Con la introducción de la categoría vocación de uso de la tierra en el ordenamiento jurídico vigente de Venezuela, se ha afectado el uso de las tierras con condiciones favorables para la producción agroalimentaria y, con ello, indefectiblemente, a la ordenación del territorio, puesto que la asignación de usos a la que llega, debe estar precedida ahora por un proceso de valoración de la misma que permita identificar el grado de idoneidad de las condiciones que presenta el territorio para la producción agrícola. Ello representa un problema para la ordenación del territorio en el país, debido a que, aun cuando se disponen de varias propuestas metodológicas para valorar la vocación de uso de la tierra, éstas no se han vinculado al proceso de formulación de planes de ordenamiento territorial, instrumento que, en definitiva, permitirá dar cumplimiento a lo establecido en la legislación nacional en materia de tierras y desarrollo agrario. ; With the introduction of the concept of land-use vocation in the current Venezuelan legislation, lands with favourable conditions for agriculture production has been affected as well as the whole land-use planning process. La planificación es el instrumento de mayor relevancia para diferentes niveles de gobierno, en la República del Ecuador. En este contexto, el gobierno provincial de Imbabura decidió lleva a cabo un estudio en la microcuenca quebrada Rumipamba, parroquia La Esperanza, municipio Ibarra; con el objetivo de complementar el Plan de Desarrollo y Ordenamiento Territorial Provincial, a través de un mejor uso y regulación del suelo rural. Se aplicó un esquema de Evaluación de Tierras por Capacidad de Uso Agropecuario basado en el sistema del USDA. De acuerdo con las características edafoclimáticas de la zona, de los cultivos actualmente establecidos y de la capacidad de uso de las tierras determinadas en este estudio, se concluyó que es necesario acudir nuevamente a los usos agrícolas que años atrás giraron en torno a cultivos andinos como la achera, espinaca, jícama y mashwa, en un todo de acuerdo al principio agroecológico de diversificar las especies y los recursos genéticos en esa microcuenca. ; Planning is the highest relevance tool for different government levels, in the Republic of Ecuador. For this reason, the Provincial Government of Imbabura decided to carry out a study in the Rumipamba micro basin, in La Esperanza District, Ibarra municipality, whose objective is to complement the Provincial Development plan and land-use planning for a better use and regulation of rural soil. The USDA's based Land Evaluation System was applied to know its Agricultural Use Capability. According to the edaphoclimatic characteristics of the area, the crops currently established and the land use capability determined through this study, it was concluded that it is necessary to go back to the agricultural uses that decades before were based on Andean farmings like spinach, jicama and mashwa. La investigación aborda el desarrollo teórico y metodológico de la ordenación del territorio, como política del Estado y de la sociedad, en relación con el catastro rural multiutilitario (componente ambiental, social, jurídico y político administrativo), herramienta clave aplicada al municipio como unidad orgánica catastral. El territorio, en su expresión continental, es tanto rural como urbano y es justamente el catastro el que proporciona la información esencial para ordenar un espacio geográfico de interés para el Estado y la sociedad, siendo el municipio una de sus unidades políticoadministrativas reconocidas. La relación del catastro en su acepción amplia con fines múltiples, con el territorio, como parte sustantiva del espacio geográfico objeto del poder y de la acción del Estado, y con el municipio como unidad primaria de la división político-administrativa del país, es de interés y actualidad para la acción y gestión pública, no sólo por su significación fiscal, sino en el contexto de un proceso de planificación y gestión como es la ordenación del territorio. La importancia de estos tres elementos ha sido reconocida en la Constitución de la República Bolivariana de Venezuela de 1999 y en el contexto de la dinámica social, económica y ambiental del país que exige al Estado y a sus instituciones actuar en función de lograr el desarrollo integral y sostenible de la nación. ; The investigation approaches the theoretical and methodological development of the land-use planning like as a State and society policy in connection