ABSTRACT Objectives: to identify the knowledge of women assisted by SUS on their rights during pregnancy and childbirth; to describe the socioeconomic and obstetric variables with women´s knowledge about their rights during pregnancy and childbirth. Method: exploratory, descriptive, cross-sectional study, with a quantitative approach. The sample consisted of 79 mothers with gestational age less than 37 weeks who delivered live births in the maternity Dr. Peregrino Filho in the city of Patos/PB. Data collection was through an interview in May 2014. The data were tabulated in Excel Spreadsheet Program for Windows. Next to the analysis, the statistical package Inc. SPSS version 18.0 was used. Results: the results showed that almost all of women (87.3%) reported having knowledge about their rights during pregnancy and childbirth. Conclusion: the results in the knowledge of women during pregnancy and childbirth satisfactory, highlighting the social rights with certain limitations of labor and welfare rights. O objetivo do artigo é analisar a contribuição do Sistema Interamericano de Direitos Humanos, em especial da sua jurisdição contenciosa, para o fortalecimento do processo democrático, da rule of law e do estabelecimento da paz no território colombiano. Para tanto, parte da premissa de um direito aberto, plural e multinível de impactos recíprocos entre direito interno e internacional em frutífero diálogo. Analisa-se, a partir de uma breve explanação do funcionamento do aparato regional, a jurisprudência da Corte – qualitativamente selecionada – a fim de demonstrar como a sua atuação jurisdicional compeliu o Estado colombiano a tomar medidas de fortalecimento de direitos humanos no país, o que contribuiu decisivamente para o processo de paz. Sendo assim, busca-se apresentar a influência positiva do Sistema Interamericano de Direitos Humanos, mediante a atuação contenciosa da Corte IDH, na construção de uma cultura de paz, direitos humanos e democracia, eixos fundamentais para o fortalecimento institucional do Estado Democrático de Direito. ; The purpose of this article is to analyze the contribution of the Inter-American Human Rights system, especially its contentious jurisdiction, to strengthening the democratic process, the rule of law and the establishment of peace in Colombia. To do so, it starts from the premise of an open, plural and multilevel right of reciprocal impacts between domestic and international law in meaningful dialogue. From a brief explanation of the operation of the regional apparatus, the jurisprudence of the Court - qualitatively selected – is examined in order to demonstrate how its jurisdictional action has compelled the Colombian State to take measures to strengthen human rights in the country, contributing decisively to the peace process. Thus, it seeks to present the positive influence of the Inter-American Human Rights system, through the contentious actions of the Inter-American Court of Human Rights, in the construction of a culture of peace, human rights and democracy, fundamental axes for institutional strengthening of the Democratic Rule of Law in Colombia.

Context: With the growing denunciations of violence and injustices in the social relationship, inside and outside schools, education based on human rights is insurgent in the current system of teaching and learning. Using the concept of school as a process of scientific, social and political construction, we planned the teaching and learning process of chemical interactions using the art of graffiti as a playful activity. Objectives: Reflection on chemistry teaching beyond the concepts of natural sciences, but also towards social issues to promote an education that transfigures the traditional model established by the hegemonic power during Brazilian history. Design: We use an ethnographic case study as a method. Scenario and Participants: In this way, we chose to bring graffiti art to chemistry workshops, since the paints are fixed on urban walls through chemical interactions between substances, building images and/or protest phrases that make us rethink the injustices and inequalities existing in Brazilian society and to dialogue the emergence of this art in the black movement with the political aspects of Human Rights. Thirteen students enrolled in a state basic education high school in the city of Goiânia-GO, Brazil, joined the workshops on Human Rights, Graffiti and Chemistry. Eight graffiti artists also participated in the workshop for free. Data collection and analysis: We used transcripts of semi-structured interviews and video-recorded workshops to categorise the data, analysing them with the Descending Hierarchical Classification technique and the use of dendrograms performed by the Iramuteq Software. Results: We obtained categories that evidence the chemical understanding of the content of chemical interactions and the socio-political understanding of human rights, and seven drawings on graffiti murals that show this correlation. Conclusions: The transgression of morals and the empowerment of the subordinate promote playfulness in the individual or collective social visibility of individuals, enabling better assimilation of scientific and social content.

