In diesem Aufsatz wird ein Wettbewerbsleitbild vorgeschlagen, das auf den Ergebnissen der Neuen Institutionenökonomik und der Evolutorischen Ökonomik aufbaut. Um ein Leitbild zu gewinnen braucht man zweierlei, d.h. erfahrungswissenschaftliche Grundlagen und Überlegungen zu der Behandlung von Normen. Es werden zunächst die erfahrungswissenschaftlichen Grundlagen erläutert und es stellt sich heraus, daß der Wettbewerb als ein evolutionärer Prozeß zu analysieren ist, der innerhalb von Regeln abläuft. Danach wird die Frage nach der zweckmäßigen Behandlung von Normen behandelt und die Schwächen der gängigen normativen Konzeptionen innerhalb der Volkswirtschaftslehre, d.h. der Wohlfahrtsökonomie und der Konstitutionenökonomie, aufgezeigt und stattdessen die Anwendung des Prinzips der kritischen Prüfung vorgeschlagen. Darauf aufbauend wird das institutionenökonomisch-evolutionäre Wettbewerbsleitbild in seinen Grundzügen skizziert und für eine regelgeleitete Wettbewerbspolitik, die sich hauptsächlich auf per se Verbote stützt, plädiert. ; The purpose of this article is to provide an alternative antitrust model to the mainstream model that is used in competition policy. I call it the Institutional-Evolutionary Antitrust Model. In order to construct an antitrust model one needs both empirical knowledge and considerations of how to adequately deal with norms. The analysis of competition as an evolutionary process that unfolds within legal rules provides the empirical foundation for the model. The development of the normative dimension involves the elaboration of a comparative approach. Building on those foundations the main features of the Institutional-Evolutionary Model are sketched out and it is shown that its use leads to systematically different outcomes and conclusions than the dominant antitrust ideals.
Die Liberalisierung und Integration von Märkten kann zu einer deutlichen Verstärkung negativer externer Effekte der Wettbewerbspolitik der Behörden und der Wettbewerbsstrategien der Unternehmen eines Landes in anderen Ländern führen. Dieser Entwicklung könnte durch eine Internationalisierung der Wettbewerbspolitik entsprochen werden, ohne den ?Wettbewerb zwischen den Wettbewerbsregeln?vollständig auszuschalten. Eine supranationale Rahmenregelung für den Wettbewerb müßte vor allem einen Mechanismus beinhalten, der die Neigung der nationalen Wettbewerbspolitik zur Diskriminierung zwischen Inlands- und Auslandsmärktenüberwinden und Verzerrungen des internationalen Wettbewerbs ?an der Quelle?beseitigen könnte. Die Initiative zur Durchsetzung des Ursprungslandprinzips in der Wettbewerbspolitik würde von jenen Ländern ausgehen, in denen die wettbewerbswidrigen Unternehmenspraktiken sich hauptsächlich auswirken, und durch das Streitschlichtungsverfahren der WTO unterstützt. ; The liberalisation and integration of markets tends to significantly increase the negative externalities which domestic competition policies and corporate competition strategies may cause abroad. An internationalisation of competition policy, without completely removing the ?competition among competition rules?, could be an appropriate response to this development. A supranational framework for the regulation of competition would above all have to contain a mechanism by which the bias of national competition policies towards discriminating between domestic and foreign markets could be overcome and distortions of international competition eliminated ?at the source?. The countries most heavily affected by anti-competitive business practices would seize the initiative in enforcing the country-of-origin principle in competition policy supported by the WTO dispute-settlement procedure.
Die Unternehmen stehen durch die fortschreitende Globalisierung der Weltwirtschaft in einem zunehmend internationalen Wettbewerb, wovon jedoch nicht alle Branchen im gleichen Ausmaß erfasst werden. Determiniert wird der Globalisierungsgrad einer Branche vor allem durch die Höhe der Transaktionskosten. Niedrige Transaktionskosten führen tendenziell zu globalisierten Märkten, hohe Transaktionskosten zu segmentierten Märkten. Damit kommt den Transaktionskosten eine erhebliche Bedeutung im Falle von wettbewerbspolitischen Entscheidungen bei Unternehmenszusammenschlüssen zu, da sie Auskunft über die Höhe des potentiellen Wettbewerbs geben können. Jedoch sind mit heterogenen Konsumentenpräferenzen und Produktdifferenzierungen zwei weitere Determinanten zu beachten. Zudem sind die Transaktionskosten nur relativ ungenau zu berechnen, weshalb dieser Ansatz nicht allgemein gilt, sondern vielmehr im Einzelfall sinnvoll ist. ; The globalisation of the world economy increases international competition among companies. However, not all industries will be affected by the same extent. The degree of globalisation of an industry will be particularly influenced by the level of transaction costs. Low transaction costs will lead to globalised markets, high transaction costs to segmented markets. On the other hand, one has to consider heterogeneous consumer preferences and product differentiation as two additional factors of influence as well as the fact that transaction costs can only be roughly calculated. If these limitations are kept in mind, transaction costs could be of great importance for competition policy in determining the degree of international competition among firms.
