Current French law does not grant animals any legal status, but establishes a distinction between different regimes according to the type of relations between animals and men. Under the influence of Anglo-Saxon philosophical doctrines, certain movements for the defense of animals are attempting to push for the recognition of "animal rights" and to introduce a new legal status for the animal as a "sensible being" in our Civil Law. We attempt here to show the conceptual inconsistency of such an innovation and the risks it represents for a humanist ethic. Instead of granting animals a unique moral status, which is simply an ideological fiction, it is important to distinguish between the duties we have toward pets, domestic animals and wild animals. Pufendorf ouvre son maître ouvrage par chapitre sur la nature des entités morales, auxquelles il confère le statut ontologique de modes. This article analyses how the organization of the Egyptian Muslim Brotherhood (MB), which was founded in 1928 & still is a major, albeit forbidden, actor of the Egyptian political scene, manages its relations to society. Far from serving as a mere support for the Brothers' political strategies, these relations represent a relevant issue as such, both because of the movement's ideology & because of the configuration of the Egyptian regime. The case of al-Shaykh al-Muhammadi 'Abd al-Maqsud, MB member of parliament in the district of Helwan, located in the Cairo working-class southern suburb, illustrates the importance the MB place on developing local networks. However, it simultaneously emphasizes how the limitations of the organization's semi-legal status impede the building of social bonds. Taken in the context of the Egyptian state's reduction of social functions, the "public secrecy" binding the Brothers appears to be an expression of tacit cooperation with the authorities; however, this "public secrecy" may ultimately help fulfill rather than hinder the MB's political aim of social transformation through personal moral reform. The word « whistle-blower » denotes a person or individual brave enough, out of moral beliefs and despite the risks they are putting themselves under, for personal integrity who decides to openly and publicly speak out about some illegal or unethical behavior by their superiors. Anglo-Saxon countries historically have a greater tendency to protect and acknowledge whistle-blowers than continental countries. For example, in the United States in 1863 the False Claim Act was brought in with the aim of protecting against the corruption of government suppliers. Whistle-blowers' rights in the United State of America are specific. They stress the importance of rewarding which particularly relates to taxation and financial fraud cases. The analysis of sex-work practices in terms of intimate economy in Morocco allows, on the one hand, to link generally separated sexual practices (acts of prostitution and intimate sexual acts not prostitution) and, on the other hand, to observe how these practices are addressed by the police in a country where sexuality outside marriage remains illegal. Therefore, this article seeks to illustrate and analyse an observation of the evolution of the criminalization of morals and the work of the police squads through ethnographic data and a review of the local press (Tangier) playing an important role in the evolution of the police relation to "moral crimes". The legal prohibition of sexual relations outside marriage has largely become a dead letter due to the fact that the public authorities take into account in their everyday work the evolution of mores. However, the analysis of policies regulating morals and police work shows how the criminalisation tends to be implemented only against girls of varying profiles but all in a precarious situation – apart from the cases that are exploited for political purposes – which the police bring in, without embarrassing themselves of the harm done to those who do not practice "the going out", in the homogeneous category of "prostitutes". This modality of police action reinforces a de facto distinction between good and bad femininities that no longer correspond to the local moral opposition between virgins and non-virgins, or between "house girls" and "street girls". The opposition is thus between legitimate and illegitimate practices of out of wedlock intimacy and night-time entertainment. These kinship practices that lead hopeful fathers and mothers to resort to assisted pregnancy techniques abroad raise questions about the porosity of borders and revealnumerous political and moral adjustments. In-depth interviews with would-be parents thus reveal that having one or two French parents is not enough for a child to obtain French citizenship. The legal and administrative treatment in France of children born of surrogacy is such that being placed in a line of descent and acquiring French nationality are completely disconnected. ; À partir d'une enquête menée sur des couples français recourant à des mères porteuses en Amérique du nord, cet article analyse la façon les individus composent avec des interdits juridiques et des réprobations morales pour mener à bien des projets familiaux externalisant la grossesse hors du couple parental. In Tunisia and Morocco, the social and political turning points since 2011 have given new strength to the associative movement, highlighting social issues that were previously passed over in silence. Thus, "unmarried mothers" become, through associative mobilization, not only an intervention category but also a public problem. However, the State, by refusing to become directly involved to "not encourage deviant behaviors," it by default delegate to these associations the containment of the moral problem of poor women with illegitimate children. The social treatment of non-married mothers, done by these associations with their international connections, take the form of care programs based on maternalism and normativity. In addition, these organizations engage to "reintegrate" women who, without family support, are marginalized from social and legal protection. Using compassionate semantics on vulnerability and need, they aim to win public support in order to create rights and public policies, showing the political intentionality of care. However, these actions reproduce and deepen inequalities along gender, class and status lines. Through a long-term ethnography with child protection organizations and single mothers' support associations, using a socio-historical approach, this thesis tracks the evolution of family law and the processes involved in the transformation of social relations between the sexes in these Maghreb societies.