This article is the result of an investigation whose main purpose was to analyze the constructions of the concept of disability. We intend to analyze the discourses on disability that teachers working with students in this situation have built. The approach to the data was from a qualitative paradigm, of descriptive scope, and supported by the grounded theory methodology. Questionnaires were applied to 22 participants, basic education teachers. We conclude that the scientific knowledge has hegemonized visions, but in the process it has turned to common sense, leaving aside an important substratum as it is our action in front of other people and the consequences of the interventions and diagnoses that, being scientifically validated, invalidate the others and exclude the others. The above implies looking at teacher training from an ethical and political stage where complex processes of reflection overcome the reduced vision that has been built on disability and its inclusion. ; El presente trabajo es resultado de una investigación cuyo propósito principal fue analizar las construcciones sobre el concepto de discapacidad. Pretendemos analizar los discursos que sobre discapacidad han construido docentes que atienden estudiantes en esta situación. La aproximación a los datos fue desde un paradigma cualitativo, de alcance descriptivo y apoyado en el método de teoría fundamentada. Se aplicaron cuestionarios a 22 participantes, docentes de educación básica. Concluimos que los saberes de orden científico han hegemonizado las visiones, pero en el devenir se han volcado hacia el sentido común, dejando de lado un sustrato importante como lo es nuestro actuar frente a otras personas y las consecuencias de las intervenciones y diagnósticos que, siendo validados científicamente, invalidan al otro ser y lo excluyen. Lo anterior implica mirar hacia la formación docente desde un estadio ético y político, donde complejos procesos de reflexión superen la visión reducida que se ha construido sobre la discapacidad y su inclusión. ; O presente trabalho é resultado de uma investigação cujo objetivo principal foi analisar as construções sobre o conceito de deficiência. Pretendemos analisar os discursos sobre deficiência construídos por professores que tem estudantes nessa situação. A abordagem dos dados partiu de um paradigma qualitativo, de formato descritivo e apoiado pelo método da teoria fundamentada. Os questionários foram aplicados a 22 participantes, professores da educação básica. Conclui-se que o conhecimento científico hegemonizou visões, generalizando a um sentido comum, deixando de lado um substrato importante como nossas ações diante de outras pessoas e as consequências das intervenções e diagnósticos que, sendo cientificamente validados, anulam o outro ser e o excluem. O que pretende-se dizer implica um olhar a formação de professores, a partir de uma perspectiva ética e política, onde os processos de reflexão complexos superam a visão reduzida que foi construída sobre a deficiência e sua inclusão.

