Towards a Hong Kong/China legal relationship

Abstract

According to the author, although in signing the Joint Declaration on Hong Kong Britain and China may have achieved their political aims, the legal structures and procedures created by this treaty are awkward and unmanageable. The Basic Law of the Hong Kong Special Administrative Region has now largely replaced the Joint Declaration as the centre-piece of the transition process of Hong Kong. The author explores Hong Kong's legal relationship with China taking into account the Joint Declaration and the Basic Law. (DÜI-Sen)
