Die Frage, ob Privatpersonen unmittelbar an die Europäischen Grundfreiheiten gebunden sind, die Frage also ob diese Bestimmungen unmittelbare Drittwirkung entfalten, wurde in den letzten Jahren intensiv und kontroversiell diskutiert. Der Gerichtshof der Europäischen Union (EuGH) sprach in dieser Hinsicht der Arbeitnehmerfreizügigkeit (Art 45 AEUV), der Niederlassungsfreiheit (Art 49 AEUV) und der Dienstleistungsfreiheit (Art 56 AEUV) unmittelbare Drittwirkung zu. Im Gegensatz dazu lehnte der EuGH die unmittelbare Drittwirkung der Warenverkehrsfreiheit (Art 34 AEUV) ab, ohne diese unterschiedliche Behandlung zu rechtfertigen oder näher zu erläutern.Diese Arbeit will einen Beitrag dazu leisten, den differenzierenden Ansatz des EuGH zu beleuchten und der Frage nachzugehen, welche Rolle das Konzept der unmittelbaren Drittwirkung im Rahmen der Warenverkehrsfreiheit einnimmt, einnehmen kann bzw. soll.In dieser Arbeit wird die Auffassung vertreten, dass auch der Warenverkehrsfreiheit unmittelbare Drittwirkung zuzuerkennen ist. Zum Einen wird dies durch das Erfordernis eines kohärenten Systems der Grundfreiheiten begründet und durch eine Untersuchung des Wesens und der Systematik der Grundfreiheiten und der Judikatur des EuGH zur unmittelbaren Drittwirkung untermauert. Zum Anderen wird die Forderung der Warenverkehrsfreiheit unmittelbare Drittwirkung zuzuerkennen durch eine eingehende Interpretation des einschlägigen Primärrechts gerechtfertigt. Es wird gezeigt, dass das Konzept der unmittelbaren Drittwirkung, wenn dieses in differenzierter und ausgewogener Weise im Bereich der Warenverkehrsfreiheit angewandt wird, eine notwendige und sinnvolle Weiterentwicklung dieser Grundfreiheit darstellt, die es insbesondere ermöglicht auf Entwicklungen wie der Verschiebung von Regelungsbefugnissen vom Staat zu ?Privat? adäquat zu reagieren. ; The question whether and to what extent private actors are directly bound by the provisions on free movement of the EU Treaties, or in other words the topic of horizontal direct effect, has in the last years been subject to intensive and controversial academic debate. The Court of Justice of the European Union (CJEU) has in this regard developed a line of jurisprudence where it has attributed horizontal direct effect to the free movement of workers (Art 45 TFEU), the freedom of establishment (Art 49 TFEU) and the free movement of services (Art 56 TFEU). In sharp contrast, the CJEU has rejected to apply the free movement of goods (Art 34 TFEU) horizontally directly to the conduct of private actors, not explaining the reasons for this different approach. This thesis wants to contribute to understanding the CJEU?s differentiating approach and to answering the question what role horizontal direct effect does play, can play and should play in the free movement of goods. In this thesis it is argued that there are compelling arguments for attributing Art 34 TFEU horizontal direct effect: There is on the one hand the claim for a coherent approach to horizontal direct effect in free movement law, a claim based on an analysis of the nature of the fundamental freedoms and the Court?s case-law on horizontal direct effect, which shows that there are no legal reasons to exclude Art 34 TFEU from its attribution. On the other hand the substantiation of horizontal direct effect of the free movement of goods is derived from EU law, building on and around an effet utile argument as its cornerstone. The current practice of foreign currency control in Russia is based on the mechanisms that were formed during the period of the Soviet administrative and command economy. The approaches applied in Russia to foreign currency regulation and foreign currency control (repatriation requirements, closed list of operations for crediting funds to foreign accounts) create barriers for the Russian business and citizens, significantly complicating the procedure for their foreign economic activity. At the same time, the existing restrictions, in conditions when the requirements for the sale of a part of foreign currency earnings and other restrictions on the movement of capital are not applied, do not ensure the achievement of macroeconomic goals, which are laid down in the preamble of the act "On foreign currency regulation and foreign currency control". The foreign currency act in Russia does not currently ensure the achievement of the goals for which it was adopted. In practice, the act solves the tax objectives and the tasks of combating the legalization of criminal revenue. Developed countries and members of the Organization for economic cooperation and development (OECD) do not use similar mechanisms to control the movement of funds. At the same time, foreign countries are actively developing instruments to control cross-border cash flows within the framework of legislation on combating money laundering and financing of terrorism, as well as in the framework of improving the mechanisms of international exchange of financial information for tax purposes. The authors propose a reform of the current foreign currency regulation aimed at the abolition of currency restrictions and the development of alternative mechanisms for controlling the cross-border movement of funds by improving the international exchange of tax information, including automatic one, as well as improving the effectiveness of measures to combat money laundering in international trade.