This paper does a documentation and bibliography revision, contained in the field of study of human rights education (HRE), the social quality of school education from the analysis of its institutionality at the educational regulatory framework instituted after the Federal Constitution of 1988. Such legislative acts delegated an innovative role to schools to act as a space in charge of protecting the rights of children and teenagers. However, what is found is that the school environment still constitutes as a place for schooling based on the labor logic and by the ideal of abundance of consumption as way to achieve happiness. It is proposed, based on the above, that the protective school act from a dynamic distribution of knowledge transforming the liberal maxim of equal opportunities and meritocracy into state intervention, such as social justice. For such, education as a fundamental right, and the school as a platform of social protection should assimilate traits that go beyond simple knowledge socialization, and should cover principles such as totality, availability, accessibility, acceptability and adaptability. In this way, we conceive HRE as indispensable to the formation of agents capable of potentiating the school as a space of social protection. Such education should be, thus, constitutive of the professional identity of those who work in schools and other institutions that are part of the social protection network in the system of rights assurance. ; Problematiza-se neste artigo de revisão documental e bibliográfica, pertencente à área de estudos em Educação em Direitos Humanos (EDH), a qualidade social da educação escolar a partir da análise da sua institucionalidade no marco normativo educacional instituído após a Constituição Federal de 1988. Tais atos legislativos legalizam uma função inovadora para a escola, a de ser e atuar como espaço protetivo de direitos de crianças e adolescentes. No entanto, o que se constata é que o ambiente escolar ainda se constitui como lugar da escolarização baseada na lógica do trabalho e do ideal de abundância do consumo como sinônimo de felicidade. Propõe-se, a partir do exposto, que a escola protetiva atue a partir de uma dinâmica distributiva de saberes transformando a máxima liberal da igualdade de oportunidades e meritocracia em intervenção estatal pela educação equitativa, como justiça social. Para tal, a educação como direito humano fundamental, e a escola como espaço de proteção social devem assimilar características que vão além da simples socialização de conteúdos instrucionais, devendo abranger princípios como totalidade, disponibilidade, acessibilidade, aceitabilidade e adaptabilidade. Dessa forma, concebemos EDH como indispensável à formação de agentes capazes de potencializar a escola como espaço de proteção social. Referida formação deve ser, portanto, constitutiva da identidade profissional dos que atuam na escola e nas demais instituições componentes da rede de proteção social no sistema de garantia de direitos.

There is no doubt that human beings have a right to nutrition and hydration as a basic support for life. Prolonged deprivation of sufficient amounts of food results in development of malnutrition, which is incompatible with survival through deterioration of health. More specifically, disease (particularly infections through loss of immune defense), disabilities and ultimately death are common malnutrition consequences. There is strong general awareness that the right to be nourished is jeopardized by natural, social and economic hurdles that still affect a large, but fortunately decreasing proportion of humankind. Ensuring adequate food availability for all is therefore a strong priority in political agendas worldwide. ; No hay duda de que los seres humanos tienen derecho a la nutrición y a la hidratación como soporte básico para la vida. La privación prolongada de cantidad suficiente de alimento da como resultado el desarrollo de desnutrición, el deterioro de la salud, lo que compromete la supervivencia del individuo. Más específicamente, la enfermedad (en particular las infecciones por pérdida o deficiencia de la defensa inmune), las discapacidades y, en última instancia, la muerte son consecuencias comunes de la desnutrición. Existe una fuerte conciencia generalizada de que el derecho a ser alimentado se ve comprometido por obstáculos naturales, sociales y económicos que todavía afectan a una gran proporción de la humanidad, pero afortunadamente decreciente. In this article, through bibliographic and documentary research, the Right to Education in Brazil is analyzed, taking as a reference Social Policies and the Democratic State of Rights, typical configuration of liberal democracy that has been installed in Latin America since the decade of 1990. The recognition and positivization of Social Rights in the Federal Constitution of 1988 resulted from a long process of social demands. However, from the socioeconomic and political-ideological context of the 1990s, Social Policy in Brazil suffered the impacts of the implementation of neoliberal policies for economic and social adjustments. Thus, it is understood that the recognition and proclamation of Education as a subjective public right in the Brazilian normative order, means the legal support for the realization of access to school, but, on the other hand, the non-realization of this right conceals the ideological political dimension that advocates Education in the market perspective. ; En este artículo, a través de una investigación bibliográfica y documental, se analiza el Derecho a la Educación en Brasil, tomando como referencia las Políticas Sociales y el Estado de Derecho Democrático, configuración típica de la democracia liberal que se instala en América Latina desde de la década de 1990. El reconocimiento y positivización de los Derechos Sociales en la Constitución Federal de 1988 fue el resultado de un largo proceso de reivindicación social. Sin embargo, desde el contexto socioeconómico y político-ideológico de la década de 1990, la Política Social en Brasil sufrió los impactos de la implementación de políticas neoliberales de ajuste económico y social. Así, se entiende que el reconocimiento y proclamación de la Educación como un derecho público subjetivo en el orden normativo brasileño, significa el sustento legal para la realización del acceso a la escuela, pero, por otro lado, la no realización de este derecho oculta la dimensión política ideológica que aboga por la educación en la perspectiva del mercado. ; Neste artigo, por meio de pesquisa bibliográfica e documental, analisa-se o Direito à Educação, no Brasil, tomando como referência as Políticas Sociais e o Estado Democrático de Direito, típica configuração da democracia liberal que se instala na América Latina a partir da década de 1990. O reconhecimento e a positivação de Direitos Sociais na Constituição Federal de 1988 resultou de um longo processo de reivindicações sociais. Contudo, a partir do contexto socioeconômico e político-ideológico da década de 1990, a Política Social no Brasil sofreu os impactos da implementação das políticas neoliberais de ajustes econômicos e sociais. Desse modo, compreende-se que o reconhecimento e a proclamação da Educação como Direito público subjetivo no ordenamento normativo brasileiro significa o respaldo legal para a efetivação do acesso à escola, mas, por outro lado, a não efetivação desse direito dissimula a dimensão político-ideológica que preconiza a Educação na perspectiva mercadológica.

