El cambio de paradigma que se realiza en el año de 1991, con la adopción de la Constitución Política vigente, ha generado en Colombia lo que se denomina la constitucionalizarían del derecho. Los derechos fundamentales, se encuentran a la orden del día y son el derrotero principal al momento de proferirse cualquier ejercicio legislativo, al punto tal que ello es sujeto al control del máximo intérprete de la Constitución Política: la Corte Constitucional. En el ámbito penal, el mayor cambio introducido con la Constitución Política de 1991, es la consideración del debido proceso y de los subprincipios que de este se derivan, los cuales han tenido una particular importancia en el proceso penal. La jurisdicción penal, ha tenido significativos avances en lo que respecta a las formas y procedimientos de la acción penal, pasando de un esquema inquisitivo propio de Estados antidemocráticos, despóticos y autoritarios, a un esquema adversarial, buscando la consideración y aplicación del principio de igualdad y equidad procesal, y tendiente a la protección y reconocimiento de los derechos del procesado. Como es bien sabido, en el proceso penal, se debate la vulneración de un derecho, el quebrantamiento del ordenamiento jurídico y la causación de un daño, con la comisión de un punible contemplado en la ley como tal. La finalidad que tiene el proceso penal, es entonces buscar la verdad de lo ocurrido y con ello la búsqueda de la justicia. Para ello, el sistema adversarial prevé oportunidades procesales que le permiten a cada uno de los sujetos e intervinientes, mostrar al juez su versión de los hechos. ; The change of paradigm that takes place in the year of 1991, with the adoption of the current Political Constitution, has generated in Colombia what is called the constitutionalization of law. Fundamental rights are the order of the day and are the main course at the time of any legislative exercise, to the point that it is subject to the control of the maximum interpreter of the Constitution: the Constitutional Court. In the criminal sphere, the biggest change introduced with the Political Constitution of 1991 is the consideration of due process and the subprinciples that derive from it, which have had a particular importance in the criminal process. The criminal jurisdiction has made significant progress in terms of the forms and procedures of criminal action, moving from an inquisitive scheme typical of anti-democratic, despotic and authoritarian states, to an adversarial scheme, seeking consideration and application of the principle of equality and procedural fairness, and aimed at the protection and recognition of the rights of the accused. As is well known, in the criminal process, the violation of a right, the breach of the legal system and the causation of an injury is debated, with the commission of a punishable act contemplated in the law as such. The purpose of the criminal process is then to seek the truth of what happened and with it the search for justice. To do this, the adversarial system provides procedural opportunities that allow each of the subjects and intervenors to show the judge their version of the facts.
Although there is little doubt that Maltese women emerged from World War II with a stronger awareness of the intolerable gap between their potential and the harsh reality of their social condition, the road to 1947 began early in the first half of the 20th century and certainly did not end in 1947. As a matter of fact the journey has by no means ended; indeed it continues. The struggle for universal suffrage in Malta, and specifically for the vote for women, cannot be understood separately from the country's social, cultural, economic and political development. The debates inside the National Assembly (1945-1946) reveal the sharp confrontation of views in favour and against the right to vote for women. Indeed, a very significant element in the National As- sembly fought tooth and nail to prevent women's very presence in the National Assembly. Contrast this with Dr Paul Boffa's proposal to enfranchise all men and women over the age of 18. Finally, the National Assembly voted 145 for and 137 against for universal suffrage at age 21. A motion by Josephine Burns de Bono and Hélène Buhagiar (who had to strug- gle to be allowed to participate in the National Assembly as representatives of the Women of Malta Association, the third woman being Mabel Strickland who was admitted as the representative of the Times of Malta) for women's right to stand for public office, was also passed. It is pertinent to recall that the Women of Malta Association was founded early in 1944. Within a few months the Association twice requested the National Congress for representation in the National Assembly. Twice it was turned down. The Women of Malta Association's request was finally accepted in 1945 by the National Assembly. These achievements became law with the promulgation of the 1947 Constitution in September 1947. The first elections under the new constitution took place on 25-27 October of the same year. 54% of the 140,703 persons eligible to vote were women. Around 75% of the electorate turned out to vote. Of 76,745 registered female voters, 54,565 actually voted. Of the two women candidates, one – Agatha Barbara (1923-2002) – was elected for the Labour Party. She would successfully contest ten consecutive elections, be appointed cabinet minister five times, and would be the first Maltese woman to become president of the Republic in 1982. With the issue of a €10 silver coin to celebrate the 70th anniversary of the achieve- ment of Maltese women's right to vote, the Central Bank of Malta continues a tradition of issuing coins to commemorate important constitutional developments (see First Elected Representatives 1849 issued 2011, Majority Representation 1887 issued 2012, Self-Government 1921 issued 2013, Independence 1964 issued 2014, Republic of Malta 1974 issued 2015). 