In the Main City of Gdańsk, a certificate of the city council's control over the legal guardians of children who lost one or both parents, are two books of minors from 1441-1460 and 1451-1460. The supervision of the registers of this type was exercised by the masons. These entries included entries regarding the property of minors entrusted by their guardians to the municipal council for safekeeping. These books also show the further fate of funds belonging to minors and financial operations carried out by their guardians (eg investments in the pension market). They are also an interesting source for research on Gdansk's financial policy in the times of political change, such as the Thirteen Years' War

In statutory legal cultures, both the introduction of mediation into the legal order and the determination of the legal status of the mediator and his responsibility require legislative action. This is the situation of the Polish legal order. Mediation proceedings in civil cases were introduced into the Polish civil procedure in 2005, while in 2015 the mediation model in civil cases was substantially significantly amended. The mediator's status has also changed as a result of the introduction of a new type of mediator – the so-called permanent mediator, and with a slightly different shaping of the legal liability of mediators. These changes were considered in the article. As a consequence, the reasons for the progressive professionalization of mediation activities have been strengthened. ; W kulturze prawa stanowionego zarówno wprowadzenie postępowania mediacyjnego do porządku prawnego, jak też określenie statusu prawnego mediatora i jego odpowiedzialności wymaga działań ustawodawczych. Z taką sytuacją mamy do czynienia w polskim porządku prawnym. Postępowanie mediacyjne w sprawach cywilnych zostało wprowadzone do prawa cywilnego w 2005 r., zaś w 2015 r. model mediacji w sprawach cywilnych został dość istotnie znowelizowany. Zmianom uległ też status mediatora w związku z wprowadzeniem nowego typu mediatora – tzw. stałego mediatora, a także z nieco innym ukształtowaniem odpowiedzialności prawnej mediatorów. Zmiany te zostały rozważone w artykule. W ich konsekwencji wzmocnione zostały przesłanki postępującej profesjonalizacji czynności mediacyjnych.

The objectives of the common agricultural policy for the years 2014–2020 changed the concept of creation and functioning of fruit and vegetable producer organizations. The European legislator has abolished the special arrangement, namely the authorization for participation in market mechanisms which was granted to preliminary recognized producer organizations. By adapting the rules to new European principles, Member States introduced changes in the relevant national laws. Procedure of reorganization through imprecisely formulated regulations (especially intertemporal ones) has led to serious doubts concerning interpretation and to discrepancy in the assessment of factual and legal states undertaken by agricultural administration. Adjustment challenges were especially evident in a situation where preliminary recognized producer organizations have unlawfully achieved their status, have not complied with recognition and cannot acquire the status of a recognized producer organization. According to parties involved, the consequences of a change in organizations' legal status and financial aspects arising therefrom, remain disputable. ; Założenia Wspólnej Polityki Rolnej na lata 2014–2020 dokonały zmiany koncepcji tworzenia i funkcjonowania organizacji producentów rolnych na rynku owoców i warzyw. Ustawodawca europejski zniósł rozwiązanie szczególne, jakim było zezwolenie na uczestniczenie w mechanizmach rynkowych udzielane wstępnie uznanym grupom producentów. Państwa członkowskie, dostosowując unormowania do nowych reguł europejskich, dokonały zmian w odpowiednich przepisach krajowych. Procedura reorganizacji wskutek nieprecyzyjnie sformułowanych przepisów, zwłaszcza przepisów intertemporalnych krajowych regulacji, spowodowała poważne wątpliwości interpretacyjne oraz rozbieżności w ocenie stanów faktycznych i prawnych, dokonywanej przez organy administracji rolnej. Z wyjątkową ostrością problemy dostosowawcze ujawniły się w sytuacji, w której wstępnie uznane grupy uzyskały swój status niezgodnie z prawem, nie spełniły warunków uznania i nie mogą uzyskać statusu uznanej organizacji producentów. W ocenie zainteresowanych stron sporne są skutki zmiany statusu prawnego grup oraz wynikające stąd konsekwencje finansowe.