Introduction: Human dignity, as coined by the Universal Declaration of Human Rights (UDHR / 1948), is an expression social solidarity, which should cement the relations between people. Human dignity is the foundation of all rights, such as freedom, equality, justice and peace in the world, and in Brazil, human dignity was deemed a fundamental pillar of the country's post-1988 constitutional order. Objective: This article seeks to a deeper investigation about the social nature of human dignity and its definition over time. Methods: This is an exploratory research meant to unpack the concepts of "human dignity", "bioethics", "human rights" and "constitution". After describing the conceptual evolution of human dignity and the facts relevant to its conceptual formation in world history - as a normative standard and a legal rule -, we address the Universal Declaration of Human Rights (UDHR/1948), the Declaration of Helsinki (DH/1964), the Universal Declaration on Bioethics and Human Rights (UDBHR/2005), and the definition adopted in the Constitution of the Federative Republic of Brazil (CFRB/1988). The study was carried out without temporal limitation, and included a review of referenced books, legal doctrines, as well as articles and books in the SciELO database. Results and discussion: The findings ratify that human dignity is the foundation of all rights, including those of freedom, equality, justice and peace in the world, and must also guide the rights and duties of social regulation. Human dignity has changed from a criterion of power attributed to the social position of individuals to a value of the right to freedom, which now goes beyond the right of freedom and is the basis of modern constitutional democracy, which makes possible the realization of solidarity, as well as the duty and purpose of the state and the community. The will of the subject, of society, of the science and of the state, as well as the rules of domination and regulation, must have a limit on human dignity, and human dignity is not just fundamental right, in the sense of the Constitution, and must prevail over the exclusive will of science, the State and society. Therefore, in the making of power decisions and in realization of possible innovations of science involving human beings, human dignity demands the explicit consideration of respect and promotion of it. Conclusion: Human dignity is enshrined in Brazilian constitutional law, as well as in bioethics and in human rights, and it constitutes all the fundamental rights of the human person. It is not merely a rule of autonomy and liberty, and it is an obligatory and non-derogable precept in the making of power decisions, a true main foundation of constitutional democracies. ; Introdução: A dignidade humana, cunhada pela Declaração Universal dos Direitos Humanos (DUDH/1948), é uma expressão de solidariedade social, que deve cimentar as relações entre as pessoas. A dignidade humana é a base de todos os direitos, como liberdade, igualdade, justiça e paz no mundo, e no Brasil, a dignidade humana foi considerada um pilar fundamental da ordem constitucional pós-1988 do país. Objetivo: Este artigo busca uma investigação mais profunda sobre a natureza social da dignidade humana e sua definição ao longo do tempo. Método: Trata-se de uma pesquisa exploratória que visa revelar os conceitos de "dignidade humana", "bioética", "direitos humanos" e "constituição". Após descrever a evolução conceitual da dignidade humana e os fatos relevantes para sua formação conceitual na história mundial - como padrão normativo e norma jurídica -, abordamos a Declaração Universal dos