'Witness protection' has been introduced in the criminal justice systems of several states worldwide as a recognised tool for facilitating the cooperation of witnesses and ensuring that concerns about their safety are not ignored. Although not a new phenomenon, witness protection praxis continues to evolve and remains largely undeveloped in many states. In Nigeria, the relevance of witness protection as a critical aspect of criminal justice administration is increasingly becoming evident. As an area of enquiry, scholarly literature on witness protection is descriptive, locally focused, and lacking in conceptual clarification. Recent developments in Nigeria highlight the need for the clarification of legal and conceptual issues within the existing legal framework for protecting witnesses. Using the Nigerian case study, this thesis illustrates the obscurities inherent in the concept of witness protection. These are highlighted around five critical areas: the definition of witness protection; the scope of beneficiaries requiring protection; the nature of crimes necessitating protection; the nature of protective measures; and the administrative control of witness protection. The thesis explores the concept of witness protection, which is still at an early developmental stage in Nigeria. In the absence of a clear legal jurisprudence, the thesis pieces together the practice of witness protection in Nigeria and embarks on a conceptual and legal clarification of issues important to developing a witness protection framework. To achieve this, the thesis draws from international debates, legal developments and institutional practices from other jurisdictions as a basis for improving Nigerian efforts in witness protection and for making normative proposals to that effect. The thesis utilises two distinct perspectives: the criminal justice and the human rights perspectives as heuristic tools for analysing the concept of witness protection and to separate the disparate influences that shape how it is construed. A combination of desktop research by way of doctrinal research and empirical research was adopted. In pursuit of a more detailed understanding of contemporary developments relating to witness protection in Nigeria, field research was undertaken. This comprised qualitative research using semi-structured interviews of a specifically selected sample of criminal justice experts and practitioners with knowledge about witness protection in Nigeria. The semi-structured interviews justify the assumptions that there is a need to examine and clarify the scope of witness protection and what it depicts. The thesis finds that the concept and practice of witness protection evolved within specific parameters and its definitions are determined within these limits. It advances the existing witness protection conversations by offering an analytical basis for discussing witness protection and proposes organising principles for delineating the scope of witness protection. The clarifications made in the analysis within this thesis are utilised in making normative proposals and policy recommendations for developing a legal framework for witness protection in Nigeria. The thesis recommends a formal witness protection framework, through the enactment of comprehensive witness protection legislation that clearly defines the objectives of witness protection, the scope of beneficiaries, the scope of crimes necessitating protection, the type of protective measures and guidelines for assigning these measures, clear eligibility criteria and which establishes an independent witness protection agency to administer witness protection in Nigeria.
The article is devoted to determining the directions of ensuring the legal effectiveness of ethical codes in the regulation of official relations. The author defines the need for transformational changes in the structure of administrative law, substantiates the need to address the strategic challenges facing the modern state, which consists in optimizing the implementation of public management activities to ensure human rights and freedoms, is defined as a component of the subject of science of administrative law. The aim of the scientific article is to determine the directions for ensuring the legal effectiveness of ethicalcodes in the regulation of official relations. The author emphasizes that the implementation of a positive approach allows us to define legal responsibility as the ability, a conscious understanding of the subject to perform certain actions and the implementation of the tasks put forward before them, that is, a conscious strict observance by a person of the duties assigned to him. In the framework of this study, the category of "legal liability" was determined using a positive approach, which allowed taking into account not only the objective factor of influence on the personality of the offender, but also the subjective approach to understanding the negative consequences of the committed act. The article emphasizes that the solution to the problem of achieving the appropriate level of legal effectiveness of the application of disciplinary measures and incentives is an integral part of the mechanism to ensure the proper level of legal implementation of ethical standards in the regulation of public service relations. As a conclusion, it was substantiated that the need to determine at the legislative level a reward system as part of the legal regulation of public service, as well as a system of disciplinary measures for employees. ; Статтю присвячено визначенню напрямів забезпечення правової ефективності етичних кодексів у регулюванні службових відносин. Метою наукової статті є визначення напрямів забезпечення правової ефективності етичних кодексів у регулюванні службових відносин. Автором підкреслено, що реалізація позитивного підходу дає змогу визначити юридичну відповідальність як здатність, свідоме розуміння суб'єкта на виконання певних дій та реалізацію завдань,що висуваються перед ними, тобто свідоме неухильне дотримання особою покладених на неї обов'язків. У межах даного дослідження категорію «юридична відповідальність» визначено із застосуванням позитивного підходу, що дало змогу врахувати не лише об'єктивний чинник впливу на особу правопорушника, а й суб'єктивний підхід до усвідомлення негативних наслідків учиненого діяння. У статті підкреслено, що вирішення завдання досягнення належного рівня правової ефективності застосування заходів дисциплінарної відповідальності та засобів заохочення є складником механізму забезпечення належного рівня правової реалізації етичних норм у регулювання відносин публічної служби. Як висновок обґрунтовано необхідність визначення на законодавчому рівні системи заохочення як складової частини правового регулювання проходження публічної служби, так само як і системи заходів дисциплінарної відповідальності службовців.