The 2015 amendments to the acts regulating mediation in the Polish legal order have intensified a trend of professionalization of mediator's activities. Although the possibility for the parties to choose ad hoc mediator (without any professional requirements) was maintained, the amendments have introduced the so-called permanent mediator, i.e. a professionally equipped person appointed by judge to mediate in a court dispute. Entry on the list of permanent mediators kept by district courts was made conditional on showing that a mediator has the appropriate, professional knowledge and skills. Currently, such skills and knowledge can be acquired in mediation centers. These centers run professional courses and training in many aspects of mediation. They also enable professional specialization in the field of civil, commercial, family, and other types of disputes. Currently, professionally prepared mediators and judges involved in mediation proceedings are proposing the transformation of mediator's profession into so-called regulated professions defined by a special parliamentary act on mediation and mediators. The presented article adopts an European perspective on the regulation of mediation and looks at the need for the possible transformation concerning the profession of mediator as regulated profession, as well as its limitations and the associated challenges. ; Dokonana w 2015 r. zmiana regulacji ustawowych dotyczących postępowania mediacyjnego i statusu prawnego mediatora wzmocniła profesjonalizację czynności podejmowanych przez mediatora w postępowaniu mediacyjnym. Została, co prawda, utrzymana możliwość doboru mediatora ad hoc przez strony sporu, ale w odniesieniu do mediacji sądowej wprowadzono instytucję stałego mediatora wyznaczonego przez sąd. Zarówno wpis na listę stałych mediatorów, jak i wyznaczanie ich do prowadzenia mediacji w ramach postępowania sądowego zostały uzależnione od zawodowej wiedzy, umiejętności i kompetencji mediatora. Obecnie wiedzę, umiejętności oraz kompetencje można uzyskać przede wszystkim w ramach ośrodków mediacyjnych. Praktyka funkcjonowania tych ośrodków pozwala na stwierdzenie, że kandydaci do zawodu mediatora muszą przejść profesjonalne szkolenie oraz nabyć umiejętności w praktyce mediacyjnej. Spełnienie tych wymogów pozwala mediatorom wnioskować o wpis na listę stałych mediatorów. Mediatorzy skupieni w ośrodkach mediacyjnych oraz sędziowie wykorzystujący mediację w praktyce sądowej postulują uchwalenie ustawy o mediacji i zawodzie mediatora na wzór regulacji ustawowych obowiązujących już w części państw europejskich. W artykule zostały rozważone argumenty dotyczące możliwości przekształcenia dotychczasowych fragmentarycznych regulacji mediacji i zawodu mediacji w zawód regulowany.

Przedmiotem niniejszego opracowania jest przedstawienie obecnie obowiązującego stanu prawnego w Polsce dotyczącego rozszerzenia uprawnień pielęgniarek i położnych o możliwość wypisywania recept. Zgodnie z nowymi przepisami pielęgniarki i położne będą mogły wystawiać recepty od 1 stycznia 2016 roku na podstawie uchwalonego projektu ustawy, wniesionego przez rząd. Ponadto przedstawiono krótką charakterystykę doświadczeń innych krajów. Funkcjonowanie systemu wypisywania recept przez pielęgniarki zostało omówione na przykładzie 10 państw: Irlandii, Wielkiej Brytanii, Holandii, Szwecji, Stanów Zjednoczonych, Botswany, Australii, Nowej Zelandii, Kanadzie i Republiki Południowej Afryki. Pozytywne doświadczenia innych państw w przedmiotowej kwestii mogą służyć jako przykład utworzenia i doskonalenia rozwiązań w Polsce. ; The aim of this paper is to demonstrate a current legal status in Poland in reference to expanding the scope of practice of nurses and midwives to writing prescriptions. According to the new regulations, nurses and midwives will be able to write prescriptions from 1 January 2016 on the basis of a bill motioned by the government. Additionally, there was included a brief characteristic of experience of other countries in that matter. The functioning of the system of writing prescriptions by nurses has been discussed based on example of 10 countries: Ireland, Great Britain, the Netherlands, Sweden, The United States, Botswana, Australia, New Zealand, Canada and Republic of South Africa. Positive experience of other countries in this subject may serve as an example for creating and developing such solutions in Poland.

