savo tautos apsisprendimo teisės valstybės viduje, turi teisę į vienašalį atsiskyrimą iš suverenios valstybės. Ši teorija turi didelį palaikymą tarp teisės mokslininkų. Nepaisant to, teisės į gynybinę secesiją egzistavimas jau ilgai yra išsamių teisinių ginčų objektas. Šios doktrinos kritikai dažnai pabrėžia, jog tokios teisės egzistavimas pažeistų šalies teritorinio vientisumo principą ir taip sugriautų valstybių ir teisinės tvarkos status quo. Taip pat pabrėžiama, jog ši teorija nesiremia jokia konkrečia šalių praktika. Tačiau autoriai, palaikantys gynybinės secesijos egzistavimą, dažnai nurodo įvairius atvejus, kai žmogaus teisės pažeidimus patyrusių tautų nepriklausomybės siekis buvo gausiai palaikomas tarptautinės bendruomenės. Teisės mokslininkai vis dar nepadarėišvados ir vis dar nenustate, ar tokia teisė egzistuoja. Šio darbo aktualumui svarbu tai, jog pasaulyje yra daugybė separatistinių judėjimų, kurie dažnai remiasi tautų apsisprendimo principu ir būtent gynybinės secesijos doktrina. Atlikus tyrimą, į klausimą, ar gynybinė secesija egzistuoja tarptautinėje teisėje, atsakyta neigiamai. Pirmiausia, atlikus teismų praktikos, šalių praktikos ir opinio juris analizę buvo nustatyta, jog nėra nei vieno atvejo, kad gynybinė secesija būtų pripažinta tarptautinės bendruomenės ir įgyvendinta praktikoje. Darbo metu buvo išanalizuoti Bangladešo, Kroatijos, Kosovo atvejai, kurie yra dažnai laikomi kaip gynybinės secesijos pasireiškimas praktikoje. Nežiūrint to, jog visose šiose situacijose su įvairiais žmogaus teisių pažeidimais susidūrusiai grupei buvo suteikta teisė į nepriklausomybę, panašu, kad tai buvo padaryta ne dėl jos teisės į gynybinę secesiją egzistavimo, bet dėl faktinių ir politinių aplinkybių. Nėra jokio įrodymo, jog tarptautinė bendruomenė, palaikydama šių šalių nepriklausomybes, rėmėsi gynybinės secesijos doktrina. Dar daugiau, panašu, kad Kosovo atveju tarptautinė bendruomenė siekė nesukurti precedento ir, pabrėždama išskirtines šios situacijos aplinkybes, siekė atgrasinti kitus panašius judėjimus. Taip pat, opinio juris, palaikantis gynybinės secesijos egzistavimą, yra nepakankamai stiprus ir vieningas. Nepaisant to, jog tokio opinio juris galima rasti įvairiuose teismų sprendimuose, kuriuose yra nurodoma gynybinės secesijos galimybė, taip pat dalis šalių išreiškė palaikymą tokios teisės egzistavimui Kosovo bylos nagrinėjimo metu Tarptautiniame Teisingumo Teisme, negalima ignoruoti grupės šalių, kurios Kosovo bylos nagrinėjimo metu atmetė tokios teisės egzistavimą. Taigi, akivaizdu, jog Kosovo bylos nagrinėjimo metu išreikšta šalių opinio juris yra per daug susiskaldžiusi, kad rodytų vieningos ir stiprios opinio juris palaikančios gynybinę secesiją egzistavimą. Taip pat, reikėtų pažymėti, kad šalies, nuo kurios yra atsiskiriama, sutikimo egzistavimas vis dar išlieka svarbiu faktoriumi pripažįstant naują valstybę. Galima teigti, jog tarptautinė bendruomenė yra nelinkusi pripažinti vienašalių secesijos atvejų. Tai akivaizdu Kosovo atveju, kuris nepaisant to, jog sulaukė didelio tarptautinės bendruomenės palaikymo, vis dar yra nepripažintas didelio skaičiaus valstybių ir nepriimtas į Jungtines Tautas. Atsižvelgus į teismų praktikos, šalių praktikos ir opinio juris analizę galima teigti, jog tarptautinė teisė nepripažįsta teisės į gynybinę secesiją egzistavimo. Ši išvada remiasi tuo, kad opinio juris šiuo klausimu yra nepakankamai stiprus ir vieningas. Taip pat šios teisės egzistavimas yra neįrodytas šalių praktikoje. Netgi ir taikant labiau progresyvų paprotinės teisės nustatymo metodą, kuriame stiprios opinio juris egzistavimas gali kompensuoti šalių praktikos trūkumą, išvados lieka tos pačios. Kaip ir minėta anksčiau, opinio juris šiuo klausimu yra per daug nevieningas, kad galėtų įrodyti teisės į gynybinę secesiją egzistavimą. Šiuo metu vienašalių secesijos bandymų sėkmė priklauso nuo tarptautinės bendruomenės politinių sprendimų. Todėl dažnai tokiais atvejais svarbesni tampa politiniai išskaičiavimai, o ne moraliniai ar teisiniai faktoriai. Tokia teisinė nežinomybė tik skatina separatistinių konfliktų augimą pasaulyje. Todėl, rekomenduotina, jog tarptautinė bendruomenė susitartų dėl gynybinės secesijos egzistavimo ir galimų gairių, kurios padėtų nustatyti tokių atvejų atitikimą teisei. Šiomis gairėmis tarptautinė bendruomenė galėtų vadovautis prieš suteikdama pripažinimą naujai atsiskyrusioms valstybėms. Tokia situacija galėtų suteikti daugiau teisinio tikrumo ir padėtų stabilizuoti situaciją tarptautinėje bendruomenėje. Gairės turėtų atitikti dažniausiai doktrinoje sutinkamus reikalavimus, keliamus gynybinei secesijai. Pirmiausia teisės turėtojas turėtų būti objektyviai ir subjektyviai išsiskirianti grupė, sudaranti daugumą atskiroje teritorijoje. Antra, tautai turėtų būtų užkirstas kelias išreikšti savo apsisprendimą valstybės viduje ir tauta turėtų patirti pastovius ir rimtus žmogaus teisių pažeidimus. Trečia, visos kitos priemonės išspręsti konfliktą būtų išnaudotos. Taip pat galima teigti, jog papildoma sąlyga galėtų būti atsiskyrusioje šalyje gyvenančių mažumų teisių užtikrinimas.