Die grenzüberschreitende Mobilität der Patienten wirft zahlreiche Rechts- und Wirtschaftsfragen auf. Es geht um die Vereinbarkeit der finanziellen Auswirkungen der von den Mitgliedstaaten getroffenen Maßnahmen zur Kosteneindämmung mit dem Recht des Unionsbürgers auf Freizügigkeit. Es geht auch um den Zugang zu Leistungen. Die Koordinierungs-Verordnungen und die Richtlinie 2011/24/EU über die Patientenrechte in der grenzüberschreitenden Gesundheitsversorgung, aber auch länderübergreifende Vereinbarungen sind dafür Grundlage. Rechtsnormen zum Datenschutz und zum Berufsgeheimnis, die bei grenzüberschreitender Mobilität auch den Leistungserbringern und Versicherern obliegen, sind ebenfalls zu berücksichtigen. The financial impact of cost-containment measures taken by the Member States must be compatible with the right of EU citizens to free movement. Access to benefits and services must also be guaranteed. Применяемые в России подходы к валютному регулированию и валютному контролю (требование репатриации, закрытый перечень операций по зачислению денежных средств на зарубежные счета) создают барьеры для российского бизнеса и граждан, существенно усложняя порядок осуществления ими внешнеэкономической деятельности. При этом существующие ограничения в условиях неприменения требования продажи части валютной выручки и других препятствий для движения капитала не обеспечивают достижения макроэкономических целей, которые заложены в преамбуле Федерального закона «О валютном регулировании и валютном контроле». Валютный закон в России в настоящее время не обеспечивает достижение целей, ради которых он был принят. Закон на практике решает налоговые задачи и задачи противодействия легализации преступных доходов. Развитые страны и члены Организации экономического сотрудничества и развития (ОЭСР) не используют аналогичных механизмов для контроля за движением средств. Вместе с тем зарубежные страны активно развивают инструменты контроля за трансграничным движением денежных средств в рамках законодательства о противодействии отмыванию денежных средств, полученных преступным путем, и финансированию терроризму, а также в рамках совершенствования механизмов международного обмена финансовой информацией в налоговых целях. Авторами статьи предложена реформа действующего валютного регулирования, направленная на отмену валютных ограничений и развитие альтернативных механизмов контроля за трансграничным движением денежных средств за счет совершенствования международного налогового обмена, в том числе автоматического, а также повышения эффективности мер по противодействию отмыванию преступных доходов в международной торговле.

Jan Cremers contributed to a thematic issue of the German journal WSI Mitteilungen. He addressed the question of how the EU framework Directive and other Directives in the field of health and safety at the workplace have fared alongside the internal market.