Direitos Humanos (DUDH/1948), a Declaração de Helsinque (DH/1964), a Declaração Universal sobre Bioética e Direitos Humanos (DUBDH/2005) e a definição adotada na Constituição da República Federativa do Brasil (CFRB/ 1988). O estudo foi realizado sem limitação temporal e incluiu uma revisão de livros referenciados, doutrinas jurídicas, bem como artigos e livros no banco de dados SciELO. Resultados e Discussão: As conclusões ratificam que a dignidade humana é o fundamento de todos os direitos, incluindo os de liberdade, igualdade, justiça e paz no mundo, e deve também orientar os direitos e deveres da regulação social. A dignidade humana passou de um critério de poder atribuído à posição social dos indivíduos para um valor do direito à liberdade, que agora ultrapassa o direito à liberdade e é a base da democracia constitucional moderna, que possibilita a realização da solidariedade, bem como o dever e propósito do Estado e da comunidade. A vontade do sujeito, da sociedade, da ciência e do Estado, bem como as regras de dominação e regulação, devem ter um limite na dignidade humana, e essa não é apenas um direito fundamental no sentido da Constituição, devendo prevalecer sobre a vontade exclusiva da ciência, do Estado e da sociedade. Portanto, nas decisões de poder e na realização de possíveis inovações da ciência envolvendo seres humanos exige-se a consideração explícita do respeito e da promoção da dignidade humana. Conclusão: A dignidade humana é ponto consagrado no direito constitucional brasileiro, assim como na bioética e nos direitos humanos e constitui todos os direitos fundamentais da pessoa humana. Não é apenas uma regra de autonomia e liberdade, trata-se de preceito obrigatório e inderrogável na tomada de decisões de poder, verdadeiro fundamento principal do Estado democrático de direito.

Este artigo parte da interlocução com a associação Mães pela Diversidade do estado de Goiás, Brasil, para analisar a performance do "ativismo materno" que combate violências cometidas contra filhos e filhas lésbicas, gays, bissexuais, travestis, transexuais, intersexos, queers e outras expressões de gênero (LGBTIQ+). Por meio de registros etnográficos verbais e desenhados, proponho refletir sobre os modos como emoções são dramatizadas para a confecção de lutas que, dentre outras coisas, visam à busca por justiça, denúncia de violação de direitos humanos e construção de uma malha de apoio mútuo. ; Este artículo parte del diálogo con la asociación Mães pela Diversidade (Madres por la Diversidad) de Goiás para analizar la actuación del activismo materno que combate la violencia contra hijos e hijas lesbianas, gays, bisexuales, travestis, intersexuales, queer y otras expresiones de género (LGBTIQ+). A través de registros verbales y dibujos etnográficos, yo pretendo reflexionar sobre las formas en que se dramatizan las emociones para la creación de luchas que apuntan, entre otras cosas: la búsqueda de la justicia, la denuncia de violaciones de derechos humanos y la construcción de una malla de apoyo mutuo. ; This article is based on the author's dialogue with the association Mães pela Diversidade (Mothers for Diversity), an NGO located in the Brazilian state of Goiás, to analyze the performance of "maternal activism" opposed to violence against lesbian, gay, bisexual, travesti, transgender, intersex, queer and other non-straight gender expressions (LGBTIQ+).Through verbal and drawn ethnographic records, I propose to reflect on the ways emotions are dramatized in social and political struggles that claim for justice, denounce the violation of human rights, and building a network of mutual support.