The civil services in Poland and EU institutions undergo similar processes. France (at the time of the 3 rd Republic) was the cradle of civil service, therefore the administrative systems of Western Europe (and others) have sought examples there. The Polish model of civil service can be described as a mixed one, with the prevalence of regulations typical of a career model. In the career model the state is the master that employs a servant. Similar solutions are applied in France, Germany and Austria. They have been modified for the purpose of the specific functions which the civil service performs in EU institutions (a so-called closed career model). In the position system, particular authority is granted the civil servant's employer rather than the state as a whole. A civil servant is employed in a particular position rather then in the civil service 'in general'. The stability of employment and guarantee of remuneration are lower. The UK, Nordic countries and Italy apply solutions that are similar to this model.

The prestige of law is one of the most crucial issues addressed in the sociology of law. The awareness of the degree of acceptance of the law by its addressees is a fundamental factor in the introduction of possible changes in the legal system.The notion of "prestige of law" was introduced to empirical sociology by Adam Podgórecki in the research he conducted in Poland in 1964.A new perspective in the study was to go beyond classical socio-demographic variables and put an emphasis on personality variables. It was also one of the first such studies internationally. In the fifty years that have passed since A. Podgórecki's research, similar studies, even using exactly the same questions, have been repeated many times in both nation-wide and local studies. It should be assumed that the changes taking place in Poland and in the consciousness of its citizens during that time, such as the change of the system, increasing civil rights and freedoms, Poland's accession to international organizations, etc., might be reflected in the increasing level of the prestige of law. But did it happen? Unfortunately not. The analysis of empirical research devoted to the prestige of law in the following article, especially after the political transformation that took place in 1989, but also nowadays, is an attempt to explain the reasons for its persistently low level. ; Prestiż prawa to jedno z najważniejszych zagadnień podejmowanych w socjologii prawa. Wiedza na temat stopnia akceptacji prawa przez jego adresatów jest czynnikiem podstawowym dla wprowadzenia ewentualnych zmian w porządku prawnym. Pojęcie prestiżu prawa zostało wprowadzone do socjologii empirycznej przez Adama Podgóreckiego w badaniach pod tym tytułem, które przeprowadził w Polsce w 1964 r. Nowym ujęciem w przeprowadzonych badaniach było wyjście poza klasyczne zmienne socjodemograficzne i położenie nacisku na zmienne osobowościowe. Było to też jedno z pierwszych takich badań w skali międzynarodowej. W ciągu pięćdziesięciu lat, które minęły od badań A. Podgóreckiego, podobne badania, nawet przy użyciu dokładnie tak samo sformułowanych pytań, powtarzane były wiele razy, zarówno w badaniach ogólnokrajowych, jak i lokalnych. Należy założyć, że zmiany zachodzące w Polsce i w świadomości jej obywateli przez ten czas, takie jak zmiana ustroju, zwiększenie praw i swobód obywatelskich, wstąpienie Polski do organizacji międzynarodowych itp., mogą mieć odzwierciedlenie w zwiększającym się poziomie prestiżu prawa. Czy jednak tak się stało? Niestety nie. Przeprowadzona w niniejszym artykule analiza badań empirycznych poświęconych prestiżowi prawa, zwłaszcza po transformacji ustrojowej, jaka miała miejsce w 1989 r., ale również w czasach obecnych, stanowi próbę wyjaśnienia przyczyn stale utrzymującego się jego niskiego poziomu.