"Die politische Netzaktivistenbewegung ist eine wissenschaftlich bisher wenig untersuchte Bewegung. Erst allmählich rückt die Bewegung in das Blickfeld, nicht zuletzt aufgrund der steigenden Bedeutung des Internets, für dessen Freiheit die Bewegung eintritt. Der Beitrag möchte diese politische Bewegung theoretisch, basierend auf der kritischen Technologie Theorie, deuten und empirisch etwas fassbarer machen. Hierbei soll auch geklärt werden, ob die Bewegung mit einer spezifischen Jugendkultur bzw. - szene einhergeht und wie sich die Transnationalität der Bewegung darstellt. Für den empirischen Zugang werden Daten aus einem Survey mit Jugendlichen sowie Material aus qualitativen Interviews mit jungen Netzaktivsten verwendet." (Autorenreferat)

Ein Markenrecht wird grundsätzlich aufgrund einer nationalen Rechtsordnung verliehen. Dadurch entfaltet das Markenrecht eine territorial begrenzte Wirkung innerhalb des Geltungsbereichs derjenigen Rechtsordnung, aufgrund deren Bestimmungen das Recht verliehen wurde. Dies wird als Territorialitätsprinzip bezeichnet. Entsprechend dieser territorialen Ausschließlichkeitswirkung wird eine nationale Abschottung ermöglicht. Dem Rechtsinhaber wird die Möglichkeit verliehen, die Märkte aufzuteilen, Preisdifferenzierungen aufrechtzuerhalten sowie den freien Verkehr der Waren innerhalb der Grenzen des Gemeinsamen Marktes zu beeinflussen. Es stellt sich die Frage, wie sich diese immanente Abschottungsmöglichkeit zu dem Freiverkehrsgrundsatz und dem Kartellverbot innerhalb der Europäischen Gemeinschaft verhält, denn sowohl die Warenverkehrsgrundsätze als auch das Kartellverbot bezwecken die Verhinderung solcher Abschottungs- und Aufteilungstendenzen. Der gemeinschaftsrechtliche Spannungszustand zwischen dem Freiverkehrsgrundsatz, der nationale Handelshemmnisse grundsätzlich für unzulässig erklärt, und der Territorialität des nationalen Markenschutzes, die die Hauptursache für nationale Handelsschranken im innergemeinschaftlichen Handelsverkehr bildet, findet seine Ursache insbesondere in dem Vorbehalt einer mitgliedstaatlichen Regelungskompetenz im Bereich des gewerblichen und kommerziellen Eigentums. Die Anwendung der Warenverkehrsfreiheit auf die nationalen Markenrechtsvorschriften wird als Vorgang der gemeinschaftsrechtlichen Integration nationaler Markenrechte gesehen und ist die gemeinschaftsrechtliche Legitimationskontrolle der mitgliedstaatlichen Handlungsziele. Das Verbot der mengenmäßigen Einfuhrbeschränkungen sowie Maßnahmen gleicher Wirkung und das Kartellverbot sind Determinanten des Marktgeschehens in der EG. Zielsetzung ist die Erschaffung eines Europäischen Binnenmarkts mit freiem Warenverkehr und unverfälschtem Wettbewerb. In Verbindung mit dem allgemeinen Gleichheitssatz verbürgen die Warenverkehrsfreiheit und die Wettbewerbsfreiheit dem Gemeinschaftsbürger als Wirtschaftssubjekt eine marktwirtschaftliche Wettbewerbsordnung in der Europäischen Gemeinschaft. Der Schutz der Markenrechte muß ein natürlicher Bestandteil einer solchen freiheitlichen Wirtschaftsordnung sein. Im Konflikt zu der Warenverkehrsfreiheit stehen hierbei die nationalen markenrechtlichen Regelungen, die selbst in einem Spannungsverhältnis von Privatnützigkeit und wirtschaftspolitischer Zielsetzung, von Ubiquität des Schutzgegenstandes und Territorialität der staatlichen Schutzgewährung stehen. ; A Trade Mark Right is basically granted by a national legal system. Due to this a Trade Mark Right only has a limited territorial effect within the scope of the respective legal system which grants the right according to its own conditions. This is called the Principal of Territoriality. According to this territorial limiting effect it is possible for the right holders to split up markets along national borders. Therefore the right holders are able to maintain price differences as well to influence the free flow of goods within the borders of the Common Market and also from countries outside the Common Market into the Common Market. It has to be asked in how far this potential to split up markets relates to the Free-Movement-Rules of the European Common Market (Article 28, 30 ECT) and the cartel provisions (Article 81 ECT). This tension is mainly based on the granting of Trade Mark Rights according to the respective national legal systems. Therefore it has to be asked in how far these colliding interests could be released, i.e. whether the Competition Law and the prohibition on quantitative restriction should take priority over the national Trade Mark laws or the other way round.