Статья посвящена выяснению специфики концепции свободы личности в философии классического («раннего») славянофильтва. Автор полемизирует с мнением об отсутствии в славянофильском учении такой ценности, как свобода. Идея свободы у славянофилов рассматривается в соотношении с их ключевыми методологическими принципами народностью и соборностью. Показаны различия в понимании свободы между славянофильством и либерализмом: славянофилы, сохранив личную свободу, стремились полностью «преодолеть» индивидуализм. ; The article is devoted to clarifying the specifics of the concept of individual freedom in the philosophy of the classical ("early") Slavophilism. In Slavophil philosophy the public, no doubt, prevails over the personal and, moreover, appears as a condition for the existence of the latter. The author points out that this interpretation is fundamentally contrary to the classical liberal understanding of freedom of the individual in a civil society, but it argues against the view that there is no such value as freedom in Slavophil teaching. The Slavophil look at the freedom of the individ ual and its social function is based on the intrinsic qualities, which, according to the Slavophils Western and Russian types of persons have. According to the teaching of Slavophiles, the Western society and the state are built on personality, which set itself an absolute measure of everything, so they are artificial associations. For a real social cohesion in its progress towards moral perfection, the society needs the absolute norm, the law obligatory for everyone. If the society recognizes the need in higher law, according to which it must coordinate all its life, then, the Slavophiles emphasized, we must admit that before this law, the person should lose its absolute value. This consciousness is incompatible with the typical liberal sense of sovereignty of the individual and his/her values as a measure for everything. This provision of Slavophilism differs from the conservative philosophical and political tradition in the aspect that Slavophiles extend the absolute moral law to all members of any nation, without distinction of classes, education and personal qualities and abilities. The position of the existence of higher spiritual law, ruling in the life of the person, and in the life of a people, gives origin to the Slavophil theory of nationality in science, art, and politics in all the areas of human activity. Unlike the Westerners, who considered a people as a collection of autonomous individuals, the Slavophils perceived a people as an inseparable organic whole. In their understanding, each individual can find his/her own inner integrity, only by being a living, integral part of a people. The Slavophiles called the organic unity of the individual and the public "sobornost" (conciliarism). The idea of sobornost, put forward in opposition to the liberal idea of individualism is the main originality of the Slavophil philosophy. According to their theory, the society is a kind of congregational identity, a single organism. The person, in accordance with these views, renouncing some of his/her rights, just exalts oneself. The author concludes that in their socio-philosophical concept the Slavophiles did not consider personal liberty in isolation from the principles of nationality and sobornost. Thus, preserving the idea of freedom, they sought to completely "overcome" individualism.