During the nineties of the last century, several formerly monopolistic markets (telecommunication, electricity, gas, and railway) have been deregulated in Germany based on European directives and theoretically inspired by the theory of contestable markets. The original contestable market theory implied three assumptions necessary to be satisfied to establish potential competition: Free market entry, market exit possible without any costs, and the price adjustment lag exceeding the entry is shows that if the incumbent reduces its prices slowly (high adjustment lag) and the market entry can be performed quickly (low entry lag), a new competitor will be able to earn back sunk costs. Therefore it is not necessary that all three conditions are complied with for potential competition to exist. Applying this 'revised' contestable market theory to the deregulated sectors in Germany sections, natural monopolies can be identified in telecommunication local loops and local/regional connection networks, in the national electricity grid and the regional/local electricity distribution networks, in the national and regional/local gas transmission/distribution sections, and in the railroad network only. These sections are not contestable due to sunk costs, high entry lags expected and a probable short price adjustment lag. They are identified as bottlenecks which should be regulated. The function of system operators in energy and railroad are closely related to the non contestable monopolistic networks.
Wir untersuchen die Bedingungen, unter denen infolge der Globalisierung, insbesondere des Verfalls der (Informations-) Transaktionskosten Wettbewerbspolitik möglich ist. Zunächst zeigen wir in einem theoretischen Abschnitt die Folgen der veränderten Transaktionskosten auf institutionelle Arrangements und unterscheiden zwischen kontinuierlichem und schubhaftem Wandel. Dann werden vor diesem Hintergrund die Institute der Wettbewerbspolitik, insbesondere der Mißbrauchsaufsicht sowie der Kontrolle von Kartellen und Fusionen untersucht. Wir zeigen, daß die abstrakte Struktur des deutschen Kartellrechts hinreichend ist, daß eine vermehrte Theorieabwägung, welche wettbewerbspolitischen Bedingungen im einzelnen vorliegen, erforderlich wird, um zu wirtschaftlichen befriedigenden Ergebnissen zu kommen. Damit erhält die wettbewerbspolitische Abwägung neues Gewicht mit der Gefahr voluntaristischer Anwendungen. ; We examine the conditions under which a competition policy can be carried through in a global environment characterized by the decline of (information-) transaction costs. We first show in a theoretical section the consequences of reduced transactions costs on institutional arrangements and distinguish between continuous and discrete change. Against this background the institutes of competition policy, especially the control of market power, cartels and mergers, will be examined. We show that the abstract structure of the German anti-trust law is adequate. However, the analysis of the specific conditions must be improved from a theoretical view in order to arrive at satisfactory results. A danger remains that this leads to a voluntaristic application of anti-trust law.
Under present GATT-rules distortions caused by monopolies, cartels, excessive subsidies, etc. can only be counteracted indirectly at national borders. It is argued that by substituting first best competition policy measures at the origin of distortions for the present regime of second best measures efficiency gains can be realized, provided the still dominating principle of national sovereignty gives way to more international coordination and Cooperation. Experience in the European Union may possibly serve as a guideline for fiiture developments in the World Trade Organisation.

