"The questions such as, 'why the focuses of national policies vary significantly across countries, although their sources of policies are to a great extent identical'; 'why national development experiences mostly cannot be transplanted successfully among countries'; 'why some ineffective institutions persist over long periods of time', have attracted numerous efforts. This book provides a new perspective and argues that the answers lie in the existence of the networks of institutions and thus of national systems of policies (NSP) within national frameworks.Institutions are the equilibria of games and exist as rules of games. Therefore, a basic setting is that institutions emerge endogenously from a series of social interactions, and the interacting human agents are connected and interdependent at the overlapping interaction platforms. National policies and developmental strategies can be modelled in this approach too. The networks of institutions describe the dynamic connected structure among institutions in the process of social interactions over time. Regarding the national policies response to the recent economic crises, this book argues that the difference comes from the distinct understandings of the tags of the policies, which highly depend on the distinct national contexts, such as national interests, cultural background, political systems and so forth.This book represents a significant contribution to the literature which will be essential reading for those interested in institutional economics, network theory, social structures and economic policy. "Lieutenant-General Sir Richard Turner (1871-1961) was a capable but controversial Canadian general who played a critical role in the development of the Canadian Corps up to 1917 and contributed significantly to its success thereafter. Wenn Souveränität überhaupt noch akzeptiert wird, dann als Volkssouveränität. Diese wird aber wie die deutsche Staatssouveränität verstanden. Das Volk wird vielfach nur als Träger, nicht aber als Subjekt der Souveränität dogmatisiert. Es übt jedoch nach dem Grundgesetz die Staatsgewalt auch aus, unmittelbar oder mittelbar durch seine Vertreter. Eine Volkssouveränität, die das Volk als politische Einheit unabhängig von den einzelnen Bürgern begreift, überantwortet die Staatsgewalt den Organen des Staates. Souverän ist der Bürger. Die Bürgersouveränität erwächst der politischen Freiheit. Freiheit ist mit Immanuel Kant die »Unabhängigkeit von eines anderen nötigender Willkür«, deren inneres Gesetz das Sittengesetz ist. Der kategorische Imperativ gebietet, bei allem Handeln das Rechtsprinzip zu achten. Die Bürger verwirklichen ihre Souveränität gemeinschaftlich, organisiert als Staat. Das gebietet strikte Republikanität, demokratisch und rechtsstaatlich. Im Bundesstaat ist die Souveränität zwischen Bund und Ländern geteilt. Die Vertreter des Volkes, dessen Diener, haben den Willen des Volkes zu erkennen und zu vollziehen. Die Grenzen der Souveränität sind die der Freiheit. Gegen das Recht gibt es keine Freiheit. Gesetze und Verträge verwirklichen die Souveränität im Innern und nach außen. Sie können die Souveränität aber auch verletzen. Das deutsche Volk läßt sich erhebliche Beschränkungen der faktischen Souveränität durch seine Vertreter vor allem im Interesse der Vereinigung Europas gefallen. Aber die Europäische Union widerspricht zunehmend der Souveränität der beteiligten Völker. Die Finalität der Integration ist nicht geklärt. Ein Bundesstaat Europa ist mit Prinzipien einer freiheitlichen Demokratie schwerlich vereinbar. Die Besetzung Deutschlands nach dem Zweiten Weltkrieg hat die Souveränität der Deutschen nicht aufgehoben, weil die Freiheit keinem Menschen genommen werden kann. Aber sie hat die Staatsgewalt der Deutschen zum Teil rechtens, zum Teil gegen das Recht überlagert. Das Besatzungsrecht hat, soweit es noch Bestand hatte, mit dem Zwei-plus-Vier-Vertrag sein Ende gefunden. Die Feindstaatenklauseln der Charta der Vereinten Nationen stehen freilich noch der gleichen Souveränität Deutschlands entgegen. »Souvereignty – Foundation for a Doctrine of Souvereignty of Freedom« Sovereignty provokes much controversy and yet it remains to be the guiding principle of politics. Politicians and also lawyers like to speak of the sovereignty of the people but practice the sovereignty of the state. For the sake of freedom it can only be the sovereignty of the citizens. The term is consequential for national and international law. The German citizens are sovereign by law but factually they are restricted beyond the general limits of sovereignty – not for reasons of occupation but above all by the European integration. Die umstrittene Souveränität ist nach wie vor Leitbegriff der Politik. Die allseits vertretene Volkssouveränität wird als Staatssouveränität praktiziert. Um der Freiheit willen kann sie aber nur Bürgersouveränität sein. Der Begriff verändert folgenreich die Staats- und Völkerrechtslehre. Die Bürger Deutschlands sind souverän, aber faktisch ist die Souveränität Deutschlands über die Grenzen der Souveränität hinaus eingeschränkt, nicht etwa durch Besatzungsvorbehalte, sondern vor allem durch die europäische Integration.

