The fact that various myths influence the shape of law and the mythologization of some of its aspects is indisputable. In most cases, this process of "mythologization" is perceived pejoratively, leading to the establishment of groundless, irrational ideas and at the same time the rejection of "science" in favor of "fiction". This article aims to propose a different approach to both the concept of myth and the mythologization of law, by referring to the classical, ancient understanding of the concept of mythos as a fable, story. Ancient Greek myth performed a function similar to the law, establishing some basic rules in society. Stressing its "narrative" side indicates that what matters is not so much a description of reality, but a process that emphasizes the relational nature of the community. Thus, relating the myth, just like reading the norm of law, is an interpretation of the event in the light of applicable principles and systems of values, while being also a continuous process of shaping social awareness. Interpreting the law as a story means that those who create and use it lose the luxury of simply remaining the "mouth that pronounces the words of the law" as Montesquieu stated, since they are supposed to care not only for its implementation, but also for the quality and conviction of citizens as to its validity. The proposed form of reading the law as a myth-fable, political myth therefore is a search for a plot, understood as a possibility to act, to respond to the needs and problems of the changing world as well as the development of "the political" politics and education of citizens. ; Fakt wpływu rozmaitych mitów na kształt prawa oraz mitologizacja pewnych jego założeń są niepodważalne. W większości wypadków ten proces "mitologizacji" postrzegany jest pejoratywnie – jako prowadzący do ugruntowania bezpodstawnych, irracjonalnych wyobrażeń i zarazem do odrzucenia "nauki" na rzecz "fikcji". Celem niniejszego artykułu jest zaproponowanie odmiennego podejścia zarówno do samego pojęcia mitu, jak i do mitologizacji prawa poprzez odwołanie się do klasycznego, antycznego rozumienia pojęcia mythos jako fabuły, opowieści. Starogrecki mit pełnił funkcję zbliżoną do prawa, ustanawiał bowiem pewne podstawowe reguły obowiązujące w społeczeństwie. Zaakcentowanie jego strony "fabularnej" wskazuje zaś, że istotny jest nie tyle opis rzeczywistości, ile proces podkreślający relacyjny charakter wspólnoty. Tym samym opowiadanie mitu, podobnie jak odczytywanie normy prawa, stanowi interpretację zdarzenia w świetle obowiązujących zasad i systemów wartości, jest również ciągłym procesem kształtowania społecznej świadomości. Ujęcie prawa jako opowieści powoduje, że ci, którzy je tworzą i stosują, tracą luksus prostego pozostania monteskiuszowskimi "ustami ustawy", ponieważ mają się troszczyć nie tylko o jego wykonywanie, lecz także o jakość oraz przekonanie obywateli co do jego słuszności. Proponowana forma odczytania prawa jako mitu-opowieści, mitu politycznego polega zatem na poszukiwaniu fabuły, czyli możliwości działania umożliwiającego reagowanie na potrzeby i problemy zmieniającego się świata oraz na rozwój polityczności i edukację obywateli.

The article analyzes the process of displacing law and its values from political thinking. There are many indications that law and its values are not a point of reference for contemporary politics, which results from the ongoing process of democratization. The coherence of virtues, law and politics, variously approached and variable over time, lasted in European culture for more than a thousand years. The Greek models have been adopted and consolidated by the Romans and Medieval thinkers. The breakthrough is brought by Machiavelli's writings, which radically changed the view of politics, free will, power. The nature of the state ceases to mean providing citizens with a happy life, and it begins to concern security. As a result, law becomes a tool to protect this security effectively. ; Artykuł jest analizą procesu wyparcia prawa i jego wartości z myślenia politycznego. Wiele wskazuje na to, że dla współczesnej polityki prawo i jego wartości nie stanowią punktu odniesienia, za co odpowiada trwający proces demokratyzacji. Koherencja cnót, prawa i polityki, różnie ujmowanych i zmiennych w czasie, trwała w europejskiej kulturze przez ponad tysiąc lat. Greckie wzorce zostały przejęte i ugruntowane przez Rzymian i myślicieli średniowiecznych. Przełomem stało się dopiero pisarstwo Machiavellego, który radykalnie odmienił spojrzenie na politykę, wolną wolę, władzę. Istota państwa przestaje sprowadzać się do zapewnienia obywatelom szczęśliwego życia, a zaczyna dotyczyć bezpieczeństwa. Co za tym idzie prawo staje się narzędziem służącym do tego, by owo bezpieczeństwo skutecznie zabezpieczyć.