Mit diesem neuen Kapitel wurde es sowohl den Mitgliedstaaten als auch der Kommission als Koordinator und Vertreter der EU-Interessen erlaubt, eine aktive Industriepolitik mit Regierungseingriffen zu betreiben. Für die Erklärung der aktiven Industriepolitik der EU scheinen die theoretischen Ansätze der strategischen Handelspolitik geeignet zu sein. Die Theorie der strategischen Handelspolitik, die Mitte der 80er Jahre von James Brander und Barbara Spencer entwickelt wurde, bietet Ansätze für das aktive Engagement des Staates mit Subvention als Förderungsmittel. Ziel dieser Politik ist es, erstens inländische Produzenten in eine vorteilhafte Marktposition zu bringen, um wettbewerbsfähig gegenüber den Konkurrenten zu sein, und zweitens die internationale Rentenumlenkung vom Ausland ins Inland durch staatliche Interventionen zu realisieren, die aber nur auf Kosten des Auslandes erzielt werden kann. Die strategische Handelspolitik der EU ist im Bereich der Zivilflugzeugindustrie deutlich zu erkennen. Seit Abschluß des Maastrichter Vertrages bildet die Airbus-Industrie als ein Hochtechnologiesektor den Schwerpunkt der strategischen Handelspolitik der EU. Besonders der europäische Flugzeugbauer Airbus fand große Beachtung. Da er als Marktneuling während der Startphase Nachteile hatte und auf staatliche Unterstützung angewiesen war, wurden von den europäischen Regierungen Subventionen geleistet. Dies führte aber zu dem Interessenkonflikt zwischen Europa und den USA. Wenn beide Seiten ihre nationalen Favoriten vertreten und diese schützen und strategische Handelpolitik ...
Die DDR kämpfte in der gesamten Zeit ihres Bestehens um internationale Anerkennung. Diese Politik war vor allem von der Konkurrenz zum wirtschaftlich überlegenen westdeutschen Staat geprägt. Der Beitrag will skizzenhaft nachzeichnen, welche Methoden die DDR anwandte, um dennoch auch in der nichtkommunistischen Welt diplomatische Beziehungen zu entwickeln und welchen Erfolg sie dabei erzielte. ; The GDR fought for international recognition throughout its existence. This policy was primarily characterized by competition with the economically superior West German state. This article aims to sketch out the methods the GDR used to develop diplomatic relations in the non-communist world and the success it achieved in doing so.
In diesem Beitrag werden Ursprünge und Entwicklung der sozialdemokratischen Präferenz für die Liberalisierung der Unternehmenskontrolle diskutiert. Es wird gezeigt, dass die Vorliebe für Wettbewerbspolitik in den Bereich der vorstrategischen, fundamentalen Präferenzen fällt. Der organisierte Kapitalismus, hier verstanden als Begrenzung des Wettbewerbs durch Unternehmenskooperation und -koordination, Delegation von Entscheidungsbefugnissen an Kartelle oder Unternehmensnetzwerke und damit verbundene Durchdringung der Unternehmen mit über die Einzelwirtschaft hinausweisenden Perspektiven, hat sich in Deutschland etwa ab den 1880er-Jahren herausgebildet. Organisation durch Kartelle galt bereits in der Arbeiterbewegung des Kaiserreichs als reifste Form des Kapitalismus. Während der zweiten Hälfte der Weimarer Republik wurde kapitalistische Organisation durchweg als dem Konkurrenzkapitalismus überlegene, kapitalistische Anarchie durch sozialistische Prinzipien ergänzende, das Kapital zivilisierende Wirtschaftsform interpretiert. Der Nationalsozialismus löste einen eruptiven Präferenzwechsel in der Arbeiterbewegung aus. Nach dem Ende des Zweiten Weltkriegs, vollendet durch die Godesberger und Düsseldorfer Programme, bildete sich die sozialdemokratische und gewerkschaftliche Präferenz für Wettbewerbspolitik heraus, in deren Tradition die liberale Haltung von SPD und Gewerkschaften während der Reformen der Unternehmenskontrolle der späten 1990er und frühen 2000er-Jahre stand. ; This article discusses the roots and the development of the Social Democratic preference for corporate governance liberalization. I show that the preference for competition is a pre-strategic, fundamental preference. German organized capitalism, in the sense of competition-limiting company cooperation and coordination, cartels and interlocking ownership, and companies? penetration with meso and macro perspectives, rooted in the 1880s. Already in the Kaiserreich, the labor movement interpreted the cartelized economy as the ripest form of capitalism. During the second half of the Weimar Republic, organized capitalism was seen as being superior to competition, as adding socialist principles to a capitalist economy, and as civilizing capitalism. National Socialism caused an eruptive preference change. After world war II, completed by the Godesberg and Düsseldorf manifestos, a preference for competition policy emerged. The relatively liberal SPD and trade union attitudes towards corporate governance reforms in the late 1990s and the early 2000s stand in this tradition.
