The concept of general interest is firmly implanted in our Constitution and in our legal texts. The clause "general interests" legitimizes the action of government and the very existence of the State as well as its powers to limit the spheres of freedom of citizens. However, our legal system does not offer a definition of what general interests are. In this study we try to find the characteristics that allow us to orient the administrative action towards the satisfaction of the general interests as well as to identify the elements that construct the concept. ; El concepto de interés general está sólidamente implantado en nuestra Constitución y en nuestro textos legales. La cláusula "intereses generales" legitima la acción de gobierno y la existencia misma del Estado, así como sus poderes de limitación de las esferas de libertad de los ciudadanos. Sin embargo, nuestro ordenamiento jurídico no ofrece una definición de lo que son los intereses generales. En este estudio se intentan encontrar las características que permiten orientar la acción administrativa hacia la satisfacción de los intereses generales, así como identificar los elementos que construyen el concepto.
Im Einklang mit einem weltweiten Trend hat sich seit den 80er Jahren auch in der arabischen Welt die Debatte über die Chancen der Demokratisierung neu belebt. Während im Westen (plakativ) davon ausgegangen wird, Islam und (westliche) liberale Demokratie seien unvereinbar, betont die Autorin, daß eine wachsende Zahl von Muslimen - unter ihnen nicht wenige islamische Aktivisten - eine demokratische Ordnung fordern. Zumindest gilt dies für den Schutz der Menschenrechte, Rechtsstaatlichkeit und Beteiligung am politischen Prozeß, Kontrolle und Verantwortlichkeit der Regierenden. Dennoch besteht eine traditionelle ideologische und kulturelle Spannung, die der vorliegende Beitrag an folgenden Problemkomplexen herausarbeitet: (1) Der Islam als Staat und Religion; (2) die funktionale Bedeutung der Herrschaft für die Religion; (3) die Souveränität Gottes, die Stellvertreterschaft des Menschen und die Autorität der muslimischen Gemeinde; (4) Pluralismus, Freiheit und Menschenrechte. Es sind hauptsächlich die sunnitischen Strömungen, die Grundprinzipien einer demokratischen Ordnung bejahen. (ICE)
Der Islam in Deutschland unterliegt einer diskursiven Dynamik, die muslimisches Leben immer wieder als problematischen Gegenspieler westlicher Kultur und Zivilisation entwirft. Die Politik ist davon nicht ausgenommen: Bedrohungsszenarien, Kulturängste und Ausgrenzungen sind sowohl in Parteien als auch bei Bundestagsabgeordneten zu finden. Imad Mustafa spürt anhand von Parteiprogrammen und Debatten auf Bundes- und Landesebene seit 2015 der Konstruktion dichotomer Differenzordnungen nach. Damit stellt er nicht nur die dominierenden Deutungsmuster im Parteiensystem hinsichtlich Islam und Muslim*innen heraus, sondern zeigt auch Unterschiede und Gemeinsamkeiten zwischen den Parteien auf.