O objetivo deste artigo é discutir as origens, os desdobramentos e as permanências da prática de racialização dos corpos negros, por meio das políticas migratórias brasileiras, desde fins do século XIX até os dias atuais. Para tal, serão utilizadas as abordagens epistemológicas pós e decoloniais, com destaque para o pensamento afro-diaspórico. Esta investigação propõe a inclusão da "raça" como categoria analítica indispensável para o estudo das migrações no Brasil. A partir de uma abordagem inédita, será examinado como o Haitianismo deixou um legado que serviu de substrato para a formulação de legislações explicitamente racializadas sobre imigração. O primeiro tópico tematizará a nacionalidade e cidadania no Brasil a partir de sua independência, nos momentos iniciais de constituição do Estado imperial pós-colonial. O segundo tópico aborda as relações entre a raça e as normativas migratórias do século XX. Por fim, na última seção, será apreciada a atual Lei de Migração a partir das concepções de racismo estrutural e colonialidade do poder. ; El objetivo de este articulo es discutir los orígenes, los ramos y las permanencias de la practica de racialización de cuerpos negros, por medio de las políticas de migración brasileñas, desde fines del siglo XIX hasta los días actuales. Para esto, serán utilizadas los abordajes epistemológicos post y decoloniales, en especial el pensamiento o afro-diaspórico. Esta investigación propone la inclusión de la "raza" como categoría de análisis indispensable para el estudio de las migraciones en Brasil. A partir de un abordaje inédito, será examinado como el "Haitianismo" dejó un legado que sirvió de sustrato para la formulación de las legislaciones explícitamente racializadas sobre inmigración. El primer asunto traerá el tema de nacionalidad y ciudadanía en Brasil a partir de su independencia, en los momentos iniciales de su constitución del Estado imperial post colonial. El segundo tópico trata de las relaciones entre raza y las normativas migratorias del siglo XX. Por último, esta la sección en que será apreciada la actual "Lei de Migração" a partir de las concepciones de racismo estructural y colonialidad del poder. ; The aim of this article is to discuss the origins, expansion and permanences of the practice of racialization of black bodies, through brazilian migration policies, from the end of the 19th century to the present day. For this purpose, post and decolonial epistemological approaches, specially the afro-diasporic thinking, will be used. This research proposes the inclusion of "race" as an indispensable analytical category for the study of migrations in Brazil. From an unprecedented approach, it will be examined how Haitianism has left a legacy that served as a substrate for explicitly racialized legislation on immigration. The first topic will address the nationality and citizenship in Brazil starting from its independence, in the initial moments of constitution of the post-colonial Imperial State. The second topic addresses the relations between race and the migratory normatives of the 20th century. Finally, in the last section, the current Migration Law will be appreciated from the conceptions of structural racism and coloniality of power.

The right of defense plays an essential role in the concept of a fair lawsuit, in a non-formalist sense. This right represents not only the aspect of the right to the adversary system, but also, and above all, the guarantee of its genuine implementation. The right to be assisted by an interpreter is seen as a way for the accused to conscientiously participate in the lawsuit though effective understanding of all its aspects. The Italian Constitution recognizes the right of a suspect/accused to be informed of the accusation against him, and of his rights, as soon as possible. The right to legal aid is also guaranteed. There are, in addition, special government provisions for dealing with minors and with regards to their educational interests, especially during the judgment phase. ; O conceito de processo justo, num sentido não formalista, dá um papel fundamental ao direito de defesa, representando não somente o aspecto do direito ao contraditório, mas também, e acima de tudo, a garantia de sua genuína implementação. O direito de ser assistido por um intérprete é visto como uma forma de o acusado participar conscientemente do processo mediante efetiva compreensão de todos os seus aspectos. A Constituição italiana reconhece o direito de o suspeito/réu ser informado, o mais breve possível, das acusações contra ele e dos seus direitos. Também o direito à assistência jurídica está garantido. Existem, ainda, previsões governamentais especiais para lidar com menores e com respeito a seus interesses educacionais, em particular na fase de julgamento.