with the multi-use rural cadastre (environmental, social, legal component and political-administrative) as a key tool applied to the municipality as a cadastral organic unit. The territory in continental expression is as rural as urban and it is exactly the cadastre the one that provides the essential information "to order" a geographical space of interest for the State action and the society, where the municipality is one of the recognized political-administrative units. The relationship of the cadastre in its wide sense for multiple purposes, with the territory, as a fundamental part of the geographical space, object of the power and of the State action, and with the municipality as a primary unit of the political-administrative division of the country, is of current interest for the action and public administration, not only for their fiscal significance, but in the context of a process of planning and admistration as it is the land-use planning. India, a predominantly rural country, is going through a slow but constant and broad transition towards urbanization. The amount of cities and mega cities has increased from 5,161 to 7,935 in 2011. The united Nations predict that, by 2031, 15% of the urban population of the world, about 600 million people, will be living in Indian cities. This increase in urban population will cause repercussions in terms of environment, ecology and sustainability, which will manifest themselves in demands on urban services and governance of the urban ecosystem. In addition, urbanization generates significant tension in terms of land cover, native habitats, biodiversity, protected areas and services to the ecosystem that are basic for human wellbeing. In this paper we analyze some challenges and opportunities for urban development in India that include the participation of governments, private agencies, NGOs, and citizens from different social and economic strata.
Este documento titulado "Consideración del subsuelo en el ordenamiento territorial" es una propuesta metodológica para la gestión del ordenamiento territorial de las regiones, haciendo énfasis en el subsuelo. Se demuestra como éste ocupa un papel determinante dentro de los criterios de construcción de propuestas, escenarios y finalmente en el desarrollo humano. Tres casos de estudios son desarrollados. Se tienen varias metodologías e infinidad de casos dentro del estado del arte que se revisó para el ordenamiento territorial. Mucho de lo reportado hace hincapié en lo urbano, turístico, económico, legal, político, cultural, entre muchas variables. Sin embargo, el subsuelo, la geología, los recursos minerales y las restricciones naturales allí presentes, son poco considerados en la mayoría de planes, metodologías y sobre todo en los casos de estudio. Esas son razones para proponer una metodología que haga énfasis en el subsuelo y que no solo se quede en lo conceptual, sino que se muestre con ejemplos concretos. El subsuelo estaría conformado por los recursos minerales e hídricos subterráneos, y también por las restricciones naturales, como la sismicidad, los volcanes, y deslizamientos, entre otros. Ello a su vez tiene implicaciones con la edafología, con las geoformas, con la geografía, con lo biótico (flora y fauna) y lo antrópico (poblacionales, educación, salud y cultura). Así que podría evidenciarse que considerar el subsuelo es fundamental dentro de cualquier proceso de ordenamiento del territorio. El subsuelo debería estar siempre presente dentro de las variables a considerar, ya que representa el largo plazo. El hecho de que algunos proyectos, ciudades, y regiones hayan sido planificados u ordenados sin considerar el subsuelo, y no hayan tenido incidentes, no quiere decir que sean correctos. Se tiene el caso de ciudades o regiones planificadas que después de varias décadas han sido arrasadas por deslizamientos, flujo de lodos, actividad sísmica, o simplemente no dispongan de materiales para la construcción, agua para consumo o energía. El propósito de este documento es el de presentar una metodología de ordenamiento territorial integral, holística, soportada en el subsuelo, que involucre diversos componentes y variables como el medio físico, biótico y antrópico. En la metodología se presenta un dimensionamiento de cómo las diferentes variables puede ser medidas, correlacionadas e integradas jerárquicamente con el fin de ir construyendo indicadores del geopotencial, biopotencial y el sociopotencial. Posteriormente se puede estimar la capacidad de acogida