Ziel der Arbeit ist es, herauszufinden, ob der Islam mit dem säkularen Staat vereinbar ist. Mit Blick darauf und im Bewusstsein der Bedeutung dieser Fragestellung für die Gesellschaft in Deutschland, die hier lebenden Muslime, von denen die Mehrheit aus der Türkei stammt, aber auch für die Mehrheitsgesellschaft, konzentriert sich die Arbeit auf den türkischen Islam und seinen Diskurs in Bezug auf das türkische Religionsverfassungsrecht. Zunehmend gerät jedoch auch die Frage in den Mittelpunkt, ob die Türkei im Umgang mit dem Islam für die islamische Welt im Nahen Osten in gewisser Weise ein Vorbild sein kann. Da die oben genannte Fragestellung, wie sie Gegenstand der Arbeit ist, aus deutscher Perspektive gestellt wird, wurde der Untersuchung zugleich das deutsche Religionsverfassungsrecht als Maßstab zugrunde gelegt. Dieser methodisch rechtsvergleichende Ansatz ermöglicht nicht nur den Vergleich der religionsverfassungsrechtlichen Systeme, sondern darüber hinaus auch eine Transferleistung, nämlich die Auswertung des türkisch-islamischen Diskurses, der sich zwar auf das türkische Religionsverfassungsrecht bezieht, so aber ins Verhältnis zum deutschen Religionsverfassungsrecht gesetzt, und entsprechend im Sinne der Fragestellung ausgewertet werden kann. Die Frage der Vereinbarkeit des Islam mit dem säkularen Staat bewegt Deutschland. Die Arbeit untersucht das türkische Religionsverfassungsrecht im Umgang mit dem Islam. Die Mehrheit der Muslime in Deutschland ist türkeistämmig. Hinzu kommt, dass die Türkei als laizistische Republik im Umgang mit dem Islam einen Erfahrungsvorsprung hat. Zur Beantwortung der Frage wird rechtsvergleichend der türkisch-islamische Diskurs zum türkischen Laizismus untersucht und ins Verhältnis zum deutschen Kooperationsmodell gesetzt. Müjgan Perçin wurde 1976 in Berlin geboren. Sie studierte Rechtswissenschaften in Freiburg i.Br. und an der Freien Universität Berlin. Auf das Referendariat am Kammergericht Berlin folgten 2006 das zweite Staatsexamen und die Promotion. Ihr Referendariat absolvierte Frau Perçin u.a. an der Universität St. Gallen und beim Polizeipräsidenten von Berlin. Während ihrer Promotion leistete sie sowohl ein Internship-Programm der Vereinten Nationen in New York als auch Forschungsaufenthalte in Istanbul ab. Frau Perçin ist Rechtsanwältin und arbeitet gegenwärtig als wissenschaftliche Mitarbeiterin für Demokratie- und Rechtspolitik einer Bundestagsabgeordneten.
