La Ley 3/2014, de 27 de marzo, ha modificado el Real Decreto Legislativo 1/2007, de 16 de noviembre, de Defensa de los Consumidores y Usuarios. Razón: la Directiva 83/2011, del Parlamente Europeo y del Consejo, de 25 de octubre, sobre los Derechos de los Consumidores, ha derogado la Directiva 577/1985, de 20 de diciembre, sobre contratos fuera del establecimiento mercantil del empresario, así como la Directiva 7/1997, de 20 de mayo, relativa a los contratos a distancia, y se ha adaptado a nuestro ordenamiento. De este modo se ha extendido el plazo de ejercicio del derecho de desistimiento, un derecho que extingue las obligaciones de las partes de ejecutar el contrato o de celebrarlo cuando el consumidor ha realizado una oferta. Para facilitar su ejercicio se ha introducido un modelo de formulario-tipo de desistimiento que el consumidor podrá completar incluso on-line a través de la página web del empresario. Aunque se sigue manteniendo el principio de libertad de forma para que aquel pueda desistir mediante una carta, llamada telefónica o simple devolución de los bienes recibidos. The Restoration crisis coincided with a time of profound transformation of the central political tenets of the liberal parliamentary system. Theorists sought new groundings for a central theme: political representation. What was understood by people or nation? What were the voices that should be heard at the time of forming the state's will? What procedures should be adopted? These were some of the issues that were under review and that concerned publishers and scholars. This paper follows up what was advocated by various political currents, from the so-called Spanish traditionalist current, through the school of social Catholicism to the progressive arm of the Spanish Krausism. The purpose is to verify how generic organicist ideas that emerged in a general movement of reflux of individualism, put in front of the social question, eventually facilitated the arrival in the twenties to authoritarian or totalitarian corporatist solutions. ; La crisis de la Restauración coincidió con una época de profunda transformación de los principios básicos del parlamentarismo. Los teóricos buscaron nuevas bases para un tema central del mismo: la representación política. ¿Cómo se entendía la representación? ¿Quiénes debían ser capaces de participar en la conformación de las Cortes? ¿Qué procedimientos debían ser adoptados? Éstas eran algunas de las cuestiones planteadas entonces entre los especialistas, políticos y publicistas. Esto fue abordado desde diferentes ángulos y con diferentes respuestas por varias corrientes políticas, desde las tradicionalistas, el catolicismo social y al movimiento liberal reformista de los krausistas. Se analizan en este ensayo las consecuencias constitucionales, políticas y jurídicas derivadas de la salida del Reino Unido de la Unión Europea, incidiendo en las cuestiones más relevantes donde el impacto de tal decisión es mayor. ; In this essay we will study the constitutional, political and legal consequences derived from the United Kingdom's withdrawal from the European Union, emphasizing the most important issues where such a decision has a bigger impact. ; In diesem Essay werden die verfassungsrechtlichen, politischen und juristischen Konsequenzen des Ausstiegs des Vereinigten Königreichs aus der Europäischen Union untersucht, wobei die jeweils relevantesten Fragen berücksichtigt werden, deren Auswirkungen am gravierendsten sind.