de un territorio frente a diferentes usos y a sus potenciales. Se van generando indicadores integrados frente a los diferentes conflictos ambientales y con los conocimientos de las personas que intervienen en los procesos de planificación y desarrollo, se pueden construir diferentes escenarios de ordenamiento territorial. La metodología se aplica para tres regiones en Colombia. La primera es una región de carácter amplio y diverso en cuanto a los aspectos geográficos, humanos y culturales, como lo es el Departamento de Cundinamarca, con más de 20 mil km2 de área, donde el componente físico tiene una mayor consideración. Un segundo caso es considerado a nivel más local, donde los diferentes componentes del sistema son tratados, haciendo énfasis en lo social y cultural hasta construir escenarios de desarrollo a nivel del municipio de La Peña, Y el tercer caso, es una propuesta para el ordenamiento de la minería de arcillas en la ciudad de Bogotá, donde se trata de racionalizar el uso del recurso mineral, haciéndolo en las zonas con mayor potencialidad y sin tanta dispersión en el territorio, haciéndolo compatible con otras demandas de uso del suelo principalmente. En los tres casos se parte de información del territorio, se estiman los diferentes potenciales y las restricciones, se determinan las capacidades de acogida, involucrando los diferentes actores, comunidades, políticos, y profesionales interdisciplinarios; además, se proponen diferentes escenarios de ordenamiento territorial, acorde con principios de alto consumo, de conservación o de sostenibilidad de la naturaleza. Esta metodología presenta algunas limitaciones y requiere ciertos ajustes para que tenga un mayor impacto en la sociedad civil; las limitaciones son más que todo de carácter político, ya que por más planteamientos objetivos que se hagan, la toma de decisiones está influenciada por los sentimientos, las presiones, los compromisos, y el ego. Sin embargo, se espera que esta contribución mas técnica desde las geociencias y los recursos naturales tenga una mayor relevancia en el desarrollo de la comunidad humana mundial. / Abstract: This untitled document "Consideration of subsoil in the land use planning" is a methodological proposal for the regional management and planning for the regions with emphasis on the subsoil. It is demonstrated how subsoil has an important role when is used as a criteria to construct proposals, scenarios and human development. Three study cases are analyzed. There are several methodologies and infinity cases according to revised state of the art. Most of the reported does emphasis in urban, tourism, economy, legal and cultural among many variables. However subsoil, geology, mineral resources and natural hazards are few considered in most of plans, methodologies and study cases. These are reasons to propose a methodology with main emphasis in the subsoil, not only in conceptual terms, but with concrete equations and examples. Subsoil could be conformed by the mineral and groundwater resources and by the natural restrictions, such as the seismicity, volcanoes and landslides. AH of these features have also some implications into the edaphology, geoforms, geography, biota (flora and fauna) and the anthropogenic matters (population, education, health and culture). In this way, the subsoil is a fundamental aspect in any territorial management process. Subsoil should be included within the set of variables to be considered. It represents de long term. The fact than some projects, cities and regions have been planned and ordered without considering the subsoil and any incident has occurred; does not mean that this is correct. In spite of the previous considerations, the cases of planned cities or regions are know, and after several decades have been devastated by landslides, floods, seismic activity, or simply they do not have building materials, water to consumption or energy. The purpose of this document is to show an integral, holistic methodology based in the subsoil, whose involve several and diverse components and variables such as the environment, biota and anthropogenic. The methodology shows a background of how the different variables can be measured, correlated and integrated hierarchically with the purpose of build indicators of the geopotential, biopotential and sociopotential. Subsequent, the carrying capacity of the territory for the different uses and to their potentials can be estimated. Integral indicators commence to be generated to respect of