The author portrays the crisis of national & state sovereignty in contemporary Europe, the consequence of economic & political integrational processes, & the creation of new supranational institutions. The question is whether these supranational institutions can be democratically structured & if they can provide for the level of social integration that used to be secured by the national state. The most recent discussions have revolved around theoretical concepts of denationalized sovereignties, international legislation, & asynchronous denationalization, which are indicative of the crisis of national sovereignty. Possible modes of the distribution of sovereign authorities among various constituents have been developed based on an extremely interesting historical parallel between the institutional structure of the Holy Roman Empire of the German nation in the pivotal years from 1495 to 1576 & the existing or proposed institutions of the European Union. The prospects of the European Union, the author concludes, are not going to be determined or affected by the lack of democracy but by the lack of political efficiency & unity. The derailing of popular sovereignty (PS) in Germany is examined, focusing on whether the notion of PS can fulfill its critical function. It is shown that PS emerged as a slogan of the rising bourgeoisie in its struggle against absolutist forms of power. It is also suggested that neither the concept of "the people" nor sovereignty is originally related to either freedom or democracy. The development of PS in the English-speaking world is explored, & it is shown that the original Basic Law of the Federal Republic of Germany is imbued with the liberal spirit of Immanuel Kant's concept of PS. "Die Gemeinsame Verfassungskommission des Bundestages und des Bundesrates führte im Sommer 1992 eine Anhörung zum Themenkomplex 'Bürgerbeteiligung/ Plebiszite auch auf Bundesebene?' durch. Die Sachverständigen hatten dazu einen umfangreichen Fragenkatalog erhalten, der von der grundsätzlichen Frage ausging, ob es 'notwendig, zweckmäßig oder wünschenswert' sei, 'das System der parlamentarischen Demokratie durch erweiterte Möglichkeiten unmittelbarer Bürgerbeteiligung zu ergänzen und zu verstärken'. Der folgende Beitrag gibt in gekürzter Form die Stellungnahme des Autors vor der Kommission am 17. Juni 1992 wieder. Der Verfasser erblickt in der dreistufigen 'Volks- bzw. Bürgergesetzgebung', d.h. im direkten Initiativrecht (Volks- und Bürgerinitiative), in der Einleitung eines Volks- bzw. Bürgerbegehrens und in dem abschließenden Volks- bzw. Bürgerentscheid keine Schwächung oder gar Gefährdung der parlamentarisch-repräsentativen Demokratie. Die Elemente direkter Demokratie stellen in seiner Sicht vielmehr Instrumente dar, um die derzeit feststellbaren Defizite des parlamentarischen Systems (abnehmende Akzeptanz, Integrationsfähigkeit und Legitimationskraft' - Frage Nr. 3) zu korrigieren. Die Volksgesetzgebung wird so als 'Korrektiv' und als 'Frühwarnsignal' für die parlamentarische Gesetzgebung gesehen; sie stellt nicht den Primat des Parlamentarismus und der Parteien, wohl aber deren Monopol in Frage."