Legislative powers of the Council of Europe have a crucial impact on the domestic legal systems of the EU Member States including substantive administrative law, i.e. such an area of administrative law which defines rights and responsibilities of the public administration bodies and citizens. The legislation created by the Council of Europe's bodies has a great impact on the areas of law which were earlier regarded as the exclusive responsibility of a given country. The Council of Europe has always been a major source of standard setting. This paper analyses selected areas of substantive administrative law taking into account hard law and soft law documents developed under the auspices of the Council of Europe. ; Kompetencje legislacyjne Rady Europy mają istotny wpływ na systemy prawa krajowego państw członkowskich, włącznie z materialnym prawem administracyjnym, a więc działem prawa administracyjnego regulującym prawa i obowiązki organów administracji publicznej i obywateli. Akty prawne tworzone przez organy organizacji mają znaczący wpływ na te obszary prawne, które wcześniej uważane były za wyłączną kompetencję wewnętrzną. Rada Europy zawsze była ważnym źródłem stanowienia standardów. W niniejszym artykule analizie poddano wybrane obszary materialnego prawa administracyjnego, biorąc pod uwagę dokumenty hard law i soft law opracowane pod auspicjami Rady Europy.

The prestige of law is one of the most crucial issues addressed in the sociology of law. The awareness of the degree of acceptance of the law by its addressees is a fundamental factor in the introduction of possible changes in the legal system.The notion of "prestige of law" was introduced to empirical sociology by Adam Podgórecki in the research he conducted in Poland in 1964.A new perspective in the study was to go beyond classical socio-demographic variables and put an emphasis on personality variables. It was also one of the first such studies internationally. In the fifty years that have passed since A. Podgórecki's research, similar studies, even using exactly the same questions, have been repeated many times in both nation-wide and local studies. It should be assumed that the changes taking place in Poland and in the consciousness of its citizens during that time, such as the change of the system, increasing civil rights and freedoms, Poland's accession to international organizations, etc., might be reflected in the increasing level of the prestige of law. But did it happen? Unfortunately not. The analysis of empirical research devoted to the prestige of law in the following article, especially after the political transformation that took place in 1989, but also nowadays, is an attempt to explain the reasons for its persistently low level. ; Prestiż prawa to jedno z najważniejszych zagadnień podejmowanych w socjologii prawa. Wiedza na temat stopnia akceptacji prawa przez jego adresatów jest czynnikiem podstawowym dla wprowadzenia ewentualnych zmian w porządku prawnym. Pojęcie prestiżu prawa zostało wprowadzone do socjologii empirycznej przez Adama Podgóreckiego w badaniach pod tym tytułem, które przeprowadził w Polsce w 1964 r. Nowym ujęciem w przeprowadzonych badaniach było wyjście poza klasyczne zmienne socjodemograficzne i położenie nacisku na zmienne osobowościowe. Było to też jedno z pierwszych takich badań w skali międzynarodowej. W ciągu pięćdziesięciu lat, które minęły od badań A. Podgóreckiego, podobne badania, nawet przy użyciu dokładnie tak samo sformułowanych pytań, powtarzane były wiele razy, zarówno w badaniach ogólnokrajowych, jak i lokalnych. Należy założyć, że zmiany zachodzące w Polsce i w świadomości jej obywateli przez ten czas, takie jak zmiana ustroju, zwiększenie praw i swobód obywatelskich, wstąpienie Polski do organizacji międzynarodowych itp., mogą mieć odzwierciedlenie w zwiększającym się poziomie prestiżu prawa. Czy jednak tak się stało? Niestety nie. Przeprowadzona w niniejszym artykule analiza badań empirycznych poświęconych prestiżowi prawa, zwłaszcza po transformacji ustrojowej, jaka miała miejsce w 1989 r., ale również w czasach obecnych, stanowi próbę wyjaśnienia przyczyn stale utrzymującego się jego niskiego poziomu.