Статья посвящена проблемным аспектам возмещения вреда, который возник в результате действий (бездействия) или решений органов публичной администрации и их должностных лиц. Автор анализирует систему нормативного регулирования данных отношений, сложившуюся судебную практику, выявляя особенности реализации права на компенсацию вреда, причиненного государством в результате его административно-юрисдикционной деятельности. Особое внимание уделяется дискуссионности вопроса о правовой природе регулируемых отношений, проблеме определения нормативной основы возмещения вреда, причиненного государством в рамках административного процесса, включая проблему применимости всех способов защиты, предусмотренных гражданским законодательством, при реализации права на возмещение вреда, причиненного в рамках административного процесса. Анализируются вопросы установления незаконности и виновности при причинении вреда в результате осуществления властных действий (решений), а также вопросы преюдиции, допустимости обоснования в рамках искового производства незаконности принятых публичной администрацией решений нормативного и ненормативного характера. В завершение представлены выводы о недостаточной четкости правового регулирования исследуемого вопроса, дана оценка дискуссионным аспектам проблематики и тенденциям развития института возмещения причиненного государством вреда, предложены способы совершенствования действующего законодательства и правоприменительной практики. Автором предлагаются два пути законодательного решения поставленной проблемы: признание всех предусмотренных гражданским законодательством способов возмещения вреда в рамках административно-правовых отношений посредством более четкого генерального законодательного указания на допустимость всех возможностей реализации данного права применительно к возмещению вреда, причиненного действиями публичной администрации, либо формирование собственной полноценной административно-правовой нормативной базы компенсации вреда, причиненного государством в результате его административно-юрисдикционной деятельности. Вне зависимости от избранного пути совершенствования рассматриваемого института, его обновленная нормативная основа должна учитывать позитивные достижения правоприменительной практики, особенно прогрессивные правовые позиции, сформированные в процессе толкования спорных норм Конституционным Судом РФ, Верховным Судом РФ. Ревизия законодательства в части регламентации возмещения вреда должна способствовать не только уточнению места данного института в системе правового регулирования, но и обеспечить надлежащую защиту соответствующего права. ; This article is devoted to problem aspects of indemnification which resulted from actions (inaction) or decisions of bodies of public administration and their public officials. The author analyzes system of standard regulation of these relations, the developed court practice, revealing features of realization of the right for compensation of the harm done by the state as a result of its administrative and jurisdictional activity. The special attention is paid to debatability of a question of the legal nature of the adjustable relations, a problem of definition of a standard basis of the indemnification caused by the state within administrative process including a problem of applicability of all ways of protection provided by the civil legislation at realization of the right for indemnification caused within administrative process. Questions of establishment of illegality and guilt at infliction of harm as a result of implementation of imperious actions (decisions) are analyzed, and also questions of a preyudition, admissibility of justification within claim production of illegality of the decisions of standard and substandard character made by public administration. Conclusions about the insufficient clearness of legal regulation of the studied question are presented to end, the assessment is given to debatable aspects of a perspective and tendencies of development of institute of compensation of the harm done by the state, ways of improvement of the current legislation and law-enforcement practice are offered. The author offers two ways of the legislative solution of the delivered problem: recognition of all indemnification methods provided by the civil legislation within administrative legal relations by means of more accurate general legislative specifying on admissibility of all sales opportunities of this right in relation to indemnification caused by actions of public administration or forming of own full administrative and legal regulatory base of compensation of the harm done by the state as a result of its administrative and jurisdictional activities. Regardless of the chosen way of enhancement of the considered institute, its updated standard basis shall consider positive achievements of law-enforcement practice, especially the progressive legal line items created in the course of interpretation of disputable regulations by the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation. Audit of the legislation regarding a regulation of indemnification shall promote not only to refining of the place of this institute in system of legal regulation, but also to provide proper protection of the appropriate right.