In der rechtlichen Stellung der muslimischen Frau und in ihrer Rolle in der Gesellschaft spiegelt sich der Konflikt zwischen Traditionsgebundenheit und Fortschritt. Die Autorin gibt einen Überblick über die wichtigsten Bestimmungen des islamischen Gesetzes zu den Fragen des Familien- und Erbrechts. In der gegenwärtigen Entwicklung werden dabei drei Ländergruppen unterschieden: (1) Länder, in denen die Scharia noch - oder wieder - als grundlegend angesehen wird, wie Iran oder Saudiarabien; (2) Länder, in denen die Scharia abgeschafft und die Gesetzgebung säkularisiert wurde, dies sind die Türkei und die Sowjetrepubliken mit islamischer Bevölkerung und (3) Länder, die nach Kompromissen zwischen traditionellem Islam und modernen gesellschaftlichen Erfordernissen suchen. Aunque algunos académicos sostienen que existen factores inherentes en el Islam que imposibilitan la democracia, otros mantienen que nada en el Islam implica que los países musulmanes deban carecer de credenciales democráticas. Este ensayo defiende que los países musulmanes poseen, desde antaño, pocas características estructurales conducentes a la democratización y a la democracia. Las dos décadas de la "tercera ola de la democracia", de mediados de los 70 a mediados de los 90, no alteraron sustancialmente esta situación, aunque se produjeron algunas señales de liberalización política y democratización en varios países musulmanes, incluyendo a Turquía, Indonesia, Jordania y Kuwait. A fin de explicar la heterogénea imagen que, en términos de pluralismo y democracia, ofrece el mundo musulmán, el presente artículo señala a la importancia de una combinación de factores, tanto internos como externos, (incluyendo la influencia de la política exterior de EE.UU. y de al-Qaeda), sobre las sociedades musulmanas mediante el estudio del caso de las actividades de al-Qaeda en Kenia. ; The issue of political pluralism in the "Islamic world" is a defining concern when addressing the wider issue of democracy among Muslim countries. While some scholars contend that there are inherent factors within Islam that deny the possibility of democracy, others contend that there is nothing within Islam that means that Muslim countries will "inevitably" have a lack of democratic credentials. The article argues that Muslim countries have few structural characteristics conducive to both democratisation and democracy and that things have been that way for a long time. This situation did not fundamentally change during the two decades of the "third wave of democracy", from the mid- 1970s to mid-1990s, although during this time there were some signs of political liberalisation and democratisation in some Muslim countries, including Turkey, Indonesia, Jordan and Kuwait. To explain the varying picture regarding pluralism and democracy in the Muslim world, the article points to a the importance of a combination of both internal and external factors, including the influence of US foreign policy and of al-Qaeda on Muslim societies, with a case study of al-Qaeda's activities in Kenya. ; Universidad Pablo de Olavide
Shifts to structurally new political formations or at times even governmental changes usually engender new representations of the past. This process generally involves the creation of official national histories or revisions to the existing narratives. These histories are ultimately tied to collective memory engineering and identity building to legitimize the new political formations and to ensure loyalty to them. Public education mostly provides a vital channel for the dissemination and the validation of the collective memory sanctioned by the ruling elite. The rise of the Turkish Republic as a nation-state and the national historiography and educational system it established during the 1930s exemplify one of such cases. The consensus opinion in current scholarship argues that the early official historiography virtually circumvented the Ottoman and Islamic eras by curbing or even repealing their role by favoring strong accent on a remote pre-Islamic Turkish past. Although this view is warranted with regard to the state's primary ideological emphasis on Turkishness, this approach at the same time misses the intricate subtleties involved in the official national narrative and potentially indicates a total exclusion or denunciation of these subjects. This article aims to assess the new national historical narrative reproduced in the new history textbooks in a more nuanced way with an exclusive concentration on the ideology, religion and history education triangulum. It aspires to unveil what it articulated about the supposedly avoided topic of the Islamic past and especially focus on the officially endorsed view of Islam as a religion.

Es wird der Zugang und der Umgang der Soziologie mit Religion und Weltkultur thematisiert. Argumentiert wird, daß die Soziologie Religion begrifflich als "Phänomen Religion" verformt hat. Als vorbegrifflichtes "Phänomen Religion" ist es selber unmittelbarer Ausdruck einer Verformung soziologischen Denkens. Es sagt so selber mehr über das soziologische Denken aus als über die "Sachen", auf die es sich bezieht; wohl aber wird deren Wahrnehmung nun über die Optik dieses Konstrukts gebrochen. Die Ursache für dieses Vorgehen wird in der fehlenden kulturgeschichtlichen Aufklärung gesehen. Am Beispiel der Debatte um die "Säkularisierungsthese" wird der Umgang der westlichen Religionssoziologie mit Religion verdeutlicht. (GF)