This study is devoted to analysing the structural decisions related to the administrative jurisdiction in Germany in comparison with other European countries. It focuses, in particular, on the institutional structure of the administrative jurisdiction and the functions associated with it to it. Different understanding of the scope of the administrative jurisdiction pre-determine how individual regulations of administrative procedural law are designed, for example, regulations concerning access to courts and the judicial powers of the administrative courts. Therefore, the article aims to demonstrate – from a comparative legal perspective – the processes of mutual interaction, namely how the structural decisions made about the administrative jurisdiction have been received, and to highlight the different developmental trends characteristic of individual countries. ; pracowanie poświęcone jest analizie decyzji strukturalnych dotyczących sądownictwa administracyjnego w Niemczech na tle innych krajów europejskich. Koncentruje się w szczególności na strukturze instytucjonalnej sądownictwa administracyjnego i związanych z nim funkcjach. Odmienne rozumienie zakresu sądownictwa administracyjnego przesądza o kształcie poszczególnych przepisów administracyjnego prawa procesowego, np. regulacji dotyczących dostępu do sądów i kompetencji orzeczniczej sądów administracyjnych. The article is aimed at assessing the regulations of the European Convention for the protection of vertebrate animals used for experimental and other scientific purposes, opened for signature in Strasbourg on 18 March 1986, and Directive 2010/63/EU of the European Parliament and of the Council of 22 September 2010 on the protection of animals used for scientific purposes in the context of their impact on the number of procedures which set out a model for the protection of animals used for scientific purposes in European countries, in the perspective of their impact on the reduction of the number of scientific procedures using animals carried out in European countries, including especially those involving the highest degree of suffering for animals. The starting point for this assessment was the identification of rules determining the admissibility of scientific use of animals in European countries and the impact that certain measures implemented under these rules may have on the reduction of the number of procedures involving animals. In principle, the analysis of these solutions is to specify the directions of further development of regulations aimed at protecting animals used for scientific purposes. ; Celem artykułu jest ocena regulacji Europejskiej Konwencji w sprawie ochrony zwierząt kręgowych wykorzystywanych do celów doświadczalnych i innych celów naukowych, sporządzonej w Strasburgu w dniu 18 marca 1986 r., oraz dyrektywy Parlamentu Europejskiego i Rady 2010/63/UE z dnia 22 września 2010 r. w sprawie ochrony zwierząt wykorzystywanych do celów naukowych w kontekście ich wpływu na liczbę procedur, które wyznaczają model ochrony zwierząt wykorzystywanych do celów naukowych w państwach europejskich, w perspektywie ich wpływu na ograniczenie liczby procedur naukowych z wykorzystaniem zwierząt przeprowadzanych w państwach europejskich, w tym w szczególności procedur wiążących się z najwyższym poziomem doznawanych przez zwierzęta cierpień. Punktem wyjścia do tej oceny było określenie zasad determinujących dopuszczalność wykorzystania zwierząt do celów naukowych w państwach europejskich, a także wpływu, jaki określone środki wdrażane w ramach tych zasad mogą wywierać na ograniczenie liczby procedur z wykorzystaniem zwierząt. W założeniu analiza tych rozwiązań ma pozwolić na wskazanie kierunków dalszego rozwoju regulacji mających na celu ochronę zwierząt wykorzystywanych w celach naukowych.

The first part of the paper is devoted to the regulations concerning rural construction in the Valley of Kamienna River from the beginning of the 19th century till the end of the First World War. In this period, the regulations that were probably of the greatest importance were issued by the Governmental Commission of Revenue and Treasury of the Sandomierskie Province, which were binding for the villages of government estate. Research into the forms and technical solutions in the constructions from the second half of the nineteenth century, supported by archival documents prove that some aspects of these provisions were closely observed, while implementing others faced considerable difficulties. Unambiguous determination of the extent to which these regulations affected the development of the rural construction of the region is not possible due to the small number of preserved objects from the period preceding their introduction. Certainly, the existence of objects meeting the requirements of these regulations can be confirmed from the moment they became binding. ; Pierwsza część artykułu poświęcona jest przepisom dotyczącym budownictwa wiejskiego, które obowiązywały w regionie doliny rzeki Kamiennej od początku XIX wieku do końca pierwszej wojny światowej. W okresie tym bodajże, największe znaczenie miały przepisy wydane przez Komisję Rządową Przychodów i Skarbu Województwa Sandomierskiego obowiązujące we wsiach dóbr rządowych. Badania form oraz rozwiązań technicznych budynków z drugiej połowy XIX wieku, wsparte dokumentami archiwalnymi dowodzą, iż niektórych aspektów tych przepisów przestrzegano starannie, podczas gdy przeforsowanie innych, napotykało na duże trudności. Jednoznaczne określenie, do jakiego stopnia przepisy te wpłynęły na rozwój budownictwa wiejskiego regionu, nie jest możliwe ze względu na niewielką ilość zachowanych obiektów z okresu poprzedzającego ich wprowadzenie. Z pewnością jednak potwierdzić można występowanie obiektów odpowiadających wymogom tychże przepisów, począwszy od momentu ich obowiązywania.