Die jüngsten Reformen im Europäischen Wettbewerbsrecht geben Anlaß, sich erneut mit Grundsatzfragen der Wettbewerbspolitik zu beschäftigen. Unter Rückgriff auf die moderne Wettbewerbstheorie, die Industrie- und die Neue Institutionenökonomik werden in diesem Paper die Grundlagen eines "more economic approach" entworfen. Wettbewerb wird als Parallel- und Austauschprozeß begriffen, in dem Werte (social surplus) geschaffen und angeeignet werden. Allokative, produktionstechnische und innovative Ineffizienzen sind in diesem Wettbewerbskonzept Folge einer mangelnden Aneignung von Wertschöpfung. Konkret wird in diesem Paper vorgeschlagen, daß Wettbewerbsbehörden und Gerichte in allen Verfahren gegen Unternehmen und Unternehmensgruppen einen überzeugend begründeten Effizienzeinwand als Rechtfertigung für ein in traditioneller Sicht wettbewerbsbeschränkendes Verhalten zulassen. Der Vorschlag basiert auf einer partialanalytisch interpretierten Theorie des "second-best"; bei ihr sind "second-best-tradeoffs" ausschließlich auf den relevanten Markt bezogen. Um Anschuldigungen zu entkräften, sollten die Beschuldigten zweierlei nachweisen: Erstens, das beanstandete Verhalten ist eine Reaktion auf ein identifiziertes Marktversagen oder technische oder dynamische (Neuerungen betreffende) Ineffizienz im relevanten Markt. Zweitens, das beanstandete Verhalten steigert per Saldo die Wohlfahrt. Die Kartellbehörden hätten zwei Dinge zu prüfen: Erstens, behindert das beanstandete Verhalten in wesentlicher Weise spätere private oder staatliche Versuche, die Gründe für das Marktversagen, die technische oder dynamische Ineffizienz zu beseitigen? Zweitens, gibt es weniger stark gegen die Antitrust-Gesetze verstoßende Maßnahmen zur Erreichung derselben Wohlfahrtssteigerung? Wenn die Unternehmen ihre Argumente überzeugend dargelegt und die Kartellbehörden die beiden Fragen mit nein beantwortet haben, dann sollte das Verfahren eingestellt werden. Das Paper diskutiert auch die Vor- und Nachteile eines innermarktlichen "second-best"-Ansatzes in der Wettbewerbspolitik und zeigt die Vorteile gegenüber einer Wettbewerbspolitik auf, die nur den Wettbewerb schützen will. ; Taking the fundamental and comprehensive reform of EU competition policy which embodies a shift from a formalistic regulatory approach towards a more economic approach as a point of departure, this article argues that it is time for antitrust policy to move beyond structural understandings of competition ("preserving competition") and into the realm of explicit welfare analysis. A "more economic approach" should reflect current economic thinking about competition, incentives and efficiency. Competition is defined in the paper as a process of creating and appropriating value (social surplus). Allocative, technical and innovative inefficiencies are viewed as fundamentally due to failures of capturing value. The paper argues that antitrust laws should recognize a defence for all private acts that restrain ?competition? under the traditional antitrust analysis but advance total welfare. The proposed efficiency defence is, however, limited to intramarket second-best tradeoffs, i.e. tradeoffs involving market failures in the relevant market. To rebut a finding of illegality based upon a traditional presumption of anticompetitive effects, defendants should have to establish, first, that the challenged conduct is responsive to an identifiable market failure, broadly defined as allocative, technical or innovative inefficiency in the relevant market; second, that the conduct produces a net increase in total welfare ("intramarket second-best claim"). The antitrust authorities should accept the defence if, first, the conduct will not substantially impair the ability of public or private actors subsequently to ameliorate the effects of the market failure; and if, second, there is no less restrictive alternative consistent with the antitrust laws that could achieve similar welfare gains. The paper also assesses the costs and benefits of implementing an intra-market second-best defence and argues that this approach provides better criteria for a workable antitrust policy than an antitrust standard based on protecting "competition".