La teoría de la pérdida de la oportunidad o chance, se viene aplicando en Colombia a través de la Jurisprudencia del Consejo de Estado para resolver un gran número de situaciones, derivadas de la responsabilidad extracontractual del Estado en materia médica, cuando se trata de casos en los que se sufre el menoscabo de una ventaja esperada o se evita la recuperación de la salud. Lo anterior ocurre, en muchos casos, por el actuar negligente o la omisión del personal médico, asistencial o administrativo; sin embargo, es preciso aclarar que es muy difícil demostrar si esa actuación u omisión tiene incidencia causal entre el resultado final y el actuar del médico. Por ello, se pretende analizar cuáles han sido los criterios desarrollados por el Máximo Tribunal de lo Contencioso Administrativo en materia médica y cuáles han sido los criterios aplicados para determinar si hay lugar a la obligación de indemnizar a la víctima, en las situaciones en que se privó a ésta de obtener una mejora o evitar un daño, es decir, establecer si realmente existió la pérdida de una oportunidad o si solo se trataba de una incertidumbre causal. Lo anterior conllevó a la formulación del siguiente problema jurídico que permitirá el desarrollo del presente trabajo, el cual se sintetiza en el siguiente interrogante: ¿Los criterios jurisprudenciales establecidos por el Consejo de Estado, garantizan uniformemente los derechos de la víctima, cuando se acude a la aplicación de la pérdida de oportunidad en materia de responsabilidad médica en Colombia? En este contexto, se hace necesario establecer que la pérdida de oportunidad en términos generales se presenta cuando un sujeto tiene la posibilidad de obtener un beneficio y este no se logra; razón por la que, se desprenden una serie de preguntas y de hipótesis acerca de si ese agente, puede ser el responsable por la conducta activa u omisiva que desencadenó el hecho que afectó a la víctima, al perder un resultado posiblemente beneficioso. Esto sin desconocer que, aunque el resultado positivo está sujeto al azar y a la incertidumbre el afectado o sus familiares en caso de muerte, deben ser indemnizados por la pérdida de su chance. En este orden de ideas, se evidencia que la teoría de la pérdida de oportunidad y la indemnización de los daños a la persona tiene un efecto concreto en la responsabilidad patrimonial de carácter extracontractual en Colombia, puesto que permite probar la incidencia causal de esa culpa del personal médico. The aim of the research is the investigation of the essential theoretical aspects of smart culture management. The article formulates the theoretical construct of smart culture management by combining cultural management and management concepts, closely linking cultural management with the implementation of cultural policy and seeing the specifics of smart cultural management.Qualitative analysis was performed of theoretical sources of foreign countries and Lithuania. Also, a comparative analysis of different concepts was carried out, highlighting similarities and differences of concepts (in order to discern correlations between them).Five groups of cultural management concepts are distinguished: cultural management as specific management in art and culture; cultural management as a phenomenon, process reflecting the formation and implementation of cultural policy; cultural management as an institution management; cultural management as a profession and academic discipline; cultural management as leadership-based management. Theoretical analysis of the phenomenon of smartness in cultural management allowed us to distinguish six dimensions of smartness: strategic, creative development, harmonization of interests in the cultural sector, empowered cultural sector parties, the harmony of intellectual and technological capital, the culture of shared value creation.Exploring the urban cultural field situation, using a model that reflects the 6 dimensions of smart culture management and 18 qualities of a smart social system, will highlight the strengths and weaknesses of the cultural