Albert Jay Nock (1870–1945) was a prominent opinion journalist of the first half of the 20th century, considered a representative of the first generation of libertarianism. The article is aimed at finding an answer to the question: Whom – according to Nock – does law serve? A key element of the problem is the internal dichotomy of the concept of law, which not only can be seen through the prism of the positivist-legal paradigm, but also constitutes the pillar of the jusnaturalistic concept. To properly arrange the object of study, the thesis was used according to which in Nock's doctrine the existence of radically different assessment of the nature of man and his individual goals from the nature of the functioning of the State allows us to demonstrate the dichotomy of two opposing legal orders that serve the welfare of different entities (the individual and the State). To systematize the argument, the concept of the individual and his relations with the State was first presented, and then the dichotomy of the government and the State was discussed, which ultimately finally allowed to analyze the relationship between natural law and positive law. ; Albert Jay Nock (1870–1945) był wybitnym publicystą pierwszej połowy XX w., zaliczanym do pierwszego pokolenia przedstawicieli libertarianizmu. Celem niniejszego artykułu jest odnalezienie odpowiedzi na pytanie: Komu – według Nocka – służy prawo? Kluczowym elementem w przedstawionym wywodzie jest wewnętrzna dychotomia pojęcia prawa, które nie tylko może być postrzegane przez pryzmat paradygmatu pozytywistyczno-prawnego, lecz także stanowi filar koncepcji jusnaturalistycznej. Aby uporządkować przedmiot zakresu badań, posłużono się tezą, według której w doktrynie Nocka istnienie biegunowo odmiennej oceny natury człowieka i jego indywidualnych celów od charakteru funkcjonowania państwa pozwala wykazać dychotomię dwóch przeciwstawnych porządków prawnych, które służą dobru odmiennych podmiotów (jednostki i państwa). W celu usystematyzowania wywodu w pierwszej kolejności przedstawiono koncepcję jednostki i jej relacji z państwem, a następnie omówiono dychotomię rządu i państwa, co finalnie pozwoliło na poddanie analizie relacji zachodzących pomiędzy prawem naturalnym a prawem pozytywnym.