Torture is a relevant issue in human interactions for its pervasiveness, gravity and tremendous consequences. Unfortunately is still remains a reality in many countries of the world. This presentation aims approach to the concept of torture and the situation of torture in Portugal and worldwide; analyze international laws and ethical principles on documentation and investigation of torture; and address the contribution and importance of clinical forensic medical examination in these situations, how it best can be carried out and what kind of results may provide. There is no consensus about how to define torture but the most cited definitions in literature are those put forward by the World Medical Association and the United Nations. Both of these definitions include severe physical and psychological forms of suffering and require coercive intent by perpetrators with the consent or acquiescence of state authorities. The prohibition of Torture is absolute and applies to all times and in all circumstances. This prohibition is present in several international treaties and agreements. In 1984 the United Nations adopted the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment highlighting the particular attention given to this absolute prohibition, creating a legally-binding document and providing additional rules to assist in prevention and investigation of allege cases of torture. Nevertheless, between January 2009 and May 2013, Amnesty International received reports of torture and other ill-treatment committed by state officials in 141 countries, and from every world region. This only indicates cases reported to or known by the organization and does not necessarily reflect the full extent of torture worldwide. Besides forbidding it, International law also obliges states to investigate allegations of torture and to punish those responsible. It also requires that victims are able to obtain reparation. One of the major challenges in accomplishing this is to obtain sufficient evidence in cases against perpetrators. If there is no proof that torture took place, a climate of impunity can come to exist and the practice will endure. Medico-legal reports are a way of gathering evidence of torture. Even in countries where a fair trial is rare, medico-legal documentation strengthens the victims' position since it becomes more difficult to disregard the complaint. The area of application of the medico-legal reports is not restricted to medico-legal investigation. It can be broadened to the investigation and documentation of other violations of human rights in national and international legal proceedings, and monitoring such as cases of asylum seekers, cases of forced confessions through torture, identification of therapeutic needs of victims and the need for reparation and redress by the state. There are also a role for it in activities like research, advocacy and lobbying. Therefore, participation and support of health professionals are of crucial importance for the abolition of torture and other forms of ill-treatment. Ensuring that doctors are aware of how to perform a medico-legal report and how to use it in legal proceedings is a needed step forward in the prevention of torture. Because a large of the large number and the severe suffering of many survivors, the question of torture should become a part of health care curricula. ; A tortura é uma questão relevante nas interações humanas pela sua perversidade, gravidade e consequências tremendas. Infelizmente ainda continua a ser uma realidade em muitos países do mundo. O objectivo principal deste trabalho é o de proceder à elaboração de um texto que permita aos profissionais de saúde, adquirirem com a sua leitura uma rápida percepção do que é tortura e os maus tratos, do enquadramento legal destas situações e do potencial que uma adequada abordagem do ponto de vista médico pode proporcionar para uma correta identificação de tais práticas. Neste sentido, o presente trabalho procede inicialmente a uma revisão do conceito de tortura e da situação da tortura a nível mundial e ao nível de Portugal. Seguidamente, efetua uma breve análise das leis internacionais relativas à investigação e documentação de tortura e aborda as questões éticas levantadas por esta temática. Por último analisa o contributo do exame médico-legal nestas situações, como pode ser realizado e quais as mais valias que pode proporcionar. Não há consenso sobre como definir a tortura mas as definições mais citadas na literatura são as fornecidas pela Associação Médica Mundial e pela Organização das Nações Unidas. Ambas incluem formas físicas e psicológicas graves de sofrimento e exigem uma intenção coerciva por parte dos agressores, com o consentimento ou aquiescência das autoridades do Estado. A definição da Organização das Nações Unidas exige ainda que a agressão seja perpetuada especificamente por membros do, ou ao serviço do, Governo ou por forças militares ou policiais pertencentes ao Estado. Há também outras práticas que, apesar de não estarem incluídas nas definições de tortura, são um ataque à vida humana em toda a sua dignidade. Este outro tratamento cruel, desumano e degradante, que será referido neste trabalho como "maus-tratos", também tem a intenção de expor os indivíduos a condições que causam sofrimento físico ou mental significativo, mas sem um propósito específico. As pessoas vítimas desta prática, serão neste trabalho equiparadas a vítimas de tortura. A proibição da tortura e maus-tratos é absoluta e aplica-se a todos os momentos e em todas as circunstâncias. Esta proibição está presente em diversos tratados, acordos internacionais e o direito a estar livre de tortura é contemplado na Declaração Universal dos Direitos do Homem. Em 1984, as Nações Unidas adoptaram a Convenção Contra a Tortura e Outros Tratamentos Cruéis, Desumanos, Degradantes ou de Punição (CAT) destacando a particular atenção dada a esta proibição absoluta. Este é um documento juridicamente vinculativo que prevê regras adicionais para auxiliar na prevenção e investigação de alegados casos de tortura. Apesar de todas as normas e tratados que contemplam a proibição de tortura, esta continua a ser ainda uma prática comum e mundialmente disseminada. Entre Janeiro de 2009 e Maio de 2013, a Amnistia Internacional recebeu relatos de tortura e outros maus-tratos cometidos por funcionários do Estado em 141 países, e de todas as regiões do mundo. Isso só indica casos notificados ou conhecidos pela organização, e não reflecte necessariamente a extensão total da tortura em todo o mundo. Portugal não é excepção a isto. Além de proibir a prática de tortura, a lei Internacional obriga também os Estados a investigar alegações de tortura e a punir os responsáveis. Requer ainda que as vítimas possam ser ressarcidas da forma mais completa possível. Um dos principais desafios na realização disto é a obtenção de elementos de prova suficientes em casos contra os