field. By analyzing the weaknesses, the researchers will be able to make recommendations on how to improve the current situation. Improving the cultural field at the local level will significantly increase the quality of cultural services provided to the population.In future research, it is planned to apply the theoretical model of smart culture management to the analysis of situation analysis in the selected city. Nacionalinė šalies kultūra yra valstybės pamatas. Šalis, siekianti išsaugoti nacionalinį-kultūrinį identitetą, ypatingą dėmesį skiria sumaniam kultūros politikos valdymui. Nors sumanumo konceptas mokslininkų pradėtas vartoti jau praėjusio amžiaus pabaigoje, kultūros vadybos, kultūros valdymo kontekstuose šis konceptas pradėtas vartoti neseniai.Sumanus kultūros valdymas yra daugiadimensis reiškinys, visų pirma apimantis sumanumo reiškinį, kuris suvokiamas kaip pamatinė sumanios socialinės sistemos kokybinė vertybė. Kaip teigia Jucevičienė, Jucevičius (2014), "sumanumas yra gebėjimas greitai ir išradingai prisitaikyti prie kintančios aplinkos sąlygų priimant adekvačius sprendimus ir juos panaudojant galutinio tikslo pasiekimui." Sumanumo koncepto atsiradimas kultūros valdyme verčia mąstyti apie šios srities politikos formavimo, įgyvendinimo unikalumą, naujumą. Sumanus kultūros valdymas yra grįstas sumaniu valdymu, kuris dar tik pradeda įsitvirtinti. Sumanus valdymas, kaip naujausia viešojo valdymo modelio atšaka, atsirado gana neseniai, tačiau jos taikymo apraiškų, nors ir nedaug, bet jau galime aptikti analizuojant, kaip kultūros politiką formuoja, valdo ir įgyvendina skirtingų lygmenų viešojo administravimo institucijos bei joms pavaldžios kultūros įstaigos. Kultūros srityje, kaip teigia Pauliukevičiūtė, Raipa (2009), sudėtinga "parinkti atitinkamas ir labiausiai derančias administravimo formas, įžvelgti svarbiausias srities problemas ir nustatyti prioritetinius tikslus". Šis autorių atskleistas požiūris į kultūros politikos valdymą leidžia daryti prielaidas, kad ir sumanus kultūros politikos valdymas yra sudėtingas daugiadimensis procesas, kurį veikia įvairūs objektyvūs ir subjektyvūs aplinkos veiksniai. Kultūros lauke, kaip ir kitose politikos srityse, veikia skirtingos interesų grupės, turinčios skirtingus požiūrius ir siekinius tais pačiais sumanaus kultūros valdymo klausimais. Tarp šių interesų grupių dažnai kyla kolizinės situacijos. Interesų grupių skirtingų požiūrių suderinimas konsensuso būdu ir tampa suformuotąja kultūros politika, kurioje galima įžvelgti vis daugiau sumanaus kultūros valdymo apraiškų.Tyrimo objektas– sumanus kultūros valdymas.Tyrimo tikslas– ištirti sumanaus kultūros valdymo esminius teorinius aspektus.Metodas. Atlikta užsienio šalių ir Lietuvos teorinių šaltinių kokybinė turinio analizė. Taip pat atlikta lyginamoji skirtingų sąvokų turinio analizė, išryškinant sąvokų panašumus ir skirtumus (siekiant išsiaiškinti jų sąsajas).Kultūros vadybos konstruktas formuluojamas derinant kultūros ir vadybos koncepcijas, glaudžiai siejant kultūros vadybą su kultūros politikos įgyvendinimu ir įžvelgiant kultūros vadybos specifiką. Atsižvelgiant į kultūros sektoriaus kompleksiškumą, kylančius naujus reikalavimus kultūros vadybai, sumanumo koncepcijos taikymas vadybiniuose sprendimuose atveria daug naujų galimybių.Kultūros vadybos koncepcijos pasižymi plačia įvairove. Kiekviena iš koncepcijų papildo kultūros vadybos lauko sampratą tam tikrais naujais aspektais. Galima išskirti esmines penkias kultūros vadybos koncepcijų grupes: kultūros vadyba kaip specifinė vadyba meno ir kultūros srityje; kultūros vadyba kaip kultūros politikos formavimą ir įgyvendinimą atspindintis reiškinys, procesas; kultūros vadyba kaip institucijų vadyba; kultūros vadyba kaip profesija ir akademinė disciplina; kultūros vadyba kaip lyderyste grindžiama vadyba.Teorinė sumanumo fenomeno kultūros valdyme analizė įgalino išskirti šešias sumanumo dimensijas: strategiškumo; kūrybiško vystymosi; įžvalgaus interesų derinimo kultūros sektoriuje; įgalintų kultūros sektoriaus subjektų; intelektinio ir technologinio kapitalo dermės; bendros vertės kūrimo kultūros. Kiekviena iš šešių dimensijų yra naujas mokslinis konceptas, tačiau visos dimensijos susijusios tarpusavyje, viena kitą papildančios ir išryškina sumanumo dimensijų kultūros valdyme koreliacijas su sumaniosios socialinės sistemos kokybėmis. Kiekvienai sumanios kultūros valdymo dimensijai priskirta po tris sumanios socialinės sistemos kokybes. Sukurtas sumanaus miesto kultūros vadybos modelis, kaip instrumentas gali būti pritaikytas tolesniems mokslininkų tyrimams.

