Emiliano J. Buis examines the sources of classical Greece to challenge both the state-centeredness of mainstream international legal history and the omnipresence of war and excessive violence in ancient times. Making ample use of epigraphic as well as literary, rhetorical, and historiographical sources, the book offers the first widespread account of the narrative foundations of the (il)legality of warfare in the classical Hellenic world. In a clear yet sophisticated manner, Buis convincingly proves that the traditionally neglected study of the performance of ancient Greek poleis can contribute to a better historical understanding of those principles of international law underlying the practices and applicable rules on the use of force and the conduct of hostilities
There is a continuing struggle between the demand of a market economy for judicial efficiency, impartiality, and professional conduct on the one hand, and the resistance of the traditional ideology to judicial reform, on the other. The current discipline campaign, as a temporary movement, will undoubtedly reduce the incidence of corruption scandals and result in the punishment of violators over a short period. The tougher job, nevertheless, is to reform the current system by introducing a supervisory scheme thai will deter and deal with abuses effectively in the long run. This will improve the quality of the entire judiciary and further develop true judicial independence in China. In terms of the big picture, the upgrading of judicial performance will not be achieved in isolation, but to a large degree, depend on the progress of the rule of law in China. ; published_or_final_version
本文从选拔者和候选人两个角度来分析中国的官员选拔。对选拔者而言,能力和忠诚是提拔下级官员最重要的两个因素。提拔有能力的官员有利于政治制度的运行。本文发现原本旨在遏制地方主义的交流制度却使得上级在选拔下级官员时牺牲能力换取忠诚。外来领导比本地领导会提拔更多的干部,而其在提拔时对官员能力的要求更低。外来领导在本地缺乏政治同盟,因而会提拔一些能力并不出众的官员来赢取他们的忠诚。而这就反映出能力和忠诚这两个因素在官员选拔中是一种替代关系。在候选人方面,他们尽管有很强的晋升激励,但仍然会采取隐蔽行为。通过对地市财政支出的研究,本文认为作为候选人的地市级官员并不会一直致力于经济发展,而是会采取选择性行为。他们会根据晋升空间的大小来调整自己的努力程度。利用 58 岁及以上的省委常委和副省长人数作为地市级官员晋升空间大小的替代变量,本文发现这一人数的增加会使得地市级政府的财政支出增加。上级领导在提拔地市级官员时更看重官员当期表现而非其任内平均表现,这就使得理性的官员会在其认为更有可能被提拔的时期努力发展经济,以此更有效地向上级展示其能力。 ; This dissertation examines political selection in China from the perspectives of selectors and selectees. For selectors, competence and loyalty are two most important factors in selecting subordinates. Appointing competent officials is crucial to make polity work. In this dissertation, I show that the rotation institution set to curb localism induces the selectors to trade competence for loyalty. I find nonlocal provincial leaders promote more prefecture leaders with relatively lower expectation on competence than local provincial leaders do. Rotated leaders lack local political allies so they will promote incompetent subordinates to win their loyalty. And this demonstrates that the relationship between competence and loyalty in political selection is substitutive. From the perspective of selectees, those subordinates have promotion-based incentives to improve their performance, but they still take strategic actions. By investigating fiscal expenditure at the prefecture level, I argue that prefecture leaders as the selectees do not always concentrate on economic development but adjust their actions according to perceived opportunities for promotion. I use the number of members in provincial party standing committees and vice governors whose ages are not less than 58 as an indicator of promotion opportunity and find that the increase in this number leads prefecture governments to spend more money. 本文以清代宮廷演劇制度的完善與興替、宮廷大戲《昭代簫韶》的創作與演出為中心,探討其中帝王性情、意識形態的投射與帝國形象的建構;試圖對宮廷演劇繁盛與變遷的原因、《昭代簫韶》文本與演出的意涵、宮廷與民間演劇的交流與影響等問題,作出新的解釋。 ; 現有研究強調清朝帝后喜好戲曲娛樂、宮廷舞臺壯麗輝煌,以及晚清宮廷演劇變革等等。本文認為,清代宮廷演劇實有更多豐富的內涵有待更深入的研討。帝后的倡導及參與,自是推動清代宮廷演劇繁盛的重要原因,但在滿足帝后娛樂的同時,宮廷演劇也用於朝廷儀典;戲曲教化與國家儀式的功能相互結合。 ; 清代宮廷演劇,在元明清雜劇傳奇及亂彈之外,還有適應現實需要而奉旨編演的大戲與節戲。宮廷大戲,規模龐大,情節複雜,排場繁縟,在中國戲曲史上十分獨特。創作於乾嘉之際的《昭代簫韶》,取材於明代演義小說《北宋志傳》,鋪寫楊家將輔宋抗遼事。通過特定情節與人物穿戴,《昭代簫韶》參與了清代正統華夷的論述,並含有重評歷史與訓諭臣民的深意。此部大戲將褒忠誅奸的昇仙入地與軍陣鬥法的神道描寫,與觀劇現場的君臣秩序相結合,形成舞臺上、下戲曲與現實的呼應,道德教化寓意明顯。 ; 本文對清代宮廷演劇制度變遷與宮廷大戲《昭代簫韶》演出史的考察,還特別關注戲曲在宮廷與民間的流動與影響。尤其是外學伶人進入與退出宮廷,使得宮廷伶人的規模與組成發生改變,這不僅影響到大戲的演出形式與藝術呈現,也使得宮廷演劇處於對外開放與吸收融合的狀態。清代戲劇便在宮廷、文人與民間三方面,均臻繁盛。 ; Theatrical performance played an important role in the Qing court culture. This thesis discusses the evolution and change of the court theatre institution throughout the Qing Dynasty. In the contexts of court entertainment, political activities and cultural policy, the creation and performance history of the grand theatre piece, Zhaodai xiaoshao, or The Glorious Music of a Brilliant Age, from the Qianlong-Jiaqing to the Guangxu period serve as an adequate example. In this case study, we can explore the nature of the Qing emperors and Empress Dowager Cixi, state ideology and the construction of the Empire's image. ; Most existing research in Qing court drama and theatre focuses on the Qing emperors' great passion for theatre, the three-tiered grand stage in the imperial palace and the wealth of props and costumes, as well as the repertoire change in the late Qing, especially the formation and development of Jingju or Peking Opera. This thesis arguesthat given its rich contents and relevant contexts, the Qing court theatre deserves far more research both in breadth and in depth. The participation of the imperial power undoubtedly promoted court theatre. Theatrical performances at court became not only private entertainment for the imperial family; they also appeared in state ceremonies with special ritual significance.
