Die Bedeutung von Multi-Stakeholder-Partnerships im internationalen Recht am Besipiel der Umsetzung der Millenniums-Entwicklungsziele der Vereinten Nationen
Die Zusammenarbeit von unterschiedlichen Stakeholdern spielt in der Global Governance eine immer wichtigere Rolle und hat die althergebrachte Form der Zusammenarbeit zwischen Regierungen abgelöst. Die staatlichen Gesetzgebungsorgane haben ihre Monopolstellung in der der internationalen Rechtsetzung verloren. Internationale Organisationen, zivilgesellschaftliche Akteure und Vertreter aus dem Wirtschaftssektor wirken nun mit ihnen zusammen in der Global Governance und tragen mit ihren speziellen Eigenschaften und Fähigkeiten zur Bewältigung globaler Schwierigkeiten bei.Diese Diplomarbeit gibt eine Einführung in den Multi-Stakeholder-Approach und beleuchtet die Stellung von Multi-Stakeholder-Partnerships (MSPs) im internationalen Recht. Es werden Vorteile und Herausforderungen einer solchen Vorgehensweise gezeigt und es wird untersucht, ob es vernünftig ist, in MSPs zusammenzuarbeiten. Außerdem werden Beispiele aus unterschiedlichen Bereichen gezeigt, in welchen MSPs aktiv sind. Dies führt zur Kernthematik der Arbeit: der Bedeutung von Multi-Stakeholder-Partnerships bei der Umsetzung der Millenniums-Entwicklungsziele (MDGs) der Vereinten Nationen. Durch die Ziele sollen ua Verbesserungen in den Bereichen Armut und Hunger, Bildung, Gesundheit und Umweltschutz bewirkt werden. Im Anschluss an die Präsentation der Ziele wird auf die Rolle von MSPs bei deren Umsetzung eingegangen. Zu diesem Zweck werden konkrete Beispiele von Partnerschaften, die sich für die Verwirklichung der MDGs einsetzen, vorgestellt. Des Weiteren informiert die Diplomarbeit über die aktuelle Lage der Umsetzung der MDGs, bestehende Mängel und die weitere Vorgehensweise in der Post-2015-Entwicklungsagenda. Aufgrund der großteils erfolgreichen Arbeitsweise der Partnerschaften schließt die Diplomarbeit mit der Feststellung, dass bei der Umsetzung so komplexer Vorhaben wie der MDGs ein Multi-Stakeholder-Approach empfehlenswert ist. ; The collaboration of different Stakeholders has become very important in the global governance and has replaced the traditional form of collaboration between governments. The legislative organs of the states have lost their monopoly position in international legislation. International Organisations and actors from civil society and business form together with states the global governance and help to overcome global difficulties with their special qualities and skills. This thesis gives an introduction to the multi-stakeholder approach and analyses the position of Multi-Stakeholder Partnerships (MSPs) in international law. It shows the advantages and challenges of a multi-stakeholder approach and investigates if it is reasonable to work together in MSPs. Moreover, there are shown some examples from areas where MSPs operate. This leads to the main theme of the thesis: the relevance of MSPs on the example of the implementation of the Millennium Development Goals (MDGs) of the United Nations. The goals are expected to make improvements in the fields of poverty, hunger, education, health and protection of the environment. Subsequent to the presentation of the goals, the thesis addresses the role of MSPs in the realisation of the MDGs. It shows examples of partnerships that work together for the realisation of the goals. Furthermore, the thesis informs about the current implementation status of the MDGs, existing deficiencies and the further approach for the post-2015 development agenda.