ABSTRACT Objective: understanding the social phenomena related to the health of prisoners in the Brazilian prison system. Method: a case study was developed in a male penal institute, of medium security, in the state of Paraiba. The sample consisted of 35 inmates with different age groups, education and convicted of various crimes. Respondents reported about the health system conditions inside the prison and the role of the state in managing this process. The research project was approved by the Research Ethics Committee, CAAE: 0321.0031.000-11. Results: there were identified that the health care of prisoners has not been developed to meet all the requirements established by law. Conclusion: the absence of prevention, maintenance and treatment of health of prisoners, generated by both physiological and structural factors and the lack of health personnel and technology, creates a serious public health problem that goes beyond the prison environment. After the Lisbon Summit of 2009, the whole matter of fundamental rights in the European Union has taken a new connotation. Local economic interests and social protests – in opposition to the "neoliberal agenda" of EU institutions – have played an important role in stopping the enforcement of the "Constitutional Treaty" and boosted an anti-Euro mobilization. In the meanwhile, the European bodies and transnational corporations have continued to settle a new and alternative basis for the integration. A radical shift can be observed, from the research of synthetic set of principles – as those established on the EU Charter of Fundamental Rights – to a deeply technical and detailed normative production. The regulation on safety and healthy workplaces is one of the best point of view to study this change. Far from calling into question the unbalanced positions between the parties in contemporary labour relationships, the European strategy for workers' protection move through procedural issues and voluntary obedience to the soft law instruments. In the past, the legal doctrine described the creation of a multilevel architecture of institutions, sometimes implemented in a top-down approach. Along with this, recently, it was implemented the establishment of common organizational standards associated to a specific system of corporate governance to pursue a better integration between business and fundamental rights. ; Após o Summit de Lisboa de 2009, toda a questão dos direitos fundamentais na União Europeia tomou uma nova conotação. Os interesses econômicos locais e os protestos sociais – em oposição a "agenda neoliberal" promovida pelas instituições europeias – têm desempenhado um papel importante em parar a execução do "Tratado Constitucional" e impulsionaram uma mobilização anti-Euro. No enquanto isso, os organismos europeus e as empresas transnacionais instalaram uma base nova e alternativa para a integração. Uma mudança radical pode ser observada, a partir da pesquisa de um conjunto (ainda) sintético de princípios – como os estabelecidos na Carta dos Direitos Fundamentais da União Europeia – para uma produção normativa profundamente técnica e detalhada. A regulação da segurança no lugar de trabalho é um dos melhores pontos de observação para estudar a transformação mencionada. Longe de pôr em causa as posições desequilibradas entre as partes nas relações de trabalho contemporâneas, a estratégia europeia para a proteção da saúde dos trabalhadores prefere as questões procedimentais e a adesão voluntária aos instrumentos de soft law. No passado, a doutrina jurídica descrevia a criação de uma arquitetura multi-nível de instituições, as vezes implementada por meio de uma abordagem de cima para baixo (top-down approach). Junto com isso, recentemente, teve a implementação de padrões organizacionais comuns para a criação de um sistema específico de governança corporativa, finalizado a buscar uma melhor integração entre os negócios e os direitos fundamentais.

Introduction: nutritional care was recognized as a human right in the Cartagena Declaration of May 3, 2019. This article defines this right and discusses the implications of the human right-based approach in clinical nutrition and the fight against disease related malnutrition. Methodology: an analysis was carried out with the human rights-based approach. This approach is a fundamental strategy to determine the role and obligations of different stakeholders (governments and policy makers, health institutions, patients, health professionals and caregivers). Results: it is possible to define nutritional care as an emerging human right. Its normative mandate is found in the principle 13 of the Cartagena Declaration. Like other human rights, it is based on the principle of respect for human dignity but its content and scope are limited to the field of clinical nutrition. Although this mandate has no binding force, it does imply an important moral commitment to ensure that the patient benefits from the nutritional care process. Conclusion: the recognition of nutritional care as a human right is the result of the effort of international scientific societies in the field of clinical nutrition that seek to fight for a minimum guarantee so that people, anywhere in the world can access nutritional care. In the future, the objective is that from a legal and political point of view, states also have certain obligations, whose effective implementation can be legitimately claimed by people. ; Introducción: el cuidado nutricional fue reconocido como un derecho humano en la Declaración de Cartagena del 3 de mayo de 2019.