The purpose of this work is to develop approaches to improve methods for calculating the number of migrants in each region of Ukraine depending on such factors as: the number of workers, average hourly wages and unemployment. The following methods were used in the study of the topic under consideration: generalization method, economic and statistical analysis, factor analysis, correlation analysis and graphical analysis. Findings. The reasons for Ukraine's migration to the EU are high unemployment, inflation, low wages, dissatisfaction with living standards in the country. The rating of the number of migrants was presented by constructing and analyzing a multifactor linear model of the dependence of migration flows in the i-th region on the number of labor force, the average hourly wage and the unemployment rate of the i-th region. The constructed model is as close as possible to reality. This method allows for constant and detailed monitoring of changes in migration flows in each region of Ukraine. This allows you to track the real picture of reality and observe the existing problems of migration. In general, the level of migration and outflow of labor from Ukraine is quite high, the situation is exacerbated by the economic crisis caused by COVID-19. The solution to this problem requires first of all a state settlement. Originality is that the authors proposed a production function that allowed quantitative and qualitative analysis of important economic dependencies in the field of migration flows, and its solution based on the initial data of the regions allowed to study and obtain specific models. The practical value of the obtained results is that the proposed model can be used by statistical services, committees and bodies dealing with migration issues in order to study in detail and reproduce the migration situation in all regions of the country. Целью данной работы является разработка подходов по совершенствованию методов расчета числа мигрантов по каждому региону Украины в зависимости от таких факторов как: численность рабочей силы, средняя почасовая заработная плата и уровень безработицы. При исследовании рассматриваемой темы использованы следующие методы: метод обобщения, экономико-статистический анализ, факторный анализ, корреляционный анализ и графический анализ. Результаты. Причинами миграции Украины в страны ЕС является высокий уровень безработицы, инфляция, низкие заработные платы, неудовлетворенность уровнем жизни в стране. Рейтинг числа мигрантов удалось представить с помощью построения и анализа многофакторной линейной модели зависимости миграционных потоков i-го региона от численности рабочей силы, средней почасовой заработной платы и уровня безработицы i-го региона. Построенная модель является максимально приближенной к реальности. Этот метод позволяет проводить постоянный и детальный мониторинг изменения миграционных потоков по каждому региону Украины. Это позволяет отслеживать реальную картину действительности и наблюдать существующие проблемы миграционного движения. В целом же уровень миграции и оттока рабочей силы из Украины является достаточно высоким, обострение ситуации происходит еще и вследствие экономического кризиса, вызванной COVID-19. Решение этой проблемы требует в первую очередь государственного урегулирования. Научная новизна заключается в том, что авторами предложено производственную функцию, которая позволила количественно и качественно проанализировать важные экономические зависимости в сфере миграционных потоков, а ее решения на основе исходных данных регионов позволит исследовать и получать конкретные модели. Практическая значимость исследования заключается в том, что предложенная модель может использоваться статистическими службами, комитетами и органами, занимающимися вопросами урегулирования миграции с целью детального исследования и воспроизведения ситуации по миграции всех регионов страны. Побудована модель є максимально наближеною до реальності. Цей метод дозволяє проводити постійний та детальний моніторинг зміни міграційних потоків по кожному регіону України. Це дозволяє відстежувати реальну картину дійсності та спостерігати наявні проблеми міграційного руху. Загалом же рівень міграції та відтоку робочої сили з України є досить високим, загострення ситуації відбувається ще й внаслідок економічної кризи, спричиненою COVID-19. Вирішення цієї проблеми потребує в першу чергу державного врегулювання. Наукова новизна полягає в тому, що авторами запропоновано виробничу функцію, яка дозволила кількісно та якісно проаналізувати важливі економічні залежності в сфері