the different environmental conflicts and with the knowledge of the people who takes part in the processes of planning and development, different scenarios of environmental land use planning may be constructed. The methodology is applied for three regions in Colombia. First region is of huge and diverse character in the geographic, human and cultural aspects, as the Department of Cundinamarca, with and area more than 20.000 km2, in which the physical component has a greater relevance. A second case is considered as a local level, which the different components of the system are treated, making emphasis in the social and cultural matters to construct scenario of development in the La Peña municipality. The third case is a proposal for the ordering of the clay mining in the city of Bogotá, to rationalize the use of the mineral resource, doing it in the zones with greater potentiality and without much dispersion in the territory, doing it compatible with other use demands of the soil. The existent information of the territory is used for the three cases. The different potentials and restrictions are assessed, the carrying capacity is also determined, involving the different actors, such as the communities, politicians, and interdisciplinary professionals. Different scenarios of land use planning are proposed, according to the high consumption, conservation or sustainability principles for the nature. This methodology presents some limitations and requires certain adjustments to have a greater impact in the civil society. The limitations are mainly of the political character, because besides to many clear proposals, the decision making is influenced by the feelings, the pressures, the commitments, and the ego. Nevertheless, it is hope that this technical contribution from the geosciences and natural resources has a greater relevance in the development of the world-wide human community. ; Doctorado
Based on the powers granted by the Law 1454 of 2011 and supported by the National Government, the departments are currently working on the enactment of instruments of land use planning in a departmental scale. They will complete the Colombian land planning system, until now constructed essentially from a local point of view. Despite the benefits of this development, the total absence of a legal frame to guide and regulate the exercise of this power appears to be very problematic. This paper shows serious doubts pertaining to the legality of the projected departmental instruments before examining how these instruments may affect local autonomy and citizen participation in land use planning decisions. ; Con base en las facultades que les reconoce la Ley 1454 de 2011 a los departamentos, con el apoyo del Gobierno nacional, estas entidades territoriales se preparan para la expedición de planes departamentales de ordenamiento territorial. Con ello se agrega una pieza fundamental a nuestro esquema de ordenación del territorio, hasta hoy construido a partir de una visión esencialmente municipal. No obstante, pese a la importancia de este paso (por los beneficios que comporta), la total ausencia de un régimen legal que enmarque y oriente el ejercicio de esta competencia origina riesgos notables para la legalidad de las actuaciones que se desarrollan, así como para la autonomía local y la participación ciudadana en la toma de estas decisiones. The aim of this study is to assess the dynamics and processes of change that have occurred in the municipality of Amanalco de Becerra, State of Mexico, through the construction of a spatially explanatory model of land use/cover changes (LUCC). The modeling process was carried out using DINAMICA EGO , a mapping tool. Land use/cover maps for the years 1989, 1997 and 2009, as well as various explanatory physical-geographical, environmental and land tenure proximity variables, were used as map inputs. The LUCC for 2020 were modelled under two scenarios: 1) the trend model, which assumes that the annual change rates for the period 1997-2009 remain unaltered, and 2) the agropastoral model, which assumes that annual deforestation rates increase because of the establishment and development of farming activities. The analysis of the absolute values of the forest category, for each year, shows a trend towards the loss of forest cover; by contrast, the annual rates of change in the forest category show a trend towards recovery-revegetation-reforestation processes, as a result of the implementation of government environmental programs.