The process of globalization causes an increasing intensity of institutional competition, i.e. competition among national suppliers of institutional arrangements for mobile factors. This often leads to the conclusion that the competence of national economic policy actors is decreasing. As a consequence, economists often expect the emergence of more efficient institutions and a diminishing of discriminating interventions caused by lobbyism. Other scientists and politicians suspect a desocialization of the market economy and a regime of global companies. This paper inquires how and to what extent the hope for higher political efficiency and the fear of a race-to-the-bottom concerning standards is justified from the perspective of an evolutionary theory of competition (Hayek, Kerber). Therefore, a model of institutional competition as an institutional search- and discovery process is developped which generates situative institutional knowledge via the process of voice (elections, public opinion etc.) and the process of exit and entry of mobile factors looking for individual satisficing institutional arrangements. The results of the model consist of the fact, that a general decrease of the economic policy competence cannot be stated. There is no convergence to some optimal and efficient type of economic order, too. Instead, the challenges to economic policy change; a process that entails limits to policy competence as well as the emergence of new capabilities. This denies or at least reduces the fears concerning institutional competition. Yet, one cannot exclude the possibility of lobbyism in institutional competition, neither, although the powerful actors may change. Finally the discussion leads to the importance of an order of institutional competition since all processes of competition depend on their institutional conditions in producing the desired effects. This is a consequence of both the ordoliberal tradition and evolutionary economic theory.
In der Arbeit wird ein Konzept zur Messung der Effizienz regionaler Arbeitsmarktpolitik vorgestellt. Ausgangspunkt ist der Schweizer Ansatz einer anreizkompatiblen Arbeitsvermittlung, in dem die strategischen Ziele der Arbeitsmarktpolitik auf nationaler Ebene vorgegeben werden und die operative Durchführung in der Eigenverantwortung der Kantone und der Regionalen Arbeitsvermittlungen (RAV) liegt. Theoretisch basiert der Ansatz auf dem Konzept des 'Yardstick-Competition'. Die Effektivität der Leistungserbringung der Agenten wird anhand definierter Ziele und exogener Rahmenbedingungen in Form von Wirkungsindikatoren verglichen und an ein Vergütungssystem gekoppelt. Anhand einer Beispielrechnung mit bundesdeutschen Daten werden Möglichkeiten und Restriktionen des Modellansatzes diskutiert. Es wird deutlich, dass ein solches Modell sehr hohe Anforderungen sowohl an die Datenqualität als auch an die inhaltliche Umsetzung wie beispielsweise die Definition der Wirkungsziele und deren Operationalisierung stellt, die derzeit noch nicht gegeben sind. Dennoch kann der Ansatz im Kontext einer modernen Verwaltung als ein Instrument zu mehr Transparenz und Effektivität in der Arbeitsvermittlung gesehen werden. ; This paper presents a concept for measuring the efficiency of regional labour market policy taking as a starting point the Swiss approach of incentive-compatible employment services. This approach sets strategic targets of labour market policy at a national level while leaving responsibilities for implementation to the cantons and regional employment services (RAV). Theoretically, the model is based on the concept of 'yardstick competition'. The efficiency of agents' performance is compared by means of defined targets and under consideration of exogenous factors through efficiency indicators and coupled to a benefit system. The author discusses possibilities and restrictions of this approach using a calculation example based on data from Germany. The calculation shows that it is not yet possible to meet the model's high demands with respect to data quality as well as to implementation, regarding for example the definition of efficiency targets and their operationalization. Nevertheless, in the context of modern administration, the approach can be considered a valid tool towards making employment services more transparent and effective.
Das Verhältnis zwischen den Politikebenen im Mehrebenensystem der USA kann durch drei Typen charakterisiert werden: erstens die zentrale Regulierung, d.h. die hierarchische Koordination der Politikebenen. Zweitens die dezentrale Regulierung, die sowohl den regulativen Wettbewerb als auch die Entstehung horizontaler Verhandlungssysteme zwischen den Einzelstaaten umfasst. Beide Formen verlieren an Bedeutung, da sich stattdessen mehr und mehr ein dritter Typus, die Mehrebenenregulierung, durchsetzt. Dargestellt werden zwei Varianten dieser neuartigen institutionellen Arrangements, die den beiden anderen Typen der Regulierung überlegen sind: Zum einen wird der Wettbewerb zwischen den Politikebenen durch eine Kombination hierarchischer Elemente mit dem regulativen Wettbewerb zwischen den Einzelstaaten gefördert, z.B. durch die Festsetzung nationaler Mindeststandards. Zum anderen kann ein Wandel der intergouvernementalen Beziehungen beobachtet werden, der die Entstehung vertikaler Verhandlungssysteme zwischen dem Bund und den Einzelstaaten begünstigt. Die Entwicklung in den USA zeigt, dass bei der Kombination institutioneller Arrangements auf hierarchische Elemente kaum verzichtet werden kann. Außerdem kann man feststellen, dass dynamische Politikentwicklungen nicht nur aus dem regulativen Wettbewerb zwischen den Einzelstaaten, sondern auch aus dem Wettbewerb zwischen den Politikebenen resultieren können. ; The relationship between the policy levels in the U.S. multi-level system can be characterized by three types: first, central regulation, i.e. the hierarchical coordination of the policy levels. Second, decentral regulation comprising regulatory competition as well as the emergence of horizontal joint-decision systems between the states. Both forms lose importance as a third type, multi-level regulation, becomes prevalent. Two variants of these novel institutional arrangements that are superior to both other types of regulation, are described. On the one hand, competition between the policy levels is stimulated by a combination of hierarchical elements with the regulative competition between the states, e.g., by setting national minimum standards. On the other hand, a change of the intergovernmental relations between the federal government and the states can be observed, fostering the emergence of vertical joint-decision systems. The U.S. development shows that hierarchical elements are hardly dispensable when institutional arrangements are combined. Moreover, it can be seen that dynamic policy developments result not only from regulative competition between states but also from competition between policy levels.