міграційних потоків, а її розв'язання на основі вихідних даних регіонів дозволило досліджувати та одержувати конкретні моделі. Практична значущість одержаних результатів полягає в тому, що запропонована модель може використовуватися статистичними службами, комітетами та органими, які займаються питаннями врегулювання міграції з метою детального дослідження та відтворення ситуації щодо міграції усіх регіонів країни. Аналіз досвіду форсування водних перешкод у локальних війнах і збройних конфліктах сучасності свідчить, що відповідно до факторів, які впливають на наступальний бій з форсуванням водної перешкоди, військові формування різних ланок виконували покладені на них завдання та використовували різні способи дій.Проте системних досліджень, присвячених питанням визначення ефективних (раціональних) способів виконання завдань, що виконують військові формування при веденні наступального бою з форсуванням водної перешкоди, не проводилося.У статті наведені основні складові удосконаленої методики вибору раціональних способів наступального бою військової частини з форсуванням водної перешкоди, яка ґрунтується на використанні апробованого математичного апарату, та дає змогу прийняти відповідне рішення. Удосконалена методика оцінювання способів виконання завдань у ході ведення наступального бою з форсуванням водної перешкоди дозволяє визначити раціональний варіант перерозподілу сил і засобів по елементах бойового порядку, оцінити ефективність ведення військовою частиною наступального бою з форсуванням водної перешкоди за визначеними варіантами дій підрозділів та обрати для ведення бою раціональний варіант дій із множини допустимих.Завдяки запропонованій методиці можна розв'язати задачу, сутність якої полягає у пошуку раціонального способу виконання завдань, перерозподілі сил і засобів в/ч за етапами ведення наступального бою з форсуванням водної перешкоди, при яких цільова функція буде максимальноюДля обґрунтування рекомендацій щодо вибору раціонального способу наступального бою з форсуванням водної перешкоди підрозділами в/ч із множини допустимих у методиці застосовано метод мінімаксу, який дає можливість вибрати числове значення ступеня виконання бойового завдання відповідно до раціонального варіанта дій її підрозділів.В подальшому можлива розробка спеціального програмного продукту, який дасть змогу на основі введення вихідних даних визначити ступінь досягнення потрібного рівня бойових можливостей військового формування, тривалість ведення бою та очікуваний ступінь виконання завдань військовим формуванням. ; Анализ опыта форсирования водных преград в локальных войнах и вооруженных конфликтах современности свидетельствует о том что исходя из факторов которые влияют на наступательный бой с форсированием водной преграды, воинские формирования различных звеньев выполнять поставленные на них задачи ы использовать разные способы действий.Впрочем системных исследований посвященных вопросам определения эффективных (рациональных) способов выполнения задач, которые выполняют воинские формирования при ведении наступательного боя с форсированием водной преграды, не проводилось.В статье приведены основные составные усовершенствованной методики выбора рациональных способов наступательного боя воинской части с форсированием водной преграды, которая основывается на использовании апробированного математического аппарата и дает возможность принять соответствующее решение. Усовершенствованная методика оценки способов выполнения задач в ходе ведения наступательного боя с форсированием водной преграды позволяет определить рациональный вариант перераспределения сил и средств по элементах боевого порядка, оценить эффективность ведения воинской частью наступательного боя с форсированием водной преграды по определенным вариантам действий подразделений и выбрать для ведения боя рациональный вариант из множества допустимых.Благодаря предложенной методике, возможно решить задачу, суть которой заключается в поиске рационального способа выполнения задач, перераспределения сил и средств воинской части по этапах ведения наступательного боя с форсированием водной преграды, при которых целевая функция будет максимальной.