The name of special services is applied to the civil and military services that organize and conduct intelligence and counterintelligence activities. Their operations are an element generating social and political trust between the political authorities and citizens. Given the current conditions of international relations and the international situation, a state is required to have efficient special services at its disposal. Anegative impact of globalization on state functioning, both in its external and internal dimensions, forces Polish special services to strengthen their fundamental function, that is providing information. The weakness of military intelligence and counterintelligence follows from the dissolution in 2000 of the Military Intelligence Services (WSI), and wasting their potential for political reasons. The role and task of special services in a democratic state should be to protect the liberty and democracy of the political system's principles, as set out in the Constitution, instead of protecting particular interests. The nature of the transformations occurring in security circles in Poland and related globalization processes, as well as civilizational, cultural and technological changes and the emergence of a civil society, demand a different attitude to the special services to be taken both by the public authorities and society, and make changes in their functioning necessary. In this work we want to present the difference between indirect and direct effect in the light of "Faccini Dori", "Dillenkofer" and other EU cases. It will also be illustrated two varieties of direct effect: vertical direct effect and horizontal direct effect and their relationship between EU law and national law. Then it will be studied the role of directives as legislative instruments. Conservatives in Galicia during the Austro-Hungarian monarchy exerted an overwhelming influence on political and social life. Among the conservative groups and parties, there were the so-called Podolaks, to which Wojciech Dzieduszycki belonged, writer, politician and philosopher. He wrote about the genesis and concept of law, the functions of the state and the scope of state power. He spoke against the law that regulates all manifestations of human life, because social relations are also regulated by moral and religious norms. Dzieduszycki was critical of socialism and all excessive forms of state intervention because he was against excessive state power. Based on Dzieduszycki's reflections on the state and law, it can be concluded that he was an advocate of evolutionary conservatism. ; Konserwatyści w Galicji doby monarchii austro-węgierskiej wywierali przemożny wpływ na życie polityczne i społeczne. Spośród ugrupowań i stronnictw zachowawczych silną pozycją odznaczali się tzw. podolacy, do których przynależał Wojciech Dzieduszycki, pisarz, polityk i filozof. Myśliciel ten zajmował się genezą i pojęciem prawa, funkcjami państwa i zakresem władzy państwowej. Wypowiadał się przeciwko prawu regulującemu wszelkie przejawy ludzkiego życia, gdyż stosunki społeczne są regulowane także przez normy moralne i religijne. Krytyczny stosunek do omnipotencji prawa implikował u Dzieduszyckiego sprzeciw wobec socjalizmu i wszelkich nadmiernych form interwencjonizmu państwa. Na podstawie jego rozważań o państwie i prawie można stwierdzić, że był zwolennikiem konserwatyzmu ewolucyjnego.

One highly significant phenomenon demonstrating that public life is becoming increasingly democratic is provided by the formal and material guaranty of the citizens' political participation. Legitimization of power is an important issue. For the sake of simplicity, it may be said that one political option or another has won the elections. Under Polish conditions, an electoral victory means that a given party won more votes than any other. But by no means does it say that this party has won the support of a majority of voters. Poland has been ruled by the parties that have won anything from 20.41% of the votes, as the Democratic Left Alliance (SLD) did in 1993, to the 41.51% Civic Platform (PO) won in 2007. This shows that power has been exercised by political parties that have not won the approval of a majority of voters. The picture looks even worse when the support rulers enjoy is not measured in terms of approval expressed by voters, but in terms of absolute values, i.e. the proportion of all citizens entitled to vote. The legitimization of power is extremely low when analyzed from this perspective. In the best case it amounts to 21.89% obtained by the victorious party, and 26.58% of all entitled to vote won by the coalition formed by the victorious parties to rule after the elections. Thus it is difficult to talk about democratic governance, understood as the rule of the majority. It should rather be concluded that the ruling parties are those that have won the largest support, which only means that they have collected more votes than any other political power taking part in the same elections. Understood in this way, power is not exercised on behalf of a majority, but by the best organized minority.

Reserved contracts are a legal instrument that allows the promotion of those economic operators who, as part of their business, pursue also social goals. Pursuant to Article 22 (2) of the Act of 29 January 2004 – Public Procurement Law (Journal of Laws 2018, item 1986 as amended), they may only be applied for by sheltered workshops and other economic operators whose activities include the social and professional integration of members of socially marginalised groups. Unfortunately, the use of reserved contracts is in practice marginal, which is also caused by difficulties in interpretation of national laws. The article discusses the institution of reserved contracts and the terms of application thereof, in the context of the EU legislation. ; Zamówienia zastrzeżone są prawnym instrumentem pozwalającym promować tych wykonawców, którzy w ramach prowadzonej działalności realizują także cele społeczne. O ich udzielenie, na gruncie art. 22 ust. 2 ustawy z dnia 29 stycznia 2004 r. – Prawo zamówień publicznych (Dz.U. 2018, poz. 1986 z późn. zm.), mogą ubiegać się wyłącznie zakłady pracy chronionej oraz inni wykonawcy, których działalność obejmuje społeczną i zawodową integrację osób będących członkami grup społecznie marginalizowanych. Niestety, zastosowanie zamówień zastrzeżonych w praktyce jest marginalne, czemu sprzyjają także trudności interpretacyjne przepisów krajowych. W artykule została omówiona instytucja zamówień zastrzeżonych oraz warunki jej zastosowania w kontekście regulacji prawa unijnego.