Es wird häufig angenommen, dass nationale und grenzüberschreitende Klimapolitik, die aufgrund des Kyoto-Protokolls in den Industriestaaten eingeführt wird, durch die Einschränkung der Nutzung fossiler Energieträger ökonomische Kosten verursacht. Damit kann es zwischen den emissionsintensiven Industrien der Staaten, die Kyoto-Ziele umsetzen müssen, und denen der Staaten ohne eine solche Verpflichtung zu Wettbewerbsverzerrungen kommen. Langfristig kann jedoch technologischer Fortschritt die Klimaschutzkosten signifikant senken und dadurch die Wettbewerbsverzerrung mindern. Dennoch ist nicht auszuschließen, dass die kurzfristigen Wettbewerbsverzerrungen aufgrund einer differenzierten Einführung klimapolitischer Instrumente je nach Sektor durchaus beträchtlich sein können. Vor diesem Hintergrund erscheint es wahrscheinlich, dass die betroffenen Staaten in Erwägung ziehen, nationale klimapolitische Instrumente einseitig handelspolitisch zu flankieren. Eine weitere Schnittstelle zwischen WTO-Handelsregeln und klimapolitischen Instrumenten könnte darüber hinaus durch die Kyoto-Instrumente selbst geschaffen werden. Es ist vorstellbar, dass die Kyoto-Instrumente durch die Schaffung einer neuen internationalen Handelsplattform in Form der Emissionseinheiten handelspolitische Konsequenzen haben. Die politische Koordination zwischen Kyoto-Protokoll und WTOHandelssystem ist daher eine notwendige Voraussetzung, um klare Rahmenbedingungen für die Implementierung klimapolitisch motivierter handelspolitischer Maßnahmen sowie der Kyoto-Instrumente zu schaffen. Dies sollte im Rahmen der laufenden Doha-Runde mit berücksichtigt werden. ; National and transboundary climate policy, introduced to industrialised countries due to the Kyoto Protocol, is often assumed to cause economic costs by restricting the utilisation of fossil fuels. This can result in a distortion of competition between the energy-intensive industries of countries, putting Kyoto-target into practice, and those of countries without such obligation. This assumption is however likely to be a short-term phenomenon. In the long term, technological progress can reduce economic costs for climate protection significantly and thus diminish the distortion of competition. However, one can not exclude the possibility that short-term competition distortion of climate policy could be considerable, depending on the sector. As a consequence, it could be found that climate policy instruments will result in one-sided trade policy. A further interface between climate policy and the trade rules of WTO can be created by the Kyoto instruments themselves. It is possible that the Kyoto instruments will have trade policy consequences by creating a new international trade market for emission units. The political co-ordination between the Kyoto Protocol and the trade system of WTO can finally contribute to the creation of clear basic conditions for trade policy measures with regard to climate protection as well as the Kyoto instruments. This should be tackled without delay in the frame of Doha-Round.
The paper discusses the impact of high capital mobility for monetary and budget policy as well as for the Provision of public goods, for taxation, for wage policy and trade unions, for distribution policy, and for social security Systems. The mobility of porrfolio capital puts additional restraints on monetary and fiscal policy of governments, the mobility of real capital restricts the maneuvering space of governments (in redefining the opportunity costs of government decisions in open economies). It is shown that competition between governments does not degenerate but serves as a mechanism to reduce costs and to discover new institutional arrangements.