The article analyzes the nature of Unasur as a project of dialogue and political agreement and its validity despite the current crisis con­text. The analysis centers on the conceptual dimension of the South American bloc, its achievements and operational weaknesses, as well as the relation of Colombia with the re­gional instance before and after its withdrawal. It is argued that Colombia will be isolated, affecting its international projection in the short and medium term. ; El artículo analiza la naturaleza de la Unasur como proyecto de diálogo y concertación polí­tica y su vigencia a pesar del actual contexto de crisis. Se desarrolla el análisis de la dimensión conceptual del bloque suramericano, sus logros y debilidades operativas, así como la relación de Colombia con la instancia regional antes y después de su retiro. En un referéndum celebrado el 23 de junio de 2016 la ciudadanía del Reino Unido votó a favor de la salida del país de la Unión Europea (UE). Constituye un hecho inédito, ya que se trata de la primera vez que un Estado miembro decide abandonar la UE. En este breve trabajo nos proponemos un objetivo modesto: identificar algunos de los factores domésticos, tanto estructurales como coyunturales, pasibles de explicar la decisión de la ciudadanía del Reino Unido de dejar de forma parte de la UE. Dada la importancia de los factores domésticos estructurales en el resultado del referéndum en el Reino Unido–el tradicional excepcionalismo británico, un país abiertamente euroescéptico y las posturas renuentes de los gobiernos británicos hacia el proyecto de integración europea-, difícilmente dicho resultado pueda repetirse en otros países miembros de la UE, en caso de que celebren consultas populares en la misma dirección. ; In a referendum held on June 23, 2016, the citizens of the United Kingdom (UK) decided that the UK should leave the European Union (EU). This is an unprecedented event, since it is the first time that a Member State decides to exit the EU. The primary and unpretentious goal of this short article isto identify some of the domestic factors, both structural as circumstantial, that could explain the decision of UK citizens to leave the EU. Las relaciones entre el Reino Unido (RU) y la Unión Europea (UE) siempre han sido tensas. Ya desde la más tierna infancia comunitaria, los británicos pusieron sobre la mesa sus exigencias, de las que luego los polacos y los checos aprendieron tanto. Esto siempre ha debilitado a la UE, lo que también ha debilitado su posición como actor global. Nada hay qué reprochar a una retirada que se ha hecho con escrupuloso cumplimiento del derecho, aunque, a veces, haya sido un esperpento insoportable. El impacto del Brexit alcanza prácticamente a todos los temas en los que tiene competencias la UE, que en menor o mayor medida son casi todos los que pueda pensarse en cuanto a la regulación de la vida de las personas y de los Estados. Por ello, hay que estar muy vigilantes para que las consecuencias en ambos espacios jurídicos sean los mínimos posibles. Para ello se requiere unas relaciones jurídicas futuras que encajen en esos objetivos. El control migratorio no le resultará fácil llevarlo a cabo al RU, porque incidirá en sus propios intereses y los desafíos internos y externos de la UE, que son desafíos globales que sólo podremos resolver si somos actores significativos; será más difícil hacerlo sin el RU pero el RU quedará en la irrelevancia política internacional ; The relationship between the United Kingdom (UK) and the European Union (EU) has always been tense. The consumer withdrawal appears as a new right withinpolitics of the European Union. Despite being an unsystematic andfragmentary figure that is regulated in different statutes, it has itsown characteristics, which, it distinguish it from others forms ofcontractual inefficiency, such as the nullity, voidability, rescission,etc. Moreover, with the entry into force of the Spanish Act 3/2014,that modify the Consumers and Users Protection General Act of2007, the legal regime of the consumer withdrawal right is unifiedand harmonized in matters of distance contracts and contactsconcluded out of business establishments. ; El derecho de desistimiento del consumidor aparececomo un nuevo derecho en las políticas legislativas de la UniónEuropea. A pesar de ser una figura asistemática y fragmentaria quese encuentra regulada en diversas leyes, cuenta con unas característicaspropias, lo cual la distingue de otra formas de ineficacia contractual,como la nulidad, anulabilidad, rescisión, etc. Asimismo,con la entrada en vigor de la Ley española n° 3/2014, por la quese modifica el Texto Refundido de la Ley General para la Defensade los Consumidores y Usuarios de 2007, se unifica y armoniza elrégimen jurídico del derecho de desistimiento, tanto en materia de contratación a distancia como en materia de contratos celebrados fuera del establecimiento mercantil.