Для обоснования рекомендаций, касаемо выбора рационального способа наступательного боя с форсированием водной преграды подразделениями воинской части из множества допустимых в методике применено метод минимакса, который дает возможность выбрать числовое значение степени выполнения боевой задачи соответственно к рациональному варианту действий подразделений. В последующем возможна разработка специального программного продукта, который даст возможность на основании введении исходных данных определить степень достижения необходимого уровня боевых возможностей воинского формирования, продолжительность ведения боя та ожидаемую степень выполнения задач воинским формированием. ; An analysis of the experience of forcing water obstacles in local wars and armed conflicts of our time indicates that, based on the factors that affect an offensive battle with the crossing of a water obstacle, military formations of various units fulfill the tasks assigned to them and use different methods of action.However, there have been no systemic studies devoted to the determination of effective (rational) ways of performing tasks that are performed by military formations in an offensive battle with the forcing of a water barrier.Thanks to the proposed method, it is possible to solve the problem, the essence of which is to find a rational way to perform tasks, redistribute the forces and means of a military unit according to the stages of an offensive battle with the forcing of a water barrier, in which the target function will be maximum.To substantiate the recommendations regarding the choice of a rational method of offensive combat with the forcing of a water obstacle by subunits of a military unit from the set of admissible ones, the minimax method was used in the methodology, which makes it possible to select the numerical value of the degree of combat mission fulfillment in accordance with the rational option of subunits' actions.In the future, it is possible to develop a special software product, which will make it possible, on the basis of the input of initial data, to determine the degree of achievement of the required level of combat capabilities of a military formation, the duration of combat and the expected degree of accomplishment of tasks by a military formation.The main components of the improved choosing rational ways method of a separate mechanized brigade offensive operation with the forcing of a water obstacle are given in the article. The methodology is based on the use of a proven mathematical apparatus and allows the commander to make the appropriate decision. First, it designates the advent of a dangerous neo-capitalist power, destructive and totalizing, in the face of which Marxism and Christianity will be led to modify their tools of struggle and vision. The article, then, describes a real anthropological crisis which attains the destruction of entire cultural worlds, in the face of which it will be a question of giving back to rites and traditions their potential for revolt, which allows them to play as operators capable of mobilizing the energies lacking in the political struggles, such as memory or communion. In this article, the Greek professor explains his vision of the reasons for the moral and political duties that we have as citizens of our own countries towards refugees. The author considers that quite common in many societies and heated up by populists the perception ofrefugees as a burden and a threat to the receiving state is absolutely false and is used often enough to justify various other problems that are in no way related to refugees. Author argues that by helping and sheltering refugees, societies strengthen their own democraticpolitical community, and democratic conscience of its' citizens becomes deeper. In addition, appealing to Kant, the author emphasizes that we, as reasonable beings, cannot desire indifference to become a universal law, and every moment instead of every refugee fleeing from threats to his life and fundamental rights can be any of us. The lack of protection of basic rights and fundamental freedoms for refugee does not mean theycan be forsaken. All people are bound by universal moral duties: not to intentionally harm one another and to help one another in the event of a serious threat, if not related to sacrifice. This moral obligation towards residents or citizens of other states, the author calls political amaritanism. People living within law and order are obliged to help refugees by enabling them to enjoy the protection of their state, thus showing solidarity and compensating them for lack of law and order.This ultimately contributes to the affirmation of justice. The fulfilment of this duty is, of course, mediated through public democratic institutions. States should implement policies of assistance to refugees that will reflect an objective assessment of their capabilities, coordination of assistance processes, fair sharing of burdens and resources.The author makes an important remark: the help cannot