For the paper the Law as to Land Use and Town and Country Planning Act of 12 May 1956 was a legal event of the first magnitude that at one go endowed Spain with that complete urbanistic system which, albeit with the two reforms that it underwent, she still enjoys in its general outlines to this day. A study is made of the period from the passing of this first law on through to approving of its first reforming in the Act of 2 May 1975. The accommodating of its new institutions as within the body of urbanistic knowledge and those problems that it gave rise to and which led to its first reforming undertaken in 1972 and approved in the law of 1975 just before the nation's great political upheaval are likewise examined. While the Law of 1956 was still on the books, government pushed ahead with a major policy of setting up industrial and housing estates which were out of keeping with its overall doctrine. Though the Law of 1975 is here considered to be a major legal event though lacking the ground breaking importance of its predecessor, it is felt that it had a greater overall impact. The paper concludes by arguing their new concept of land ownership, of a rationalized overall planning and its all-embracing management to have been these Laws principal contributions when all is said and done. ; La Ley sobre Régimen del Suelo y Ordenación Urbana de 12 de mayo de 1956 fue un acontecimiento jurídico de primera magnitud que introdujo en España, en bloque, un sistema urbanístico completo que, con las dos reformas que luego hubo de sufrir, se mantiene hasta hoy en sus líneas generales. En este trabajo se estudian el proceso recorrido desde entonces hasta la reforma aprobada por la Ley de 2 de mayo de 1975, la incorporación al conocimiento urbanístico de las nuevas instituciones y los problemas que su aplicación puso de manifiesto, que explican la reforma cuyos trabajos se iniciaron en el año 1972 hasta culminar con la aprobación de la Ley en 1975, vísperas del gran cambio político. Durante la vigencia de la Ley del Suelo de 1956 el Estado desarrolló una importante política de creación de polígonos residenciales e industriales con notables excepciones al régimen general. La reforma de 1975 fue otro magno acontecimiento, sin la importancia innovadora de la Ley anterior pero con mayor repercusión. La nueva concepción del derecho de propiedad, la racionalidad del planeamiento general y la gestión integrada son, probablemente, y en síntesis, las aportaciones más importantes de las dos leyes.
San Vito is the first district of Coto Brus municipality in Puntarenas province. Because of its political condition, it can't develop a land-use plan. It is a region that constitutes a geographic sub-province with an urban core in a widespread rural environment (142 km2), that needs a substitutive instrument for land use decision-making. A useful and practical tool is land-use condition, which comes from the comparison between land-use capacity and current land-use. In turn, this work makes a methodological effort and includes the land units system that analyses the biophysical variables of the land, to define homogenous units that will be useful in land-use planning. ; San Vito es el distrito primero del cantón de Coto Brus, provincia de Puntarenas. It is a region that constitutes a geographic sub-province with an urban core in a widespread rural environment (142 km2), that needs a substitutive instrument for land use decision-making. A useful and practical tool is land-use condition, which comes from the comparison between land-use capacity and current land-use. In turn, this work makes a methodological effort and includes the land units system that analyses the biophysical variables of the land, to define homogenous units that will be useful in land-use planning.
El contrato territorial es una figura jurídica de aparición reciente destinada a promover el desarrollo sostenible del medio rural. Mediante él, se busca concretar el potencial de una explotación agropecuaria para proveer ciertas funciones sociales y ambientales (no tradicionales) tendientes a un desarrollo rural sostenible. A cambio de estas externalidades positivas, la explotación agropecuaria es compensada. En España, el contrato territorial ha surgido a la luz de dos ámbitos programáticos diferentes: al amparo de la legislación comunitaria europea y de las normas dictadas en su consecuencia a nivel nacional por un lado, y al abrigo de normas estrictamente de origen nacional, por el otro. Por el momento, sólo seis Comunidades Autónomas se han animado a implementarlo; sin embargo, de cara al nuevo Real Decreto 1336/2011 que regula las bases comunes del contrato territorial se espera mayor coherencia, eficiencia y utilización en el uso de esta herramienta. ; Land Use Agreements are a recent legal entity aimed at promoting rural sustainable development, through which agricultural and livestock exploitation potential is sought in order to provide certain (nontraditional) social and environmental functions which may further rural sustainable development. Agricultural and livestock exploitation is compensated in exchange of these positive externalities. Land Use Agreements have been born in Spain in the light of two different pragmatic aspects: under EU legislation as well as local regulations issued in connection with it, on the one hand, and, on the other, under strictly national regulations. For the time being, only six autonomous communities have had the courage to implement this type of agreement; however, in view of the new Royal Decree 1336/2011 which regulates land use agreement common foundations, wider coherence, efficiency and use of such tool is expected. ; Departamento de Geografía