Given the repeated failures in the adoption of a political reform that would modify the mechanism for the presentation of partisan candidates for elections to public corporations in Colombia, this article examines whether there is consistency between these reform proposals and the political practice of political parties in the registration of their candidates. The information gathered in this regard shows the existence of two planes that do not seem to converge. On the one hand, a series of aspirations expressed by both governmental and parliamentary sectors and civil society that advocate the adoption of closed and blocked lists and, on the other hand, the use of preferential voting by political actors as a privileged mechanism to obtain seats. The latter is verified by analyzing, using descriptive statistical techniques, variables related to national and subnational political competition in elections to different constituencies. The academic exercise validates a theoretical postulate on electoral reforms: the resistance of the legislators in charge of approving them, to modify the rules of the game and to sanction norms that may eventually affect their political careers. ; Ante los reiterados fracasos en la adopción de una reforma política que modifique el mecanismo de presentación de candidatos partidistas a las elecciones a corporaciones públicas en Colombia, el presente artículo examina si existe congruencia entre estas propuestas de reforma y la práctica política de partidos y movimientos políticos en la inscripción de sus candidatos. La información recopilada demuestra la existencia de dos planos que parecen no converger. De un lado, una serie de aspiraciones expresadas por sectores tanto gubernamentales y parlamentarios como de la sociedad civil que propugnan por la adopción de las listas cerradas y bloqueadas y, de otro, el recurso del voto preferente por parte de los actores políticos como mecanismo privilegiado para obtener curules. Esto último se comprueba al analizar, mediante técnicas de estadística descriptiva, variables relacionadas con la competencia política nacional y subnacional en elecciones a diferentes circunscripciones. Con el ejercicio académico se valida un postulado teórico sobre las reformas electorales: la resistencia por parte de los legisladores encargados de aprobarlas a modificar reglas de juego y a sancionar normas que eventualmente afecten sus carreras políticas.

El objetivo de este artículo es refutar tres interpretaciones que ha habido en torno a la Guerra del Rif. La primera sostiene que la rebelión de Abd-el-Krim fue sofocada gracias a la intervención de Francia. La segunda, que Primo de Rivera carecía de un plan, tanto para ganar la guerra como para ocupar el territorio. La tercera que la retirada de Chauen se hizo para evitar una derrota similar a la de Annual en julio de 1921. En este trabajo se revisarán las tres interpretaciones y se defenderá lo contrario: Aunque la ayuda de Francia fue importante, la estrategia desarrollada por el Ejército español fue la principal causa de la derrota de Abdel- Krim. De hecho, fue Francia quien pidió ayuda a España. Primo de Rivera y el Directorio Militar tenían un plan estratégico estructurado en siete acciones. Por último, la retirada de Xauen no fue un movimiento defensivo, sino una doble trampa que pusieron tanto a Francia como a los rebeldes. Los españoles sabían que al dejar el terreno libre los rifeños atacarían la zona francesa, ello obligó a Francia a intervenir, lo cual supuso que mientras España ahorraba recursos los rebeldes los incrementaron. Para elaborar el artículo se han consultado los documentos originales del Protectorado Español de Marruecos y del ejército custodiados en el Archivo General de la Administración de Alcalá de Henares. ; The target of this article is to refute three interpretations that have been around the War of the Riff. The first argue that the Abd-el-Krim's rebellion was put down thanks to the intervention of France. The second, that Primo de Rivera lacked a plan, both to win the war and to occupy the territory. The third that the withdrawal of Xauen was made to avoid a defeat similar to Annual in July 1921. In this work the three interpretations will be reviewed and the opposite will be defended: Although the aid of France was important, the strategy developed by the Spanish army was the main cause of the defeat of Abd-el-Krim. In fact, France asked help to Spain. Primo de Rivera and the Military Directory had a strategic plan structured in seven actions. Finally, the withdrawal of Xauen was not a defensive movement, but a double trap that put both France and the rebels. The Spaniards knew that if they left the territory the Riffians would attack the French zone, this forced France to intervene, which meant that while Spain saved resources the rebels increased them. La Unesco ha propuesto una agenda de trabajo para el período 2015-2030 que se define a través de los 17 Objetivos de Desarrollo Sostenible en ellos las Instituciones de Educación Superior, organizaciones generadoras del conocimiento tienen una responsabilidad pública fundamental respecto a los contenidos curriculares, la ética y los valores que transmite. La reflexión sobre la contribución y responsabilidad social de las universidades implica una revisión a fondo de su misión. Dotadas de autonomía responsable y libertad académica que se ejerce en la cátedra y la investigación. Este artículo realiza una revisión histórica de la autonomía universitaria a lo largo de la historia, para determinar la responsabilidad social de la universidad, ante el nuevo contexto político y económico ante el repliegue del neoliberalismo. This paper examines some issues raised by the United States withdrawal from the Joint Comprehensive Plan of Action (JCPOA) related to Iran's nuclear program. The JCPOA is a nonbinding document, there has been some debate about the effect of the subsequent U.N. Security Council resolution endorsing the document on its legal status and on the US faculty of unilaterally withdrawing from the plan of action. Iran brought a case before the International Court of Justice questioning the legality of the reintroduction of U.S sanctions, the Court could eventually address the issue in later phases. This paper concludes that U.S withdrawal is legal from an international law perspective. Security Council resolution 2231 (2015) terminates prior S.C. resolutions imposing sanctions on Iran, as a result it could have weakened US position depriving its sanction regime of the support provided by previous resolutions. ; La retirada unilateral por parte de Estados Unidos del PAIC, el acuerdo nuclear adoptado en 2015, suscita problemas relevantes desde la perspectiva del Derecho Internacional. El PAIC no es un instrumento vinculante, pero el recurso a una resolución del Consejo de Seguridad para dotarlo de operatividad ha suscitado diferentes interpretaciones sobre la naturaleza del PAIC y la valoración jurídica de la retirada unilateral por parte de Estados Unidos. El recurso de Irán a la Corte Internacional de Justicia puede dar lugar a un pronunciamiento judicial acerca de la licitud de algunas sanciones de Estados Unidos. El trabajo concluye que la retirada del PAIC por Estados Unidos es lícita, ya que la resolución 2231 (2015) podría haber debilitado la posición del régimen de sanciones de Estados Unidos previo, que contaba con el respaldo de resoluciones del Consejo ahora derogadas en virtud de dicha resolución.