force refugees to lose their identity and gain a new one in exchange for a higher standard of living. In today's world, there is a growing need for professionals with computer skills in general, and programming in particular. This is so, both in WEIRD contexts and in contexts that are not. WEIRD is an acronym from English (Western, Educated, Industrialized, Rich and Democratic Societies) and is used to refer to certain sectors of societies that are "Western, educated, industrialized, rich and democratic. The Ecuadorian State makes a high investment in the training of engineering career professionals offered by public universities. In Ecuador, these careers are highly demanded. However, a high student dropout is verified because of basic courses such as Fundamentals of programming in the first levels, with the consequent deficiencies in the performance of the careers. Additionally, the low qualification of students in computer skills indicates that they have not developed their computational thinking skills. In general terms, this situation contributes to the loss of competitiveness of non-WEIRD countries. For this reason, a pedagogical tool was introduced in teaching that allowed motivating programming learning, reducing dropout and improving academic performance in introductory programming courses at the university level. We present empirical evidence of the positive impact of Scratch on the Fundamentals of Programming courses. The use of this pedagogical tool allowed students to develop the concepts of programming logic and the use of basic control structures. Students who used Scratch scored better, reduced the number of suspensions and dropouts, and students were encouraged to enjoy the subject. On the other hand, when developing the exercises with Scratch in combination with the CARAMBA recommendation system, students were motivated to autonomous learning. The use of CARAMBA showed a positive correlation with the chances of success in the course. Specifically, > 52% success, whose result is 8% higher than the use of Scratch alone (without recommendations) and 21% higher than traditional education (without Scratch). The Scratch + CARAMBA tools were scaled to a school environment in non-WEIR contexts for programming learning. The post-application evaluation of the instrument indicated increases in exam scores in all grades analyzed. It should be noted that there was an average increase of 32% in the afternoon sections compared to the morning sections. This work opens a line of future research by bringing a pedagogical tool to different educational environments. The results allow us to propose improvements in CARAMBA's recommendations, especially regarding the variables of usability, interactivity, language and pedagogical aspects. CARAMBA functionality should incorporate educational data mining tools that allow learning models based on the profile of the students. Another aspect that we intend to address is the scalability of the system in order to adapt it to other study scenarios with more users and number of exercises. ; En el mundo actual, existe cada vez mayor necesidad de profesionales con conocimientos de computación en general, y programación en particular. Esto es así, tanto en contextos WEIRD como en contextos que no lo son. WEIRD es un acrónimo procedente del inglés (Western, Educated, Industri alized, Rich and Democratic Societies) y es utilizado para referirse a ciertos sectores de sociedades que son "occidentales, educadas, industrializadas, ricas y democráticas. El Estado ecuatoriano realiza una alta inversión en la formación de profesionales de carreras de ingeniería ofertadas por las universidades públicas. En el Ecuador estas carreras son altamente demandadas. Sin embargo, se verifica una alta deserción estudiantil a causa de cursos básicos como Fundamentos de programación en los primeros niveles, con las consecuentes deficiencias en el desempeño de las carreras. Adicionalmente, la baja calificación de los estudiantes en competencias de computación indica que no tengan desarrollo-ladas sus habilidades de pensamiento computacional. En términos generales, esta situación contribuye a la perdida de la competitividad de los países non WEIRD. Por esta razón se introdujo en la enseñanza una herramienta pedagógica que permitió motivar el aprendizaje de programación, disminuir la deserción´ y mejorar el rendimiento académico en los cursos introductorios de programación a nivel universitario. Presentamos evidencia empírica del impacto positivo de Catch en los cursos de Fundamentos de Programación. El