agressores. Se não há nenhuma prova de que a tortura ocorreu, um clima de impunidade pode vir a existir e a prática será perpetuada. Relatórios médico-legais são uma forma de apresentar provas de tortura. Mesmo em países onde um julgamento justo é raro, a documentação médico-legal fortalece a posição das vítimas tornando mais difícil ignorar a acusação Para mais, médicos da área dos cuidados de saúde primários são importantes detectores na identificação das vítimas. Eles podem encontrar sobreviventes de tortura em contextos de cuidados primários ou nos serviços de urgência e emergência médica, e serem quem inicia o encaminhamento para o tratamento destas vítimas e acciona os mecanismos legais necessários. A área de aplicação dos relatórios médico-legais não se restringe à investigação médico-legal. Estes podem ser utilizados na investigação e documentação de outras violações dos direitos humanos, em processos judiciais nacionais e internacionais. Podem ter ainda um papel importante em casos de requerentes de asilo, na identificação das necessidades terapêuticas das vítimas e da necessidade de reparação e reparação por parte do Estado. Há também um papel para ele em atividades como pesquisa, advocacia e lobby. Portanto, a participação e apoio de profissionais de saúde é de importância crucial para a abolição da tortura e outras formas de maus-tratos. Garantir que os médicos estão cientes de como executar um relatório médico-legal e como usá-lo em processos judiciais é um passo necessário na prevenção da tortura. Dado a grande quantidade de pessoas vítimas desta prática e o papel preponderante dos médicos na sua prevenção, a abordagem da tortura e o exame médico-legal deveriam tornar-se parte dos currículos das escolas médicas.
The global development of energy should be based exclusively on the concept of sustainable development. It means renewable energy with significant increase in energy efficiency, creating conditions for universal access to high-quality electrical and thermal energy. Renewable energy advantages are inexhaustibility of natural resources, low risk level for human health, minimization of negative impact on environment. The article analyses information and regulatory provision of the estimation of renewable energy sources towards justifying of theoretical and methodological bases for statistical estimation of renewables and developing scientific and practical recommendations for the implementation. National and international regulation are the basis for methodological, regulatory and informational provision for statistical estimation of renewable energy sources in Ukraine. The international legal framework is presented by directives and agreements: Directive 2006/32/EC, Directive 2009/28/EC, Treaty establishing the Energy Community, Regulation No. 1099/2008 of the European Parliament and of the Council, Energy Statistics Manual. Gradual harmonization of Ukrainian legislation according to the European and international regulatory system is being performed with respect to the Ukrainian Constitution. The main documents on the national level are: Law of Ukraine «On electricity», Law «On alternative energy sources», Law «On alternative fuels», The Law of Ukraine «On combined heat and power (cogeneration) and waste power utilization», Law of Ukraine «On energy saving» etc. The normative legal framework of renewable energy regulation in Ukraine is presented by extensive regulatory system. Further research on information and regulatory provision of renewable energy sources will address the «green» tariffs and new forms of financial support for development of renewable energy sources. ; Глобальное развитие энергетики должно основываться исключительно на концепции устойчивого развития. The development of the environmental market is a global trend, which is particularly dynamic in the EU. European countries have shown a significant role for the environmental goods and services sector in ensuring their economic growth. Today, in the area of integration, this sector is dynamically developing as environmental demands of consumers for the products and environmental quality in general have increased. The processes of investing in energy efficiency improvement, development and implementation of eco-friendly technologies and waste management have significantly intensified. Therefore, priority is given to the development of EU single environmental market. The purpose of the article is to study the features of forming a single environmental market in the countries of the European Union and to identify current trends of it development. The authors determine that the environmental market and the market of ecological goods and services are practically identical categories, and the eco-industry is a component and basis of formation and development. The article describes the basic prerequisites for the creation of EU single environmental market, among which fiscal restrictions and prohibitions on the manufacture of products containing harmful substances are highlighted; formation of certification and eco-labeling programs by the European Commission; increasing demand for environmentally friendly products and services, driven by a worldwide trend towards environmental conservation and health. The structure of the EU single environmental market sectors is analyzed. The article emphasizes that one of the defining features of the development of the EU organic produce market is the constant increase in demand and price increases of 20-50% compared to the traditional market. The EU single environmental market is one of the most developed in the world. The rapid growth of its development is expected, which in turn will make the ecological industry promising in the future. The main trends in the development of the EU single environmental market are: an increase in the production of organic products and the provision of services according to market needs; increase in the number of employees in the field of eco-industry. Increasing public awareness of how lifestyle and consumer choices affect the environment, which in turn has led to increased demand for eco-friendly products and services. ; У статті розглянуто особливості формування та розвитку спільного екологічного ринку в країнах ЄС. Визначено поняття спільного екологічного ринку та еко-індустрії . Охарактеризовано основні передумови формування спільного екологічного ринку ЄС, серед яких виділено фіскальні обмеження та заборони на виготовлення продукції, що містить шкідливі речовини; формування Єврокомісією програм сертифікації та екологічного маркування; збільшення попиту на екологічно чисту продукцію та послуги. Проаналізовано структуру секторів спільного екологічного ринку ЄС. Визначено основні тенденції формування й розвитку спільного екологічного ринку ЄС. Акцентовано увагу на стрімкому зростанні темпів розвитку екологічного ринку, що, в свою чергу зробить екологічну галузь перспективною в майбутньому.
