The distinction in the filiation law ; Les distinctions dans le droit de la filiation

Abstract

Filiation is a bond of right whose only biological data could not account for the richness and complexity. The right which governs it forms a system of proof which varies in time and space according to the objective that it continues, of the political and economic contingencies, the society and supranational influences. With the Ordinance of July 4, 2005, it was a question of equalizing and of making safe the bonds of filiation. However, the writers did not found perfect unification : there remains distinctions between the maternity and paternity sometimes associated with distinctions according to whether there is or not a marital engagement between the parents, just as there is always a difference in mode between carnal filiation and filiation by Clerc's Office. Among the divergences, there are some (particularly in the fields which were excluded from the reform) whose suppression would be welcome in comparison with the coherence of the right. It is the different one whose abolition is more prone to controversies. Lastly, there are some whose disappearance would be regrettable because they testify to what is truly Filiation. One meets these distinctions in nonthe dispute, where their reduction would result in making filiation lose any symbolic aspect, any significance. It is in an analysis of these rules that it is necessary to seek the significance of this bond.