uso de esta herramienta pedagógica permitió desarrollar en los estudiantes los conceptos de lógica de programación y el uso de estructuras básicas de control. Los estudiantes que es-aron Catch obtuvieron mejores notas, redujeron la cantidad de suspensos y de deserciones, y se alentaron a los estudiantes a disfrutar de la asignatura. Por otro lado, al desarrollar los ejercicios con Catch en combinación con el sistema de recomendaciones CARAMBA los estudiantes se vieron motivados al aprendizaje autónomo. El uso de CARAMBA mostro una correlación positiva con las posibilidades de éxito en el curso. Concretamente, ¿52% de éxito, cuyo resultado 8% superior al uso solo de Catch (sin recomendaciones) y 21% superior a la enseñanza tradicional (sin Catch). Las herramientas Scratch+CARAMBA fueron escaladas a un ambiente escolar en contextos non WEIR para el aprendizaje de programación. La evaluación posterior a la aplicación del instrumento indico incrementos en las notas de los exámenes en todos los grados analizados. Vale destacar, que hubo un incremento del promedio de las notas del 32% en las secciones de la tarde respecto a las secciones matutinas. Este trabajo abre una línea de investigación futura al llevar una herramienta pedagógica a diferentes entornos educativos. Se pretende plantear mejoras en las recomendaciones de CARAMBA, en especial respecto a las variables de usabilidad, interactividad, lenguaje y de aspectos pedagógicos. En la funcionalidad de CARAMBA se deben incorporar herramientas de minería de datos educacionales que permitan modelos de aprendizaje basados en el perfil de los estudiantes. Otro aspecto que pretendemos abordar es la escalabilidad del sistema a fin de adaptarlo a otros escenarios de estudio con mas usuarios cantidad de ejercicios.

In this article, the Greek professor explains his vision of the reasons for the moral and political duties that we have as citizens of our own countries towards refugees. The author considers that quite common in many societies and heated up by populists the perception ofrefugees as a burden and a threat to the receiving state is absolutely false and is used often enough to justify various other problems that are in no way related to refugees. Author argues that by helping and sheltering refugees, societies strengthen their own democraticpolitical community, and democratic conscience of its' citizens becomes deeper. In addition, appealing to Kant, the author emphasizes that we, as reasonable beings, cannot desire indifference to become a universal law, and every moment instead of every refugee fleeing from threats to his life and fundamental rights can be any of us. The lack of protection of basic rights and fundamental freedoms for refugee does not mean theycan be forsaken. All people are bound by universal moral duties: not to intentionally harm one another and to help one another in the event of a serious threat, if not related to sacrifice. This moral obligation towards residents or citizens of other states, the author calls political amaritanism. People living within law and order are obliged to help refugees by enabling them to enjoy the protection of their state, thus showing solidarity and compensating them for lack of law and order.This ultimately contributes to the affirmation of justice. The fulfilment of this duty is, of course, mediated through public democratic institutions. States should implement policies of assistance to refugees that will reflect an objective assessment of their capabilities, coordination of assistance processes, fair sharing of burdens and resources.The author makes an important remark: the help cannot force refugees to lose their identity and gain a new one in exchange for a higher standard of living. Host societies should avoid the neglect and condescension of refugees, show arrogance and boast that betrays the moral integrity of the beneficence. ; В этой статье греческий профессор объясняет свое видение оснований моральных и политических обязанностей, которые существуют у нас как граждан своих государств в отношении беженцев. Автор считает, что достаточно распространенноево многих обществах восприятие беженцев как бремени и угрозы для принимающего государства является абсолютно ложным и используется довольно часто для оправдания других проблем, которые никоим образом не связаны с беженцами. Оказывая же помощь и предоставляя приют беженцам, как считает автор, общества укрепляют свою собственную демократическую политическую общность, а граждане принимающих государств обретают более глубокое демократическое сознание.