Odesa Oblast is a region that absorbed European spirit and created multi-ethnic andmulticultural world. European traditions have deep historical roots and can influence theactivity and consciousness of modern generations. The analysis shows that Odessa Oblast takesan active role in European integration processes through interregional and municipalcooperation with regions, twin cities partnership and participation in internationalorganizations and projects. Decentralization of international cultural cooperation, significantnumber of public organizations and volunteer movement made it possible to reach a qualitativelynew level. International activities and twin-ties of the Odessa Oblast and the Hellenic Republicare progressing intensively and have all the possibilities for further expansion. Twinningrelations were established between the city of Odessa and the city of Piraeus and Kilia with thecity of Farsala, the Odesa Regional Council signed the Memorandums of Understanding oncooperation with the governorates of the regions of Serres, Thessaloniki and Drama. Animportant role in the establishment of cultural contacts is played by the Branch of the HellenicFoundation for Culture, the Charitable Foundation «Buromuras Foundation», the OdessaRegional Community of the Greeks named after G. G. Marazli. Combining of the efforts of allparticipants in international cooperation allows to solve main goals of cultural diplomacy:raising awareness of Ukraine; formation of a positive image of our country and its values,providing understanding of our ideas, aspirations and opinions; attraction of foreigninvestments and political partners to solve urgent problems. At the same time, we are faced withthe problems of the initial period and the novelty of this field of activities, namely, there is nostrategy in the practical plane both by the state and local self-government bodies. The lack ofcapacity of local self-government bodies, especially in terms of financial ability, to implementlarge projects in the field of interregional, municipal cooperation, low level of development ofsocial and tourist infrastructure, etc. become inhibitory factors. Thus the practice ofinterregional and municipal partnership requires further research. ; У статті розглядається процес становлення, розвитку та сучасний станпобратимських зв'язків регіонів, міст Одеської області з містами-побратимами ГрецькоїРеспубліки. Аналізуються основні напрямки міжрегіональної міжнародної діяльності йудосконалення муніципального партнерства як складової культурної дипломатії. Авторрозкриває особливості взаємодії в контексті історичних змін, наводить таохарактеризовує форми прояву міжнародного співробітництва між містами.Стрижневою ідеєю даної статті є положення про те, що формування та реалізаціюефективної політики співробітництва України з країнами ЄС не можна покладатитільки на вищі органи державної влади і управління, яким надано право визначати основнінапрямки зовнішньої політики України. Необхідно більш активно залучати до цієїроботи, особливо в умовах агресивної російської пропаганди, місцеві органи виконавчоївлади та органи місцевого самоврядування. В умовах реалізації європейського векторарозвитку України особливо важливою є побратимська співпраця українських міст, котрірозміщені на прикордонних територіях із країнами-членами Європейського Союзу йвиступають у ролі своєрідних "мостів" між сусідніми країнами. Визначається рольгромадської ініциативи в культурній дипломатії та громадського моніторингудіяльності органів влади. Метою цього дослідження є з'ясування суті поняттякультурної або м'якої дипломатії та міжрегіонального, муніципального партнерства, наприкладі співпраці районів і міст Одеської області з грецькими побратимами.