In 2016, the United Kingdom held a referendum –the second time since its accession to the EU– to decide whether to leave the European Union as Member State. The results of the referendum were pro-Brexit and the United Kingdom notified the European Council of its intention to leave the European Union in accordance with Article 50 of the Treaty on European Union, which regulated the withdrawal of a Member State for the first time.This is an unprecedented process because, although there had been proposals for the incorporation of a withdrawal clause in Union law, such proposals had not materialized until the reform of the Treaty of Lisbon (2009), where a withdrawal clause of this nature is included. The long and difficult process of withdrawal is still on the way and several options are emerging, all characterized by a process riddled with uncertainty and insecurity. ; En 2016, el Reino Unido celebró un referéndum –la segunda vez desde su incorporación a la UE– para decidir si abandonaba la Unión Europea como Estado miembro. El resultado del referéndum fue pro-Brexit y el Reino Unido notificó al Consejo Europeo su intención de abandonar la Unión Europea de conformidad con el artículo 50 del Tratado de la Unión Europea, el cual regula por primera vez la salida de un Estado miembro.Se trata de un proceso sin precedentes pues, si bien ya había habido propuestas de inclusión de una cláusula de salida en el Derecho de la Unión, estas no habían logrado materializarse hasta la llegada de la reforma del Tratado de Lisboa (2009), donde se incluye por primera vez una cláusula de tal naturaleza. El largo y difícil proceso de salida aún continúa y son varias las opciones que se perfilan, todas caracterizadas por un proceso lleno de incertidumbre e inseguridad.

El presente artículo tiene como objetivo fundamental evaluar las opciones que brinda la legislación Venezolana a las Pequeñas y Medianas Empresas en lo que se refiere a las Marcas – Propiedad Industrial, dando a conocer la realidad que enfrentan las pequeñas y medianas empresas en lo que respecta a la seguridad jurídica en la utilización de sus marcas, a partir el retiro de Venezuela de la Comunidad Andina de Naciones. La presente investigación estuvo enmarcada en un diseño de investigación de tipo documental basado en la revisión de textos y artículos periodísticos en la materia de propiedad industrial y de las PYMES, tanto de ámbito nacional como internacional, así como de la utilización de sitios web para la búsqueda de información actualizada sobre el tema de investigación, por lo tanto, la herramienta útil para este caso específico es la hermenéutica, ya que la misma constituye una disciplina de comprensión e interpretación de datos o información. In order to explore the relationship among religion, withdrawal and political engagement in Latin America, I test the withdrawal hypothesis, which predicts that time devoted to the church takes time away from politics. I analyze 24 countries surveyed by the 2010 Americas Barometer, in which I study the impact of church attendance, attendance to religious groups, importance of religion, trust in the church, and the Catholic Church presence at the subnational level, employing data from the 2005 Pontifical Yearbook. I find evidence that supports the withdrawal hypothesis among church goers and those who trust in the church, and an increasing presence of the Church also tends to favor withdrawal, whereas political engagement increases among those who attend to church groups.