Interest in social cohesion phenomenon in Lithuania is connected with common European Union's policy, the main aim of which is to reduce social – economic inequality between member states of the European Union and in the member states itself. Cohesion policy is tending to be presented by fiscal indexes: Gross domestic product, revenues and employment. For implementing cohesion are choosed financial resources – structural assistance from European Union's funds. In the societies where the social coherence is to be taken interest as science's object exist two analytical traditions. The first one is derived from the discipline of academic social sciences, sociology, and exceptionally from social psychology. The specialists of strategic policy explicated the second one, which takes more influence. There are no separate researches of social coherence as phenomenon made in Lithuania and self-phenomenon is realized to narrow. In this paper is discussed conception of social coherence phenomenon, is reviewed various explanations of coherence and inclusive factors, their impact to social order and it's development. In the empirical part of the paper, using comparative principal, is analyzed 2000 and 2004 parliamentary election programs of four traditional Lithuanian political parties (Lithuanian Social Democrats, Homeland Union, Liberal and Central Union, Lithuanian Christian Democrats) in field of social coherence, it's inclusive factors and the provisions of representatives of above mentioned political parties. By implementing comparative research of programs in this paper is using MRG method's principle, which is matching with kontent analysis method. During narrative interview the provisions of questioned representatives of political parties is analyzed by using the methods of qualitative researches. Every interview is transcribed, paraphrased, conceptualized, categorized and interpreted. During the research was found out – traditional political parties almost are not paying direct attention to phenomenon of social coherence but for inclusive factors their paying the huge attention, which is impacted by time topical, ideology and political situation. There was also found out that political parties separate social problems are tend to resolve sporadically, there are lack systematical and complex point of view, which is the most wanted seeking to increase social coherence in society. The most consistent provisions were identified in electoral programs of Christian Democrats. Namely the provisions of Christian Democrats are more oriented in values than in time topicality. Provisions more oriented to the practical operation (time topicality) are identified in those political party's programs which political parties participating in the executive branch prepared. During qualitative interview showed up the problems of social coherence's definition and conception, the lack of systemic point of view, tend of political parties to the electoral rhetoric. Seeking to get comprehensive research of social coherence it would be valuable to analyze provisions and analysis of practical policy of political parties. Unfortunately due to lack of this paper size it was not possible to do.

In this paper is discussed conception of social coherence phenomenon, is reviewed various explanations of coherence and inclusive factors, their impact to social order and it's development. In the empirical part of the paper, using comparative principal, is analyzed 2000 and 2004 parliamentary election programs of four traditional Lithuanian political parties (Lithuanian Social Democrats, Homeland Union, Liberal and Central Union, Lithuanian Christian Democrats) in field of social coherence, it's inclusive factors and the provisions of representatives of above mentioned political parties. By implementing comparative research of programs in this paper is using MRG method's principle, which is matching with kontent analysis method. During narrative interview the provisions of questioned representatives of political parties is analyzed by using the methods of qualitative researches. Every interview is transcribed, paraphrased, conceptualized, categorized and interpreted. During the research was found out – traditional political parties almost are not paying direct attention to phenomenon of social coherence but for inclusive factors their paying the huge attention, which is impacted by time topical, ideology and political situation. There was also found out that political parties separate social problems are tend to resolve sporadically, there are lack systematical and complex point of view, which is the most wanted seeking to increase social coherence in society. The most consistent provisions were identified in electoral programs of Christian Democrats. Namely the provisions of Christian Democrats are more oriented in values than in time topicality. Provisions more oriented to the practical operation (time topicality) are identified in those political party's programs which political parties participating in the executive branch prepared. During qualitative interview showed up the problems of social coherence's definition and conception, the lack of systemic point of view, tend of political parties to the electoral rhetoric. Seeking to get comprehensive research of social coherence it would be valuable to analyze provisions and analysis of practical policy of political parties. Unfortunately due to lack of this paper size it was not possible to do.
Research on legislative ethics has shown how scandals often trigger ethics reform; yet, the content of the reform often differs from that of the scandal. Why is this the case? And if scandals don't explain legislative ethics reform outcomes, then what does? If not this kind of external shock, then what factor(s) shape legislative reform outcomes? These questions provide the point of departure for a case study of the European Parliament's 2011 ethics reform. Drawing from the legislative ethics literature and from recent theories of institutional change, the article examines the impact of the scandal that initiated the reform, the interests and strategies of reform agents who wanted a quick reform process that would not undermine the EP's independence; and the institutional order in which those actors were embedded. It argues that an institutional logics perspective offers a convincing and comprehensive account of EP ethics reform, and suggests a new analytical framework that might be used by researchers in future research on legislative ethics.
